The Past, Present, And Future Of Universal Opt-Out Mechanisms, Lior Jacob Strahilevitz

Coase-Sandor Institute for Law & Economics Research Paper Series

Suppose that a consumer has the legal right to opt out of receiving certain communications, being tracked across the Internet by advertisers, or having their personal data transferred from one company to another. Should the consumer be able to exercise a one-time universal opt-out that effectively binds all similarly situated companies with whom the consumer does business? Or must the consumer invoke their opt-out right repeatedly, communicating their preference to each potential transaction partner individually? This question arises in numerous different privacy contexts and elsewhere. In many instances, the answer to this procedural question of whether universal opt-out mechanisms are …

Confirmatory Factor Analysis And Measurement Invariance Of The Sexual Orientation Concealment Scale Among Nonbinary Lgbtq+ Adults, Peter D. Goldie, Michael T. Bixter, Suzanne Mclaren

Department of Psychology Faculty Scholarship and Creative Works

Sexual orientation concealment is a prevalent minority stressor among LGBTQ+ people (including nonbinary people) and it is associated with a series of adverse mental health outcomes. The Sexual Orientation Concealment Scale (SOCS) is a widely used brief measure assessing sexual orientation concealment. Although the SOCS has been used with diverse cisgender populations, its validity for nonbinary people, including those of varied racial/ethnic backgrounds and sexual orientations, remains unknown. Based on data from an international sample of 340 nonbinary LGBTQ+ individuals, the present study reports the findings of a confirmatory factor analysis to assess the one-factor structure and validity of the …

Matter Of Hillside Place, Llc V. Housing & Community Renewal

All Decisions

App Div reverses Supreme Court and reinstates DHCR's determination removing the $45/month RGB #40 increase. The prior Civil Court order granting leave to amend—allowing the owner to add an RGB #40 claim—resolved only that the claim was not palpably insufficient; it decided nothing on the merits, creating no law of the case, res judicata, or collateral estoppel. DHCR's conclusion that the owner failed to preserve the $45 option in the 2008-2009 lease renewal, which instead used a 3% increase, was rational and not arbitrary.

Faculty Publications

Catalog for the 2017-2018 exhibit at L. Tom Perry Special Collections, BYU Library. Charity bazaars were a product of a massive nineteenth-century philanthropic undertaking in the United Kingdom, as private citizens attempted to respond to the social ills created by a rapidly industrializing economy. Bazaars combined the entertainment value of a social gathering and the fun of a town fair, with the moral earnestness of philanthropic work. Typically organized by women, these bazaars offered handmade goods for sale, raising funds for numerous local and national charitable causes. The exhibit showcases the history and print culture of the charity bazaar, from …
