Open Access Publications

Background: The purpose of this study was to assess the expression of molecular markers and epineural blood flow after differing degrees of nerve injury to identify potential tools to predict nerve recovery in a rat sciatic nerve model.

Methods: A total of 72 rats were divided into nine groups. Each group was subjected to one of three crush injuries, created by applying one of three vascular clamps for 30 seconds. Vascularity was assessed with laser Doppler flowmetry before and after crush, and at nonsurvival surgery. Nonsurvival surgeries were performed 6 hours, 2 weeks, or 6 weeks later with nerve conduction …

What Characterizes Equitable And Effective Assessment And Instructional Practices For El Students In The Secondary Stem Classroom?, Hannah Holt , '22

Senior Theses, Projects, and Awards

English learners (ELs) need to be equipped with tools that can help them find success in their secondary school STEM classes, as well as for the world beyond high school. There is a delicate balance between making sure the curriculum provides all the necessary tools for later success, and also allowing students to use their linguistic and cultural diversity to enable their learning process. Thus, teachers must consider both effectiveness and equity in the design of their instruction and assessment. This literature review compiles the findings and research of educators seeking to provide better resources for content teachers with ELs …

Beacons: A Viable Solution To The Ever-Evolving Problem Of Corporate Data Breaches, Lauren Fiotakis Apr 2022

Beacons: A Viable Solution To The Ever-Evolving Problem Of Corporate Data Breaches, Lauren Fiotakis

Northwestern Journal of Technology and Intellectual Property

In an increasingly virtual world, data breaches continuously plague large corporations. These companies have few options to keep their data out of the hands of persistent hackers, who often discover ways around any safeguards that may be in place. It seems as though any measures companies are currently able to employ merely delay the inevitable breach that will bring with it the potential loss of both customers’ data and their faith in the privacy and security of their information. These attacks can be debilitating to corporations; thus, it seems only fair to provide them the ability to take active measures …

Toward Decentralized Commercial Law For Digital Assets, Marek Dubovec Apr 2022

Toward Decentralized Commercial Law For Digital Assets, Marek Dubovec

Northwestern Journal of Technology and Intellectual Property

Technology affects various facets of the society and law. It has been tightly coupled in a symbiotic relationship with commercial law, including the Uniform Commercial Code (U.C.C.). While the conceptual framework of the U.C.C. and its realist ethos has fostered innovation since the 1950s, recent technological advances pose new challenges. In particular, digital assets traded in decentralized blockchain systems promise to engender a wide array of applications, prompting new business practices.

A number of efforts have been recently undertaken to address the fundamental challenges to established legal concepts posed by these technological advances. All these efforts march forward grappling with …

Student Speech Online: A Matter Of Public Concern, Eric Hogrefe Apr 2022

Student Speech Online: A Matter Of Public Concern, Eric Hogrefe

Northwestern Journal of Technology and Intellectual Property

The Supreme Court’s recent decision in Mahanoy Area School District v. B. L. ex rel. Levy partially answered the long-standing question of when schools can police student speech that takes place online. But Mahanoy largely ignored decades of scholarship, and opinions by lower courts, all of which assumed online speech was governed by the Court’s earlier student speech cases—especially the seminal Tinker v. Des Moines Independent Community School District.

This Note argues that Mahanoy and Tinker are consistent with each other, and both are consistent with the Court’s decisions governing another distinctive kind of speech: public employee speech. It …

Fiscal Transformations Due To Ai And Robotization: Where Do Recent Changes In Tax Administrations, Procedures And Legal Systems Lead Us?, Maria Amparo Grau Ruiz Apr 2022

Fiscal Transformations Due To Ai And Robotization: Where Do Recent Changes In Tax Administrations, Procedures And Legal Systems Lead Us?, Maria Amparo Grau Ruiz

Northwestern Journal of Technology and Intellectual Property

Tax administrations are currently experiencing transformations worldwide. This phenomenon has an impact on traditional tax rules. Increased technological capabilities open the door to review procedural and substantial regulation. The reinforcement of reporting and transparency requirements, and the connectivity between information systems in the public and private sector, will probably have a decisive influence on the evolution of tax law. Chatbots capture relevant data about the legal persons subject to different types of tax obligations. This information may be used to prepare more detailed administrative guidance, or even design future normative reforms. To efficiently protect justice and the rule of law …

The Role Of The European Union In The Promotion Of Western Balkan “Stabilitocracies:” Case Study Of Serbia, Aleksandra Kozovic Apr 2022

The Role Of The European Union In The Promotion Of Western Balkan “Stabilitocracies:” Case Study Of Serbia, Aleksandra Kozovic

Research Papers

In recent years, several regional experts have supported the term “stabilitocracy” to describe the current state of the relationship between the European Union and the Western Balkans, and to depict the autocracies with clear democratic shortcomings who staunchly claim their commitment to democratic reforms. A “stabilitocracy” is believed to represent a significant shortcoming of the EU’s vision to expand the Union and get the former Yugoslav states to maintain peace, align on foreign policy issues and join the European market. Granted, with the exclusion of occasional skirmishes and threatening statements from the regional leaders, after a decade-long war that resulted …

Federal Sentencing Guidelines: The Continuous Line Between Unwarranted Disparities And Institutional Discretion In Federal Sentencing, Miaya Scott

Research Papers

In 1984, the Federal Sentencing Reform Act was signed into law. This act of reformation set a new standard of mandatory minimum federal sentencing guidelines for anyone who was convicted of an unlawful crime. Under the Federal Sentencing Reform Act, Congress created a new agency, the United States Sentencing Commission. As a bi-partisan, independent agency, the United States Sentencing Commission set the standard of guidelines with the objective to decrease unwarranted disparities within the federal system. Federal Supreme Court cases like United States v Booker overturned federal guidelines moving them mandatory to advisory based on a Sixth Amendment violation. With …

Patriotic Media And The Consequences Of Nationalism, Nicholas Knappenburger

Research Papers

The topic of this paper will be patriotic media (specifically American blockbuster movies) that propagate the narrative of inherent goodness in the United States, its armed forces, and its foreign policy. Through examination of texts on nationalism, propaganda, and its influence on the twentieth century, I aim to draw parallels to modern-day patriotism in the media. The goal being to discover if the patriotic media the American populace consumes is making them more supportive of the American armed forces and our international impact. I will also examine what factors found in patriotic media are elements most likely to cause this …

When Justice Ruth Bader Ginsburg died on September 18, 2020, the world lost a trailblazer for gender equality, a pop culture icon, a feisty liberal luminary who fought on behalf of the disenfranchised in the areas of civil rights and social Justice, and an inspiration to millions of people. She will long be remembered for the social changes she helped effectuate as an advocate, scholar, and Jurist.

Her amazing civil rights legacy overshadows other areas where Justice Ginsburg's contributions have been substantial. This Article discusses one of the most interesting: copyright law. During her time as a Jurist on the …

The Development Of Inhibitors For Sars-Cov-2 Orf8, My Thanh Thao Nguyen Apr 2022

The Development Of Inhibitors For Sars-Cov-2 Orf8, My Thanh Thao Nguyen

CSB and SJU Distinguished Thesis

An unexpected outbreak of SARS-CoV-2 caused a worldwide pandemic in 2020. Many repurposed drugs were tested, but there are currently only three FDA approved antivirals (Merck’s antiviral Molnupiravir, Pfizer’s antiviral Paxlovid, and Remdisivir).1 Most of the antiviral drugs tested SARS-CoV-2 main protease and RNA-dependent RNA polymerase. However, it is important to explore different drug targets of SARS-CoV-2 to prepare for the virus mutations of the future. This research looks at an alternative approach in which SARSCoV- 2 Open Reading Frame 8 (ORF8), which has been shown to be a rapidly evolving hypervariable gene, was chosen to be the protein of …

Sars-Cov-2 Main Protease Inhibitors Repurposed For Hiv-1 Protease Binding, Jacob Minkkinen Apr 2022

Sars-Cov-2 Main Protease Inhibitors Repurposed For Hiv-1 Protease Binding, Jacob Minkkinen

CSB and SJU Distinguished Thesis

Severe acute respiratory syndrome (SARS-CoV-2) led to the COVID-19 global pandemic, with over 460 million cases of infection and over 6 million deaths since the start of the pandemic. SARS-CoV-2 is a retrovirus that utilizes a main protease (Mpro). Mpro is a catalytic cys/his protease. Several treatments were proposed to stop the pandemic including repurposing drugs to inhibit the Mpro. Another retrovirus that uses a protease is human immunodeficiency virus (HIV-1) which has been a global epidemic for 40 years and is a devastating disease that attacks the immune system. HIV-1 has infected 79.5 million people and has killed an …

Crafting Affect Through Memory: Venezuelan Narratives Of Belonging And Exclusion In Chile, Erin Long Apr 2022

Crafting Affect Through Memory: Venezuelan Narratives Of Belonging And Exclusion In Chile, Erin Long

CSB and SJU Distinguished Thesis

The economic and political crisis in Venezuela has led to a large influx of Venezuelans living abroad, and Chile is a significant receiving country. By analyzing ethnographic interview data as well as literature on the meanings of home and belonging, I argue that the element of loss experienced by many Venezuelan emigrants and everyday exclusions in Chile combine in narratives highlighting longing, uncertainty, and alienation. Venezuelan migrants articulate a duality between wanting to return to the country that cannot provide a home for them and being excluded in the country that can provide a home for them. As a result, …

Enlightened Evangelicalism And The American Revolutionary War: A Comparison Of John Witherspoon And John Zubly, Henry Bolin Jr. Apr 2022

Enlightened Evangelicalism And The American Revolutionary War: A Comparison Of John Witherspoon And John Zubly, Henry Bolin Jr.

Senior Theses

This paper compares the religion, philosophy, and politics of Presbyterian ministers John Witherspoon and John Zubly leading up to the American Revolutionary War, during which Zubly was a Loyalist and Witherspoon was a Patriot. The two ministers integrated Enlightenment thought and evangelical Calvinism differently which led to hold opposing political views. Witherspoon’s commitment to the Scottish Enlightenment concept of ethical sensibility was not contrary to Calvinist doctrine, but rather fits within the Reformed understanding of how God’s grace restores nature. Even though Zubly ended up becoming a Loyalist during the Revolutionary War, his pre-war political leanings are complicated, as he …

Independent Study Project (ISP) Collection

Independent Study Project (ISP) Collection

Art in the public sphere is an integral tool of communication that transcends the vertical hierarchies of social organization by infiltrating the popular consciousness with disruptive mediums and reclamations of visual space. Because of the specific accessibility of a variety of forms of public art, for both creators and observers, manifestations of public art have become a popular method through which counter-hegemonic social narratives can be constructed and mediated; in Argentina, a profound history of disruptive art has has been intricately intertwined with an equally rich history of popular activism. With a focus in El Bolsón and Ushuaia, two localities …

This research studies the community of women in Senegal whose husbands migrate to other countries for work. I examine how migration has impacted their marriages and their understanding of their roles as wives. I aim to answer the following question: How does migration affect women’s relationships with their husbands, their roles and responsibilities as wives, and their standing in society? To answer this question, I interviewed six women whose husbands work abroad. Before interviewing these women, I will arrange an initial conversation so we can get to know one another. This pre-interview also will allow me to determine other potential …

Carpets, Education, And Documentation: A Case Study Of The Jawalakhel Tibetan Handicrafts Settlement, Diana Hewitt

Independent Study Project (ISP) Collection

The Jawalakhel Handicrafts Center has been the economic center of the Tibetan community in southern Kathmandu since its founding in 1961. The success of the carpet industry in Nepal allowed the Tibetans in Jawalakhel to become economically self-sustaining, the carpet factory provided livelihood for the refugees who fled from Tibet and their children. The young generation, however, has difficulties finding stable jobs due to the fact that they have no documentation and all formal sector jobs in Nepal require proof of documentation. This lack of opportunity among the younger generation has been a major driver of outmigration from Nepal. The …

Investigating The Relationship Between Identity Salience And Attitudes Of Groups, Grazia Dipierro Apr 2022

Investigating The Relationship Between Identity Salience And Attitudes Of Groups, Grazia Dipierro

Honors Theses

A person’s political views are largely dependent on who they are, meaning a person’s identities may inform their political attitudes. The extent to which a person is made aware of an identity may influence how they view certain issues. For example, a white woman may view the same issue in two different ways depending on whether her racial or gender identity is activated. It is hypothesized that when participants are made aware of their racial identity, White participants will hold more conservative views, while non-white participants will hold more liberal views. Additionally, when made aware of a gender identity, white …

Tracing Stigma: The Evolution Of The Tattoo In The Middle Ages, Isabella Fusillo Apr 2022

Tracing Stigma: The Evolution Of The Tattoo In The Middle Ages, Isabella Fusillo

Honors Theses

In the Western world, tattooing began as a mechanism for marking slaves and prisoners in Ancient Greece and Rome. As a result of changes in religion and philosophy, the period between 1100 and 1600 CE set the stage for the tattoo to transform from something that was forcibly done to represent a communal identity into an individual expression of self. This project traces the use and meaning of tattooing from the ancient world into the 1600’s.

Faculty Scholarship

This study aimed to expand psychological research on hope by contributing a construct and scale to measure central dimensions of theistic eschatological hope derived from Christian scriptures. Eschatological hope was conceptualized as the anticipation that God will make all things new, raising people to everlasting life with God in joyful celebration, including people from every culture and nation, ending all personal pain and suffering, eliminating all societal evil and harm, and bringing reconciliation and healing to all of creation. We developed the Eschatological Hope Scale with three studies (N = 1,466). Exploratory and confirmatory factor analyses supported the single-factor structure …

Cancer has a significant impact on morbidity and mortality worldwide, with estimates reaching 18.1 million cases in 2018 alone. This chapter reviews the contributions of evolutionary medicine and palaeopathology to oncological research and addresses how these disciplines can conjointly develop models that evaluate how biological, ecological and sociocultural dynamics have prompted the development of cancer across deep time. It highlights that cancer has a long history affecting species across the tree of life, as well as being particularly pervasive in human populations today. While addressing recent advances in comparative oncology and palaeopathology, it discusses how novel environments may contribute to …

Unsettled Law: Social-Movement Conflict, Stare Decisis, And Roe V. Wade, Mary Ziegler Apr 2022

Unsettled Law: Social-Movement Conflict, Stare Decisis, And Roe V. Wade, Mary Ziegler

Connecticut Law Review

With President Donald Trump’s third Supreme Court nomination, the reexamination of Roe v. Wade has become a probability. An increasingly conservative Court will almost certainly not embrace the idea of abortion rights. Instead, the fate of abortion rights will likely turn on the meaning of stare decisis, a doctrine requiring the Court to pay some deference to its past decisions. Stare decisis has recently played a starring role in abortion jurisprudence. In his controlling concurrence in June Medical Services L.L.C. v. Russo, Chief Justice Roberts invoked stare decisis while gutting the substantive rule written into the precedent to which he …
