Journal of Prison Education Research

This study explores inmates’ perceptions of educational services in Southeast Nigerian prisons, focusing on their role in rehabilitation and reintegration. Using a qualitative design grounded in the capability approach and interpretive phenomenological analysis, data were gathered through in-depth interviews with 15 convicted inmates across three correctional facilities in Southeast Nigeria. Interviews were conducted in English and Nigerian Pidgin, and analyzed using NVivo 12. Findings revealed three major themes: the relevance and accessibility of educational programs, benefits such as improved self-worth, skill acquisition, and hope for reintegration, and key barriers like limited access, inadequate resources, and institutional apathy. Although the capability …

The Eleventh Circuit And The Current State Of The Anti-Modification Provision, Lexton Garrett Apr 2026

The Eleventh Circuit And The Current State Of The Anti-Modification Provision, Lexton Garrett

Texas A&M Journal of Property Law

This Note examines the Eleventh Circuit’s decision in Lee v. U.S. Bank National Association, where the court held that the “anti-modification” provision applies to mixed-use properties that are used for both commercial and residential purposes. The Eleventh Circuit’s decision in Lee created a federal circuit split, as both the First and Third Circuits held that the anti-modification provision does not apply to mixed-use properties. As detailed in this Note, the Eleventh Circuit came to the incorrect conclusion in this case because it incorrectly interpreted the text of the anti-modification provision. However, the Eleventh Circuit’s incorrect decision is not the …

Weaponizing Consumer Protection Laws, Uriel De La Rosa Apr 2026

Weaponizing Consumer Protection Laws, Uriel De La Rosa

Texas A&M Journal of Property Law

State attorneys general (“AGs”) wield significant authority under consumer protection laws intended to safeguard the public from unfair and deceptive business practices. However, this authority is increasingly being used to target nonprofit organizations, interfering with their ability to control and utilize their property and resources effectively. By issuing vague and overly broad administrative subpoenas, AGs are overstepping their mandate, using their powers for politically motivated or retaliatory purposes that jeopardize nonprofits’ assets, donor funds, and operational resources. This Note examines recent cases, such as the Texas AG’s investigation of Annunciation House and the Washington AG’s scrutiny of the Second Amendment …

Patents, Pills, And Pricing: Breaking Through The Thicket Of Pharma Protection, John B. Devaney Apr 2026

Patents, Pills, And Pricing: Breaking Through The Thicket Of Pharma Protection, John B. Devaney

Texas A&M Journal of Property Law

Patent thickets are becoming more pertinent in the United States every day. They unnecessarily extend a pharmaceutical company’s monopoly over a drug, prevent generics and biosimilars from entering the market, force Americans to pay high prices for medications, and bring fear to the lives of those who need special drugs to survive. Yet despite all these prevalent issues, few Americans even know what a patent thicket is. And for those who do, their attempts to bring them to an end have been utterly futile. This Comment discusses the mechanisms that comprise patent thickets and highlights the specific issues that each …

You Shall Not Pass: Historical Origins And Modern Solutions To Public-Private Land-Use Conflict, Alexander Dye Apr 2026

You Shall Not Pass: Historical Origins And Modern Solutions To Public-Private Land-Use Conflict, Alexander Dye

Texas A&M Journal of Property Law

As increasing populations and competing interests have exacerbated the historic conflict between public and private interests in land, cooperation, as well as a potential shift in public policy, may need to be considered. But for these shifts to occur, any predicate that private property rights should be somehow stronger or more easily enforced than that of the public to access land owned by a state or the federal government should be challenged. This Comment will analyze the historical events that led to a significant shift in land ownership and use conflicts in the American West. The historical element will focus …

Alabama’S Ruling In Lepage: A Need To Classify Extrauterine Embryos As Property And Incentivize Stem Cell Research Through Regulatory Federal Legislation, Reagan Moser Apr 2026

Alabama’S Ruling In Lepage: A Need To Classify Extrauterine Embryos As Property And Incentivize Stem Cell Research Through Regulatory Federal Legislation, Reagan Moser

Texas A&M Journal of Property Law

The tensions between scientific advancement and moral applications of legislation are at the political forefront of the polarizing nature of the United States. As the Supreme Court of the United States proceeds to forego stare decisis in different fields of the law, states have been delegated more power to implement restrictive laws. Notably, the Supreme Court of the United States held in Dobbs that laws regulating abortion are under the purview of state legislation. Subsequently, the Alabama Supreme Court held in LePage v. Center for Reproductive Medicine P.C. that frozen extrauterine embryos be given the constitutional guarantees of children—removing their …

Juror Contact In The Digital Age: The Linkedin Problem, Drew Thornley Apr 2026

Juror Contact In The Digital Age: The Linkedin Problem, Drew Thornley

Duke Law & Technology Review

This Article examines an evolving dispute in professional responsibility: whether a lawyer makes a prohibited communication when viewing a juror’s LinkedIn account. When one LinkedIn user views another’s profile, the platform automatically notifies the profile owner and may include the viewer’s identity. Ethics rules are currently divided on whether or not this notification would count as a prohibited juror communication. On one hand, the ABA and some state bar associations explicitly allow attorneys to view social-media profiles of jurors even when the lawyer’s identity is revealed. On the other hand, some bar associations and courts believe these automatic notifications violate …

Evaluating United Nations Peacekeeping In Africa: Successes, Failures, And The Challenges Of Contemporary Conflict, Gabrielle Josselyn Apr 2026

Evaluating United Nations Peacekeeping In Africa: Successes, Failures, And The Challenges Of Contemporary Conflict, Gabrielle Josselyn

Honors Theses

This thesis evaluated the effectiveness of United Nations peacekeeping missions in promoting stability, civilian protection, and post-conflict recovery in Africa. It asked: To what extent have UN peacekeeping operations in Africa been effective, and what structural and strategic factors explain their successes or failures? To answer this question, the study conducted comparative case analyses of Sierra Leone (UNAMSIL), the Democratic Republic of Congo (MONUC/MONUSCO), and Ethiopia–Eritrea (UNMEE), with a focus on mission mandates, troop composition, resource allocation, and cooperation with host states. Using qualitative content analysis and policy evaluation, the findings demonstrate that missions with robust mandates, adequate resources, and …

Digital Touchpoints: Investigating Contact Page Accessibility And Visual Authenticity Within Medical Tourism Health Websites, Alicia Mason, Elizabeth Spencer, Kristen Livingston, Treyton Meyers, Sakshi Bhati, Himika Akram Apr 2026

Digital Touchpoints: Investigating Contact Page Accessibility And Visual Authenticity Within Medical Tourism Health Websites, Alicia Mason, Elizabeth Spencer, Kristen Livingston, Treyton Meyers, Sakshi Bhati, Himika Akram

Faculty Submissions

This study examines two critical digital touchpoints on medical tourism provider (MTP) websites: (1) the accessibility of contact pages which often function as entry points for inquiries, scheduling, and pre-travel coordination, and (2) the authenticity of visual imagery used to shape expectations about care environments, personnel, and technological capacity. A sample of 105 MTPs across all six World Health Organization regions were analyzed using quantitative web accessibility testing and qualitative visual analysis. Results indicate pervasive accessibility errors on contact-page touchpoints and extensive reliance on inauthentic imagery to depict patients, providers, and medical technologies. Together, these practices may distort user expectations …

The Military Officer's Oath To Disobey Lawful But Unethical Orders, Joshua Braver Apr 2026

The Military Officer's Oath To Disobey Lawful But Unethical Orders, Joshua Braver

Northwestern University Law Review

How should a military officer respond to a lawful yet unethical order, unethical in the sense that it conflicts with their professional responsibilities? Army culture, scholarship, and doctrine regard officers as professionals, akin to doctors and lawyers, with expertise in the management of violence and a shared commitment to an ethical code. This code demands obedience to lawful orders to uphold civilian control of the military. But to protect against civilian misuse of the military, the code requires disobedience to unethical orders. Faced with a lawful but unethical order, the military officer is mired in a contradiction in which their …

Disproportionate Influence: Rethinking Control In American Corporate Governance, Dhruv Aggarwal, Ofer Eldar Apr 2026

Disproportionate Influence: Rethinking Control In American Corporate Governance, Dhruv Aggarwal, Ofer Eldar

Northwestern University Law Review

Corporate law has undergone a gradual transformation. Founding chief executive officers (“founder-CEOs”) and activist hedge funds increasingly dominate leading American corporations despite owning well short of a majority of shares. Founder-CEOs, through personal brands or dual-class voting structures, control firms despite having minority stakes; activist hedge funds, with single-digit holdings, press for major governance changes. We argue that these two types of shareholders, often treated as opposites, both dominate corporations through disproportionate influence rather than majority ownership. We describe these investors who dictate corporate policy through disproportionate influence as high-influence shareholders.

Delaware’s doctrinal response to high-influence shareholders has been inconsistent, …

Should Judicial Opinions Be Read Like Statutes?, Margaret H. Lemos Apr 2026

Should Judicial Opinions Be Read Like Statutes?, Margaret H. Lemos

Northwestern University Law Review

Should judicial opinions be interpreted with an eye to their purpose, context, or the intent of their authors, or should interpreters focus on the ordinary meaning of the text? Opinions present the same sorts of interpretive puzzles as other legal texts, and yet they have been omitted from the debates over interpretive methodology that dominate the fields of constitutional and statutory interpretation. The omission is no accident: the Supreme Court has stated repeatedly—and with increasing frequency in recent years—that judicial opinions are not to be read like statutes. Yet neither courts nor commentators have explained why the principles that ground …

The Ex Parte Young Cause Of Action: A Riddle, Wrapped In A Mystery, Inside An Enigma, Andrew S. Oldham, Adam I. Steene, John W. Tienken Apr 2026

The Ex Parte Young Cause Of Action: A Riddle, Wrapped In A Mystery, Inside An Enigma, Andrew S. Oldham, Adam I. Steene, John W. Tienken

Northwestern University Law Review

Ex parte Young ushered in a new era of the American judicial system. Most famously, the decision allowed plaintiffs, in certain circumstances, to sue state officials without having to worry about sovereign immunity. Young’s other holding, though perhaps lesser known, is no less important: individuals, the Supreme Court held, have an equitable cause of action to sue government officials for injunctive relief.

Even today, that second holding remains something of a riddle. Did this cause of action always exist in American law? Or was it an invention of the Young Court? And, at any rate, does the Ex parte …

What The Free-Roaming Cats Dragged In: Regulatory Concerns With Privatized Local Services, Jonathan Korger Apr 2026

What The Free-Roaming Cats Dragged In: Regulatory Concerns With Privatized Local Services, Jonathan Korger

Northwestern University Law Review

The United States entrusts local governments to provide citizens with a wide range of public services, and animal control makes up a small but essential piece of these local responsibilities. In recent years, American localities have largely privatized how they manage the nation’s growing free-roaming cat population, relying primarily on animal-loving volunteers and a controversial practice called trap-neuter-return (TNR). Academics have long debated the merits of privatization, but TNR raises a novel question: how should local governments think about regulating a privatized public service when altruism, instead of profits, motivates the service deliverer? This Note argues that TNR demonstrates the …

Place Names And Presidential Control, Austin Kruse Apr 2026

Place Names And Presidential Control, Austin Kruse

Northwestern University Law Review

Since the start of his second term, President Trump has issued executive orders at an extraordinary pace, using them to advance a broader ideological agenda across the administrative state. While scholarly attention has largely focused on the most sweeping of these directives, less prominent orders raise similar concerns about the reach of presidential power. This Note examines one such order: Executive Order 14,172, which directs the renaming of the Gulf of Mexico and Denali and expands presidential influence over the U.S. Board on Geographic Names (BGN).

Although geographic naming is ostensibly apolitical, place names are deeply entangled with questions of …

A Tale Of Two Credits: The Post-Nestlé Alien Tort Statute And Carbon Credit Externalities, Stephanie Mao Apr 2026

A Tale Of Two Credits: The Post-Nestlé Alien Tort Statute And Carbon Credit Externalities, Stephanie Mao

Northwestern University Law Review

As companies increasingly embrace carbon-neutrality commitments, many rely on the voluntary carbon market to offset their emissions rather than reduce them directly. Regulatory and consumer scrutiny has focused on the widespread use of “phantom” carbon credits, i.e., credits that fail to produce meaningful climate benefits. But less attention has been paid to what this Note terms “colonial” carbon credits: those that may technically reduce emissions but do so at the expense of communities abroad. These projects may contribute to land dispossession, human rights abuses, and threats to public and environmental health. Yet, current regulatory and legal frameworks, with their focus …

Dual History Enhancement With Hybrid Hypergraph-Graph Networks For Temporal Knowledge Graph Reasoning, Kailun Ye, Xiangjie Kong, Yuchao Zhang, Xuan Wang, Linan Zhu, Jiaxin Du, Guojiang Shen, Jianxin Li

Research outputs 2022 to 2026

Temporal Knowledge Graph (TKG) reasoning seeks to predict future events by analyzing historical data, where the effective leverage of both local and global historical facts proves crucial. Existing approaches employ graph neural networks (GNNs) and recurrent neural networks (RNNs) for local evolution patterns, complemented by statistical methods to enhance attention to global facts, demonstrating efficient predictive capabilities. However, traditional GNNs, constrained by their low-order neighborhood aggregation design, inherently fail to model potential high-order dependencies among facts. Furthermore, existing global history modeling approaches may introduce irrelevant historical information that interferes with prediction tasks. To address these limitations, we propose a Dual …

Relationships Between The Parameters Of The Vegetable Oil Refining Process And Energy Consumption, Umidjon Abdimajitovich Ruziev, Marufjon Kobuljonovich Shodiev

Technical science and innovation

Vegetable oil refining is a multi-stage thermochemical process that is closely related to energy consumption, process parameters, product quality, and food safety requirements. Despite the extensive scientific literature on oil quality and pollutant formation, the quantitative relationship between purification parameters and relative energy consumption has not been sufficiently studied. In this work, a systematic analysis and engineering synthesis were carried out based on existing studies. According to the analysis results, the deodorization process accounts for 52–56% of the total thermal energy consumption, with a relative value ranging from 160 to 380 kJ/kg, depending on the enterprise's capacity and heat utilization …
