Resolving Bankruptcy's Non-Voting Impaired Class Issue Using The Nonfactor Solution, Jacob Harrington Apr 2026

Resolving Bankruptcy's Non-Voting Impaired Class Issue Using The Nonfactor Solution, Jacob Harrington

Texas A&M Law Review

In chapter 11 bankruptcy voting procedures, the issue of non-voting impaired classes can be a complicated issue, but the Southern District of Texas’s new “nonfactor” approach can be used as a lens through which different solutions to this issue may be understood. The United States Bankruptcy Code states that a bankruptcy plan may only be confirmed if every impaired class votes to accept the plan. But despite the statute’s apparent clarity, different jurisdictions’ solutions vary, some deeming non-voting impaired classes to plan. This Note demystifies the Bankruptcy Code’s approach to this matter, examines the different jurisdictional approaches to this issue, …

Adjudicating 35 U.S.C. § 112(A): The "Person Of Ordinary Skill In The Art" Conundrum And How To Address It, Matthew T. Simmons Apr 2026

Adjudicating 35 U.S.C. § 112(A): The "Person Of Ordinary Skill In The Art" Conundrum And How To Address It, Matthew T. Simmons

Texas A&M Law Review

A viable alternative for adjudicating issues under 35 U.S.C. § 112(a) of the Patent Act is needed due to the difficulties of trying these issues to a lay jury. Congress agreed when it enacted the America Invents Act (“AIA”), which created alternative proceedings for challenging patent validity post-grant, including post-grant review (“PGR”) and inter partes review (“IPR”). In theory, PGR proceedings permit the Patent Trial and Appeal Board of the United States Patent and Trademark Office to adjudicate whether one or more claims of a patent are valid on § 112 grounds. In practice, history has shown that the limitations …

The Power Of An Unplanned Path: My Bonner Journey, Amia Mcdonald '26

Senior Presentation of Learning

Coming into my freshman year at DePauw, I had no idea what the Bonner program was or how much it would come to shape my college experience. It wasn’t until a senior Posse scholar took the time to tell me about Bonner and encouraged me to apply that I even saw myself as a part of it. From the start, I’ve always loved giving back and being involved in the communities I’m in, so joining Bonner felt like a natural fit. Over the past 3.5 years, my journey hasn’t been linear, but each service site I’ve been a part of …

I was struggling on whether or not I wanted to attend DePauw University because it was a completely different experience from what I was used to being from Chicago. DePauw is located in a small town and predominately white institution, with limited modes of transportation. I didn’t know anyone on campus, but then a faculty member from my tour told me about Bonner because of the community service I did in High School. I have always been passionate about serving my community. I told that member if I get in the program ,I will attend, and that’s what I did. …

Regulatory Role Of Il-1Β And Cxcl8 In Inflammatory Cell Dynamics And Gingival Inflammation In Gingivitis, Dhuha Mahmood Ali

Muthanna Medical Journal

Background: Gingivitis is a common inflammatory disease of the periodontal tissues characterized by immune responses triggered by microbial biofilm. The inflammatory process involves the release of several cytokines and chemokines, including interleukin-1 beta (IL-1β ) and chemokine CXCL8, which play crucial roles in regulating leukocyte recruitment and inflammatory signaling within the gingival tissues. These biomarkers are considered important indicators of periodontal inflammation and may reflect the progression of periodontal diseases.

Aim: This study aimed to evaluate the levels of inflammatory biomarkers IL-1β and CXCL8 and investigate their role in gingival inflammation.

An Education Project To Address Pain Management Solutions For Adult Clients With Ue Involvement To Reduce Dependence On Pharmacological Options To Increase Comfort And Performance With Life Activities, Alexander J. Birdsall

Student Capstone Papers

Upper extremity (UE) pain affects approximately 30.7% of adults in the United States and is associated with decreased function and participation. Despite evidence supporting non-pharmacological approaches, pharmacological interventions remain commonly used. This capstone project implemented and evaluated an occupation-based educational program to promote non-pharmacological pain management among adults receiving outpatient occupational therapy for UE conditions. This 14-week project included 10 participants and utilized a mixed-methods design with pre-, mid-, and post-surveys. The program consisted of an introduction and three modules addressing therapeutic movement, physical agent modalities, and sensory regulation. Outcome measures included pain, activity engagement, medication use, confidence, and program …

Inequality And Well-Being, Sarah E. Boslaugh Apr 2026

Inequality And Well-Being, Sarah E. Boslaugh

Theses

Human well-being has been a topic of interest to philosophers at least since the time of Aristotle, and well-being has also been a core concern of social scientists since the birth of the discipline in the late 18th century. Some theories of well-being include economic inequality as a factor, and multiple ways to measure this factor have been developed; as with well-being, there is no single best measure of economic inequality and the choice of which measure to use may be based on both theoretical and practical reasons. I argue that income inequality should always be included as a …

Secondary Contact Dynamics In White-Breasted Nuthatches (Sitta Carolinensis) Across The Pine Ridge Of Nebraska, Eugene A. Huryn Apr 2026

Secondary Contact Dynamics In White-Breasted Nuthatches (Sitta Carolinensis) Across The Pine Ridge Of Nebraska, Eugene A. Huryn

Biology Theses, Dissertations, and Student Creative Activity

Populations’ interactions in contact zones are important for understanding divergence dynamics of closely related taxa. Such interactions may vary from inter-population divergence being reinforced to secondary contact resulting in the creation of a hybrid swarm. The ecology of each lineage, and different factors like behavior and ecological niches, may impact the outcome of such contact. However, there is little current research on how habitat choice at local scales might reflect distinct populations, particularly in cryptic species. To study how niche dynamics affect diversification, we studied the White-breasted Nuthatch (Sitta carolinensis) complex in northwestern Nebraska. Two members of this …

Maddicks V. 106-108 Convent Bcr, Llc

All Decisions

The Appellate Division affirmed the denial of tenants' motion, seeking a declaration of a rent overcharge scheme. The motion, improperly brought under CPLR 906(1) and thus treated as one for summary judgment, was denied because tenants failed to provide all necessary documentary evidence, such as leases and underlying records for claimed improvements, to meet their prima facie burden. The court noted that while an attorney affirmation is permissible for admissible documents, personal knowledge is required for unrefutable facts. The court also clarified that post-2024 legislative amendments (L 2024, ch 95) eliminated the common law fraud standard and tenant affidavit requirement …

Turkish Journal of Medical Sciences

Background/aim: Tumor budding (TB) and poorly differentiated clusters (PDCs) are histopathological parameters that have been associated with poor prognosis in various malignancies, particularly colorectal carcinoma. Although numerous studies have demonstrated an association between the microcystic, elongated, and fragmented (MELF) pattern in endometrial carcinomas and lymphovascular invasion as well as lymph node metastasis, the literature regarding TB and PDCs in this context remains limited. This study aimed to investigate the potential associations of the MELF pattern, TB, and PDCs with overall survival, progression-free survival, and clinicopathological parameters in cases of endometrioid endometrial carcinoma (EEC).

Acute Compartment Syndrome Following Lower Leg Vascular Injury: A Big-Data Approach To Estimating Incidence And Risk Factors, Harry Moroz, Edward J. Harvey, Yasser C. Bouklouch

Journal of Shock and Hemodynamics

Acute Compartment Syndrome (ACS) is a limb- and life-threatening complication of lower leg fractures. Rapid recognition and fasciotomy can prevent irreversible ischemic injury, but ACS is often under-recognized. Vascular injury may increase the risk of ACS by impairing perfusion and exacerbating swelling. This study aimed to determine the incidence, risk factors, and outcomes of ACS in patients with lower leg fractures, with particular emphasis on the impact of vascular injury. This retrospective cohort study used data from the 2017 American College of Surgeons Trauma Quality Programs database to perform a multicenter analysis of patients with lower leg fractures. Patients were …

Hypertext Transfer Protocol Fingerprinting: Techniques For Attacker-In-The-Middle Proxy Detection, Evasion, And Counter-Evasion, Jensen George Wood

Theses and Dissertations

Attacker-in-the-middle (AitM) phishing toolkits have emerged as a critical threat to enterprise and individual security by enabling adversaries to bypass multi-factor authentication (MFA) and compromise cloud-based accounts at scale. Traditional detection techniques--such as IP blocklists or content-based detection methods--are often ineffective against these increasingly sophisticated attacks. We propose a novel method that detects malicious proxies by identifying artifacts they introduce into HTTP request headers. To evaluate our approach, we systematically analyze traffic passed through several open-source AitM toolkits and proxies, identifying distinct modifications to header structures and content, then formalize these features as YARA rules for automated use. To validate …

Automated Land Surface Temperature Estimation And Prediction Using Multispectral And Multi-Temporal Indices In Google Earth Engine: Bizerte Study Case, Northern Tunisia, Fatma Ezzahra Ben Cheikh, Mohamed Hafedh Hamza

Journal of King Abdulaziz University: Meteorology, Environment and Arid Land Agriculture

This study analyzes the spatiotemporal evolution and near-future trajectory of land surface temperature (LST) in Bizerte, a rapidly urbanizing Tunisian coastal governorate. Using multi-temporal Landsat imagery (2009–2024) processed in Google Earth Engine, we quantify bi-seasonal warming and project thermal conditions to 2029. Over 2009–2024, mean summer LST rose by 2.8 °C (to 41.7 °C) and winter LST by 2.5 °C (to 18.9 °C), with urban and bare-soil areas warming most intensely (+5.3 °C). This coincided with increased built-up density and marked declines in vegetation and moisture indices. A Random Forest regression model, trained on 2009–2019 data and validated on 2024 …

Hip Strengthening Exercises That Improve The Sit-To-Stand In Older Adults, Savanna Pohly Apr 2026

Hip Strengthening Exercises That Improve The Sit-To-Stand In Older Adults, Savanna Pohly

Doctorate in Kinesiology

To date, no home-based exercise programs have been established as definitive interventions for improving the sit-to-stand (STS) performance in older adults (OAs). Previous research identifies a duration of >15 seconds on the Five-Time-Sit-to-Stand Test (FTSST) as a significant predictor of increased fall risk for OAs. This study applies higher-ranked gluteal activation therapeutic exercises that can improve STS performance for OAs.

Twenty-five OAs age 72.68 ± 4.02 years old were given a 6-week home exercise program that included five therapeutic exercises to be performed three times a week using a Perform Better resistance loop. The FTSST and surveys were completed pre- …
