The Sixth Assessment report (AR6) of the Intergovernmental Panel on Climate Change (IPCC) states with high confidence that most sandy coasts around the world will experience an increase in coastal erosion over the twenty-first century. An increase in long term coastal erosion (coastline recession) along sandy coasts can translate into massive socio-economic impacts, unless appropriate adaptation measures are implemented in the next few decades. The touch and concern doctrine addresses a very particular problem: Successors, at best, weakly assent to the land use promises that their predecessors made when they take the property with notice that their predecessors intended to bind them. A 2-yr study (year 1: March to September 2017; year 2: February to August 2018) was conducted using crossbred steers (year 1: n = 1677; initial body weight [BW] = 372 kg, SD = 47; year 2: n = 1713; initial BW = 379 kg, SD = 10) in a commercial feedyard study in Eastern NE to determine the effects of shade on cattle performance, ear temperature, and cattle activity. INTRODUCTION AND OBJECTIVE: The United States (US) currently faces a medical malpractice crisis, and a survey done in 2006 informed that 63% of urologists faced an average of 2.1 medical malpractice lawsuits. Surgery for benign prostatic hyperplasia (BPH) is performed by 95% of US urologists. Hence, we postulated that these procedures might be responsible for a substantial number of medical malpractice lawsuits. We examined claims related to BPH surgery in various US courts.

This Article is the first law review article to comprehensively examine Final Agency Determinations (FADs) of the United States Department of Agriculture. A key part of the administrative process within the Risk Management Agency of USDA, FADs contribute to the interpretation and understanding of the Common Crop Insurance Policy, which is the federally-reinsured multi-peril insurance contract. This Article surveys ten of the most significant recent FADs and emphasizes the importance of FADs to litigated disputes between insurance providers and insureds with regard to the federal crop insurance program. Property, Psyche, And The Theory Of Tenancy: Independent And Interdependent Lease Law Covenants Through The Lens Of Cultural Psychology, Hanjo Hamann

Texas A&M Journal of Property Law

Is it property or contract? This question has perplexed scholars studying the residential lease for most of the last century. The present contribution combines the complementary perspectives of legal history and cultural psychology to clarify our theory of tenancy. From a historical perspective, I find that the oscillation of tenancy between competing doctrinal paradigms has resulted in a compromise solution rather than a coherent theory. While piecemeal reforms in the 1970s revised the doctrine of independent covenants, they did not provide a theoretical justification for increasing interdependence. From a psychological perspective, I suggest that such a theoretical justification may come …

Background: Diabetes is a chronic disease that affects millions of people in the United States. Compliance with treatment plans is important for preventing life-threatening complications of the disease. However, many diabetics forgo recommended testing and other management standards due to lack of health insurance.

Purpose: This study aims to assess the effect of health insurance status on compliance with diabetes care.

Methods: This study was a secondary analysis using 2005–2018 National Health and Nutrition Examination Survey data. For participants who reported having diabetes, compliance with care was assessed based on insurance status. Compliance indicators included hemoglobin A1C check by …

Purpose: The purpose of this research paper is to consider the experiences of gay or bisexual males in male-dominated organizations and apply the lessons learned to help facilitate meaningful culture change in Diversity, Equity, and Inclusion initiatives. This paper examines the dynamics of hegemonic masculinity, marginalization and hypervisibility as they relate to the perception of professionalism and leadership capabilities of gay or bisexual males in organizational cultures including the military as well as other male-dominated organizations.

Despite a college degree being a prerequisite for economic and social mobility, many low-income students graduate at far lower rates than students from wealthier families. Existing research suggests that low-income students are more likely to attend college less prepared to succeed once they get there, experience financial challenges, have difficult navigating the complex higher education system, and have multiple obligations outside of their academic responsibilities, resulting in low completion rates. Understanding what makes governance 'good' or 'bad' has been impeded by construct ambiguity. Contemporary governance research has struggled to define 'governance' and related constructs such as 'ownership', 'agency', and 'management' in a way that clearly separates and distinguishes them. Often, the line between governance and management is so blurred that it is impossible to say what is good or bad 'governance' versus 'management'. Here we provide a systematic classification of key governance concepts in terms of their distinct economic functions. 'Governance', for instance, is the economic function of behavioural constraint. The interaction between a quantum charge and a dynamic source of a magnetic field is considered in the Aharonov–Bohm (AB) scenario. It is shown that, in weak interactions with a post-selection of the source, the effective vector potential is, generally, complex-valued. This leads to new experimental protocols to detect the AB phase before the source is fully encircled. While this does not necessarily change the nonlocal status of the AB effect, it brings new insights into it. Upholding The Domestic Violence Firearm Prohibitors Under Bruen’S Second Amendment, Samantha L. Fawcett

Duke Journal of Constitutional Law & Public Policy Sidebar

Federal law prohibits individuals subject to a domestic violence protective order (§ 922(g)(8)) or convicted of domestic violence misdemeanors (§ 922(g)(9)) from possessing firearms. Before New York State Rifle and Pistol Association v. Bruen, these commonsense gun laws had generally been considered uncontroversial, both in terms of their broad popular support and their constitutionality under the Second Amendment. In Bruen, however, the Supreme Court held that when a regulation burdens a Second Amendment right, the regulation must be consistent with American historical tradition, meaning that the regulation must be analogous to a pattern of historical firearm regulation.

Introduction: Attention Deficit Hyperactivity Disorder (ADHD) is one of the most common neurodevelopmental disorders, characterized by the Diagnostic and Statistical Manual of Mental Disorders, Fifth Edition (DSM-5), which is marked by symptoms such as inappropriate levels of inattention, hyperactivity, and impulsivity that can affect academic, social, and personal functioning in children and adolescents. This review summarizes clinical trials demonstrating the effectiveness of Alpha-2 agonists in reducing symptoms of inattention, hyperactivity, and impulsivity in children with ADHD. Nella Larsen’s Passing (1929) serves as a namesake for this general idea, as two light-skinned African American women represent the divisionary approach to racial passing. In George S. The purposes of this study were to propose a conceptual framework and then develop and validate a checklist to assess treatment fidelity in K-12 school physical education. The present study aimed to expand the current knowledge of psychological skills usage within athletes of action sports by exploring the use of imagery and self-talk within skateboarders and snowboarders. Skateboarders and snowboarders (N 5 74) completed the Athletic Coping Skills Inventory (ACSI-28; Smith et al., 1995), the Self-Talk Questionnaire (S-TQ) for sports (Zervas et al., 2007), and the Sport Imagery Questionnaire (SIQ; Hall et al., 1998). Obesity's multifaceted causes give rise to a complex and diverse range of health associated morbidities and comorbidities, including diabetes, hypertension, and cardiovascular disease, particularly among British Asian and Minority Ethnic (BAME) populations within in the UK. As found within the recent COVID-19 pandemic these can have wider reaching implications including increased risk of mortality within this population group. In 2019, the American University in Cairo (AUC) conducted a research study on campus attitudes towards tobacco use and smoking behaviors within their community, in light of the then newly enforced tobacco-free policy. They found most campus members in support of the policy, with higher rates of disapproval from the smoking community. In 2021, this research aimed to follow-up on changes in attitudes towards the policy as well was smoking behaviors. It hypothesized that over time, levels of support to the policy would increase, smoking habits would be positively impacted and that positive health behaviors would correlate with policy support. …

Educational reform efforts have emphasized preparing highly competent and confident preservice teachers to deliver effective K-12 Science, Technology, Engineering, and Mathematics (STEM) instruction. Self-efficacy is a key variable that influences motivation and performance, and therefore it is necessary to support the development of preservice teachers’ integrated STEM teaching self-efficacy. This mixed-methods study investigates how preservice elementary teachers’ integrated STEM teaching self-efficacy is shaped during their participation in a newly redesigned STEM semester consisting of three concurrent methods courses (science and engineering, mathematics, and technology methods courses).
