The Foundation Review
The Hogg Foundation for Mental Health’s mission is to transform how communities promote mental health in everyday life. Policy engagement — fundamental to improving the social and structural determinants of mental health — has always been a strategic priority for the foundation, which has become a trusted resource for mental health and substance use policy issues in Texas. Yet, the state’s mental health and substance use policy community is limited in size, capacity, and training.
To address that reality, the Hogg Foundation for Mental Health Policy Academy and Policy Fellow Initiative was launched to invest in a mental health policy …
Community Building As A Philosophy, Not An Initiative, Anne C. Kubisch, Kasi Allen, Max Gimbel
Community Building As A Philosophy, Not An Initiative, Anne C. Kubisch, Kasi Allen, Max Gimbel
The Foundation Review
What happens when a foundation invests in community building for the long haul? The Ford Family Foundation, a rural embedded funder in southern Oregon, has made that transition over the past decade. The result is a transformed organization with a 10-year strategic plan focused on helping rural communities build the futures that they want to see — places where children and families can thrive.
The foundation is pursuing community building not as a stand-alone strategy or “initiative,” but as a philosophy that guides local community development efforts based on capacity building and grantmaking based on partnerships. The shift to a …
The Wrong, The Wronged, And The Wrongfully Dead: Deodand Law As A Practice Of Absolution, Trayce Hockstad
The Wrong, The Wronged, And The Wrongfully Dead: Deodand Law As A Practice Of Absolution, Trayce Hockstad
Nebraska Law Review
We call legal regimes of the world “justice systems” because they aim to provide us with just that—justice. As it turns out, a significant part of achieving justice involves finding someone or something to blame for the wrongs we endure. How successful the law is in ascertaining perpetrators and doling out just desserts is a complicated question. But on March 27, 1535, one such jury in Nottinghamshire, England was able to meet that extraordinary burden by carefully identifying the particular hay in a haystack that shifted and crushed Anthony Wylde.1 The offending hay, having killed the deceased, was appraised, and …
What’S “Controversial” About Esg? A Theory Of Compelled Commercial Speech Under The First Amendment, Sean J. Griffith
What’S “Controversial” About Esg? A Theory Of Compelled Commercial Speech Under The First Amendment, Sean J. Griffith
Nebraska Law Review
This Article uses the Securities and Exchange Commission’s SEC’s recent foray into Environmental, Social, and Governance ESG to illuminate ambiguities in First Amendment doctrine. Situating mandatory disclosure regulations within the compelled commercial speech paradigm, it identifies the doctrinal hinge as “controversy.” Rules compelling commercial speech receive deferential judicial review, provided they are purely factual and uncontroversial. The Article argues that this requirement operates as a pretext check, preventing regulators from exceeding the plausible limits of the consumer protection rationale.
Applied to securities regulation, the compelled commercial speech paradigm requires the SEC to justify disclosure mandates as a form of investor …
Subsurface Trespass: Private Remedies And Public Regulation, Joseph A. Schremmer
Subsurface Trespass: Private Remedies And Public Regulation, Joseph A. Schremmer
Nebraska Law Review
There is a growing literature examining when subsurface invasions from activities like tunneling, horizontal drilling, hydraulic fracturing, and waste disposal will constitute actionable subsurface trespasses. Liability for subsurface trespass has become an important question for many reasons, including that a significant climate-change technology, carbon dioxide sequestration, hinges on the ability to inject massive quantities of carbon dioxide underneath the land of many owners. To date, the subsurface trespass scholarship has paid relatively little attention to two topics downstream of liability: private remedies for trespassing subsurface activities.
This Article provides a high level accountof the role of, and relationship between, private …
Exclusionary Rules And Deterrence After Vega V. Tekoh: The Trend Toward A More Consistent Approach Across The Fourth And Fifth Amendments, Eugene R. Milhizer
Exclusionary Rules And Deterrence After Vega V. Tekoh: The Trend Toward A More Consistent Approach Across The Fourth And Fifth Amendments, Eugene R. Milhizer
Nebraska Law Review
The sound and fury of the U.S. Supreme Court decisions announced in the 2022 term obscured Vega v. Tekoh, in which the Court held that a violation of the Miranda rights warning and waiver requirements does not provide a basis for claiming a denial of rights under 42 U.S.C. § 1983. While Tekoh’s rejection of Miranda protections for § 1983 claims may ultimately prove to be significant, of far greater potential import is the Court’s rationale in support of its holding, which was premised on its assessment of the inadequacy of deterrent benefits that would be obtained by allowing …

NGTC “How Technology Regulates” Writing Competition Winner
This Article examines Google’s stated and potentially unstated justifications for ending support for the third-party cookie and the ripple effects this move creates for data collection across the digital advertising ecosystem. It argues that Google’s allegedly pro-privacy move and marketers’ allegedly pro-privacy switch to first-party data ignore and create privacy harms. The only way to protect privacy in the era of first-party data (and protect against future shifts in collection techniques) is to reconceive the corporation-consumer data relationship. On a broader level, this Article aims to provide a warning about the nature of …

The Forgotten Jurisprudence Of Parole And State Constitutional Doctrines Of Vagueness, Kristen Bell
Cardozo Law Review
