The Origins Of Covid-19 — Why It Matters (And Why It Doesn’T), Lawrence O. Gostin, Gigi K. Gronvall

Georgetown Law Faculty Publications and Other Works

When Health emergencies arise, scientists seek to discover the cause — such as how a pathogen emerged and spread — because this knowledge can enhance our understanding of risks and strategies for prevention, preparedness, and mitigation. Yet well into the fourth year of the Covid-19 pandemic, intense political and scientific debates about its origins continue. The two major hypotheses are a natural zoonotic spillover, most likely occurring at the Huanan Seafood Wholesale Market, and a laboratory leak from the Wuhan Institute of Virology (WIV). It is worth examining the efforts to discover the origins of SARS-CoV-2, the political obstacles, and …

Preliminary Data Of Potentially Hazardous Radon Concentrations In Modrič Cave (Croatia), Robert Lončarić, Vanja Radolić, Maša Surić, Igor Miklavčić, Matea Šatalić, Dalibor Paar, Lukrecija Obšivač

International Journal of Speleology

Instigated by relatively high cave-air CO2 concentrations in Modrič Cave (Croatia) recorded for the purpose of speleothem-based paleoclimate research, we established preliminary monitoring of radon (222Rn) concentrations within the cave for a 4.5-year period (2018–2022). As radioactive geogenic gas, radon, which often correlates with cave-air CO2 concentrations, presents a potential health hazard in cases of longer exposure time in high concentration conditions. Since the Modrič Cave is open to tourists and long-term scientific research has been performed within, a safety assessment for radon concentrations was essential. The integrated measurements of radon concentrations were performed by passive …

To face this situation, banks need to transfer long-term debts to the benefit of a bank or other financial institution in exchange for an urgent payment of the value of these debts, so that the bank can recover its financial balance.

In response to the needs of bank debt trading, the Tunisian legislator has organized many legal processes that enable the bank in need of financing to transfer its debts to …

Fake “Universities” The Concept And Coping Strategies, Prof. Safaa Otani Prof., Hassan Al-Abdallat Dr

مجلة جامعة الإمارات للبحوث القانونية UAEU LAW JOURNAL

The increase in societal demand for higher education has resulted in a wide spread of global activities of universities and academic institutions. Moreover, the rise of e-learning patterns, distance education, and the increase of non-traditional types of education have prompted the development of quality assurance mechanisms as essential elements to the recognition and accreditation of academic institutions.

The problem that aroused, however, was in the exploitation of these models by certain entities claiming to be universities, idiomatically called the “degree mills”, and taking advantage of the educational environment to gain illegal profits, by selling “fake” degrees to individuals who pay …

Furthermore, we studied the method that could be implemented to ensure the rights of all included parties. Therefore, we recommended that it is necessary to stipulate the possibility of separating the movable from the real estate without causing damage to either of them, so that the real estate can be fixed by privatization to be a guarantee, …

Cognitive, Ideological, And Goal-Pursuit Barriers To Ethical Decision Making, Jeffrey J. Bailey Jun 2023

Cognitive, Ideological, And Goal-Pursuit Barriers To Ethical Decision Making, Jeffrey J. Bailey

Mountain Plains Journal of Business and Technology

This paper brings together diverse research findings to suggest that there are several cognitive, ideological, and goal-pursuit barriers that often get in the way of ethical decision-making. The barriers lead managers to give little or no conscious attention to the ethical implications of their actions. The barriers that I categorize and describe are overconfidence, cognitively “filling-in” of missing information, social norm beliefs, ethical fixed mindsets, metaphors in-use, fairness and justice ideology, behavioral scripts, goal-fever (teleopathy), and goal framing. I describe the processes and mechanisms that underlie these barriers to increase awareness of them so that the willing manager may be …

The Use Of Arbitration Clauses By Social Media Websites: A Critique, Kavya Jha, Ananya Singh

Pepperdine Dispute Resolution Law Journal

The arbitration clauses contained in the Terms of Services (ToS) of most social media websites mandate arbitration and the waiver of class arbitration.1 In light of this reality, this article seeks to analyze the legal position with respect to mandatory arbitration and class arbitration waiver in the United States, India, and European Union (EU). It compares and juxtaposes the respective positions in these three jurisdictions to find that whereas the United States has been pro-arbitration to the extent of being detrimental to consumer interest, India has adopted an overly protectionist approach, while the EU has adopted an effective model to …

Is There A Role For Conflict Photography In Conflict Resolution? It's Complicated, Joseph Clift

Pepperdine Dispute Resolution Law Journal

In this essay, I argue that conflict photography has an important and useful role in conflict understanding and resolution. While conflict images’ usefulness has been debated, I argue that its importance has not. I start with a description of conflict photography and then provide a short historical account of the camera and its use in documenting conflicts. Next, I discuss conflict resolution and present examples of conflict resolution strategies. I then present evidence of how conflict photography can be a useful tool to support some of those strategies. Afterwards, I discuss the complicated nature of conflict photography’s usefulness. I conclude …

Managing Multiplicity: Consolidating Parallel Arbitration Proceedings For Renewal Energy Disputes, Francesca Pinto Jun 2023

Managing Multiplicity: Consolidating Parallel Arbitration Proceedings For Renewal Energy Disputes, Francesca Pinto

Pepperdine Dispute Resolution Law Journal

The United Nations Commission on International Trade Law (UNCITRAL) Arbitration Rules, considered the most widely used set of ad hoc rules in international arbitration, do not contain any provisions on consolidating parallel proceedings. Considering the complex, multiparty, and multiple-contract nature of renewable energy investment and development, the UNCITRAL Arbitration Rules should implement consolidation provisions that explicitly address consolidation for related arbitration proceedings and—in some circumstances—enforce consolidation regardless of whether all parties consent. Part II of this article provides an overview of transactions related to the investment, development, and operation of renewable energy projects. Part III identifies the risks of parallel …

Arbitration—From Sacred Cow To Golden Calf: Three Phases In The History Of The Federal Arbitration Act, Katherine V.W. Stone

Pepperdine Dispute Resolution Law Journal

For the past twenty-five years, without much fanfare, arbitration law has remade the civil justice system in the United States. As now interpreted, the Federal Arbitration Act (the ‘FAA’) requires millions of consumers, workers, homeowners, credit card holders, rental car uses, hospital patients, and other ordinary people to forgo use of the courts to vindicate important rights. One development that has garnered particular attention is the tendency of corporations to include class action waivers in arbitration agreements, thereby preventing consumers and employees from aggregating small claims and litigating on a collective basis. While arbitration has become ubiquitous, it has also …

A Case For Tolkien As Master Of The Sublime, Graham A.C. Scheper Jun 2023

A Case For Tolkien As Master Of The Sublime, Graham A.C. Scheper

Journal of Tolkien Research

The present article aims to reconcile Tolkien with the Literary Critics through an exploration of Tolkien's use of the sublime. First, an explanation of the sublime is given, with a summary of its evolution over the past two millennia. Subsequently, three key thrusts of the sublime's manifestation in Tolkien's work are identified: his use of depth and incompleteness, his use of vastness and grandeur, and his usage of shadows and death. Investigating Tolkien's usage of these devices in turn illuminates his skill as an artist and as an author.

Baltic Journal of Health and Physical Activity

Introduction: Anterior cruciate ligament (ACL) injuries are among the most common ligament injuries of the knee and often require reconstruction. The etiology of the molecular mechanisms of rupture of the anterior cruciate ligament (ACL) is poorly understood, and many external and internal factors have been associated with it, including genetics. This study aimed to investigate the association of sequence variants in the ELN and FMOD candidate genes with ACL ruptures based on the essential biological functions of these two proteoglycan-encoding genes in maintaining the structural integrity of tissues and regulating fibrillogenesis. Material and Methods: The partici-pants consisted of 229 (164 …

Perspectives From African American Male Rural School Leaders Regarding Targeted Recruitment Strategies For Future African American Male Rural School Leaders, Chameeka N. Smith, Portia Gibbs-Roseboro

Journal of Organizational & Educational Leadership

African American male educators are becoming extinct in our current United States School system. Representing less than 2% of the teaching force, our recruitment efforts will need adjustments to increase this population of educators in schools (Bristol & Mentor, 2018; Goings & Bianco, 2016; Wallace & Gagen, 2019). To address this concern, our study explores the perspective of African American male rural school leaders on the need to recruit more African American males into educational professions. Through three semi-structured interviews, 60-90 minutes, we identified the lack of opportunities and targeted recruitment strategies for this population into the field of education. …

Examining Movement-Specific Reinvestment And The Yips In Professional Baseball, Lazaro Gutierrez Mba, Ma, Phd, Pradeep R. Vanguri Phd, Lat, Atc

Journal for Sports Neuroscience

The sudden inability of a professional baseball player to throw the baseball accurately, a condition known as the “yips”, is considered a motor movement disruption. Movement-specific reinvestment, including movement self-consciousness (MS-C) and conscious motor processing (CMP), explains the disruption of well-learned motor movements in different performance domains such as throwing. The purpose of this quantitative, causal-comparative study is to examine movement-specific reinvestment level differences between self-reported yips-afflicted and non-afflicted professional baseball players in the United States as measured by the Movement Specific Reinvestment Scale (MSRS). A total of 130 professional baseball players (65 yips-afflicted and 65 non-afflicted) participated in the …
