Don't Call It 'Privacy': Data Protection, From Ideas To Constitutional Law, Raphaël Beauregard-Lacroix Jan 2024

Don't Call It 'Privacy': Data Protection, From Ideas To Constitutional Law, Raphaël Beauregard-Lacroix

SJD Dissertations

Data protection law has been subject to various criticisms, among which is one of a fundamental kind: devoted to procedures, it lost sight of its privacy-bound origins. This dissertation aims to provide a novel historical and comparative account of the transatlantic development of data protection law, from the origins to this day, identifying how it may yet succeed in reaching the policy goals its original proponents imagined, and untangling key legal concepts along the way.

The regulatory concept of data protection was founded on three basic principles: purpose limitation, universality, and institutional supervision and enforcement. These three principles trace their …

Nanoscale Characterization Of Interaction Of Nucleosomes With H1 Linker Histone, Ahmed Yesvi Rafa, Shaun Filliaux, Yuri L. Lyubchenko Jan 2024

Nanoscale Characterization Of Interaction Of Nucleosomes With H1 Linker Histone, Ahmed Yesvi Rafa, Shaun Filliaux, Yuri L. Lyubchenko

Journal Articles: Pharmaceutical Sciences

In eukaryotic nuclei, DNA is wrapped around an octamer of core histones to form nucleosomes. H1 binds to the linker DNA of nucleosome to form the chromatosome, the next structural unit of chromatin. Structural features on individual chromatosomes contribute to chromatin structure, but not fully characterized. In addition to canonical nucleosomes composed of two copies each of histones H2A, H2B, H3, and H4 (H3 nucleosomes), centromeres chromatin contain nucleosomes in which H3 is replaced with its analog CENP-A, changing structural properties of CENP-A nucleosomes. Nothing is known about the interaction of H1 with CENP-A nucleosomes. Here we filled this gap …

Approximation Of Sample Mean And Standard Deviation From Percentiles And Application To Reference Model For Sprint Time Of Elite Soccer Players, Kyra Batarse, Jessica Naranjo, Jakob Garcia, Steven Kim Jan 2024

Approximation Of Sample Mean And Standard Deviation From Percentiles And Application To Reference Model For Sprint Time Of Elite Soccer Players, Kyra Batarse, Jessica Naranjo, Jakob Garcia, Steven Kim

Mathematics and Statistics Faculty Publications and Presentations

The original goal of this project was to conduct meta-analysis and develop a reference model for 20-meter sprint time of elite soccer players with respect to age group. According to the likelihood function, we found that age-specific sample means and standard deviations are sufficient statistics. However, instead of the two sufficient statistics, the sample 10- th percentile, 90th-percentile, and quartiles were given to us. To deal with this unexpected challenge, we studied and compared methods of approximating the sample mean and standard deviation given various combinations of percentiles. Simulation studies showed that the likelihood method presented in this paper is …

Reverse Technological Spillovers From Outward Fdi On Home Countries’ Total Factor Productivity: Does The Mode Of Investment Matter?, Ayesha Ashraf, Federico Carril-Caccia, Nadia Doytch Jan 2024

Reverse Technological Spillovers From Outward Fdi On Home Countries’ Total Factor Productivity: Does The Mode Of Investment Matter?, Ayesha Ashraf, Federico Carril-Caccia, Nadia Doytch

Ateneo School of Government Publications

We examine the effect of outward foreign direct investment (OFDI) on total factor productivity (TFP) of home (source of FDI) countries in a global sample of 85 economies, distinguishing between outward greenfield FDI (OGFDI) and outward cross-border merger and acquisition (M&A) purchases. The goal of the study is to test for reverse technological spillovers to the FDI source country. The hypothesis is that OGFDI and M&As have different capabilities of carrying out reverse technological spillovers, which would affect the TFP of home countries differently. We apply a two-step system generalized method of moments (GMM) to deal with possible endogeneity and …

The Inadmissibility Of Victim Impact Evidence, Fernanda Gonzalez Jan 2024

The Inadmissibility Of Victim Impact Evidence, Fernanda Gonzalez

UC Law Constitutional Quarterly

Currently, 41% of inmates on death row in the United States are Black, even though Black people make up only 13.6% of the total population in the country. Additionally, the data has repeatedly shown that states that do not have the death penalty have lower murder rates than states that do. Despite these disparities, more than half of states in the United States continue to allow capital punishment in some form as an alternative to a life sentence. These disparities were further exacerbated by the Supreme Court’s decision in Payne v. Tennessee, which allowed prosecutors to introduce victim impact evidence …

Euryhalinity is present in diverse aquatic taxa and requires flexible osmoregulation to field the challenges posed by differing salinities. Na+, K+-ATPase (NKA) is a ubiquitous ion pump in the gills of fishes and, for some species, paralogs of the catalytic -subunit (NKA 1a and NKA 1b) exhibit reciprocal expression between fresh- and seawater, termed paralog-switching. We investigated the expression and evolution of NKA paralogs in Alewife (Alosa pseudoharengus), a euryhaline and migratory fish. Comparisons between landlocked and diadromous life history forms and migrant and pre-migrant ontogenetic stages were used to study shifts in NKA paralog expression related to freshwater or …

Norm-Breakers, Rights-Makers: Legislative Norms, Democratization, And The Fight For Civil Rights, Gregory A. Elinson Jan 2024

Norm-Breakers, Rights-Makers: Legislative Norms, Democratization, And The Fight For Civil Rights, Gregory A. Elinson

College of Law Faculty Publications

Norms, the conventional wisdom goes, help to keep our democracy stable. And breaking norms, scholars believe, puts democracy at risk of backsliding. This Article challenges that consensus. The original historical evidence marshaled here shows that norm-breaking by civil rights reformers in Congress was critical to jumpstarting the democratization of the United States in the mid-twentieth century, ensuring passage of both the Civil Rights Act of 1964 and Voting Rights Act of 1965. Norm-breaking, the Article makes clear, is sometimes essential to democratic reform.

Leveraging these detailed case studies, the Article explains why. In preserving the status quo, norms protect existing …

A Progressive Judiciary? Judicial Review And National Politics From Reconstruction To The Present, Joshua Braver, Gregory A. Elinson Jan 2024

A Progressive Judiciary? Judicial Review And National Politics From Reconstruction To The Present, Joshua Braver, Gregory A. Elinson

College of Law Faculty Publications

Within legal academia, the conventional historical narrative is that the Supreme Court has regularly interfered with legislative and executive efforts to protect minority rights and remedy economic inequality. Citing this reactionary tendency, an influential and vocal group of progressive legal scholars have argued that progressives ought to stop defending judicial review and instead devote their energies to eliminating it, or at least aggressively curbing its use. These progressive critics of judicial review (our term) proffer two related historical claims. First, they assert, the Supreme Court has consistently been less progressive than congressional majorities and Presidents. Second, they suggest, even landmark …

Towards Performance Guarantee For Federated Computing, Stoddard A. Rosenkrantz Jan 2024

Towards Performance Guarantee For Federated Computing, Stoddard A. Rosenkrantz

Computer Science and Engineering Dissertations - Archive

In federated computing environments, where multiple independent devices collaborate without centralized resource control, ensuring reliable and predictable performance is crucial for meeting Service Level Objectives (SLOs). This dissertation presents a novel framework for achieving SLOs by utilizing measured subtask response times, which are obtained and processed locally on the client devices. Each device generates a performance curve based on its subtask response times, and only the essential parameters of this curve are transmitted to a centralized client selector. The client selector then uses these parameters to determine which devices are best suited to meet predefined SLOs for specific tasks, ensuring …

Improving The Accuracy Of Software Models Using Refinement And Mutation Testing, Ana Jovanovic

Computer Science and Engineering Dissertations - Archive

Writing correct software models is important in today’s society. Unfortunately, software development is an error-prone task that frequently leads to buggy software. That is why users, both novices and experts, make use of additional techniques and tools to make software more reliable and correct. One of the languages that proposes a solution to this is Alloy. Alloy is a declarative language based on first order logic. Its main advantage is the ability to describe complex systems using concise formal logic. To verify the model and its properties, Alloy uses the Alloy Analyzer, an SAT-based verification tool that supports fully automatic …

Understanding Social Dynamics In Toxic Conversations And Public Health Intervention Acceptance On Social Media, Ana Aleksandric

Computer Science and Engineering Dissertations - Archive

Social media is now central to daily life, offering users a space to share content and opinions. However, these platforms also facilitate the spread of hate speech and misinformation, which can negatively impact public health. This dissertation develops methodologies to analyze social media data for insights that could inform health interventions. The research first examines user responses to toxic content, focusing on behavioral and emotional reactions, as well as group dynamics and bystander effects in toxic interactions. Another key focus is public opinion toward health interventions, particularly COVID-19 vaccination, using geolocated posts and analyzing factors such as race, ethnicity, and …

Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael M. O'Hear Jan 2024

Can The Excessive Fines Clause Mitigate The Lfo Crisis? An Assessment Of The Caselaw, Michael M. O'Hear

Faculty Publications

The nation’s increasing use of fees, fines, forfeiture, and restitution has resulted in chronic debt burdens for millions of poor and working-class Americans. These legal financial obligations (LFOs) likely entrench racial and socioeconomic divides and contribute to the breakdown of trust in the police and courts in disadvantaged communities. One possible source of restraint on LFOs may be the Excessive Fines Clause of the Eighth Amendment. Largely ignored by courts and commentators for two centuries, the Clause has in recent years been the subject of a burgeoning volume of litigation and scholarship. The U.S. Supreme Court has decided a handful …
