On The Meaning Of Discrimination: Anti-Racism Versus Color- Blind Policy, Keith N. Hylton
On The Meaning Of Discrimination: Anti-Racism Versus Color- Blind Policy, Keith N. Hylton
Cardozo Journal of Equal Rights & Social Justice
Chief Justice Roberts of the United States Supreme Court has said that "the way to stop discrimination on the basis of race is to stop discriminating on the basis of race. "I In this Article, I examine what it means to discriminate on the basis of race-or what it means to stop discriminating on the basis of race. I consider interventions designed to enhance social welfare in an economy with racially discriminatory games operating at its base. One set of interventions is color-blind, in the sense that it treats all actors alike regardless of race. The other set of interventions …

Kendra's Paradox: Redefining The Statutory Approach To Assisted Outpatient Psychiatric Treatment In New York, Matt Donelian
Kendra's Paradox: Redefining The Statutory Approach To Assisted Outpatient Psychiatric Treatment In New York, Matt Donelian
Cardozo Journal of Equal Rights & Social Justice
The note critically examines the limitations of Kendra's Law in New York, which provides Assisted Outpatient Treatment (AOT) for individuals with severe mental illnesses. While the law aims to balance public safety and individual rights, its strict eligibility criteria often prevent timely intervention, leading to worse outcomes for those in need. The note proposes reforming the law to prioritize clinical assessments over past actions, enabling earlier intervention while respecting individual rights. This reform would address the law's retroactive nature and promote a more proactive, compassionate approach to mental health care.
Graphic Design Is (Not) My Passion: How A Hypothetical Wedding Website Upended Lgbtq+ Public Accommodations Law And Where We Go From Here, Skylar Corby
Cardozo Journal of Equal Rights & Social Justice
The note examines the implications of the Supreme Court's decision in 303 Creative LLC v. Elenis, which upheld the First Amendment protection for a website designer refusing to create designs contrary to her beliefs, thereby invalidating part of Colorado's antidiscrimination law. This ruling undermines LGBTQ+ public accommodations protections, highlighting the need for federal legislation, such as the Equality Act, to safeguard these rights and address First Amendment concerns.
Protecting The Freedom Of Movement For All: A Proposal For Complete Street Policies That Prioritize The Needs Of Travelers With Idds And Autism In The Wake Of N.J. Bill S147, Olivia Handelman
Cardozo Journal of Equal Rights & Social Justice
The note examines the groundbreaking implications of New Jersey Bill S147, which mandates the New Jersey Department of Transportation (NJDOT) to develop complete street designs specifically addressing the needs of individuals with intellectual and developmental disabilities (IDD) and Autism Spectrum Disorder (autism). This legislation represents a significant shift in complete streets policies, which traditionally focus on physical accessibility but rarely prioritize non-physical disabilities. The note argues that NJDOT’s implementation of these designs must include tailored strategies, such as mobility education, staff training, and improved signage, to ensure independent and safe travel for this population. By addressing these needs, New Jersey …
A Masque Of Red Death: The Fda's "Individual Risk-Based" Blood Donor Final Guidance Report Is A Poorly Constructed Facade Covering Continued Animus Toward Queer Men, Gerald Dryden
Cardozo Journal of Equal Rights & Social Justice
The note argues that the FDA's blood donation guidelines discriminatorily target queer men, perpetuating stigma and failing to align with contemporary science. These guidelines, while aiming to protect blood recipients, are unconstitutional and not tailored to avoid discrimination, thus requiring revision to reflect current scientific understanding and eliminate bias.
Pay Transparency Laws Clear As Mud: A Discussion Of And Proposal For The Pay Transparency Legislation In Colorado And New York, Emily Hall
Cardozo Journal of Equal Rights & Social Justice
The note argues that while pay transparency laws in Colorado and New York represent progress, they fall short of achieving true pay equity because they do not require employers to disclose the factors influencing salary ranges. The author advocates for amendments to these laws, including mandatory annual pay audits and the disclosure of factors and their weights used in determining salary ranges, to enhance transparency and fairness in negotiations.

Dual Quaternions For Gravity Recovery Missions, Ryan Kinzie
Dual Quaternions For Gravity Recovery Missions, Ryan Kinzie
Doctoral Dissertations and Master's Theses
A dual quaternion-based modeling, state estimation and control approach is introduced as a better alternative to the traditional methods which are currently utilized for gravity recovery missions. The proposed modeling and control approach was verified against and compared to the tangent bundle to Special Euclidean Group 3 through MATLAB simulations. The dual quaternion-based approach shows superior performance over traditional linearized and uncoupled methodologies, in both modeling accuracy of spacecraft translational position, and the ability to control the pose of a test mass relative to its host spacecraft. Utilizing data products from the Gravity Recovery and Climate Experiment Follow-On mission, a …

Each of the techniques employed to achieve this goal is characterized by its own strengths and limitations. Hence, the main objective of this research is to develop the …
On The Provenance Of Software Systems: Automating Software Traceability With Knowledge Graph And Large Language Model Synergy, Tyler Procko
On The Provenance Of Software Systems: Automating Software Traceability With Knowledge Graph And Large Language Model Synergy, Tyler Procko
Doctoral Dissertations and Master's Theses
The present dissertation delineates a system that enables those engaged in software development to automatically generate and maintain project life cycle provenance. All projects are implemented and made manifest with the development of artifacts, e.g., papers, code files, etc. Tools exist to accelerate artifact creation, but little focus is paid to the processes that produce them. In terms of Ontology, or, from Ancient Greek, the study of being, the two most basic entities in reality are Continuant and Occurrent, or, roughly, “Artifact” and “Process”. This dissertation posits that for any created artifact, its process of creation, i.e., its life …
Enhancing Multifactor Authentication Using Machine Learning Techniques, Rafea Mohammed Ibrahim
Enhancing Multifactor Authentication Using Machine Learning Techniques, Rafea Mohammed Ibrahim

To improve the provision of psychotherapy, many countries have now established clinical practice guidelines for the treatment of specific disorders and mental health concerns. These guidelines have typically been based on evidence from meta-analyses of randomized clinical trials with minimal consideration of findings from qualitative research designs. This said, there has been growing interest in incorporating qualitative research in guideline development processes from both stakeholders and guideline development bodies. In this international collaboration, 19 qualitative psychotherapy researchers from 10 countries articulated the benefits of including qualitative findings within the guideline development process and generated recommendations for guideline developers. The underlying …
Do Bank Ceos Learn From Crisis Experiences?, Gloria Yang Yu
Do Bank Ceos Learn From Crisis Experiences?, Gloria Yang Yu
Research Collection Lee Kong Chian School Of Business
Does the early-career exposure of bank CEOs to the 1980s savings and loans (S&L) crisis affect the outcomes of banks they subsequently managed? We measure the S&L crisis exposure by the bank failure rate in the states where CEOs worked during the S&L crisis. Armed with this measure, we find that banks managed by CEOs with higher S&L crisis exposure took on less risk and that these banks better survived the financial crisis of 2008. In particular, CEOs adjusted risk attitudes in areas causing the S&L crisis: their more intense crisis experience reduced banks’ interest rate risk, exposure to risky …

Transnational Accountability For Space Debris As A Precursor To Maintaining Peace In Outer Space, Bella Alonzo
The International Law Review Association Student Forum
Beginning with the Space Age in the 1950s, space exploration has accelerated exponentially as humans on Earth are continuously drawn to the mystery and opportunity that lies in outer space. The United States (“U.S.”) and the Soviet Union led the charge in space discovery throughout the “Space Race,” and once other countries saw the value in developing the technology to utilize space as a resource, multiple nations followed suit. While the U.S. and Russia retain the most dominant presence in outer space, other global superpowers like China, India, and Japan have exhibited competitive capabilities.
The Intersection Of Cultural Rights And The Repatriation Of African Art: A Comparative Analysis Of International And North American Legal And Ethical Frameworks, Kennedy Wilson
The International Law Review Association Student Forum
The debate surrounding the repatriation of African and Indigenous art held in global museums is a complex and multifaceted issue that demands an examination of its historical, legal, and ethical dimensions. Emmanuel Macron's 2018 statement in Ouagadougou, Burkina Faso, encapsulates the core of this debate: “I cannot accept that a large part of the cultural heritage of several African countries is in France,” he declared. “There are historical explanations for this but there is no valid, lasting and unconditional justification. African heritage cannot be only in private collections and European museums.” This sentiment perfectly captures the profound unease surrounding the …

From Hanging To Nitrogen Hypoxia: The Evolution Of Execution And The Case For American Abolition, Anna Kuhlman
The International Law Review Association Student Forum
The death penalty has been a dark fixture in societal punishment for most of human history. It has allowed for grisly, violent executions of people found guilty of misconduct relative to the culture they live in. “The first established death penalty laws date as far back as the Eighteenth Century BCE in the Code of King Hammurabi of Babylon, which codified the death penalty for 25 different crimes.” The first death sentence on record was a member of nobility in 16th-century BCE Egypt, where the wrongdoer was accused of magic and ordered to commit suicide. In the seventh century B.C.E., …
