Closing The Gap In American History Knowledge In K-12 Students, Benjamin D. Langholz Apr 2025

Closing The Gap In American History Knowledge In K-12 Students, Benjamin D. Langholz

Masters Projects

Research indicates there is a decline in student comprehension and engagement in Social Studies knowledge among secondary students in the United States. Students lack access to diverse voices in their history classrooms, which may lead to an unbalanced perspective of American history. While there are multiple reasons behind this lack of diversity in the secondary classroom, this paper focuses on three culprits: Lack of diversity in state standards, lack of diversity in class curriculums, and that teachers may lack the knowledge to teach multiple viewpoints to students. One way to combat these problems is by implementing culturally relevant pedagogy, which …

Seasonality Of Groundfish Community Structure And Habitat Associations On A Mesophotic Reef In Monterey Bay National Marine Sanctuary: Implications For Conservation And Management, Lauren Parker Apr 2025

Seasonality Of Groundfish Community Structure And Habitat Associations On A Mesophotic Reef In Monterey Bay National Marine Sanctuary: Implications For Conservation And Management, Lauren Parker

Capstone Projects and Master's Theses

Management of marine ecosystems requires accurate, quantitative, and spatially explicit information on species distributions at scales that are relevant to the management process (J. Ward et al. 1999). This study investigates fish assemblages at depths between 30 and 40 meters, which are relatively understudied compared to shallower ( < 30 m) waters, surveyed extensively via SCUBA, and deeper (>40 m) waters, which are surveyed using submersibles. This research addresses ecological and management-based questions about seasonal and depth-related shifts in groundfish community structure, the role of oceanographic variables in predicting these shifts, and microhabitat selectivity as predictors of community assemblage. To evaluate species abundance, biomass, diversity, and microhabitat associations associations on …

The Purpose Of The Preliminary Injunction, Samuel L. Bray Apr 2025

The Purpose Of The Preliminary Injunction, Samuel L. Bray

Vanderbilt Law Review

This Article explores a reshaping of the preliminary injunction that is occurring in the federal courts. A preliminary injunction is designed to be a “hold in place” order, blocking actions by the parties that would undermine the efficacy of the court’s remedial options. But the preliminary injunction is becoming a device for accelerating the merits decision. Instead of a four-factor test for preliminary relief, increasingly there is one factor: the merits. This Article critiques this transformation, and it argues that the preliminary injunction should be recentered on the protection of the court’s remedial options.

Super-Canons, William N. Eskridge, Jr. Apr 2025

Super-Canons, William N. Eskridge, Jr.

Vanderbilt Law Review

Especially since 2017, the Roberts Court has been imposing a new regime onto American public law. The new regime is paring back the authority of expert agencies to implement their delegated responsibilities, reducing the power of Congress to make long-term delegations while enhancing the power of the states and the President (and the U.S. Supreme Court itself), protecting and encouraging expression of religious values in public and commercial fora, limiting women’s rights to reproductive choice, and reducing the capacity of state and private institutions to inculcate diversity and inclusion.

This Article maintains that the new regime is not entirely driven …

Energizing Federal Action Toward A More Coherent National Nuclear Waste Policy, Sydney C. Schoonover Apr 2025

Energizing Federal Action Toward A More Coherent National Nuclear Waste Policy, Sydney C. Schoonover

Vanderbilt Law Review

Nuclear power offers the United States one viable path toward decarbonization of the energy sector as the only zero-emission energy source capable of baseload generation. Despite the clear climatic, economic, and energy independence benefits of expanding reliance on nuclear power and the emergence of cheaper, safer, and more efficient advanced reactor technology that has lowered barriers to adoption, buildout of nuclear generation capacity faces impediments. The lack of a comprehensive national nuclear waste management strategy is perhaps the most significant obstacle to the siting of new nuclear power facilities. Currently, due to the federal government’s failure to establish a geologic …

Rethinking The Litigation Boom, Charlotte S. Alexander Apr 2025

Rethinking The Litigation Boom, Charlotte S. Alexander

Vanderbilt Law Review

This Article rethinks the functions and functioning of litigation booms. Using an original data set that tracks Fair Labor Standards Act cases during the 2000–2016 period, the Article shows that booms are not anomalies but are instead an expected behavior in our distributed system of civil law enforcement. Specifically, plaintiffs and their lawyers “herd” or converge on a particular type of case, fueled by information transmitted via networks, made available to the general public, or both. The data also reveal that booms can end on their own, reaching a natural tipping point without legislative or judicial retrenchment. This analysis has …

Against Monetary Primacy, Yair Listokin, Rory Van Loo Apr 2025

Against Monetary Primacy, Yair Listokin, Rory Van Loo

Faculty Scholarship

To reduce inflation, the Federal Reserve (Fed) raises interest rates. But every month with high interest rates increases the risk of a devastating recession. Recessions impose not only short-term pain in the form of widespread unemployment but also lifelong harm for many, as vulnerable workers and those who start their careers during a downturn never fully recover. Yet hiking interest rates is the centerpiece of U.S. inflation-fighting policy. When inflation is high, the Fed raises interest rates until inflation is tamed, regardless of the consequent sacrifices. We call this inflation-fighting paradigm “monetary primacy.” Despite its great risks, monetary primacy has …

Promises, Promises: Understanding Claims Made In Social Robot Consumer Experiences, Johanna Gunawan, Sarah Elizabeth Gillespie, David Choffnes, Woodrow Hartzog, Christo Wilson Apr 2025

Promises, Promises: Understanding Claims Made In Social Robot Consumer Experiences, Johanna Gunawan, Sarah Elizabeth Gillespie, David Choffnes, Woodrow Hartzog, Christo Wilson

Faculty Scholarship

Social robots are a class of emerging smart consumer electronics devices that promise sophisticated experiences featuring emotive capabilities, artificial intelligence, conversational interaction, and more. With unique risk factors like emotional attachment, little is known on how social robots communicate these promises to consumers and whether they adequately deliver upon them within their overall product experiences prior to and during user interaction.

Animated by a consumer protection lens, this paper systematically investigates manufacturer claims made for four commercially available social robots, evaluating these claims against the provided user experience and consumer reviews. We find that social robots vary widely in the …

U.S. Territories And The Criminal Law Curriculum, Emmanuel Hiram Arnaud Apr 2025

U.S. Territories And The Criminal Law Curriculum, Emmanuel Hiram Arnaud

Faculty Scholarship

In this Article, I make a case for why issues concerning the territories should be taught in law school courses and suggest a few ways in which federal criminal adjudication in the territories can and should be incorporated into the criminal law and procedure curriculum.10 As I advance elsewhere,11 criminal adjudication in the territories functions differently than in the mainland United States.12 Using the framework of what I call the “territorial criminal legal system,” I have begun mapping the contours of the unique prosecutorial ecosystem produced by the territorial condition.13 Chief among the characteristics is the …

The Lost English Roots Of Notice-And-Comment Rulemaking, Rephael G. Stern Apr 2025

The Lost English Roots Of Notice-And-Comment Rulemaking, Rephael G. Stern

Faculty Scholarship

Notice-and-comment rulemaking is arguably the most important procedure in the modern administrative state. Influential accounts even frame it as the 1946 Administrative Procedure Act’s “most important idea.” But its historical origins are obscure. Scholars have variously suggested that it grew out of the constitutionally sanctioned practice of congressional petitioning, organically developed from the practices of nineteenth-century agencies, or was influenced by German conceptions of administrative rulemaking. These histories, however, are incomplete. Using original archival research, this Article demonstrates that notice-and-comment rulemaking was the product of a series of American transplantations of English rulemaking procedures that developed in the late nineteenth …

On The Meaning Of Discrimination: Anti-Racism Versus Color-Blind Policy, Keith N. Hylton Apr 2025

On The Meaning Of Discrimination: Anti-Racism Versus Color-Blind Policy, Keith N. Hylton

Faculty Scholarship

Chief Justice Roberts of the United States Supreme Court has said that “the way to stop discrimination on the basis of race is to stop discriminating on the basis of race.”1 In this Article, I examine what it means to discriminate on the basis of race—or what it means to stop discriminating on the basis of race. I consider interventions designed to enhance social welfare in an economy with racially discriminatory games operating at its base. One set of interventions is color-blind, in the sense that it treats all actors alike regardless of race. The other set of interventions is …

Sexual And Reproductive Health & Rights: Advances And Setbacks, Aziza Ahmed, Alicia Ely Yamin, Sofia Gruskin Apr 2025

Sexual And Reproductive Health & Rights: Advances And Setbacks, Aziza Ahmed, Alicia Ely Yamin, Sofia Gruskin

Faculty Scholarship

This article first describes shifts in human rights law that have led to improvements in the realization of sexual and reproductive health and rights (SRHR) over the last decade. The article does so, however, with careful attention to the structural factors beyond formal legal mechanisms that may undermine the ability of governments, even with the best of intentions, to fully develop the necessary robust health and justice systems. Second, this article considers two additional factors: the political economy factors that enable or limit the ability of States to realize SRHR, as well as the growing evidence base that supports positive …

The Misuse Of Ratification-Era Sources By Unitary Executive Theorists, Jed Handelsman Shugerman Apr 2025

The Misuse Of Ratification-Era Sources By Unitary Executive Theorists, Jed Handelsman Shugerman

Faculty Scholarship

This symposium essay suggests that, given an ostensibly originalist Supreme Court, the future depends on getting the past right. The unitary executive theory is approaching its political and doctrinal zenith in 2025, at the very moment it is approaching an evidentiary crisis. This essay details that crisis: a subset of misuses and misrepresentations of sources in the unitary executive scholarship. This subset focuses on serious misrepresentations of the Ratifications debates.

The Ratification debates appropriately have become the primary source of evidence for original public meaning, the dominant theory of originalism. The Ratification debates have always been a significant problem for …

Banjir Rescue Iot Based Flood Evacuation Center, Nor Azimah Khalid, Nur Aliah Syamsurial, Noorhayati Mohamed Noor, Shapina Hj Abdullah Apr 2025

Banjir Rescue Iot Based Flood Evacuation Center, Nor Azimah Khalid, Nur Aliah Syamsurial, Noorhayati Mohamed Noor, Shapina Hj Abdullah

Malaysian Journal of Computing (MJoC)

One of the important processes involved when a disaster happens is to allocate the victims to the navigation center. Current evacuation practices may cause further damage as the victims must wait for the rescue team to come. A self-navigation system, called Banjir Rescue, would allow the victims to save their lives and belongings sooner by determining the appropriate evacuation center. In this approach, the appropriate evacuation center is determined based on two critical parameters, which are the water level and distance. First, the near-real-time data retrieved from the water level sensor set up at the evacuation centers is sent to …

Secondary School Students Attitude And Its Effects On Mathematics Achievement, Aini Shuhaimah Selamat, Zarith Sofiah Othman, Siti Salwana Mamat Apr 2025

Secondary School Students Attitude And Its Effects On Mathematics Achievement, Aini Shuhaimah Selamat, Zarith Sofiah Othman, Siti Salwana Mamat

Malaysian Journal of Computing (MJoC)

This study examines students' attitudes and motivation toward learning mathematics. The purpose of the study is to determine the relationship between the variables of students' attitudes toward mathematics and their motivation to learn mathematics. The study also addresses the question of how non-intelligence variables affect student achievement. To answer the research questions, a questionnaire was administered to 150 grade 4 students who were surveyed. From the results, the relationship between these two variables is shown to be significant. However, the variables did not seem to affect the students' performance. It appeared that although the students had a positive attitude towards …

Impact Of Ageing Population Towards Pension Expenditure In Malaysia An Ardl Approach, Nurul Dahiyah Shahirah Alias, Rose Irnawaty Ibrahim Apr 2025

Impact Of Ageing Population Towards Pension Expenditure In Malaysia An Ardl Approach, Nurul Dahiyah Shahirah Alias, Rose Irnawaty Ibrahim

Malaysian Journal of Computing (MJoC)

When the aging population increases, the demand for pension is also higher causing pension expenditure to also increase. Persistent increase in pensions expenditure can cause strain on government budgets and pose sustainability challenges for pension systems in the future. Therefore, this empirical study delves into the relationship between population aging and pension expenditure and identifies both short-term and long-term relationships between pension expenditure and its determinant for the sample spanning from 1970 to 2020. This study uses Autoregressive Distributed Lag (ARDL) model to achieve the objectives. The independent variables are life expectancy, the population aged 65 and above, total fertility …

Exploring Transfer Learning And Convolutional Autoencoder For Effective Kitchen Utensils Classification, Hashim Rosli, Rozniza Ali, Muhamad Suzuri Hitam, Ashanira Mat Deris, Noor Hafhizah Abd Rahim

Malaysian Journal of Computing (MJoC)

Effective classification of kitchen utensils is crucial for advancing assistive technologies and enhancing daily living for individuals with visual impairments. This study investigates the use of transfer learning and convolutional autoencoders to improve classification accuracy. We integrate pre-trained networks into an autoencoder framework to enhance feature extraction and image reconstruction. Models including ResNet50, DenseNet121, and their autoencoder variants were evaluated using precision, recall, accuracy, Structural Similarity Index Measure (SSIM), and Peak Signal-to-Noise Ratio (PSNR). Results show that DenseNet121 outperforms ResNet50 with a classification accuracy of 72% and shorter training time. When combined with autoencoders, DenseNet121-Autoencoder achieves the highest classification accuracy …

Beyond Non-Recognition: U.S.–Taiwan Trade Agreements In Indo-Pacific Dynamics, Pasha L. Hsieh

Research Collection Yong Pung How School Of Law

At the core of U.S.-China tensions and the Indo-Pacific strategy, the evolving legal frameworks that govern U.S.-Taiwan relations present legal intricacies under American and international law. The Article provides the first comprehensive analysis of the groundbreaking U.S.-Taiwan Initiative on 21st-Century Trade, the only Congress-approved trade agreement during the Biden administration. It argues that within the space of non-recognition, the United States has accorded Taiwan diverse and incremental forms of legal recognition, which culminated in the Initiative and its Implementation Act. Through an interdisciplinary lens, the Article develops a theoretical framework that bridges recognition theories under international law and international relations. …

Core Self-Evaluation And The Relationship To Employee Green Behavior, Matthew Nyquist Apr 2025

Core Self-Evaluation And The Relationship To Employee Green Behavior, Matthew Nyquist

Theses and Dissertations from DePaul University

Employee green behavior (EGB) is a construct that includes environmentally related workplace behaviors (Zacher et al., 2023). This construct has been researched in terms of its relationship with personality traits under the Big 5 but has scarce research on its relationship with Core Self Evaluation (CSE) (Katz et al., 2022; Patrasc-Lungu & Iliescu, 2022). This is important to examine for the purpose of increasing the understanding of how personality characteristics relate to EGB. The present research aims to identify the strength of the relationship between CSE and EGB. Autonomy, which is the degree to which an employee has control over …

Innovative Mechanisms For Marketing Health Insurance: An Experimental Field Test (Results From Colorado), Wendy Netter Epstein, Christopher Robertson, David Yokum, Hansoo Ko, Kevin Wilson

Faculty Scholarship

We hypothesize that marketing messages using a generosity framing have the potential to draw healthy persons into the insurance pool, thereby improving access and health outcomes and lowering premiums, but without removing choice or requiring substantial government action. The dependent variable for our field experiment is whether or not recipients of the marketing campaigns enroll in health insurance via the participating exchanges or in Medicaid.

Taking Revolution Seriously, Zohra Ahmed

Every so often, a prison strike will make national news, as it did in 2014, 2016, and 2018. 1 The media will focus on the atrocious conditions of confinement; the unchecked violence; the wages numerated in pennies; and the state’s indifference to the strikers’ modest demands for food, medical care, and human contact.

Orisanmi Burton’s2 book, Tip of the Spear: Black Radicalism, Prison Repression, and the Long Attica Revolt, urges us to process such reporting with a healthy dose of skepticism. What if prison rebellions were telling us something else, something even more important? What if they were …

Felicia Sonmez alleges that the Washington Post violated the D.C. Human Rights Act by banning her from covering certain stories because she is a woman and a sexual-assault survivor. Op. 2-3. After finding Sonmez’s detailed allegations plausible, a panel of this Court rejected as premature the Post’s First Amendment defense that its decision was driven not by discrimination but by a desire to maintain an appearance of objectivity. Op. 4. Because “what actually motivated the Post editors to impose the bans on Sonmez is a factual question,” the panel held, the Post’s First Amendment defense could not be resolved on …

Marketing For Musicians And Artists: A Pedagogical Model For Creative Business Education, Aron Levin, Jose Luis Saavedra Torres Apr 2025

Marketing For Musicians And Artists: A Pedagogical Model For Creative Business Education, Aron Levin, Jose Luis Saavedra Torres

AMTP Proceedings 2025

The myth of the "starving artist" persists, but marketing and entrepreneurial skills can empower creatives to thrive in the gig economy. This paper presents a pedagogical framework for a marketing course tailored to non-business students, particularly those in the creative arts. Using Sam Ryder, a musician who leveraged digital platforms to achieve meteoric success, as a case study, we explore the role of higher education in equipping artists with business skills. Grounded in experiential learning theory, the course integrates modules on branding, digital marketing, pricing, and work-life balance, emphasizing hands-on projects like SWOT analyses, brand identity design, and marketing strategy …
