This Comment explores the common law property concepts of nuisance, water law, and easements which arise by operation of law in order to determine the kind and degree of solar access protection they can provide Maine residential users of solar energy. The final section of this Comment proposes an express solar easement by which Maine citizens can create their own enforceable interests in unobstructed sunlight for solar energy use. Maine law provides three distinct statutory proceedings to try title: the real action, an action at law to quiet title, and an action in equity to quiet title. As the preceding Comment demonstrates, the present statutory scheme preserves outmoded distinctions between law and equity that are functionally obsolete in modern civil practice. Although the statutory law governing actions to try title in most states is, like Maine's, a patchwork product replete with archaic concepts, several other states have consolidated legal and equitable remedies into simple, comprehensive statutory actions. In June of 1979 the 109th Maine Legislature enacted four statutes dealing with abortion. The public and legislative debate on these issues was intense and emotional. Due to the great scope of the subject, this Comment will be limited to discussion of the statutes dealing with informed consent and parental notification, which directly raise issues of individual constitutional rights. The constitutional implications of these two statutes will be examined, and the likely outcome of a constitutional challenge to each will be suggested. Actions to try title are commonly used by Maine lawyers to adjudicate real estate title conflicts. Though often time consuming, expensive, and complicated, such actions are necessary in any state that seeks to foster a stable, economically efficient real estate market. Actions to try title have been necessary in all states because no protective statutory scheme for land titles has ever succeeded in eliminating all title defects that interfere with quiet possession or salability. A basic premise of Professor Orlando Delogu's article, The Misuse of Land Use Control Powers Must End: Suggestions for Legislative and Judicial Responses, is that many Maine municipalities are using their land use regulatory powers in impermissibly exclusionary ways. Professor Delogu proposes that the legislature and courts of Maine should respond to correct the situation. This Commentary will attempt to illustrate that Professor Delogu has failed to document his premise or to define accurately the difference between permissible and impermissible exclusion. There are currently two major international agreements of the United States which have been signed by the parties and transmitted by the President to the Senate for its advice and consent: the Treaty with the Soviet Union on the Limitation of Strategic Offensive Arms, known as SALT II, and the Agreement with Canada on East Coast Fishery Resources and the accompanying Treaty to Submit to Binding Dispute Settlement the Delimitation of the Maritime Boundary in the Gulf of Maine Area. Employment discrimination litigation has increased dramatically during the past decade. Under Title VII of the Civil Rights Act of 1964—Congress' sweeping prohibition of discrimination in employment decisions on the basis of race, color, religion, sex, or national origin –older federal civil rights statutes and state counterparts to Title VII, courts have developed discrete, cognizable theories of discrimination. An analytical framework has also developed by which to evaluate the facts, innuendoes, and statistics that constitute the claims and defenses in a discrimination case. The 1978 Amendments to the federal Age Discrimination in Employment Act (ADEA), which generally prohibit mandatory retirement before the age of seventy, have been criticized as proposing to "extend freedom of choice by restricting freedom of contract. Despite such criticisms and other less philosophical objections to the Act, the 108th Maine Legislature in 1977 passed the first part of a legislative program which, as of January 1, 1980, prohibits all mandatory retirement in Maine, in both the public and private sectors. The coastal shores of the United States are a peculiar form of property in that both the littoral landowner and the general public have legally protected interests in the use and enjoyment of the land. In most coastal states the title to the land below the high-water mark is vested in the state in trust for the beneficial use of the public, subject to certain limited rights of the littoral owner. Federal regulation of added poisonous and deleterious substances in food by the Food and Drug Administration has become an administrative quagmire. Although responsibility for this situation evades precise assignment, FDA regulatory problems typically arise through the operation of three factors. First, the applicable statutory provisions are highly ambiguous, far exceeding the level of ambiguity traditionally viewed as necessary to administrative flexibility and efficiency. Land use planning and control has traditionally been perceived as a set of issues best dealt with by local government. For several years the federal district courts and circuit courts of appeal wrestled with the question of a labor union's liabilities and obligations when its members engaged in a wildcat strike. Concern for halting wildcat strikes increased considerably after the Supreme Court's decision in Buffalo Forge Co. v. United Steelworkers. In Buffalo Forge the Court held that a union-sanctioned strike over an issue not subject to binding arbitration could not be enjoined pending an arbitrator's determination of whether the strike violated the no-strike provision of the collective agreement. As a result this study investigated use of online information resources and academic staff research productivity. A survey research design was used, in which the population consist of academic staff in public universities in Ogun State. Amid growing teacher dissatisfaction and attrition, this 2022 research project explored the potential benefits of spiritual direction in enhancing teacher well-being, identity, and resilience. The study involved 11 trained spiritual directors providing eight sessions of spiritual direction to 38 teachers from Australian Christian schools. Findings highlight the positive impact of spiritual direction on teachers' vocational clarity, self-awareness, and ability to manage workplace challenges. Participants reported a renewed commitment to their profession, improved emotional resilience, and a deeper connection between their spiritual and professional identities. The Role Of Gender Equity In Olympic Success Using Panel Data, Anusha Khan

This study investigates whether gender equity is one of the determinants of Olympic success at the country level. Using panel data with 766 observations from six Olympic years (2012–2022), it examines the relationship between gender equity and national medal counts. Three Ordinary Least Squares (OLS) models were estimated using total, men’s, and women’s medal counts as dependent variables. While the findings vary across models, results suggest that gender equity may be positively associated with Olympic performance, though its significance is limited when controlling for other social and economic variables.

Past research has investigated what on-field statistics have impacted the success of MLB teams. However, this paper aims to look at the effect that the recent rule change of the pitch clock has on the win percentage of MLB teams. With the implementation of the pitch clock, it was expected that teams with a lower average pitch time would see more success. Using data from the 2013-2024 seasons, statistical analysis was run to determine which variables impacted team win percentage the most. Recent news stories reported that the U.S. military is currently experiencing an unprecedented recruiting crisis. In fact, between 2022-2023, the U.S. armed forces (the Army in particular) failed to meet their numbers by a large margin: against goals of 232,021 accessions for 2022 and 244,533 for 2023, the branches collectively missed their targets by 40,369 and 41,336 accessions respectively. Even though the branches proved able to meet their recruitment goals – although barely – in fiscal year 2024, concerns continue to linger.

This study investigated the perceptions and beliefs of four general education kindergarten teachers regarding their use of evidence-based behavior practices compared to their observed implementation of those practices. Classroom observations were conducted to collect data regarding teachers use of “honey” (positive, evidence-based practices) as compared to their use of “vinegar” (negative comments, redirections, etc.). Teacher interviews were also conducted to examine teacher perceptions, and the data was compared to determine if perceptions matched reality. Reproductive Governance In China: National Policies, Human Rights, And Accountability Under International Law, Victoria Xuan Wang

Northwestern Journal of Human Rights

China’s reproductive policies, including the One-Child, Two-Child, and Three-Child Policies, have been widely criticized for violating women’s reproductive rights through coercive enforcement measures such as forced abortion, sterilization, and employment discrimination. This Article argues that these policies violate international human rights law, particularly the right to freely determine the number and spacing of children as protected under the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW).

Despite international scrutiny, China has largely resisted direct responses to criticisms from treaty-based and charter-based human rights monitoring bodies, including the CEDAW Committee, the Universal Periodic Review and Special Procedures …

Protecting patient information is a major priority for healthcare providers, information technology (IT) security teams, policymakers, and patients in the United States (U.S.) healthcare system.
