Stacked Against Defendants: Retroactivity, Vacatur, And The First Step Act In Hewitt V. United States, Matthew N. Barry

In 2018, Congress passed the First Step Act with overwhelming bipartisan support. One of its provisions, § 403, clarifies 18 U.S.C. § 924(c) by eliminating the "stacking" of mandatory minimum sentences for certain firearm offenses for first-time offenders. Section 403(b) makes the provision retroactive so long as "a sentence for the offense has not been imposed" as of the Act's date of enactment.
In 2009, bank robbers Corey Duffey, Tony Hewitt, and Jarvis Ross were convicted of several federal crimes, including stacked § 924(c) offenses. After their sentences were vacated in 2020, they argued that they should be resentenced under …

This thesis examines the legal complexities surrounding eminent domain, common carrier status, and landowner protections in the context of Summit Carbon Solutions carbon sequestration pipeline. This proposed pipeline spans five states, including South Dakota, North Dakota, Minnesota, Iowa, and Nebraska, with each state presenting different regulatory frameworks that impact the project's implementation. These findings highlight discrepancies in eminent domain laws, common carrier status, challenges in the permitting process, and landowners rights. Of the five states involved in the pipeline project, some impose strict judicial oversight and negotiation requirements, while others maintain flexible or decentralized policies. Solar panels are a cornerstone of renewable energy infrastructure, playing a pivotal role in global sustainability efforts. To ensure their resilience and long-term viability, accurate wind load estimations are essential for designing supporting structures, which account for nearly 50% of their total cost. However, traditional building codes lack comprehensive guidance for solar panels, resulting in inconsistent estimations due to discrepancies in scaled wall-bounded wind tunnel testing methodologies. These inaccuracies pose safety risks, increase costs, and hinder adoption. A Long Non-Coding Erna Forms R-Loops To Shape Emotional Experience-Induced Behavioral Adaptations, Rose Marie Akiki

Emotional experiences often evoke neural plasticity that supports adaptive changes in behavior, including maladaptive plasticity associated with mood and substance use disorders. These adaptations are supported in part by experience-dependent activation of immediate-early response genes, such as Npas4. We discovered that a conserved, long non-coding enhancer RNA (lnc-eRNA) transcribed from an activity-sensitive enhancer produces DNA-RNA hybrid R-loop structures that support 3D chromatin-looping of the enhancer and proximal promoter and stimulus-induced, rapid Npas4 gene induction. We also show that this Npas4 lnceRNA and its R-loops are required for the development of behavioral adaptations produced by chronic psychosocial stress or cocaine exposure, …

Faith In Tomorrow: Strategies To Inspire Philanthropic Support For Catholic Schools, Angelo Milicia

Philanthropy plays a vital role in sustaining Catholic schools; however, the factors that motivate donors to support these institutions remain an area of ongoing inquiry. This study examines the key influences driving philanthropic giving to Catholic education, exploring the intersection of faith, personal values, institutional trust, and perceived impact on students and communities. Using a mixed-methods approach, the research incorporates survey data from 185 participants and insights from 17 focus group members to identify the primary motivations behind donor support. The findings indicate that religious commitment, personal connections to Catholic education, and belief in the school’s mission are among the …

Indonesia has renewable energy potential spread across various islands. However, limited interconnection between regions is an obstacle to energy distribution. The purpose of this study is to analyze the planning of renewable energy (RE) power plants covering eight types: Geothermal Power Plants (PLTP), Solar Power Plants (PLTS), Wind Power Plants (PLTB), Biomass Power Plants (PLTBm), Biogas Power Plants (PLTBg), and Waste Power Plants (PLTSa). The analysis was conducted in four main system regions in Indonesia, namely Java-Bali, Sumatra, Kalimantan, and Sulawesi, which are currently not interconnected. In this presentation, academic librarians will explore their roles within unions and the impact of union work on their profession. The panelists, representing diverse institutions across the United States, will discuss how unions have improved their working conditions by securing fair wages, benefits, and job security. Trade Openness And Spatial Inequality In Developing Countries: Case Study Of Asean-4, Rosalia Marcha Violeta, Vedy Ardine Sahetapy, Garda Maharsi, Mohamad Dian Revindo

Trade openness is widely associated with stronger medium- to-long-term economic growth, yet its distributional consequences within countries, particularly in developing economies, remain contested. This paper examines the relationship between trade openness and spatial inequality in four major ASEAN economies, Indonesia, Malaysia, Thailand, and the Philippines, over the period 2012–2019. Spatial inequality is measured using Theil’s Index based on provincial-level GDP per capita, while trade openness is proxied by the trade-to-GDP ratio. Employing pooled OLS and fixed-effects estimations, the analysis controls for key structural factors such as economic development, population size, urbanization, government expenditure, and the number of spatial units. High crime rates in rural areas indicate development inequality and low welfare. The government initiated the Padat Karya Tunai Desa Program (Cash-for-Work) to improve welfare by providing employment. Using the Difference-in-Difference method with 2018 and 2021 PODES data from 7,721 villages in East Java, this study analyzes the impact of the PKTD Program and socio-economic factors on crime using three measures: total crime types, theft, and violence. Results show that the Cash-for-Work program does not reduce total crime types and violence, but has the potential to reduce theft. Burnout has a negative and pervasive impact on individual workers, employee groups, and organizations. At the organizational level, role conflict and role ambiguity in human service settings have consistently been associated with burnout (Fraser et al., 2018; Jackson et al., 1986, Maslach, 1993, & O’Connor et al., 2018; Thomas et al., 2014). This paper examines the transformative impact of mobile technologies on electronic music-making, highlighting how portable apps and hardware enable idiosyncratic approaches beyond traditional live and studio setups. Drawing on the authors’ extensive experience within and beyond Clan Analogue—Australia’s longest-running electronic music collective—the research contrasts conventional configurations with innovative mobile instruments and apps. By analysing a range of tools, from budget-friendly synthesisers to advanced smartphone and tablet apps, the paper explores how mobile technologies foster new creative possibilities. The lack of understanding about probation officers’ (POs’) training views, especially concerning female offenders, reduces training and reentry effectiveness for female criminals. This study investigated POs’ perspectives on their training to assist women with co-occurring offenses by developing a practical intervention framework to improve reentry outcomes. The labeling and dual-role relationship theories served as the theoretical foundation to answer the research question, which involved identifying the perspectives of POs on training to support women with co-occurring crimes. Purpose of Review: Advances in HIV testing, prevention, and treatment, alongside increased awareness and harm reduction efforts for substance use disorder (SUD) have improved care and treatment access over the past decade. However, racial and ethnic minorities with SUD and HIV or at risk for HIV still face disproportionately high health disparities. Understanding and addressing the reasons behind these disparities is crucial. Recent Findings: Structural and systemic barriers continue to negatively impact minoritized communities, due to lack of access to care, mistrust, and feelings of ostracization. In today's media landscape, where consumers are overloaded with information and have shorter attention spans, digital marketers face significant difficulty in grabbing and holding customers' attention. This research examines how visual attention affects the processing of advertising stimuli. It does this by using eye-tracking technology to determine where branding components should be placed in digital ads to maximize processing efficiency and perceptual salience. The research shows that placing branding features strategically in the top central part of the advertisement can greatly increase visual attention and subsequent recall by analyzing fixation patterns and saccadic behavior. Objective: To compare the effects of ketorolac and dexamethasone on postoperative pain in patients who underwent impacted mandibular third molars surgery. Material and Methods: A double-anonymized clinical trial study involving 60 patients with impacted third molars. The samples were randomly divided into two groups by block randomization method: DG: Dexamethasone (8 mg) and KG: Ketorolac (30 mg). The severity of pain was assessed using the visual analog scale and Wong-Baker Faces Pain Rating Scale immediately and during the first to seventh days after the surgery. CODE^SHIFT is a multidisciplinary “collaboratory” research space that focuses on data justice by humanizing data for storytelling, community impact, and social healing. Its goal is to address social inequalities (especially relating to race, gender, ethnicity, and indigeneity) using data, media, technology, art, and storytelling. Our activities include community-building, curriculum development, and collaborative research projects, especially focused on critical media literacies, arts-based interventions, and digital storytelling. The four main principles that guide our practice and theorizing are: collaboration, purposiveness or intentionality, actionorientation, and equity-mindedness. In this paper, we use Prometheus and his perpetual punishment to draw attention to the historic role Black people have played in U.S. education and contemplate the state of education for Black people 70 years after the Brown decision. We note the parallels between the period of reconstruction to the current period and use a case study of a school in Oakland, California to draw attention to a community-based response to the unfulfilled promise of the historic Brown decision. Our hope is that the case study can be used to undertake similar initiatives.

Technology and national security have been intimately related throughout American history. Over the past eighty-five years, the United States has increasingly made use of export controls to prevent adversarial countries from using the fruits of its technological advancement to strengthen their militaries and harm American interests. Today, strategic competition with the People’s Republic of China involves a myriad of technologies which present risks outside of, as well as within, the military context.
