All Decisions
In this rent-stabilized nonpayment proceeding, tenant moved for summary judgment seeking dismissal based on a prior action pending, lack of standing under LLC Law §206, and the absence of a valid lease. While the court rejected the first two arguments "finding no duplicative proceeding and holding that the foreign LLC's filing deficiencies were curable under LLC Law §802" the court granted dismissal due to the absence of privity of contract. The alleged renewal lease was unsigned by any landlord and still listed the prior owner. Without a fully executed lease, there was no binding rental agreement at the time of …

901 Walton Ave Realty Llc V. Laboy
All Decisions
Tenant moved to dismiss a nonpayment proceeding arguing that the rent demand overstated the legal rent due, rendering it defective. The landlord sought rent based on a concession rider, asserting the legal regulated rent was $1,472.41 and charging $1,522.41 for some months, despite a pattern of charging $1,300 through biannual credits. The court found that the concession functioned as a preferential rent under recent case law and DHCR guidance. Since preferential rents must remain for the duration of the tenancy under HSTPA, the higher amounts sought were improper. The rent demand was thus not a good faith approximation of what …

All Decisions
Handwritten opinion. In this holdover proceeding, tenant moved to dismiss for lack of standing due to landlord’s failure to comply with LLC Law § 206, which mandates publication of the LLC’s formation. The court held that the failure to publish, as required, is a noncurable defect and deprives the LLC of the ability to maintain a proceeding in New York courts. Relying on binding precedent, (Small Step Day Care, LLC v. Broadway Bushwick Bldrs., L.P., 137 A.D.3d 102 2nd Dept 2016) the court found this defect to be fatal to the landlord's case and granted the tenant’s motion to dismiss. …

Balancing Privacy And Security: A Comparative Analysis Of Ai-Driven Surveillance In The Uae And Usa, Belal Alghafri, Abdallah Tubaishat
All Works
AI-driven surveillance has emerged as a critical tool for enhancing public safety, enabling authorities to monitor and prevent crime and terrorism more effectively. In countries like the UAE and the USA, these systems are often implemented under the pretext of national security, offering advanced methods to track potential threats. However, the increasing reliance on AI for surveillance raises significant ethical concerns about privacy and individual freedoms. The boundary between protecting citizens and infringing on their privacy becomes increasingly blurred, potentially leading to abuses of power, diminished public trust, and a pervasive atmosphere of fear. This paper explores the complex relationship …

Neutrosophic Systems with Applications
Healthcare services must fulfill patients' desires for secure data sharing and high accessibility. Blockchain technology, through blockchain platforms (BPs), can overcome healthcare challenges. This study develops a decision-making methodology for selecting the best BP, by integrating blockchain with IoT and Metaverse, the proposed approach ensures data integrity, quality, privacy and security, secure data sharing, and interoperability. The decision-making methodology uses the multi-criteria decision-making (MCDM) methodology to handle conflicting criteria. Two MCDM methods are used in this study: CRiteria Importance Through Intercriteria Correlation (CRITIC) for weight computation, and Ranking of Alternatives with Weights of Criterion (RAWEC) for alternative ranking. To deal …
Accessibility Care Beyond The University Disability Office, Mae L. Zurita
Accessibility Care Beyond The University Disability Office, Mae L. Zurita
Masters Projects
When higher education institutions rely on a single office to provide primarily in-class accommodations for students with diagnosed disabilities, practitioners beyond this office receive little guidance on supporting the broader disabled community in daily practices. By critiquing the dominant models, theories, interventions, and solutions that create an ambiguous responsibility for how practitioners are to include and accommodate disabled people the project can outline alternative methods. A culture of ableism and rampant inaccessibility is innate to how North American higher education operates as an institutional practice. The Americans with Disabilities Act of 1990 is treated like a successful initiative that guarantees …

Narrow Band Random Vibration Reliability Of A Doped Near Eutectic Tin-Bismuth-Based Alloy With A Large Fine-Pitch Ball Grid Array Device, Gregory Derr-Haverlach
Theses
This thesis investigates the vibration reliability and microstructure of two low temperature lead-free solder alloys. The experimental design involved a 2x2 factorial setup, with solder paste type and time above liquidus (TAL) as the primary factors. The solder pastes tested were Indalloy 281 and Indalloy 303, with TALs of two minutes and three minutes. Indalloy 281 is a eutectic Sn42/Bi58 solder and Indalloy 303 is a doped near eutectic Sn-Bi solder. The objective of the study is to identify how reliability changes between solders and the time above liquidous and to also examine the microstructure and the significant factors that …

Impacts Of Climate Change On Cannibalism And Disease Transmission In The Fall Armyworm, Kale Rougeau
LSU Master's Theses
Climate change may alter host-pathogen dynamics in terrestrial ecosystems due to rising global temperatures and carbon dioxide levels. Here, we examined cannibalism and disease transmission using the fall armyworm (Spodoptera frugiperda), an invasive agricultural pest, and its species-specific lethal baculovirus, Spodoptera frugiperda multiple nucleopolyhedrovirus (SfMNPV), under various potential challenges of climate change. We used three temperature treatments (cooler, optimal, warmer) based on the fall armyworm’s thermal performance curve to simulate a changing climate and four artificial diets with various protein-to-carbohydrate ratios (low, equal, high, standard) to manipulate resource quality from altered carbon dioxide levels. We found that higher …

Actigraphy-Based Sleep Disruption And Diurnal Biomarkers Of Autonomic Function In Paroxysmal Atrial Fibrillation, Harneet Walia
All Publications
Introduction Sleep architectural disruption is associated with atrial fibrillation (AF); however, associated autonomic influences remain unclear and it is unknown if this detriment persists during wakefulness. We hypothesize sleep disruption and autonomic dysfunction have diurnal patterning in patients with paroxysmal AF. Methods We analyzed data from the Sleep Apnea and Atrial Fibrillation Biomarkers and Electrophysiologic Atrial Triggers (SAFEBEAT) study designed to examine paroxysmal AF and sleep apnea, including simultaneous collection of continuous electrocardiogram monitoring (Heartrak Telemetry®) and actigraphy (Actiwatch GTX) for 7–21 days. Heart rate variability (HRV) measures in time-domain (standard deviation of normal-to-normal (NN) intervals (SDNN), coefficient of variation …

Chronic pain and opioid use have become topics of importance as opioid overdose deaths have risen to epidemic proportions throughout the nation. Chronic pain lasts for long periods of time and can be caused by a past injury or have no known cause. Opioids have been utilized to treat pain in the past, but it has been discovered that opioids are better used to treat acute pain and not chronic pain. Opioids can have negative consequences including changes to the brain, depression, increased pain, constipation, sedation, and even death. This fact sheet reviews and explains some of the most successful …

Liposomes As Imaging Agents Of Inflammation And Oxidative Stress In Bone Implants, Delia Danila, Patricia S Pardo, R Devesh Kumar Misra, Aladin M Boriek
Faculty, Staff and Students Publications
Liposomes are tiny, spherical vesicles made from cholesterol and natural phospholipids that are promising imaging agents for detecting medical complications. They can carry fluorescent markers or other imaging agents, making them effective for medical imaging. Furthermore, liposomes can target specific cells involved in inflammation, such as macrophages, and accumulate at inflammation sites when injected. Additionally, liposomes can be designed to respond to oxidative stress, which is often associated with bone implant complications. By detecting areas of stress, liposomes provide valuable information about implant health. However, challenges such as rapid clearance from the body, precise targeting, immune reactions, and high production …

Floating And Submerged Plants Of Utah: Pocket Field Guide, Kate Sinnott, Karin M. Kettenring
All Current Publications
This is a field guide to identifying floating and submerged plants of Utah. We include a page for each species and also a dichotomous key at the end for the pondweeds. Submerged and floating plant species play critical roles in aquatic ecosystems. They provide habitat to aquatic organisms, improve water clarity by trapping sediment, and absorb excess nutrients from the water column, among other vital services. However, they have been threatened and degraded by pollution, land conversion, and introductions of harmful species. Identifying native and non-native plants is an important component of tackling this degradation and promoting the conservation and …
