Developing Sustainable Smart Cities To Improve Citizen's Quality Of Life And Well-Being, Mohammed Ali Berawi, Mustika Sari, Perdana Miraj
CSID Journal of Infrastructure Development
In the wake of urbanization and environmental challenges, cities nowadays face multiple issues related to uncontrolled urban growth, insufficient public infrastructure, and inadequate citizen participation in the management of public affairs. Sustainable urban development cannot be achieved without addressing these challenges, necessitating a paradigm shift in urban space management. Therefore, urban development needs to shift traditional concepts and focus on incorporating smart and environmentally friendly practices that allow cities to adapt and implement intelligent solutions to meet the needs of their citizens while continuing to protect the environment.
To achieve sustainability, cities should prioritize a balance between economic activity, population …

Understanding Wellness In Law Enforcement: A Crisis, Phil Baebenroth
Understanding Wellness In Law Enforcement: A Crisis, Phil Baebenroth
Doctorate in Education
This study investigates the perceptions of current licensed peace officers in Minnesota regarding reforming their profession. From 2017 to 2020, more police officers in the United States died by suicide than officers killed by gunfire, assaults, crashes, or accidents in the line of duty (Officer Down Memorial Page, 2023 & Blue H.E.L.P, 2023). These statistics present a wellness crisis in the policing profession that deserves immediate attention. There have been worldwide calls for changes in policing from people outside of law enforcement, but few incorporate the practical insights of police officers and even fewer are concerned with officer wellness aspects. …
State Sequestration: Federal Policy Accelerates Carbon Storage, But Leaves Full Climate, Equity Protections To States, Gabriel Pacyniak
State Sequestration: Federal Policy Accelerates Carbon Storage, But Leaves Full Climate, Equity Protections To States, Gabriel Pacyniak
San Diego Journal of Climate & Energy Law
The Intergovernmental Panel on Climate Change—the UN’s expert science panel—has found that limiting climate change to prevent catastrophic harms will require at least some use of carbon capture and sequestration (CCS) unless the world rapidly shifts away from fossil fuels and reduces energy demand. There is significant uncertainty, however, about the level of lifecycle GHG reductions achievable in practice from varying CCS applications; some applications could even lead to net increases in emissions. In addition, a number of these applications create or maintain other harms, especially those related to fossil fuel extraction and use. For these reasons, many environmental justice …
Can Local Governments Exercise Police Power To Combat Climate Change Impacts By Banning Natural Gas In New Buildings?, Yichao Gu
San Diego Journal of Climate & Energy Law
This Article analyzes whether the Berkeley Gas Ban Ordinance would survive federal or state preemption challenges and examines whether Berkeley properly exercised its police power in adopting the Gas Ban Ordinance. Section II of this article provides background on the air quality and climate change impact from natural gas combustion. Section III discusses Berkeley’s police power authority to adopt the Gas Ban Ordinance. Sections IV through VI present potential express and implied preemption challenges and analyze arguments on both sides. Section VII concludes that the Gas Ban Ordinance is likely to survive federal and state express preemption, but it may …

“So, I Am Back”: Adjudicated Youths’ School Reentry Experiences, Inita S. Knox
USF Tampa Graduate Theses and Dissertations
Adjudicated youth face a multitude of barriers when reentering school following incarceration. School administrators and educational personnel know very little about how these students perceive their reentry experiences and what the students identify as needed supports, resources, and barriers throughout the process. This qualitative study used in-depth, semi-structured interviews with photo-elicitation to explore and describe how formerly incarcerated youth perceive their high school reentry experiences. Participants were male adolescents ages 16 to 18 years old. who provided rich and in-depth descriptions of their reentry experiences. Recommendations for policy, practice and future research are provided.

In a nuisance holdover proceeding, the court voided a "no cure" provision in a probationary stipulation between a landlord and tenant, finding it against public policy. The court ordered a hearing to determine if the tenant, who alleged behavior breaches due to a mental health condition, is entitled to reasonable accommodation under the Fair Housing Act, emphasizing landlords' obligations to accommodate disabled tenants. This decision aligns with legal precedents protecting individuals with disabilities in housing disputes.

Taxing Social Impact Bonds, Orly Mazur
Taxing Social Impact Bonds, Orly Mazur
Florida Tax Review
An exciting new way to fund social services has recently emerged. This new financing mechanism, called a social impact bond (SIB), has the potential to help us tackle some of our nation’s most challenging social problems. Broadly speaking, a SIB is a type of “pay-for-success” contract where private investors provide the upfront capital to finance a social program, but only recoup their investment and realize returns if the program is successful. Like any new financing instrument, SIBs create numerous regulatory challenges that have not yet been addressed. One unresolved issue is the tax implications of a SIB investment. This Article …
Make White-Collar-Offenders Pay (Additional) Tax And Subject Them To Technological Incarceration Instead Of Being A Tax Burden On Society, Mirko Bagaric, Theo Alexander, Brienna Bagaric
Make White-Collar-Offenders Pay (Additional) Tax And Subject Them To Technological Incarceration Instead Of Being A Tax Burden On Society, Mirko Bagaric, Theo Alexander, Brienna Bagaric
San Diego International Law Journal
White-collar offenders do not scare people. There is no reason to be afraid of them. Yet, they are subjected to the most serious sanction in our legal system – prison. Every white-collar prisoner costs society over $30,000 annually. Rather than punishing white-collar offenders in a way that further depletes the public revenue, we should compel them to remedy the damage they have caused by paying additional tax. There are more intelligent, evidence-based approaches to dealing with white-collar offenders. The objectives for dealing with white-collar offenders should be to impose penalties that are proportionate to the seriousness of the crimes; ensure …
Star Trek, Star Wars, Or Battlestar Galactica—The Occurring Privatization Of Space Exploration, And The Need For “Global” Regulations, Marty Levers
San Diego International Law Journal
Privatized space travel is not innately bad because of its commercial nature. Commercialization leads to efficient innovation; and our scientific pursuits benefit from advancements in technology in every space-related industry. This is not to say that privatized space travel is not without disgust and dissenters. As a dissenter, Buzz Aldrin questioned Elon Musk’s Mars proposal by arguing, “Well, now, when your [rocket] lands on Mars with people, is there going to be anything down there for you to live in or do?” Buzz Aldrin is not alone in his questioning of the motives behind mega corporations’ space projects. Billionaire-funded space …

Workplace Traumatic Stress And Mental Health Sequelae Among Public Safety Telecommunications Officers In Florida, Kellie O'Dare, Tammie M. Johnson, Erin A. King, Joseph Herzog, Dana R. Dillard, Kimberley Powell, Arthur R. Kirby, Leah Atwell
Florida Public Health Review
Background: Public safety telecommunications officers (PSTCOs), aka emergency “dispatchers,” are exposed to workplace traumatic stress and can experience situations characterized by uncertainty, communication difficulties, and a lack of resources. Traumatic stress experienced by emergency dispatchers has led to mental health symptoms. Purpose: This paper aims to describe the results of a study examining the patterns of workplace traumatic stress and the relationship between workplace traumatic stress and mental health concerns among a sample of PSTCOs. Methods: PSTCOs (n=54) participated in a cross-sectional, anonymous survey including screeners for depression, anxiety, post-traumatic stress disorder (PTSD), suicidal thoughts, and harmful alcohol use. …

The Right To Vote Of Persons With Disabilities And The Difficult Relationship Between The Crpd And The European Court Of Human Rights, Francesco Seatzu, Paolo Vargiu
San Diego International Law Journal
This Article addresses the question of the right to vote of persons with disabilities in light of the recent case-law of the European Court of Human Rights. The approach of the Court is critiqued from a general perspective of non-discrimination as well as tested against Article 29 of the United Nations Convention on the Rights of Persons with Disabilities, which provides for the right to vote as a foundational element of the participation in political and public life of persons with disabilities. This Article maintains that the European Court of Human Rights’ approach, instead of creating the conditions for equality …
Big Haven And Tax Haven Secrecy, Arthur J. Cockfield
Big Haven And Tax Haven Secrecy, Arthur J. Cockfield
Florida Tax Review
While there is now significant literature in law, politics, economics, and other disciplines that examines tax havens, there is little information on what tax haven intermediaries—so-called offshore service providers—actually do to facilitate offshore evasion, international money laundering, and the financing of global terrorism. To provide insight into this secret world of tax havens, this Article relies on the Author’s study of big data derived from the financial data leak obtained by the International Consortium for investigative Journalists (ICIJ). A hypothetical involving Breaking Bad’s Walter White is used to explain how offshore service providers facilitate global financial crimes. A transaction cost …

Reclaiming Public Space: How Black Portlanders Transformed Irving Park, 1960s-1980s, Ana Bane
University Honors Theses
Although we often take their existence for granted, public parks are imperative for the vitality of a functioning democratic society. Parks are more than just sites for recreation–an important arena for community building in its own right; occupying public space is an inherently political act that takes on new dimensions in resistance movements. This project explores the role that public space played in the history of Black community organizing and resistance in Portland. Irving Park is a sixteen acre park in the heart of the Albina district, Portland’s historic African American neighborhood. Though the area is now heavily gentrified, from …

Seeing Race As We Are: Avoiding, Arguing, Aspiring, Michael A. Cowan
Seeing Race As We Are: Avoiding, Arguing, Aspiring, Michael A. Cowan
New England Journal of Public Policy
Racial conflict in the United States pushes people to positions of argument or avoidance, more or less intensely and for varying lengths of time, depending on external events like the murder of George Floyd. Neither stance produces the conversations required to seek common ground and compromise around racial issues. Argument alone deepens divisions and avoidance leaves them to metastasize in the social body. In an attempt to go beneath these two positions, this article first explains the role and form of interpretation in all conflict and dispute resolution and how it is shaped. Then it examines the concepts and strategies …
Recent Developments In Timber Design & Its Impact On Carbon Emissions, Raquel Jackson
Recent Developments In Timber Design & Its Impact On Carbon Emissions, Raquel Jackson
Spectra Undergraduate Research Journal
This paper explores recent developments in timber building designs and its potential towards reducing carbon emissions. Carbon dioxide emissions are a growing issue worldwide as urbanization and industrialization continues to increase. The rising concentration of carbon dioxide emissions pose significant concerns towards public welfare and environmental health. Despite current methods to reduce greenhouse gasses, carbon emissions remain difficult to reduce from steel and concrete industries. Increasing timber use in building design is a possible solution. Increasing more timber in building design can help reduce carbon emissions due to the carbon-absorbing properties of the construction material. Timber as a construction material …
Why The Buffett-Gates Pledge Requires Limitation Of The Estate Tax Charitable Deduction, Edward A. Zelinsky
Why The Buffett-Gates Pledge Requires Limitation Of The Estate Tax Charitable Deduction, Edward A. Zelinsky
Florida Tax Review
The Buffett-Gates Giving Pledge, under which wealthy individuals promise to leave a majority of their assets to charity, is an admirable effort to encourage philanthropy. However, the Pledge requires us to confront the paradox that the federal estate tax charitable deduction is unlimited while the federal income tax charitable deduction is capped. If a Giving Pledger leaves his wealth to charity, the federal fisc loses significant revenue since the Pledger thereby avoids federal estate taxation as charitable bequests are deductible without limit for federal estate tax purposes. Despite its laudable qualities, the Giving Pledge is a systematic (albeit inadvertent) threat …
The Internal Revenue Service And A Crisis Of Confidence: A New Regulatory Approach For A New Era, Donald B. Tobin
The Internal Revenue Service And A Crisis Of Confidence: A New Regulatory Approach For A New Era, Donald B. Tobin
Florida Tax Review
The Internal Revenue Service is not usually thought of as the agency charged with enforcing the nation’s campaign finance laws. It has found itself, however, at the center of a firestorm over both its involvement and its ineptitude in enforcing certain rules that regulate the campaign activities of tax-exempt organizations. For historical, legal, and practical reasons, the Internal Revenue Code regulates the political activity of tax-exempt groups, in some instances providing for disclosure of campaign donors and expenditures, and in other instances limiting the amount of political activity engaged in by tax-exempt organizations. As campaigns become more sophisticated and complicated, …
Blowing In The Wind: Cannabis Legalization, Insiders, And Methodological Insights From British Columbia, Jon Heidt, Johannes Wheeldon
Blowing In The Wind: Cannabis Legalization, Insiders, And Methodological Insights From British Columbia, Jon Heidt, Johannes Wheeldon
Qualitative Criminology (QC)
Legalizing cannabis in Canada has proven momentous in some ways and insufficient in others. This paper presents findings from a re-analysis of two studies on cannabis legalization conducted in British Columbia (B.C.) before and after legalization. Prioritizing public health over access appears to prolong stigmatization, complicate policing, and undermine efforts to disrupt illicit cannabis markets. We outline three contributions to the nascent post- prohibition cannabis research agenda. First, we demonstrate the potential for secondary data analysis (SDA) and model an approach to address recent concerns about this practice. Second, we show the value of insiders when assessing cannabis policy by …

“I’M Not Unemployed, I’M Unemployable”: Challenges Finding And Sustaining Work For People Requires To Register As Sex Offenders, Jennifer L. Wooldridge, Danielle J. S. Bailey
Qualitative Criminology (QC)
Many individuals convicted of a sexual offense (ICSOs) experience various collateral consequences due to registration requirements, including income loss, unemployment, harassment, social isolation, homelessness, and more. Finding employment post-conviction is a difficult endeavor for many reentering citizens with criminal records, but for ICSOs, the difficulty increases due to their label as sex offenders. When these individuals are unsuccessful in obtaining steady, living-wage employment, it can result in mental health impacts such as depression, hopelessness, and other reactions. This paper seeks to analyze participants’ emotional and mental health reactions to their direct experiences with employment struggles due to registration. What feelings …

Dying In Prison: End-Of-Life Care Services In A State Correctional Facility, Brook Cooley Webb, Mollee K. Steely Smith, Tusty Ten Bensel
Qualitative Criminology (QC)
The aging inmate population in American prisons has noticeably increased, contributing to a more significant number of offenders who will die in prison, thus forcing correctional facilities to aid in caring for prisoners at the end of life. Two common responses have emerged to deliver adequate healthcare to inmates, including hospice programs and End-of-Life (EOL) care services. This study aimed to explore the nature of EOL care in a state prison by interviewing correctional administrators, correctional officers, and relevant medical personnel (N=17). The current study provided insight into the inclusion criteria for inmates who utilized EOL care in the prison …
