A Critical Assessment Of The First Step Act’S Recidivism-Reduction Measures, Raquel Wilson Jan 2024

A Critical Assessment Of The First Step Act’S Recidivism-Reduction Measures, Raquel Wilson

Dickinson Law Review (2017-Present)

The First Step Act of 2018 (“FSA”) is the most impactful federal sentencing reform of the past 40 years. While the Act represents a partial resurgence of the rehabilitative model of imprisonment, which had fallen out of favor decades before, it also represents a missed opportunity to fully integrate evidence-based rehabilitation programs for those offenders who pose the greatest risks to public safety.

The public has a strong interest in reducing recidivism, particularly among violent offenders, most of whom will be released from federal prison eventually. The FSA incentivizes participation in evidence-based, recidivism-reducing programs offered by the Bureau of Prisons …

Estate To State: Pay-To-Stay Statutes And The Problematic Seizure Of Inherited Property, Brittany L. Deitch Jan 2024

Estate To State: Pay-To-Stay Statutes And The Problematic Seizure Of Inherited Property, Brittany L. Deitch

University of Colorado Law Review

Pay-to-stay statutes allow states to recover their incarceration-related expenditures from those who are currently or have formerly been incarcerated. Mass incarceration is expensive, and states have aimed to shift this financial burden from their taxpayers and government coffers to the individuals who experience incarceration. Although pay-to-stay laws take many forms, in general, they authorize the government to seek recompense for an individual’s incarceration costs from the currently or formerly incarcerated person’s assets and income. Many states permit the seizure of inherited property to satisfy this legal financial obligation. Pay-to-stay laws have survived constitutional challenges thus far, but some state legislatures …

Lexisnexis’S Contract With Ice As Unjust Enrichment, Lizzie Bird Jan 2024

Lexisnexis’S Contract With Ice As Unjust Enrichment, Lizzie Bird

University of Colorado Law Review

For $22.1 million, LexisNexis is currently helping Immigration and Customs Enforcement (ICE) surveil, detain, and deport noncitizens. Like other data brokers, LexisNexis’s role in the collection and sale of personal information has largely been ignored by regulators, judges, and the public. A recent lawsuit against LexisNexis in Illinois includes, among other claims, a claim of unjust enrichment. This often misunderstood and unpopular claim has a complex history which presents both a barrier to relief and an opportunity for advocates to push courts to clarify the doctrine. This Note examines the history of the theory of unjust enrichment, surveys its recent …

The Future Of State Police In Nigeria : A Focus On The Southeast, Ihekwoaba Onwudiwe Jan 2024

The Future Of State Police In Nigeria : A Focus On The Southeast, Ihekwoaba Onwudiwe

African Journal of Criminology and Justice Studies

Using the Routine Activity Theory (RAT), in combination with the Copenhagen School's Regional Security Complex Theory (RSCT), it is underscored that the prevailing security challenges in Nigeria, particularly in the southeastern states, demand an immediate overhaul of the Nigerian Police Force. It is crucial to establish a state police system that empowers each region to address security concerns in collaboration with neighboring regions. This article highlights the benefits of police devolution and stresses the vital role of community engagement in ensuring public safety. By integrating community policing into local police forces and drawing inspiration from successful policing practices in other …

Police Vigilantism, Nadia Banteka Jan 2024

Police Vigilantism, Nadia Banteka

Scholarly Publications

This Article uncovers a critical yet unexplored dimension of policing: the strategic oscillation of police officers between their roles as state actors and private individuals, and its significant implications for police accountability frameworks. As officers toggle between these two roles to their legal advantage, they exploit a deep, systemic flaw in the structural design of policing. Tracing the trajectory of policing from its vigilante origins to its institutionalized form today, this Article argues that contemporary policing merges state-sanctioned power with vestiges of vigilantism to blur the public-private divide. This duality enables a form of state-sanctioned vigilantism through which officers exploit …

"Flowers In The Concrete”: Anti-Violence Nonprofit Leadership And Primary Prevention In Minnesota, Kim Lohse Jan 2024

"Flowers In The Concrete”: Anti-Violence Nonprofit Leadership And Primary Prevention In Minnesota, Kim Lohse

All Graduate Theses, Dissertations, and Other Capstone Projects

The grassroots origins of the American anti-violence movement have evolved to rely on institutions that perpetuate cycles of violence including law enforcement, criminal justice, and government funding programs. These systems do not meet the needs of most survivors and, in many cases, increase the physical violence and emotional abuse they experience. While the anti-violence movement has had success in shifting perceptions of gender-based violence, systemic responses have proven inadequate to prevent cases of sexual assault and intimate partner violence. This thesis study will analyze various forms of anti-violence response in the state of Minnesota using qualitative interviews with anti-violence advocates …

Coasting North: The Problem With The Jones Act For The Offshore Wind Industry And A Remedy From Canada, Sarah Macleod Nagle Jan 2024

Coasting North: The Problem With The Jones Act For The Offshore Wind Industry And A Remedy From Canada, Sarah Macleod Nagle

William & Mary Environmental Law and Policy Review

This Note is organized into three parts to examine how the Jones Act hampers the U.S. wind energy industry’s construction of offshore wind farms by requiring that only U.S. vessels transport materials from U.S. ports to the wind farms. The Note proposes a license modeled on Canada’s Coasting Trade Act (“CTA”) to allow non-U.S.-flagged vessels to participate in wind turbine construction. Part I will address the development of cabotage law in the United States, the creation of the Jones Act, and its impact on offshore wind. Part II surveys Canada’s cabotage laws, which culminated in the passage of the CTA …

Mandated Sexual Violence Prevention In Higher Education: A Quantitative Analysis Of Student Response To Sexual Harassment And Violence Through A Framework Of Organizational Culture, Andrew L. Jones Jan 2024

Mandated Sexual Violence Prevention In Higher Education: A Quantitative Analysis Of Student Response To Sexual Harassment And Violence Through A Framework Of Organizational Culture, Andrew L. Jones

Theses and Dissertations

Sexual violence (SV) is a global public health crisis of pandemic proportions. Sexual harassment (SH) and violence are pervasive on college campuses, negatively impacting students, faculty, and staff. To address this, U.S. universities are required by federal law to implement EBP programs to foster awareness, knowledge, attitudes, and skills/behaviors (competencies) to prevent or mitigate sexual misconduct. Improving these competencies can increase students’ capacity to respond to SH and SV they experience or witness positively impacting retention, health, wellness, and graduation outcomes. Additionally, recent empirical evidence has linked organizational culture (i.e., values, shared beliefs, and artifacts) and competencies to effectively responding …

Flood Frequency Analyses Using Depth-Area Reduction Factors (Darfs) In Texas, Mohamad Ahmadzadeh Jan 2024

Flood Frequency Analyses Using Depth-Area Reduction Factors (Darfs) In Texas, Mohamad Ahmadzadeh

Civil Engineering Dissertations - Archive

The increasing frequency and severity of flood events globally necessitate more accurate and reliable hydrologic models to inform flood risk management and mitigation strategies. Traditional hydrologic models have often relied on the simplification of uniformly distributed rainfall across watersheds, a method that fails to account for the spatial variability inherent in real-world storm events. This dissertation addresses this critical gap by applying Depth-Area Reduction Factors (DARFs) in hydrologic modeling, specifically focusing on the Trinity and Neches River Basins in Texas. DARFs are used to adjust point rainfall data to reflect the reduction in rainfall intensity as storm areas increase, thereby …

Evaluation Of Air Emissions For Cured-In-Place Pipe Construction Method For Sewer Pipe Rehabilitation, Rasoul Adnan Abbas Jan 2024

Evaluation Of Air Emissions For Cured-In-Place Pipe Construction Method For Sewer Pipe Rehabilitation, Rasoul Adnan Abbas

Civil Engineering Dissertations - Archive

The aging underground pipelines in the United States, which include sewer and water supply systems, have exceeded their design lifespan and will have to be renewed or replaced to continue providing these vital services to communities. Two methods can be used to replace the pipes: open-cut and trenchless technologies. Trenchless methods offer several advantages in urban areas: a small work area, lower operational and maintenance costs, and fewer negative impacts on the surrounding communities. Among the trenchless options, the CIPP method has been chosen for this research since it minimizes surface disruption, making it particularly well-suited for densely populated areas …

Two-Dimensional Flood Modeling Of Huron Creek In Houghton, Michigan, Sara Khoshnevis Jan 2024

Two-Dimensional Flood Modeling Of Huron Creek In Houghton, Michigan, Sara Khoshnevis

Dissertations, Master's Theses and Master's Reports

Hydraulic models and inundation maps serve as essential tools for implementing proactive measures against potential infrastructure damage from flood events, thereby reducing economic losses and enhancing public safety. This research combines hydraulic modeling and geospatial technology in a case study of the Huron Creek Watershed in Houghton, Michigan. Specifically, a preliminary two-dimensional unsteady flow model was developed in the Hydrologic Engineering Center River Analysis System (HEC- RAS) based on estimated conditions of the 2018 Father's Day Flood. By utilizing high-resolution topographic data, and hydraulic infrastructure information, this study aims to simulate flood behavior throughout the urbanized portion of the watershed. …

Musical Reward In Young Children, Haley E. Kragness, Kendra Mehl, Amy M. Belfi Jan 2024

Musical Reward In Young Children, Haley E. Kragness, Kendra Mehl, Amy M. Belfi

Psychological Science Faculty Research & Creative Works

Musical pleasure stems from an interplay of social, emotional, and cognitive factors. In adults, there are large individual differences in musical reward, with some individuals (deemed "hyperhedonic" to music) reporting very high reward and others (deemed "anhedonic" to music) reporting very low reward. Musical anhedonia is, therefore, a selective lack of pleasure in response to music, defined by self-reported low musical reward in the absence of generalized anhedonia. While this phenomenon has been investigated in adults in recent years, little is known about musical anhedonia or musical reward more generally in children. To address this, we investigated parents' perceptions of …

Centering Community Voice And Knowledge Through Participatory Action Research, Jennifer Lucko Jan 2024

Centering Community Voice And Knowledge Through Participatory Action Research, Jennifer Lucko

Education | Faculty Scholarship

This paper analyzes a Participatory Action Research (PAR) Project focused on improving public safety and community lighting in one Latinx immigrant community in California as a case example to better understand the possibilities for university-community-government partnerships. The paper explores residents' motivations for their sustained participation in the project, the relationships and power dynamics that led to a $100,000 commitment from the city government to fund the recommendations of the PAR collective, and the social contexts that allowed community residents to position themselves as political actors as the PAR project progressed over the 2021-2022 academic year. This case example illustrates how …

Progressive Facade: How Bail Reforms Expose The Limitations Of The Progressive Prosecutor Movement, Sarah Gottlieb Jan 2024

Progressive Facade: How Bail Reforms Expose The Limitations Of The Progressive Prosecutor Movement, Sarah Gottlieb

Washington and Lee Law Review

Progressive prosecutors have been acclaimed as the new hope for change in the criminal legal system. Advocates and scholars touting progressive prosecution believe that progressive prosecutors will use their power and discretion to address systemic racism and end mass incarceration. Just as this hope has arisen, however, so have concerns that meaningful change cannot be enacted within the criminal system by the very actors whose job it is to incarcerate. This Article highlights these concerns by looking at the bail reforms enacted by four different progressive prosecutors and analyzes the initial promises made, the actions taken to reform and eliminate …

Punishing Gender, Erin Collins Jan 2024

Punishing Gender, Erin Collins

Law Faculty Publications

As jurisdictions across the country grapple with the urgent need to redress the impact of mass incarceration, there has been renewed interest in reforms that reduce the harms punishment inflicts on women. These "gender-responsive" reforms aim to adapt traditional punishment practices that, proponents claim, were designed "for men." The push to change how we punish based on gender, while perhaps well intentioned, is misguided. As abolition feminist principles reveal, these gender-responsive practices not only reify traditional gender norms, but also strengthen the operation of the carceral state. This Article catalogs the ways in that the gender-responsive approach currently influences various …

The Necessity Of Restorative Justice Within Prisons, Sarah J. Pietrowski Jan 2024

The Necessity Of Restorative Justice Within Prisons, Sarah J. Pietrowski

Law Student Publications

In the era of mass incarceration, it is vital to reexamine the prison system to identify not only its weaknesses, but its successes. Successes in correctional systems are often measured by a reduction in recidivism rates, and in states where restorative justice practices have been implemented in prisons, recidivism rates have exhibited a significant decrease, affirming the necessity of restorative justice practices in prisons. Additionally, restorative justice not only helps victims of crime feel that their voices are heard and that the one who harmed them will experience personal growth, but it is preferred by the majority of victims as …

American Star Chamber: Online Misinformation, Government Intervention, And The Intellectual Matrix Of The First Amendment, Emily E. Burton Jan 2024

American Star Chamber: Online Misinformation, Government Intervention, And The Intellectual Matrix Of The First Amendment, Emily E. Burton

Catholic University Journal of Law and Technology

Just as monarchs and clerical authorities struggled to respond to seditious and heretical writings enabled by the invention of the printing press, twenty-first century governments are experiencing a similar information revolution as a result of the digital age and a rising tide of what the United States has labeled online misinformation. Like the printing press, the Internet has enabled the spread of information at an exponentially lower cost and an exponentially higher speed as it extends the ability to publish thoughts and opinions to an increasingly diverse array of individuals. Although this was largely celebrated during the first two decades …

The Intellectual Structure And The Future Of Counter-Uncrewed Aerial Systems (Uas) Research: A Bibliometric And A Scoping Review, Chuyang Yang, Chenyu Huang, Yanhui Zhao Jan 2024

The Intellectual Structure And The Future Of Counter-Uncrewed Aerial Systems (Uas) Research: A Bibliometric And A Scoping Review, Chuyang Yang, Chenyu Huang, Yanhui Zhao

International Journal of Aviation, Aeronautics, and Aerospace

With advancements in remote sensing technology and affordable design, uncrewed aerial systems (UAS), commonly known as drones, have become prevalent in civil and military applications, such as agriculture, public safety, and aerial imaging. However, the rise in unlawful UAS activities, such as non-compliance with legal standards and potential terrorist attacks, has raised significant public concern, necessitating effective detection and mitigation solutions. Despite the growing importance of this issue, comprehensive and detailed examinations of existing counter-UAS solutions are lacking. To address this gap, this study conducts a bibliometric analysis and scoping review of the current literature to identify key topics and …
