Prohibition Constitutionalism, Matthew Lawrence Jan 2024

Prohibition Constitutionalism, Matthew Lawrence

Constitutional Commentary, Vol. 37 and later (2023–present)

This Review describes and applauds David Pozen’s book, The Constitution of the War on Drugs, and offers its own intervention. Scholars have traced the failed addiction policies exemplified by the “war on drugs” to underlying root causes including racism, politics, and moral stigma. The core contribution of The Constitution of the War on Drugs is to show that constitutional law is an additional such root cause. The book does so by unearthing ways the Constitution has accepted and abetted carceral addiction policy. In pointing to constitutional law as a root cause of the drug war and, so, as a …

Objective: To estimate the behavioral impacts of training police officers in implicit bias awareness and management. Hypotheses: Training police in implicit bias reduces racial and ethnic disparities in stops, arrests, summonses, frisks, searches, and/or use of force. Method: A cluster randomized controlled trial using the stepped wedge design was applied to 14,471 officers in the New York City Police Department, with a one-day training delivered to clusters of police commands between May 2018 and April 2019, and outcomes measured with police records of individual events from April 2018 through May 2019. Police records were supplemented with survey data on 1,973 …

Nebraska Department Of Correctional Services Classification And Crowding Project Technical Report, Zachary Hamilton, Alex Kigerl, Baylee Allen-Flores, Addison Kobie, John Ursino, Amber Krushas, Brian Gildea, Ryan E. Spohn

Reports

In response to recent reports and noted issues of prison crowding, NDCS (Nebraska Department of Correctional Services) contracted with NCJR (Nebraska Center for Justice Research) to investigate the impacts of crowding. Going beyond the CSG, CJI, and Master Plan reports (Council of State Governments, 2015; Criminal Justice Institute, 2022; Dewberry, 2023; JFA, 2020), NDCS requested NCJR identify which facilities and populations are impacted greatest via crowding. Further, findings provide areas of recommended changes needed to ease growth and help maintain safety and functionality of NDCS institutions. As part of Phase I, we completed a process evaluation, which included a review …

Justice Theater In The Criminal Law Curriculum, Gregory Brazeal Jan 2024

Justice Theater In The Criminal Law Curriculum, Gregory Brazeal

Faculty Publications

For the last half-century, law students have been required to take a criminal law course that ostensibly trains them to think critically about the justifications for criminal punishment. The same students have then gone on to serve as central actors in a system of mass incarceration that millions of Americans today view as profoundly unjust. How did this happen? A number of legal scholars, notably including Alice Ristroph in her 2020 Article "The Curriculum of the Carceral State," have argued that the traditional criminal law curriculum has played a role in creating and reproducing the practices of mass incarceration. This …

Exoneration Finance, Kay L. Levine, Russell M. Gold Jan 2024

Exoneration Finance, Kay L. Levine, Russell M. Gold

Faculty Articles

The path to financial compensation for the wrongfully convicted can be complex and time-consuming. Exonerees often struggle to make ends meet and function in free society, let alone navigate serpentine processes while waiting years for the recovery they deserve. Securing the assistance of an attorney is often a critical step, but too few lawyers are willing to risk accepting these complicated cases on a contingency-fee basis—the only way that exoneree-clients can likely pay their lawyers without outside help.

Litigation finance—an important tool for increasing access to justice in tort cases—could help close this access to justice gap for exonerees. In …

Anna Nicole's Constitutional Estates Law Legacy, David Fagundes Jan 2024

Anna Nicole's Constitutional Estates Law Legacy, David Fagundes

Faculty Articles

This Essay examines Anna Nicole's surprising constitutional estates legacy in three parts. First, it overviews the bitter litigation between Anna Nicole and the estate of J. Howard Marshall II. It then turns to the pair of Supreme Court cases spawned by that litigation. Part II discusses the holding and significance of Marshall v. Marshall, a successful challenge to the scope of the wills exception to federal jurisdiction. Part III discusses the holding and significance of Stern v. Marshall, which held that Article I bankruptcy judges cannot enter final judgments on state law counterclaims. In its Conclusion, the Essay …

Lead Exposure: Neurological Implications, Transmission In Utero, And Treatment, Chana Birnbaum Jan 2024

Lead Exposure: Neurological Implications, Transmission In Utero, And Treatment, Chana Birnbaum

The Science Journal of the Lander College of Arts and Sciences

Blood lead levels are routinely measured in pediatric clinics due to the well-documented detrimental effects of lead exposure on neurodevelopment and consequently cognition. Reading difficulties, impaired detailed movement, and depressed reaction time are three areas, among others, implicated in lead toxicity (Needleman, 1990). Furthermore, lead toxicity can be of particular concern in pregnant women, as placental transmission is viable (Gundacker & Hengstschläger, 2012, as cited in Sun et al., 2018). Future research investigating the transmission of lead from mother to fetus may provide insight into the timeline of in utero lead transmission and consequently the ability to direct anti-toxicity treatment …

Evacuation Plan Assessment Using Agent-Based Simulation: A Case Of Mix-Use Building, Peerada Tangprasert

Chulalongkorn University Theses and Dissertations (Chula ETD)

This research investigates the effectiveness of fire evacuation plan in complex urban structures by developing an agent-based simulation (ABS) model tailored to a high-rise, mixed-use case building located in Bangkok, Thailand. As urban populations grow and multi-functional buildings become more prevalent, ensuring efficient evacuation during fire emergencies has become increasingly critical. The selected case building features a combination of commercial, retail, and public transit access points, making it representative of modern urban infrastructure with high pedestrian traffic and structural complexity. The simulation model incorporates key factors influencing evacuation performance, including walking speed, age demographics, and crowd density. Empirical data such …

Physical And Psychosocial Factors Related To Firefighter Musculoskeletal Disorders, Jennifer Ellen Tinsley Kubala Jan 2024

Physical And Psychosocial Factors Related To Firefighter Musculoskeletal Disorders, Jennifer Ellen Tinsley Kubala

Theses and Dissertations--Rehabilitation Sciences

Career firefighters must perform physically and psychologically challenging duties in unpredictable and dangerous conditions. Previous investigations have found that firefighters suffer nearly 4 times the recorded musculoskeletal disorders (MSD) and workplace injuries compared to private and public sector workers, and take approximately 1.5 days longer to return to normal work. Thus, the burden of firefighter MSD experiences has been a growing area of exploration. The few investigations that have concurrently examined physical and psychosocial consequences experienced by firefighters have found a positive relationship between increased occupational stress reports and MSD experiences. However, these investigations, as well as those that individually …

Indefinite Detention Under Part Xx.1 Of The Criminal Code And Winko V. British Columbia, Jamie Cameron

Articles & Book Chapters

“Indefinite Detention Under Part XX.1 of the Criminal Code and Winko v. British Columbia” is chapter 27 in a textbook titled Canadian Anthology on Mental Health and the Law. It draws on the author’s ten years as a legal member and alternate chair on the Ontario Review Board, as well as on her participation in a research study on perceptions of fairness in ORB proceedings, to provide critical comment on the procedural fairness and constitutionality of forensic detention for mentally disordered criminal offenders (i.e. not criminally responsible (NCR); unfit to stand trial (UST); and dual status offenders …

The Intersection Of Asset Management And Geographic Information Systems For University Facilities Maintenance, Andrew Westerlund Beland Jan 2024

The Intersection Of Asset Management And Geographic Information Systems For University Facilities Maintenance, Andrew Westerlund Beland

Masters in GIS Practicum Reports

This project describes a proof of concept for developing a digital asset management system dashboard for water backflow assemblies at Portland State University (PSU) using a modified ESRI ArcGIS Online backflow solution. Asset management is crucial for optimizing the lifecycle of tangible assets, which ensures cost-effective operational efficiency and regulatory compliance. PSU manages over 250 backflow assemblies spread across the 50-acre campus and has traditionally relied on manual processes, which can lead to inefficiencies and potential transcription errors.

The system links spatial data with asset attributes for backflow devices, enabling field staff to update inspection results directly from mobile devices. …

Sanctuary Without Resistance, Ava Ayers Jan 2024

Sanctuary Without Resistance, Ava Ayers

Lewis & Clark Law Review

Activist movements that embrace the idea of sanctuary for noncitizens are rich with narratives of resistance. These narratives vary; some sanctuary advocates pursue resistance only to specific federal immigration policies, while others offer more radical critiques that challenge the very legitimacy of U.S. immigration law. But when local and state governments adopt sanctuary policies, the idea of resistance is often altogether lost.

Local and state governments who adopt policies of noncooperation with federal immigration enforcement sometimes offer narratives in which the values that motivate sanctuary policies involve not resistance to injustice, but public safety, economic development, and other more traditional …

Punishment After The Punishment: How Deportation Of Juvenile Offenders Violates The Eighth Amendment And International Law, Elisabeth Sethi Jan 2024

Punishment After The Punishment: How Deportation Of Juvenile Offenders Violates The Eighth Amendment And International Law, Elisabeth Sethi

Lewis & Clark Law Review

This Comment examines how the United States deviates from most of the Western world by allowing deportation of noncitizen juvenile offenders to be essentially mandatory for a wide number of crimes. Deportation is “mandatory” in the sense that it is often an automatic result with very few options for judges to consider relevant mitigating factors, such as how long the noncitizen has lived in the United States, ties to U.S. citizen family members, or behavior since committing the crime. Deportation of juvenile offenders is applied harshly to both authorized and unauthorized noncitizens, many of whom have lived in the United …

Applying The Public Trust Doctrine To Local Governments, Talia O. Thuet Jan 2024

Applying The Public Trust Doctrine To Local Governments, Talia O. Thuet

Lewis & Clark Law Review

Under the public trust doctrine, the government holds public lands in trust for the public and cannot unreasonably restrict citizens from accessing them or otherwise breach its duties as a trustee. The public trust doctrine is often thought of as a state law doctrine. However, local governments own a significant portion of public land. Some local governments argue that the public trust doctrine does not apply to them because the state is the proper trustee under the public trust doctrine. This Comment argues that the public trust doctrine applies to local governments. State law preempts local government law on matters …

Restricting The Use Of Rap Lyrics As Evidence In Courts: A Targeted Approach To Tackling Discrimination In Criminal Procedure, Paige M. Walker

Lewis & Clark Law Review

This Article is a review of Rap on Trial: Race, Lyrics, and Guilt in America. The book largely focuses on the dangers of allowing rap lyrics to be presented as evidence in criminal trials. The authors posit that the fictitious and hyperbolic nature of rap lyrics are misrepresented by prosecutors as autobiographical confessions that document illegal activity and violent character traits of defendants. The authors compare rap to other musical genres and conclude that racism is the underlying cause for why the genres are treated differently in court. The authors also advocate for evidence nullification and argue for a complete …

Voices Of The Denied, Heather Spencer Jan 2024

Voices Of The Denied, Heather Spencer

Lewis & Clark Law Review

This Note explores the impact of lengthy prison sentences on rehabilitation and the need for second chances. While incarceration serves purposes such as retribution and incapacitation, it fails to promote rehabilitation and deterrence. Oregon should do more in providing opportunities for early release and rehabilitation for individuals serving lengthy sentences. The Note features interviews with incarcerated individuals who share their thoughts and experiences. Overall, this Note sheds light on the importance of second chances and on the need for reform in the criminal justice system to ensure that prisoners are not denied the chance to lead productive and fulfilling lives.

The Right To A Glass Box: Rethinking The Use Of Artificial Intelligence In Criminal Justice, Brandon L. Garrett, Cynthia Rudin Jan 2024

The Right To A Glass Box: Rethinking The Use Of Artificial Intelligence In Criminal Justice, Brandon L. Garrett, Cynthia Rudin

Faculty Scholarship

Artificial intelligence (“AI”) increasingly is used to make important decisions that affect individuals and society. As governments and corporations use AI more pervasively, one of the most troubling trends is that developers so often design it to be a “black box.” Designers create AI models too complex for people to understand or they conceal how AI functions. Policymakers and the public increasingly sound alarms about black box AI. A particularly pressing area of concern has been criminal cases, in which a person’s life, liberty, and public safety can be at stake. In the United States and globally, despite concerns that …
