The research report presents an extensive analysis of hurricane evacuation strategies, highlighting the critical role of transportation networks in emergency situations. It examines how variables such as hurricane severity and the geographic positioning of residential areas impact evacuation patterns, using real-time GPS data and the Rayleigh distribution to accurately model evacuation timing. The study is focused on assessing the transportation network's capacity to handle the surge in evacuation traffic, identifying the most critical links within the network that are vital for effective evacuation. Additionally, the report offers an in-depth look at the socio-economic implications of these evacuation strategies, particularly underscoring …

During his 2018 campaign to become Dallas County District Attorney, John Creuzot promised to decline prosecution of low-level marijuana misdemeanors. After his election, District Attorney Creuzot (DA Creuzot) honored this campaign promise, issuing policies designed to radically reduce misdemeanor marijuana prosecutions. Analyzing qualitative and quantitative data, the authors describe police enforcement changes associated with the Dallas County District Attorney's Office's (DAO) marijuana prosecution policies. The authors also explore how the
DAO's Intake Unit successfully implemented and enforced these marijuana prosecution policies.
The authors show that DA Creuzot's policies were associated with a significant decrease in marijuana misdemeanor arrests and an …
Motivation, Learning, And The Workplace: A Study Of Community College Student Affairs Professionals And Continued Professional Learning, Joseph M. Ginese
Motivation, Learning, And The Workplace: A Study Of Community College Student Affairs Professionals And Continued Professional Learning, Joseph M. Ginese
Theses and Dissertations
Continued professional learning is a consistent focus of attention for the field of student affairs within higher education. Yet, very little research has been conducted on the factors that influence the motivation of student affairs professionals to pursue continued professional learning, especially professionals within community colleges. This study utilized a quantitative research design to examine the physical and psychological factors of the work environment that can influence a community college student affairs professional’s motivation to pursue continued professional learning. Through the theoretical lens of Lewin’s Field Theory and Eccles’ Expectancy-Value Theory, I designed a 58-item survey (N = 41) …
The Return Of Boy Scouts Of America V. Dale, Elizabeth Sepper
The Return Of Boy Scouts Of America V. Dale, Elizabeth Sepper
Saint Louis University Law Journal
In 2000, the Supreme Court’s decision in Boy Scouts of America v. Dale seemed to upend the law of freedom of association. Fears surfaced that the right of expressive association would be “an easy trump of any antidiscrimination law”—and perhaps other regulations of conduct. Organizations from schools to employers, social service providers to unions, could mount constitutional claims against the inclusion of individuals unwanted because of their sex, sexuality, race, disability, or beyond.
Instead, lower courts read Dale narrowly. Expressive associational rights would, it seemed, be bound by the facts of the case. Freedom of association would not override equality …

The Failure Of "Quick Look" Analyses Of Antitrust Claims, Jonathan Berman
The Failure Of "Quick Look" Analyses Of Antitrust Claims, Jonathan Berman
American University Business Law Review
Before courts can determine whether a defendant may have violated antitrust laws, they must first select the appropriate mode of analysis: the fact-intensive rule of reason, summary condemnation under the per se rules, or a quick look analysis. “Quick look” is intended to shorten and simplify inquiries into conduct that does not fall under the per se rules but that nonetheless has obvious anticompetitive effects.
The quick look doctrine, however, has failed to streamline antitrust litigation, and the related caselaw has failed to develop concrete or usable rules. Despite decades of litigation, the quick look doctrine remains of dubious legal …

Designing Sanctuary, Rick Su
Designing Sanctuary, Rick Su
Faculty Publications
In recent decades, a growing number of cities in the United States have adopted “sanctuary policies” that limit local participation in federal immigration enforcement. Existing scholarship has focused on their legality and effect, especially with respect to our nation’s immigration laws. Largely overlooked, however, is the local process through which sanctuary policies are designed and the reasons why cities choose to adopt them through city ordinances, mayoral orders, or employee handbooks. This Article argues that municipal sanctuary policies are far from uniform, and their variation reflects the different local interests and institutional actors behind their adoption and implementation. More specifically, …

Can Criminal Defense Attorneys Be Victim-Centered?, Natalie Nanasi, Demetrice Lopez-Loftis
Can Criminal Defense Attorneys Be Victim-Centered?, Natalie Nanasi, Demetrice Lopez-Loftis
SMU Law Review
Attorneys defending those accused of intimate partner violence, like all lawyers, owe duties of zealous advocacy and confidentiality to their clients. But is there a place within these ethical obligations for them to also consider the safety of the victim? Defense counsel are often uniquely situated—by virtue of their relationships with their clients and victims—to help mitigate potentially serious harm. This article explores the spaces where defending an accused perpetrator of domestic violence and taking actions to limit further harm to a survivor are compatible. It also identifies areas where defense attorneys can obtain additional resources and data to inform …

The goal of developing this program is to enhance mental health in the public safety sector, explicitly addressing the unique challenges firefighters face. In this program, I discuss the prevalence of mental health issues among these professionals, acknowledging the potential impact on their well-being and job performance. Through an extensive literature review, I will develop a mental health education program that will effectively mitigate stressors associated with the firefighter profession and build long-term resilience.
The program highlights the significance of mental health education in fostering resilience, reducing stigma, and promoting early intervention. Moreover, the program helps identify key stressors, such …
The Future Of Livestock Genetic Engineering In The United States: Going Against The Grain Or With The Herd?, Sam Harvey
The Future Of Livestock Genetic Engineering In The United States: Going Against The Grain Or With The Herd?, Sam Harvey
St. Thomas Law Review
For several years, the United States Department of Agriculture (USDA) and the Food and Drug Administration (FDA) have carried tension over which agency should regulate genetically modified livestock. Recently, this tension has boiled over with the release of many articles and statements from each organization as they battle over regulatory authority, most notably the USDA's claim that they are ready to take the bull by the horns and control the regulation of genetically engineered livestock. This note examines history and present-day practices to predict which agency will succeed in this battle of regulations, the USDA or the FDA.
Time For Reform, Not Abolition: Balancing Justice And Morality Through Amendment Of The Federal Death Penalty, Madison Steinkamp
Time For Reform, Not Abolition: Balancing Justice And Morality Through Amendment Of The Federal Death Penalty, Madison Steinkamp
St. Thomas Law Review
In 1987, President Ronald Reagan addressed Congress, saying it was "scandalous and intolerable" that federal law did not provide for an enforceable death penalty.' Ten years prior, following a brief moratorium on its application, the death penalty had been ruled constitutional. While thirty-five states had already reinstated the death penalty at the state level and constitutionally executed ninety-three prisoners since 1976, Congress had not yet enacted the rational, objective standards necessary for applying the death penalty constitutionally. In the year following his speech to Congress, President Reagan successfully signed the federal death penalty into law through the Anti-Drug Abuse Act …

The Eu-China Cai And The Uyghur Challenge In The Context Of China's Domestic Law Barriers To International Labor And Human Rights Standards, Ronald C. Brown
American University Business Law Review
While China engages in world commerce as a global player and is signatory to international labor and human rights standards, at the same time it uses treaty reservations and its own domestic laws to limit and undermine the full application of those standards. Concern from Western governments and global human rights groups regarding China’s longstanding treatment of the Uyghur people has resulted in a freeze in negotiations for the EU-China Comprehensive Investment Agreement (CAI). This was also a result of China’s failure to ratify or implement relevant United Nations (U.N.) covenants and International Labour Organization (ILO) conventions and placing reservations …
Understanding Dictators' Violent Repression And How It's Remembered, Juliet Welk
Understanding Dictators' Violent Repression And How It's Remembered, Juliet Welk
Scripps Senior Theses
This thesis examines the use of violent repression by dictators and the ways in which that violence is remembered, particularly through the lenses of literature and film. The first chapter will deal with the questions of when dictators choose to use violence as opposed to other forms of repression and against whom the violence is used. To do so, it will employ select cases to test a number of possible answers. The second chapter, written in Spanish, will analyze the memory of Francisco Franco’s dictatorship in Spain, focusing on the empowerment of previously-silenced voices. The third chapter, written in Italian, …

Hemispheric Justice: Awakening To 303 Creative’S Troubles – A Glocalized Latcrit Analysis, Berta E. Hernández-Truyol

In this essay, I will first describe and critique 303 Creative, a 2023 Supreme Court decision that subordinates LGBTQIA+ equality and nondiscrimination rights to an imagined intrusion into the free speech rights of a Christian business owner. Based upon her religious beliefs, the business owner claimed that Colorado’s public accommodations law, which prohibited discrimination based upon sexual orientation or gender identity (among other categories), violated her rights because it mandated that she serve the LGBTQIA+ community. Next, this essay shares insights from the recent Awakened decisions of Inter-American Human Rights institutions to demonstrate a path towards achieving justice for …

"I Call Them Supermoms": Therapists' Reflections On The Impact Of Youth Sexual Offending On Latina Mothers, Mauricio P. Yabar
Theses and Dissertations
Families of youth who have sexually offended often suffer significant collateral consequences following the discovery of the sexual offense. Samples in research with these families disproportionately consist of mothers and other female parental figures. This is rarely acknowledged in the literature, and the experiences of these mothers have not been explicitly examined. In addition, research on the experiences of these families has largely ignored factors related to race and ethnicity. This is a significant oversight considering the prevalence of systemic racism and discrimination in the United States, particularly in the systems with which these families must interact (e.g., juvenile justice …

Perceptions And Prejudices: The Impact Of Societal Views On Minority Populations And Their Relations With Law Enforcement, Charlize K. Mejia-Velilla
Honors Undergraduate Theses
This thesis explores the perspectives of University of Central Florida (UCF) students on the complex interactions between minority communities and law enforcement. Through a carefully designed survey, this study captures a range of student opinions on the social dynamics shaping these encounters, with a particular focus on the underlying factors that influence these perspectives. By examining elements such as media exposure, personal encounters, and societal narratives, this research delves into how students form their views on policing and minority relations. This study also investigates potential biases, whether implicit or explicit, that may arise from these factors and contribute to shaping …

A Case Study To Determine The Literacy Needs Within Remediation Practices For Students In Grades 1-3, Miranda M. Gillis
A Case Study To Determine The Literacy Needs Within Remediation Practices For Students In Grades 1-3, Miranda M. Gillis
Doctor of Education Dissertations
In order to effectively teach reading, it is not enough for a teacher to possess knowledge and skills alone. It is equally important to use evidence-based instructional approaches and interventions, especially when working with at-risk or struggling students. Without appropriate instructional materials and contexts, even the most competent teacher may fail to teach essential literacy skills, such as phonemic awareness, phonics, vocabulary, spelling, and writing processes. As the importance of teacher quality gains attention at the state and federal levels, lesson structure and allocation of lesson time for literacy-related activities have become a focus. The emergence of structured literacy underscores …
