These units handle severe, life-threatening medical cases (Marshal et al., 2017). Patients in these intensive care units experience a wide variety of changes which can contribute to their mental health. According to the World Health Organization (WHO), mental health is “a state of well-being in which the individual realizes his or her own abilities, can cope with the normal stresses of life, …

Positive Liberty, Negative Liberty, And Marketing Regulations: A Holistic Analysis, Tony Yan, Michael R. Hyman Mar 2024

Positive Liberty, Negative Liberty, And Marketing Regulations: A Holistic Analysis, Tony Yan, Michael R. Hyman

Global Business Leadership Faculty Publications

Marketing regulations are warranted when unfettered marketing practices compromise many people's positive and negative liberties. We elucidate these liberties’ multifaceted but interdependent connotations for societally justified marketing regulations from a novel framework integrating the social sciences, philosophy, history, and marketing. The limitations of unbalanced or less represented market or government regulation notwithstanding, overcoming marketing imbalances and enhancing personal and societal liberties via pluralistic, well-designed, enforceable, and multilateral regulations can advance a pluralistic democracy's diverse market-related interests. By informing companies and consumers about societally responsible liberties, well-regulated marketing can spur common goods creation.

Impact Of Race And Culture Assessments (Ircas) In Combatting Anti-Black Racism And Reducing Recidivism, Ardavan Eizadirad, Greg Leslie

Education Faculty Publications

The Gladue report, named after R. v. Gladue, is a landmark Supreme Court of Canada case which emphasizes the need to consider unique circumstances faced by Indigenous individuals when determining appropriate sentences. Given the overrepresentation of Black identities at all levels in the justice system, it is argued that the use of pre-sentencing reports referred to as Impact of Race and Culture Assessments (IRCAs), also needs to be comprehensively implemented for Black offenders in Canada. IRCAs are pre-sentencing reports that help sentencing judges better understand the effect of poverty, marginalization, racism, and social exclusion on the offender and their life …

Data-Driven Approaches For Enhancing Power Grid Reliability, Behrouz Sohrabi

Electronic Theses and Dissertations

This thesis explores the transformative potential of data-driven approaches in addressing key operational and reliability issues in power systems. The first part of this thesis addresses a prevalent problem in power distribution networks: the accurate identification of load phases. This study develops a data-driven model leveraging consumption measurements from smart meters and corresponding substation data to reconstruct topology information in low-voltage distribution networks. The proposed model is extensively tested using a dataset with more than 5,000 real load profiles, demonstrating satisfactory performance for large-scale networks. The second part of the thesis pivots to a crucial safety concern: the risk and …

Armed And Under The Influence: The Second Amendment And The Intoxicant Rule After Bruen, F. Lee Francis

Marquette Law Review

In 2001, the Michigan Legislature passed a law prohibiting the possession or use of a firearm by a person under the influence of alcoholic liquor or a controlled substance. Presumably the legislature thought it necessary to prevent individuals from possessing a firearm while under the influence of drugs or alcohol. One study has indicated that alcohol misuse is keenly associated with firearm ownership, risk behaviors involving firearms as well as risk for perpetrating harm to one’s self or others. Researchers also found that an estimated 8.9 to 11.7 million firearm owners binge drink in an average month. In an attempt …

Willfully Forgetting Miranda's True Nature: Vega V. Tekoh Severs The Warnings Requirement From The Constitution, George M. Dery Iii

Marquette Law Review

This Article analyzes Vega v. Tekoh, in which the Supreme Court ruled that

a violation of Miranda was not a violation of the Fifth Amendment privilege

against self-incrimination. This Article examines the original language of the

Miranda opinion, the statements and intentions of the members of the Miranda

Court, and subsequent precedent to determine Miranda’s true nature. Further,

this Article examines the reasoning of Vega and the dangers created by its

pronouncements, especially in light of the Court’s earlier characterization of

Miranda as a constitutional rule in Dickerson v. United States. This Article

asserts that the Justices who …

The Restatement Of Law On Juveniles’ Adjudicative Competence And Rights In Interrogation: Evidence Of Progress, Thomas Grisso

University of Chicago Law Review

Part 3 of the Restatement of Children and the Law, 1 “Children in the Justice System,” reflects recent dramatic reform in juvenile law and practice.2 The reform recognizes that kids are different, requiring special attention to protecting due process when the justice system must make decisions in delinquency cases.3 The Restatement’s analyses use neuroscientific and psychosocial developmental research that has improved our under- standing of children’s and adolescents’ immature decision-making capacities and psychosocial vulnerability compared to adults.4 This developmental perspective has led to extensive reform of laws and practices that seek to better protect juveniles’ due process …

The Kids Are Not Alright: Negative Consequences Of Student Device And Account Surveillance, Ashley Peterson

It reaches students’ most intimate data and spaces, including things students likely believe are private: internet searches, emails, and messages. This Comment focuses on the problems associated with off-campus surveillance of school accounts and school-issued devices, including chilling effects that fundamentally alter student behavior, reinforcement of the school-to-prison pipeline, …

Engaging The Base: Using Veterans Treatment Courts In Missouri To Address Core Issues, Evan Rodriguez

UMKC Law Review

With a per capita veteran population surpassing the national average, Missouri presents its veterans with unique challenges in their day-to-day lives. For example, nearly one-third of Missouri veterans are disabled, compared to one-sixth of civilians. The State established the Missouri Veterans Commission, which supports veterans and their families with the veteran-specific obstacles they face. To that end, Missouri offers the second highest number of veteran benefits of any state in the country.

Like all groups of people, some veterans will unfortunately enter the criminal justice system due to varying factors. Veterans Treatment Courts ("VTCs") originated to address veteran-specific reasons for …

Reducing Harm: The Legal Viability Of Supervised Consumption Sites In Georgia, Kathleen Kassa Mar 2024

Reducing Harm: The Legal Viability Of Supervised Consumption Sites In Georgia, Kathleen Kassa

Georgia State University Law Review

Every five minutes in the United States, someone dies from a drug overdose. This public health crisis, referred to as the opioid epidemic, caused the federal government and many states and localities to issue public health emergency declarations. Despite billions of dollars in funding and response at every level of government, overdoses continue to increase.

The complexity of addiction prevention and treatment, socioeconomic inequalities, and the stigmatization of drug use make the opioid crisis difficult to solve. The severity of the epidemic led many jurisdictions to adopt once-controversial harm reduction approaches aimed at reducing the stigma and negative impacts of …

Misrepresentations In Labor Trafficking: State Laws As An Alternative Theory Of Liability For Recruiters, Hannah Garvin Mar 2024

Misrepresentations In Labor Trafficking: State Laws As An Alternative Theory Of Liability For Recruiters, Hannah Garvin

Georgia State University Law Review

When addressing labor trafficking of migrants, the focus is typically on prosecuting the traffickers directly involved in obtaining a victim’s labor, but traffickers cannot exploit labor without victims. Research has shown that recruiters, both those intending to provide labor traffickers with victims and those who have no knowledge of the subsequent exploitation perpetrated by the supposed employer, often misrepresent job opportunities to migrants. Both types of recruiters profit off of the exploitation of migrants and ultimately continue to propagate labor trafficking. To effectively deter trafficker-recruiters and ensure independent recruiters are acting ethically, an all-encompassing method of accountability needs to be …

Hofstra Law Review

The article focuses on the inadequacies of the Miranda rights protections for minors during custodial interrogations. It highlights how current practices, such as deceptive interrogation techniques, disproportionately affect minors who often lack the capacity to fully understand or voluntarily waive their rights. It underscores the need for legal reforms, such as mandating attorney consultation for minors before waiving their rights.
