Survival Of The Social Interest: Redefining The Bruen Standard To Protect Women From Violence Through United States V. Rahimi, Katelyn M. Sundstrom Jan 2025

Survival Of The Social Interest: Redefining The Bruen Standard To Protect Women From Violence Through United States V. Rahimi, Katelyn M. Sundstrom

Lewis & Clark Law Review

This Note explores the intersection of gun rights and gender-based violence within the U.S. legal system. It delves into the pervasive issue of domestic violence and explores the 2022 Supreme Court decision in New York State Rifle & Pistol Association v. Bruen, which rejected the use of “interest balancing” in evaluating gun regulations in favor of a purely historical and traditional approach. This shift placed significant legal scrutiny on existing firearm restrictions, including 18 U.S.C. § 922(g)(8), which prohibits individuals subject to domestic violence restraining orders from possessing firearms.

The analysis centers on the 2023 case United States v. Rahimi, …

Perfecting Our Submission? Mann And Trump, Ruffin And Roberts, Joseph Scott Miller Jan 2025

Perfecting Our Submission? Mann And Trump, Ruffin And Roberts, Joseph Scott Miller

Lewis & Clark Law Review

Presidential power is vast, both under law and in practice. Who holds presidents accountable, and by what means? Courts wrestle with these intertwined questions of power and accountability. The majority opinion in the 2024 presidential immunity case, Trump v. United States, is eerily resonant, rhetorically, with a notorious judgment enhancing one person’s power over others by shielding that power utterly from criminal-law accountability. That judgment, from 1829, is Judge Thomas Ruffin’s infamous slavery-law opinion for the North Carolina Supreme Court in State v. Mann. I juxtapose the two opinions, which share jarringly similar claims about the nature of power, rule, …

Carceral Bonds, Tyler E. Dougherty Jan 2025

Carceral Bonds, Tyler E. Dougherty

Lewis & Clark Law Review

Over the past 50 years, the U.S. financed a massive physical and fiscal expansion of prisons via the municipal bond market—with devastating results. This project is the first to shine a light on the role of municipal debt in state-level carceral decision making, spotlighting the ways that the municipal bond market affects states’ capacities to incarcerate.

This Article argues that the two primary controls of states’ use of the carceral bond market—(1) market discipline and (2) states’ fiscal constitutions—are particularly ineffective at limiting states’ spending on prisons. This failure to restrain states’ spending through the carceral bond market enables private …

Deep Learning For Uav Classification: Impact Of Noise And Multipath Fading In Rf Signals, Prajoy Podder, Maciej Jan Zawodniok, Sanjay Kumar Madria Jan 2025

Deep Learning For Uav Classification: Impact Of Noise And Multipath Fading In Rf Signals, Prajoy Podder, Maciej Jan Zawodniok, Sanjay Kumar Madria

Electrical and Computer Engineering Faculty Research & Creative Works

The increasing presence of unmanned aerial vehicles (UAVs) raises serious security concerns, particularly regarding unauthorized drone operations. Recent U.S. security statistics report a sharp rise in unauthorized UAV activities, with the Federal Aviation Administration (FAA) receiving over 100 monthly reports of illegal drone operations near airports. In 2024 alone, Dedrone records 1.19 million unauthorized drone flights across major U.S. cities, highlighting the need for robust UAV detection and classification systems. In this work, a lightweight Convolutional Neural Network (CNN) model is proposed for RF-based UAV classification under noisy and multipath fading conditions. The proposed CNN consists of multiple convolutional blocks, …

Sealed Justice: Federal Courts' Inconsistent Record-Sealing Rules And Their Impact On Judicial Transparency, David S. Ardia Jan 2025

Sealed Justice: Federal Courts' Inconsistent Record-Sealing Rules And Their Impact On Judicial Transparency, David S. Ardia

Faculty Publications

Public access to court records is a cornerstone of democratic governance, enabling public oversight of the judiciary and fostering confidence in the rule of law. Despite a strong presumption in favor of openness under both the First Amendment and common law, the sealing of federal court records has become widespread, often with minimal judicial scrutiny. Re-cent investigations have revealed that excessive court secrecy shields government and corporate misconduct, conceals vital public-safety information, and erodes public confidence in the courts.

This Article presents the first comprehensive analysis of the local rules governing sealing in all 94 federal districts, reviewing more than …

The Interplay Between Injury And Body Composition With Performance In Police Recruits, Vanessa Sutton Jan 2025

The Interplay Between Injury And Body Composition With Performance In Police Recruits, Vanessa Sutton

Theses: Doctorates and Masters

The occupational demands of policing are challenging and potentially hazardous, with substantial rates of musculoskeletal injuries occurring during recruit training. Academy injury prevalence can be as high as one in five recruits. Injuries impact performance, result in lost training, and impose financial burdens on police agencies. However, limited research has explored pre-injury body composition or musculoskeletal characteristics in relation to police recruit performance. This thesis investigates injuries, body composition and musculoskeletal characteristics in physical performance and injury risk among law enforcement recruits.

Study One quantified prevalence and severity of pre-academy injuries and association with performance. Among 121 recruits, nearly half …

Criminalization Of Immigration, Emily Ryo, Jennifer M. Chacón, Cecilia Menjívar Jan 2025

Criminalization Of Immigration, Emily Ryo, Jennifer M. Chacón, Cecilia Menjívar

Faculty Scholarship

This article presents a critical analysis of social scientific research from the past fifteen years on the criminalization of immigration in the United States. Our review reveals three central themes. First, although immigration law is considered federal civil law, immigration enforcement has become substantially intertwined with criminal law enforcement in ways that have broad-ranging and radiating effects on immigrant communities of color. Second, race plays an important bidirectional role in the increasing criminalization of immigration. Specifically, criminalizing immigration results in the racialization of certain immigrant groups as dangerous outsiders, and such racialization has the effect of sustaining and promoting the …

Technologies Of Violence: Law, Markets, And Innovation For Gun Safety, Joseph Blocher, Christopher Buccafusco Jan 2025

Technologies Of Violence: Law, Markets, And Innovation For Gun Safety, Joseph Blocher, Christopher Buccafusco

Faculty Scholarship

Violence in the United States is distinctive in many ways, perhaps none more visceral and fundamental than the technologies with which it is practiced. American violence disproportionately involves guns, and because guns are such an effective tool of violence, confrontations involving them are disproportionately deadly. Decades of research confirm this "instrumentality effect, " and it is reflected in the broad, bipartisan agreement that the nation has a gun violence problem. The deep disagreement, of course, remains about how to address it, with most of the debate focused on regulating who can carry which guns, where, and how.

But fully understanding, …

“Murder The Media”: Press Freedom, Violence, And The Public Sphere, Joseph Blocher

Faculty Scholarship

The first goal of this chapter is to argue that the press as an institution is entitled to special solicitude under the First Amendment, not only because it is textually specified in the Constitution or because it serves important roles such as checking public and private power, but because it can contribute to the marketplace of ideas in ways that a healthy democracy needs. In other words, the press as an institution can provide an important link between the First Amendment’s epistemic and democratic values. The chapter’s second goal is to provide a rough and preliminary sketch of the relationship …

History And Tradition As Heightened Scrutiny, Andrew Willinger Jan 2025

History And Tradition As Heightened Scrutiny, Andrew Willinger

Faculty Scholarship

The Supreme Court is turning to methodologies privileging text, history, and tradition, or THT, to interpret and implement various constitutional provisions. The Court has recently endorsed historically-focused approaches to determine how the Second Amendment protects the right to keep and carry a firearm, how the First Amendment protects the rights to free speech and freedom of religion, and whether the Due Process Clause protects reproductive autonomy, among other questions.

Much scholarship and popular commentary surrounding THT portrays the methodology as sui generis: presenting unique analytical challenges and impervious to direct comparison to existing doctrinal approaches. However, the jurist most …

Heat Camps: Juvenile Curfews, Extreme Heat & The Eighth Amendment, Norrinda Brown Jan 2025

Heat Camps: Juvenile Curfews, Extreme Heat & The Eighth Amendment, Norrinda Brown

Faculty Scholarship

For decades, in the summertime, America has confined certain of its youth in what are essentially open-air heat camps. In city after city, camp-form is established through the enactment of warm-weather juvenile curfews which keep the youth at home or in state-sponsored centers during summer nights and, increasingly, during days as well. Local governments justify these curfews with general notions of “public safety,” including to protect the youth they confine. But the laws are not benevolent. Reducing youth mobility by curfew results in exclusion, oversurveillance, and potentially lethal heat punishment of the youth, possibly in violation of the Eighth Amendment. …

The Towering Inferno: Art, Policy, And Legacy, Charles R. Jennings

Publications and Research

The Christian Regenhard Center for Emergency Response Studies, leveraging the expertise of its faculty, staff, Advisory Board and colleagues, has consistently programmed activities focused on high-rise fire safety. The upcoming 50th anniversary of the film The Towering Inferno was an inspiration.

We decided this would be more lighthearted and less purely technical than many of our events. We wanted to consider both the film, and use it to reflect on the state of fire safety in tall buildings in New York City.

Of course it does not escape us that the topic of fire safety is a serious one, …

Understanding Violence In Juvenile Correctional Facilities: A National Study Of Victim-Offender Overlap In The United States, Tzu-Ying Lo, Yu-Hsuan Liu, Amy Adamczyk Jan 2025

Understanding Violence In Juvenile Correctional Facilities: A National Study Of Victim-Offender Overlap In The United States, Tzu-Ying Lo, Yu-Hsuan Liu, Amy Adamczyk

Publications and Research

The phenomenon of victim-offender overlap within juvenile correctional facilities is an underexplored area in criminological research. This study examines the prevalence and correlates of victim-offender overlap using data from two collections of the National Survey of Youth in Custody conducted in 2008–2009 and 2012. Our findings reveal that the victim-offender overlap group constitutes a significant proportion of incarcerated youth. Multinomial logistic regression analysis indicates that institutional factors, such as correctional officer legitimacy, in-facility gang membership, fear of inmate assault, experience of filing complaints against staff, and time served, significantly differentiate victim-offenders from the three other groups: victims-only, offenders-only, and those …

Roadside Right-Of-Way Maintenance Strategies, Cheryl Daniels, Angela Burdell, Patrick Ewbank, Keith Shane Jan 2025

Roadside Right-Of-Way Maintenance Strategies, Cheryl Daniels, Angela Burdell, Patrick Ewbank, Keith Shane

JTRP Technical Reports

The Indiana Department of Transportation’s (INDOT) roadside management program is tasked with multiple items across the state’s 39,000 lane miles. Roadside maintenance is an essential task that keeps INDOT’s rights-of-way (ROWs) safe and functional for drivers. Most roadside vegetation maintenance work for INDOT is outsourced, and INDOT’s in-house staff perform any follow-up vegetation maintenance as needed. INDOT needs to focus on cost-efficient solutions due to budgetary constraints from increased labor, equipment, and contractor costs and no budgetary increases.

INDOT contracted Davey Resource Group, Inc. (DRG) to provide recommendations for updates to INDOT’s roadside ROW vegetation maintenance strategies. DRG completed a …

Investigation Of Low Friction On Asphalt Pavements, Jieyi Bao, Cheng Peng, Xiaoqiang Hu, Yi Jiang, Jusang Lee, Shuo Li, Ayesha Shah

JTRP Technical Reports

This study explores low-friction issues in specific asphalt pavements utilizing dolomite aggregates within an Indiana Department of Transportation district. It examines the frictional characteristics of these aggregates, concentrating on initial friction (PSV0) and long-term friction retention (PSV10). Employing a mix of laboratory tests, field data analysis, and statistical modeling, the research assesses how mechanical, physical, and chemical properties influence the overall friction behavior of dolomite aggregates.

The evaluation of Design Mix Formulas (DMFs) revealed no statistically significant effect on pavement friction, with variations more closely tied to aggregate quality and construction practices rather than the mix design itself. Inconsistent friction …

Connected Vehicle Trajectory Data To Screen Network For Hard-Braking And Hard-Acceleration Events, Rahul Suryakant Sakhare, Jairaj Desai, Christopher Gartner, Justin Mukai, Nathan Sturdevant, Nathan Shellhamer, Taylor Ruble, Dan Mccoy, Darcy M. Bullock Jan 2025

Connected Vehicle Trajectory Data To Screen Network For Hard-Braking And Hard-Acceleration Events, Rahul Suryakant Sakhare, Jairaj Desai, Christopher Gartner, Justin Mukai, Nathan Sturdevant, Nathan Shellhamer, Taylor Ruble, Dan Mccoy, Darcy M. Bullock

JTRP Technical Reports

Hard braking and hard acceleration data has been demonstrated as an important emerging data source that provides quicker feedback than crash data. In fact, a strong correlation between hard braking on the interstate and crash rates has been reported in previous studies. A previous study has shown that there are approximately 147 hard braking events in a work zone for every crash. However, there have been subtle changes in acceleration thresholds as well as techniques automotive companies and third-party vendors use to compute hard braking. The motivation of this study is to define scalable and sustainable procedures for obtaining consistent …

The Nuances Of Prosecutorial Nonenforcement, Meighan R. Parsh, Carissa Byrne Hessick Jan 2025

The Nuances Of Prosecutorial Nonenforcement, Meighan R. Parsh, Carissa Byrne Hessick

Faculty Publications

The academic literature on prosecutors is divided: Some commentors believe that prosecutors should more aggressively use their ability to decline to bring charges, decreasing the overall number of criminal cases and helping to address the problem of mass incarceration. Others believe that broad prosecutorial nonenforcement poses significant risks to our constitutional order and public safety. While the visibility of this debate has increased—spilling over from the pages of law reviews into political campaigns and headlines—the terms of this debate are at times unclear. Prosecutorial nonenforcement is a multifaceted phenomenon, and discussions about its costs and benefits can obscure necessary tradeoffs …

The primary research question was: “How do currently enrolled postsecondary students attending a state university located in the Midwest region of the United States describe their beliefs relative to behavior that …

Jurisprudence Of Problem-Solving Courts: A Study Of Structure, Success, And Sociological Theory, Lauren M. Boos Jan 2025

Jurisprudence Of Problem-Solving Courts: A Study Of Structure, Success, And Sociological Theory, Lauren M. Boos

Graduate Student Theses, Dissertations, & Professional Papers

In response to the failures of mass incarceration and its disproportionate impact on marginalized communities, Problem-Solving Courts (PSCs) have emerged as alternatives to traditional prosecution. These courts employ therapeutic-informed and rehabilitative practices aimed at addressing the root causes of criminal behavior. While widely regarded as more effective than traditional courts, PSCs have developed largely without a formal theoretical foundation. This is notable given their alignment with Sociological Jurisprudence (SJ) and Therapeutic Jurisprudence (TJ), which view the legal system as a vehicle for promoting individual and community well-being.

Despite being celebrated as therapeutic innovations, PSCs often embody these principles unevenly. Using …

Visual Semiotics In Parks: Assessing Pictorial Symbol Effectiveness In Outdoor Recreation Settings, Miranda Jane Foster

Graduate Student Theses, Dissertations, & Professional Papers

As interest in outdoor recreation grows, so does the need for effective communication in parks and protected areas. With a larger, more diverse visiting population, managers face new challenges, including intensified recreational use, staffing demands, and barriers to communication presented by cultural and linguistic diversity (Manning et al., 2017; Perry et al., 2021). Effective, indirect communication tools, such as pictorial symbol signage, are essential for addressing these challenges. Pictorial symbol signs are widely used in recreational signage and serve as vital indirect management strategies for communicating to diverse visitors as a universal visual language (Davies et al., 1998). However, research …
