In Martin v. City of Boise, the United States Court of Appeals for the Ninth Circuit relied on the Cruel and Unusual Punishment Clause of the Eighth Amendment to rule that a class of involuntarily unhoused individuals may not be criminally punished for sleeping on public property in the absence of “sufficient alternatives” for all unhoused people. In Johnson v. City of Grants Pass, the Ninth Circuit elaborated that civil schemes which lead to criminal punishment are unconstitutional as well. However, the United States Supreme Court granted certiorari in the latter case and disrupted both Ninth Circuit decisions. The Court …

This article examines a multifaceted approach to reducing illegal gun violence in the United States through the implementation of layered defense strategies. While acknowledging the constitutional protections afforded by the Second Amendment, the author argues that targeted legislative and community-based interventions can effectively reduce gun violence without infringing on lawful gun ownership rights. The analysis explores several key defensive measures, including extreme risk laws (risk protection orders), which allow for temporary firearm removal from individuals posing credible threats to themselves or others—a practice recently upheld by the Supreme Court in United States v. This paper compares the reported statistics of staff-on-inmate sexual misconduct allegations in privately and federally operated correctional facilities. The federal Bureau of Prisons (BOP) was first created with the goal of protecting public safety and promoting rehabilitation for criminal offenders humanely. As decades have passed, and the support for the validity of this mission has wavered, the federal government has implemented oversight and remedial programs to report on the misconduct that is evident in prison management in an attempt to curb these incidents. This paper seeks to explain the rhetoric the U.S. Supreme Court uses when deciding disability cases, specifically when the Court upholds or overrides disability rights. The paper attempts to show how when the Court upholds disabled rights they use passive and weak rhetoric, and utilizes active and enforcing rhetoric when overriding disability rights. All music therapy undergraduate and equivalency students in the United States must complete 1,200 hours of fieldwork experience to obtain degree conferment from an accredited and approved higher education program (American Music Therapy Association, 2023b, p. 1). While engaging in fieldwork had several benefits for music therapy students, such as the opportunity to build practical experience and refine skills, the experience also involved several challenges (Forinash, 2019; Tien & Trang, 2020). This research investigates the design optimization of a small-scale Vertical Axis Wind Turbine (VAWT) utilizing helical rotor blades fabricated from graphene-reinforced polyethylene terephthalate. While previous studies have largely concentrated on largescale turbines for rural environments or on high-performance composite materials that often compromise recyclability, this research addresses the specific challenges associated with small-scale VAWTs intended for urban and populated areas. The study identified tip speed ratio, helical angle, and blade length as critical design parameters. This study explores the lived experiences of residents in marginalized neighborhoods, focusing on the impact of neighborhood associations on perceived justice and resilience. Utilizing a feminist qualitative approach, the Everyday Justice and Neighborhood Associations (EJANA) framework integrates Human Capabilities, Everyday Life Experiences, and Resilience Justice frameworks. Semi-structured interviews across three distinct neighborhoods (Bashford Manor, Oakdale, and Shelby Park in Louisville, Kentucky) revealed that neighborhood associations were often perceived as inaccessible and ineffective, failing to address prevalent inequities. The new “major questions doctrine” (MQD) requires courts to apply a “distinct” approach to statutory interpretation when reviewing challenges to an agency action of “vast economic and political significance.” Under that approach, courts must assume that such an action exceeds the scope of that agency’s statutory authority unless there exists “clear congressional authorization” for it. The Hickory Street Square Revitalization Project seeks to transform a central public space in Sidney, Nebraska into a dynamic, community-oriented area that supports local events, economic activity, and cultural heritage. The project addresses six core objectives: 1) convertible street design, 2) parking lot reconfiguration, 3) public amenities, 4) event flexibility, 5) lighting and signage, and 6) old electric plant renovation. A conceptual design was developed by the design team (S.T.E.E.L. Cybercrime evolves over time to create significant dangers that affect individuals of all ages. The senior population faces extraordinary risk from cybercriminals who specifically target them. The Senior Citizen Cybersecurity Awareness Training Program emerged as a response to the increasing security concern. The initiative delivers specialized training to older adults between 60 and 90 years old to teach them essential digital threat protection skills. Indigenous people have been the victims of harsh persecution since the time of colonization; this has negatively impacted Native communities and has contributed significantly to the ongoing crisis of Missing and Murdered Indigenous Women and Children (MMIWC) across the United States and Canada. Under Legislative Bill 154, Richards et al. (2021) conducted an initial study to identify missing Native cases in Nebraska and in 2023, the Attorney General appointed a Missing and Murdered Indigenous People (MMIP) Liaison to help combat the number of missing Indigenous in the state. This Article is divided into three Parts. Part I will outline the history-in-law case forwhy the historical record sufficiently supports recognizing distinct constitutional press freedoms. Part II then provides a history-in-law response to some of the most common arguments made by press freedom skeptics as to why distinct constitutional press freedoms should not be recognized by the courts. Lastly, Part III makes the case for why the recognition of distinct constitutional press freedoms should become a jurisprudential reality and provides a roadmap to accomplish this.

The integration of Unmanned Aircraft Systems (UAS) within state Departments of Transportation (DOTs) has become increasingly essential for improving efficiency, safety, and regulatory compliance in transportation operations. However, the lack of a standardized approach to UAS program management has resulted in variability in policies, procedures, and implementation strategies across state agencies. This study examines how state DOTs incorporate the Association of Unscrewed Vehicle Systems International (AUVSI) Organizational Implementation Guide (OIG) 35 essential components into their UAS Standard Operating Procedures (SOPs) and identifies 13 additional components that address agency-specific operational, regulatory, and administrative needs. This thesis examines the tension between the First Amendment’s guarantee of free speech and the harmful impact of hate speech on college campuses. As incidents of targeted, discriminatory rhetoric rise in academic settings, the need to reevaluate what constitutes protected speech has become increasingly urgent. Through legal analysis, including case law such as Brandenburg v. Ohio and Schenck v. United States, this paper argues that the Supreme Court must distinguish between constitutionally protected speech and harmful hate speech. New York has made it easier to involuntarily hospitalize people with severe mental illness as part of the state budget signed at the Capitol in early May by Gov. Kathy Hochul. State law previously allowed people with severe mental illness to be involuntarily hospitalized if two physicians determined they pose a threat to themselves or others. The updated law sets a standard to include people who are deemed unwilling or unable to support their basic needs, including food, shelter and medical care, due to their mental illness. Massachusetts is experiencing a critical shortage of affordable housing, driven by decades of underbuilding, which is exacerbated by local opposition to multifamily housing development. Although the Commonwealth has adopted policies to increase housing supply, such as Chapter 40B and the MBTA Communities Act, the impact of these efforts is mitigated by resistance from residents at the local level. This project addressed the issue of justice-involved veterans who fail to utilize Department of Veteran Affairs (VA) benefits, increasing their risk of incarceration. The project consisted of distributing a VA Resource Handbook aimed at enhancing veterans' awareness and utilization of VA benefits, thus improving their reintegration outcomes. Using convenience sampling, the project administered pre- and post-intervention surveys to measure changes in awareness, barriers, and benefit utilization among 16 justice-involved veterans. Results indicated a significant increase in veterans’ awareness of VA benefits post-intervention, prompting additional benefit claims submissions. This qualitative study at the Monterey County Public Defender’s Office explored client experiences within the mental health diversion program. The research was prompted by a noticeable discrepancy of high case dismissal rates that appeared to be linked to declining client engagement rather than successful program completion. Twelve clients were interviewed and categorized into two groups: active participants and program graduates. Additionally, two lead attorneys overseeing diversion cases were interviewed to provide further insight into the program’s impact and potential strategies to strengthen client engagement.
