Are Dhs Technology Grants For Local Police Departments An Effective Tool Against Terrorism?, Erika Mcginty
Are Dhs Technology Grants For Local Police Departments An Effective Tool Against Terrorism?, Erika Mcginty
Student Theses
This paper examines the effectiveness of allocating funds to the nation’s police departments for the prevention of domestic terrorism, as is done annually through the Department of Homeland Security’s Homeland Security Grants Program. The program, administered by the Federal Emergency Management Administration, has distributed billions of dollars since its 2003 inception in equipment, software, and technology services based on the recipient police agencies’ own risk assessments of local terrorism. Much of the technology desired by police consists of systems of mass surveillance; this thesis focuses on implementations of surveillance video cameras or CCTV, license plate readers, and unmanned aerial vehicles. …

Fatigue Crack Detection Using Unmanned Aerial Systems In Under-Bridge Inspection, Sattar Dorafshan, Marc Maguire, Nathan V. Hoffer, Calvin Coopmans
Civil and Environmental Engineering Faculty Publications
The applications of Unmanned Aerial Systems (UAS) for bridge inspection, with emphasis on under-bridge inspection and fatigue crack detection, were studied in this report. The potential benefits and challenges of using UAS for bridge inspection were identified through an extensive literature survey. The feasibility of using UAS for fatigue crack detection was studied by determining the minimum lighting, camera distance and environmental requirements for three UAS. The DJI Mavic UAS performed better than the others in both indoor and outdoor GPS-denied inspections. An in-service bridge in Ashton, Idaho was inspected using this UAS to find fatigue cracks. No fatigue crack, …

The Economic Loss Rule: Is A Building A “Product?” — Another View, Steve Siegfried, Erwin Gonzalez, H. Hugh (Terry) Mcconnell, Allen Bonner, James Czodli
University of Miami Law Review
This Article addresses how the Florida Supreme Court in Tiara Condominium Association v. Marsh & McLennan Cos. receded from its definition of “other property” in Casa Clara Condominium Association, Inc. v. Charley Toppino & Sons, Inc. In Casa Clara the Florida Supreme Court held that a building is to be treated as a “product” for purposes of applying the Economic Loss Rule’s bar to tort claims for defective building materials incorporated into the building. Although Casa Clara adopted the economic loss rule established by Seely v. White Motor Co. and East River Steamship Corp. v. Transamerica Delaval, Inc., …
Lack Of Spatial Resilience In A Recovery Process: Case L'Aquila, Italy, Diana Contreras, Thomas Blaschke, Michael E. Hodgson
Lack Of Spatial Resilience In A Recovery Process: Case L'Aquila, Italy, Diana Contreras, Thomas Blaschke, Michael E. Hodgson
Faculty Publications
The lack of coordination between government agencies, involvement of the collaboration networks existing in the community, and incorporation of spatial planning in the location of the new settlements around L'Aquila (Italy) after the 2009 earthquake has delayed reconstruction of the city centre. The displaced population was relocated to 19 new settlements. These new settlements are characterized by a lack of urban facilities. The aim of this paper was to analyze the relationship between urban facilities, collaboration networks and lack of spatial resilience in the recovery process in L'Aquila. Specifically, we focused on the preferences of inhabitants to search for alternative …
Restoring Democratic Moral Judgment Within Bureaucratic Criminal Justice, Stephanos Bibas
Restoring Democratic Moral Judgment Within Bureaucratic Criminal Justice, Stephanos Bibas
Northwestern University Law Review
While America's criminal justice system is deeply rooted in the ideal of a popular morality play, it has long since drifted into becoming a bureaucratic plea bargaining machine. We cannot (and would not want to) return to the Colonial Era. Even so, there is much more we can do to reclaim our heritage and incorporate popular participation within our lawyer-run system. That requires pushing back against the relentless pressures toward efficiency and maximizing quantity, to ensure that criminal justice treats each criminal with justice, as a human and not just a number. The criminal justice system must narrow its ambitions …
Policing And Procedural Justice: Shaping Citizens' Identities To Increase Democratic Participation, Tracey Meares
Policing And Procedural Justice: Shaping Citizens' Identities To Increase Democratic Participation, Tracey Meares
Northwestern University Law Review
Like the education system, the criminal justice system offers both formal, overt curricula—found in the Bill of Rights, and informal or “hidden” curricula—embodied in how people are treated in interactions with legal authorities in courtrooms and on the streets. The overt policing curriculum identifies police officers as “peace officers” tasked with public safety and concern for individual rights, but the hidden curriculum, fraught with racially targeted stop and frisks and unconstitutional exercises of force, teaches many that they are members of a special, dangerous, and undesirable class. The social psychology of how people understand the fairness of legal authorities—procedural justice—is …
Democratizing Criminal Justice Through Contestation And Resistance, Jocelyn Simonson
Democratizing Criminal Justice Through Contestation And Resistance, Jocelyn Simonson
Northwestern University Law Review
Collective forms of participation in criminal justice from members of marginalized groups—for example, when people gather together to engage in participatory defense, organized copwatching, community bail funds, or prison labor strikes—have a profound effect on everyday criminal justice. In this Essay I argue that these bottom-up forms of participation are not only powerful and important, but also crucial for democratic criminal justice. Collective mechanisms of resistance and contestation build agency, remedy power imbalances, bring aggregate structural harms into view, and shift deeply entrenched legal and constitutional meanings. Many of these forms of contestation display a faith in local democracy as …

Security For 5g Mobile Wireless Networks, Dongfeng Fang, Yi Qian, Rose Qingyang Hu
Department of Electrical and Computer Engineering: Faculty Publications
The advanced features of 5G mobile wireless network systems yield new security requirements and challenges. This paper presents a comprehensive survey on security of 5G wireless network systems compared to the traditional cellular networks. The paper starts with a review on 5G wireless networks particularities as well as on the new requirements and motivations of 5G wireless security. The potential attacks and security services with the consideration of new service requirements and new use cases in 5G wireless networks are then summarized. The recent development and the existing schemes for the 5G wireless security are presented based on the corresponding …
The Use Of Social Media Interactivity Between Nevada E-Government Agencies And The Public: An Analysis Of The Role And Impact Of Twitter Accounts, Jung Eun Song
UNLV Theses, Dissertations, Professional Papers, and Capstones
Social media platforms have extended the information and communication technology (ICT) landscape in the public sector and have been used to increase e-government transparency, participation, and collaboration in the U.S. e-government. The use of social media platforms has improved a two-way communication for the interactivity with the public, which can provide insights to understand compliance with the Open Government initiative. However, many government agencies using social media have not thoroughly measured the impact of their digital interactions. Moreover, a lack of empirical studies of social media exist for improving the interactivity between governments and the public. Furthermore, scholars have not …
Exploring The Barriers To Effective Federal Flood Mitigation In The Mississippi River Region., Linda Kay Bailey
Exploring The Barriers To Effective Federal Flood Mitigation In The Mississippi River Region., Linda Kay Bailey
Electronic Theses and Dissertations
This dissertation is a comprehensive study of flood mitigation in the Mississippi River region as it is impacted by federal flood policies and programs. The study begins with a historical narrative of flooding events and flood mitigation that provided the impetus for federal flood mitigation in the late 1920s. The historical narrative sheds light on issues related to federalism, path dependency, dynamic growth, and socio-culture influence during the development of flood mitigation policy. Growth machine theory is used to describe how inequality and disparate access to political power has worked to exacerbate flood disaster outcomes and how this dynamic is …

A Cross-Sectional Exploration Of Household Financial Reactions And Homebuyer Awareness Of Registered Sex Offenders In A Rural, Suburban, And Urban County., John Charles Navarro
Electronic Theses and Dissertations
As stigmatized persons, registered sex offenders betoken instability in communities. Depressed home sale values are associated with the presence of registered sex offenders even though the public is largely unaware of the presence of registered sex offenders. Using a spatial multilevel approach, the current study examines the role registered sex offenders influence sale values of homes sold in 2015 for three U.S. counties (rural, suburban, and urban) located in Illinois and Kentucky within the social disorganization framework. Homebuyers were surveyed to examine whether awareness of local registered sex offenders and the homebuyer’s community type operate as moderators between home selling …

Breaking Iphones Under Calea And The All Writs Act: Why The Government Was (Mostly) Right, Steven R. Morrison
Cardozo Law Review
During the investigation of the 2015 San Bernardino shooting, the government asked a district court to order Apple to draft code that would bypass the password protection system of the iPhone of one of the shooters. This request was preceded by the holding of a United States District Court in New York, which found that the All Writs Act (A WA) and the Communications Assistance for Law Enforcement Act (CALEA) prohibited the court from issuing the order. This finding was supported by Apple, amici in support of Apple in the San Bernardino investigation, and numerous experts. Although sympathetic to Apple, …

Restroom Use, Civil Rights, And Free Speech "Opportunism", Timothy Zick
Faculty Publications
Commentators have expressed concerns that litigants are invoking the First Amendment's Free Speech Clause strategically, in order to compensate for the weakness or futility of other constitutional claims. The phenomenon has been given a label- "opportunism "-and scholars have examined some of its causes and consequences. This Article takes a closer and somewhat skeptical look at the concept offree speech "opportunism." It imagines that the Free Speech Clause will be invoked in challenges to laws or policies that restrict public restroom use based on a person's gender. Would such challenges be "opportunistic, " as the term has been defined? What …

Politicians and many in the general public ask, “Why do university faculty need tenure?” One could give many reasons based on history or philosophy. But sometimes examples prove the most powerful explanations.
Two weeks ago, on July 18, one of the world’s academic heroes passed away. His name is not familiar to most, but thanks to his work we live in a healthier world. His name was Herbert Needleman. Born on Dec. 13, 1927, in Philadelphia, he came from a Jewish family of modest means. His father sold furniture, and his mother, whose family owned a pickle business, ran the …

Albuquerque Street Paper Value Chain Development, Jeffrey C. Hertz
Architecture and Planning ETDs
Rationale for conducting this research project was based upon prior experiences with the street paper community. The first objective of this study was to work cooperatively with local experts in the fields of social entrepreneurship, workforce development, social service provisioning, city planning, and journalism to identify barriers and strategies for developing a street paper value chain for Albuquerque. The second objective of this study was to support these experts in selfidentifying their involvement as potential actors and/or value chain coordinators in developing a street paper operation in Albuquerque. While a comprehensive list of barriers to upward mobility for low-income and …
The Next Best Defendant: Examining A Remote Text Sender's Liability Under Kubert V. Best, Christopher P. Edwards
The Next Best Defendant: Examining A Remote Text Sender's Liability Under Kubert V. Best, Christopher P. Edwards
Akron Law Review
Texting and driving is a dangerous activity that is responsible for many of the avoidable accidents that occur due to distracted driving. While many state legislatures have responded by enacting formal prohibitions on texting and driving, the penalties are far less severe than other forms of distracted driving, namely driving while intoxicated. While a texting driver is exposed to some liability for their conduct, the text sender generally bears no responsibility. While prohibiting texting and driving on the part of the recipient-driver is the more obvious approach to addressing the issue, the very nature of texting requires the participation of …
Sound Principles, Undesirable Outcomes: Justice Scalia's Paradoxical Eighth Amendment Jurisprudence, Mirko Bagaric, Sandeep Gopalan
Sound Principles, Undesirable Outcomes: Justice Scalia's Paradoxical Eighth Amendment Jurisprudence, Mirko Bagaric, Sandeep Gopalan
Akron Law Review
Justice Scalia is renowned for his conservative stance on the Eighth Amendment and prisoners’ rights. Justice Scalia held that the Eighth Amendment incorporates no proportionality requirement of any nature regarding the type and duration of punishment which the state can inflict on criminal offenders. Justice Scalia has also been labelled as “one of the Justices least likely to support a prisoner’s legal claim” and as adopting, because of his originalist orientation, “a restrictive view of the existence of prisoners’ rights.” A closer examination of the seminal judgments in these areas and the jurisprudential nature of the principle of proportionality and …
Justice Scalia As Neither Friend Nor Foe To Criminal Defendants, Tung Yin
Justice Scalia As Neither Friend Nor Foe To Criminal Defendants, Tung Yin
Akron Law Review
At first glance, Justice Scalia may appear to have been something of a “friend” to criminal defendants, as he authored a number of opinions ruling against law enforcement. However, his opinions reflect his fidelity to his constitutional vision of originalism rather than an intent to favor criminal defendants. Nevertheless, these cases are often offered as legitimate examples of how he did not have a purely results-oriented approach to deciding criminal procedure issues. Yet, a closer examination of Justice Scalia’s “defendant-favorable” opinions suggests that the results often have an air of unreality to them. In practice, there is no way for …
Justice Scalia's Eighth Amendment Jurisprudence: An Unabashed Foe Of Criminal Defendants, Michael Vitiello
Justice Scalia's Eighth Amendment Jurisprudence: An Unabashed Foe Of Criminal Defendants, Michael Vitiello
Akron Law Review
Justice Scalia’s death has already produced a host of commentary on his career. Depending on the issue, Justice Scalia’s legacy is quite complicated. Justice Scalia’s commitment to originalism explains at least some of his pro-defendant positions. Some of his supporters point to such examples to support a claim that Justice Scalia was principled in his application of his jurisprudential philosophy. However, in one area, Justice Scalia was an unabashed foe of criminal defendants: his Eighth Amendment jurisprudential dealing with terms of imprisonment. There, based on his reading of the historical record, he argued that the Eighth Amendment’s prohibition against cruel …

Intutitve Decision-Making: Engagement, Agency, And Leverage, Roger E. Callese
All Capstone Projects
This project explored law enforcement decision-making through the review of decision-making literature, consideration of the Critical Decision Model (CDM), and semistructured interviews with law enforcement officers. In 2016, the Police Executive Research Forum (PERF) recommended the adoption and use of the CDM by law enforcement officers as a new way to approach tactical decisions. A review of the CDM suggests a linear, rational, weighing of options by officers. While this may be an excellent tool for slowly developing situations, for pre-mortems, or for debriefing, the CDM step four (identify options and determine best course of action) and step five (act, …
