Active And Public Transportation Connectivity Between North Temple Tod And Jordan Park River Trail, Ivis Garcia Zambrana, Christie Oostema

TREC Final Reports

The project seeks to capitalize on existing community assets—several TOD stations and a regional bike and pedestrian trail system—by studying how these can be linked. The overarching goal of this project is to increase scholarship on networking safe routes that can encourage public and active transportation choices and thus, encourage a healthier lifestyle and advance sustainability. By expanding pedestrian, bicycle and transit connections to green space and offering the most potential for TOD, this proposal clearly demonstrates the greatest priorities of NITC. Land Insecurity In Gulu, Uganda: A Clash Between Culture And Capitalism, Zachary Slotkin

Independent Study Project (ISP) Collection

This paper presents the causes and consequences of land insecurity in Gulu, Uganda. In order to address this important and often sensitive issue, the paper analyzes the role of the Lord’s Resistance Army (LRA) insurgency and the government’s policy of forced encampment during the insurgency in contributing to land insecurity, causing widespread displacement among former internally displaced persons (IDPs). It further explores the importance of land ownership in providing economic productivity to rural landowners, as well as the nature of customary land tenure in Acholi culture and the government’s efforts to privatize communal land, to give a background on the …

The Search For Third Options In A Two-Bathroom Society, Sharon R. Cruz

Cardozo International & Comparative Law Review

The note examines the systemic discrimination faced by transgender individuals, particularly in access to bathrooms and prison housing, arguing that such treatment reflects broader societal and legal failures to recognize and protect gender identity. It critiques binary policies that perpetuate harm and advocates for inclusive measures to ensure equal rights and safety. The analysis underscores the legal system's evolving understanding of gender identity and the urgent need for enforceable protections.

Guantanamo Bay - Why Would The United States Ever Actually Prosecute?, Benjamin Wine Oct 2017

Guantanamo Bay - Why Would The United States Ever Actually Prosecute?, Benjamin Wine

Cardozo International & Comparative Law Review

The note examines the legal and ethical dilemmas surrounding the detention of individuals at Guantanamo Bay, focusing on the U.S. government's reluctance to prosecute many detainees despite their prolonged detention. It argues that the indefinite detention, often without formal charges, and the use of controversial interrogation methods violate both domestic and international laws. The analysis highlights the lack of recognition of Guantanamo Bay as a competent tribunal by other nations and explores potential solutions to address these issues.

Bathroom Laws As Status Crimes, Stephen Rushin, Jenny Carroll Oct 2017

Bathroom Laws As Status Crimes, Stephen Rushin, Jenny Carroll

Fordham Law Review

A growing number of American jurisdictions have considered laws that prohibit trans individuals from using bathroom facilities consistent with their gender identities. Several scholars have criticized these so-called “bathroom laws” as a form of discrimination in violation of federal law. Few scholars, though, have considered the criminal justice implications of these proposals. By analyzing dozens of proposed bathroom laws, this Article explores how many laws do more than stigmatize the trans community—they effectively criminalize it. Some of these proposed laws would establish new categories of criminal offenses for trans individuals who use bathrooms consistent with their gender identity. Others would …

Fifty Years Later And Miranda Still Leaves Us With Questions, Nicole Langston, Bernice B. Donald Oct 2017

Fifty Years Later And Miranda Still Leaves Us With Questions, Nicole Langston, Bernice B. Donald

Vanderbilt Law School Faculty Publications

This affords the suspect safeguards to make an informed choice between speech and silence and prevents involuntary statements. Although Miranda warnings are seemingly standard, the Miranda decision did not come without criticism.' Now, on the fiftieth anniversary of the Supreme Court's decision, the topic still garners intense debate.' Even after all of these years, there are still critics who do not support Miranda warnings, and now they rely on long-term studies about the effectiveness of Miranda warnings to support their positions. Yet, even with these new studies, there still remains some ambiguity about the effectiveness of Miranda rights concerning whether …

Increasing Diversity By A New Master's Degree In Legal Principles, Joni Hersch Oct 2017

Increasing Diversity By A New Master's Degree In Legal Principles, Joni Hersch

Vanderbilt Law School Faculty Publications

Students who leave their JD program before graduation leave empty handed, without an additional degree or other credential indicating that their law school studies had any professional, educational, or marketable value. The absence of such a credential combines with the substantial risks and costs associated with law school education to discourage risk averse students from applying. The adverse impacts of these risks may be especially great for lower income students who have fewer financial resources to draw on and less information about their fit with legal education and the legal profession. I propose that law schools award a master’s degree …

The Culture Of Misdemeanor Courts, Jessica A. Roth Oct 2017

The Culture Of Misdemeanor Courts, Jessica A. Roth

Articles

The misdemeanor courts that preside over the majority of criminal cases in the United States represent the “front porch” of our criminal justice system. These courts vary in myriad ways, including size, structure, and method of judicial appointment. Each also has its own culture – i.e., a settled way of doing things that reflects deeper assumptions about the court’s mission and its role in the community – which can assist or impede desired policy reforms. This Article, written for a Symposium issue of the Hofstra Law Review, draws upon the insights of organizational culture theory to explore how leaders can …

Hit Them Where It Hurts: State Responses To Biker Gangs In Canada, Graema Melcher Oct 2017

Hit Them Where It Hurts: State Responses To Biker Gangs In Canada, Graema Melcher

Dalhousie Law Journal

From civil and criminal forfeiture, to "gangsterism"offences in the Criminal Code, Canada does not lack for tools to address biker gangs. Yet attempts to stamp out bikers have met with little to no success. State responses to criminal organizations should use those organizations' own structures and symbols of power against them. A gang's reputation may be effectively used against a gang, but this strategy poses significant challenges to prosecution. Attempts to use a gang's internal hierarchy and administrative structure can succeed, but may only produce circumstantial findings if not supported by sufficient and substantial evidence. Attempts to combat gang violence …

An Examination Of Policy Options For Achieving Greenhouse Gas Emissions Reductions In New Jersey, Gabriel Pacyniak

Faculty Scholarship

An Examination of Policy Options for Achieving Greenhouse Gas Emissions Reductions in New Jersey surveys emissions and energy trends, describes a “deep decarbonization pathway” for the state, and identifies the types of policies that would be necessary to achieve those reductions. Many of the policies address the power and transportation sectors, which account for more than 60 percent of total greenhouse gas emissions from New Jersey. The report also includes options for improving building efficiency, reducing methane leaks from natural gas infrastructure, restoring natural carbon sinks in forests and wetlands, and incorporating equity considerations to address the needs of frontline …

Jailing The Twitter Bird: Social Media, Material Support To Terrorism, And Muzzling The Modern Press, Rachel E. Vanlandingham Oct 2017

Jailing The Twitter Bird: Social Media, Material Support To Terrorism, And Muzzling The Modern Press, Rachel E. Vanlandingham

Cardozo Law Review

Social media companies such as Facebook and Twitter are vulnerable to federal criminal prosecution under 18 U.S.C. § 2339B, the material support to terrorism statute, for providing a means for terrorists and their sympathizers to glorify and pursue their violence on social media. This Article exposes that vulnerability as well as the material support statute's conflicts with the First and Fifth Amendments in this context, such as the statute's chilling effect. In particular, the Article explores how social media providers have responded to threats from the U.S. government by suspending hundreds of thousands of user accounts, effectively censoring constitutionally protected …

An Estimate On The Supply And Demand Of Marketing Education Teachers In The Next Five Years In The Hampton Roads, Virginia Area, Alison Danielle Briel

OTS Master's Level Projects & Papers

As of 2017, there is a lack of information about the number of Marketing Education teachers at the high school level employed in the Hampton Roads area of south eastern Virginia. Marketing Education is an essential subject to teach at the secondary level because it prepares students for careers in marketing and management. For this study, a survey was created to understand the current state of Marketing Education and the supply and demand of Marketing Education teachers. This study primarily focused on Marketing Education programs in the high school setting. A survey consisting of open-ended questions was developed and distributed …

A Framework For Understanding Subfederal Enforcement Of Immigration Laws, Huyen Pham Oct 2017

A Framework For Understanding Subfederal Enforcement Of Immigration Laws, Huyen Pham

Faculty Scholarship

In discussing the varied LEA responses, the normative question naturally arises: Which model of immigration enforcement should an LEA embrace? If an LEA with no current immigration enforcement policy were to decide on a model, which model should it choose? Or, if an LEA wants to reconsider its current enforcement model, what factors should it consider in making its decision? The answers to these questions depend on the interests of individual LEAs-interests that may vary from LEA to LEA. The second contribution of this article then is to raise important questions that LEAs should consider in deciding which model is …
