The Criminalization Of Poverty: The Impact Of Cash Bail System On Black Women In New Orleans, Salome Kushindana Jan 2018

The Criminalization Of Poverty: The Impact Of Cash Bail System On Black Women In New Orleans, Salome Kushindana

All Graduate Theses, Dissertations, and Other Capstone Projects

Research on bail practices has shown that most of the people are in jail because of their inability to pay bail set by the court. A 2016 study by the Vera Institute of Justice concluded that the use of the cash bail system disproportionately impacts poor black people in Orleans Parish Prison, the entity that serves as the principal driver of the mass incarceration. With a focus on poor black people in Orleans Parish Prison, the experiences of the impact of the cash bail system on poor black women are still missing.

Using semi-structured interviews and qualitative method of data …

Watch Or Report? Livestream Or Help? Good Samaritan Laws Revisited: The Need To Create A Duty To Report, Patricia G. Montana Jan 2018

Watch Or Report? Livestream Or Help? Good Samaritan Laws Revisited: The Need To Create A Duty To Report, Patricia G. Montana

Faculty Publications

In July 2017, a group of five Florida teenagers taunted a drowning disabled man while filming his death on a cell phone. In the video, the teenagers laughed and shouted harsh statements like "ain’t nobody finna to help you, you dumb bitch." At the moment the man’s head sank under the water for the very last time, one of the teenagers remarked: "Oh, he just died" before laughter ensued. None of the teenagers helped the man, nor did any of them report the drowning or his death to the authorities.

Because the Good Samaritan law in Florida, like in most …

Interrogation Parity, Kate Levine, Stephen Rushin Jan 2018

Interrogation Parity, Kate Levine, Stephen Rushin

Faculty Publications

This Article addresses the special interrogation protections afforded exclusively to the police when they are questioned about misconduct. In approximately twenty states, police officers suspected of misconduct are shielded by statutory Law Enforcement Officer Bills of Rights. These statutes frequently limit the tactics investigators can use during interrogations of police officers. Many of these provisions limit the manner and length of questioning, ban the use of threats or promises, require the recording of interrogations, and guarantee officers a reprieve from questioning to tend to personal necessities. These protections, which are available to police but not to ordinary criminal suspects, create …

Punishing Criminals For Their Conduct: A Return To Reason For The Armed Career Criminal Act, Sheldon Evans Jan 2018

Punishing Criminals For Their Conduct: A Return To Reason For The Armed Career Criminal Act, Sheldon Evans

Faculty Publications

For over twenty-five years, the Armed Career Criminal Act has produced inconsistent results and has taxed judicial economy perhaps more than any other federal sentencing mechanism. This recidivist sentencing enhancement is meant to punish habitual criminals based on their numerous past crimes, but the Supreme Court’s application of the Act too often allows habitual criminals to escape the intended enhancement on a legal technicality. This comes as a result of the Court’s categorical approach, which punishes habitual criminal offenders based on the statutory elements of their past crimes rather than the conduct of their past crimes.

In an effort to …

Rape, Revenge, Reclamation: An Analysis Of Female Agency In American Rape-Revenge Films, Marissa Connell Jan 2018

Rape, Revenge, Reclamation: An Analysis Of Female Agency In American Rape-Revenge Films, Marissa Connell

Master's Theses and Doctoral Dissertations

In this thesis, I will analyze five films that have a rape-revenge narrative: Ms. 45 (1981), M.F.A. (2017), I Spit on Your Grave (1978), I Spit on Your Grave (2010), and The Girl with the Dragon Tattoo (2011). I will argue that the violent actions taken by the female protagonist during her revenge against her rapist(s) serve to allow her to reclaim her agency that was stolen from her during the rape(s). I will show that the rape-revenge narrative is more diverse than it might seem, as the five films I analyze deal with rape, and responses to rape, in …

Impact Of Highway Work Zones On Traffic Crashes: A Case Study In Michigan, Qadri Hafez Shaheen Jan 2018

Impact Of Highway Work Zones On Traffic Crashes: A Case Study In Michigan, Qadri Hafez Shaheen

Master's Theses and Doctoral Dissertations

Infrastructure in the US is severely aged and outdated. This presents a seemingly paradoxical problem in the field of construction management: In order to fix and make roads and highways more safe, construction zones must become inherently less safe in the process. There is a high cost to taxpayers and drivers, as work zones experience a significant amount of crashes and fatalities each year. To mitigate some of the factors that contribute to these crashes, this paper attempts to deliver guidelines on how to update relevant crash data, identify relevant factors, and create recommendations accordingly. The research focused particularly on …

Parallel Enforcement And Agency Interdependence, Anthony O'Rourke Jan 2018

Parallel Enforcement And Agency Interdependence, Anthony O'Rourke

Journal Articles

Parallel civil and criminal enforcement dominates public enforcement of everything from securities regulation to immigration control. The scholarship, however, lacks any structural analysis of how parallel enforcement differs from other types of interagency coordination. Drawing on original interviews with prosecutors, regulators, and white-collar defense attorneys, this Article is the first to provide a realistic presentation of how parallel enforcement works in practice. It builds on this descriptive account to offer an explanatory theory of the pressures and incentives that shape parallel enforcement. The Article shows that, in parallel proceedings, criminal prosecutors lack the gatekeeping monopoly that traditionally defines their relationships …

From Theory To Doctrine: An Empirical Analysis Of The Right To Keep And Bear Arms After Heller, Eric Ruben, Joseph Blocher Jan 2018

From Theory To Doctrine: An Empirical Analysis Of The Right To Keep And Bear Arms After Heller, Eric Ruben, Joseph Blocher

Faculty Journal Articles and Book Chapters

As a matter of constitutional doctrine, the right to keep and bear arms is coming of age. But although the doctrine has begun to mature in the decade since District of Columbia v. Heller, scholars, advocates, and judges disagree about (and sometimes simply do not know) how to characterize it.

This Article is the first comprehensive empirical analysis of post-Heller Second Amendment doctrine. Beginning with a set of more than one thousand Second Amendment challenges, we have coded every available Second Amendment opinion — state and federal, trial and appellate — from Heller up until February 1, 2016. The dataset …

Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen Jan 2018

Risk And Resiliency Factors In Predicting Recidivism Among Native Americans On A Montana Reservation, Ciara Dawn Hansen

Graduate Student Theses, Dissertations, & Professional Papers

Background: According to a 2014 report, approximately 1 in 100 American adults are incarcerated, which represents a 500% increase over the past 40 years and accounts for the largest population of prisoners in the world. Despite research that suggests incarceration is not an effective deterrent for crime, incarceration continues to increase at a historically unprecedented rate. Mass incarceration disproportionately affects communities of color. In Montana, Native Americans are overrepresented at all levels of the correctional system. In addition, Native American ex-offenders are just over twice as likely as non-Native Americans to recidivate and be returned to a correctional institution, mostly …

Report And Recommendations Of The Arizona Task Force On Court Management Of Digital Evidence, Arizona Task Force On Court Management Of Digital Evidence

Washington Journal of Law, Technology & Arts

The court record has three components, each historically paper-based and tangible: (1) filings; (2) transcripts; and (3) exhibits. Given technology changes, filings and transcripts now are often kept as digital files. Exhibits, however, continue to be received and held by the court in tangible form. Technology changes mean that will soon change, and will change drastically. The 2016 Joint Technology Committee Resource Bulletin: Managing Digital Evidence in Courts, warned that “[c]ourt management systems are not currently designed to manage large quantities of digital evidence, which means that courts and industry must find creative ways to deal immediately with the dramatically …

Overwhelming The Saa System Of Delivery Uavs By Drone Swarming, Barry Lynn Pfaff

Browse all Theses and Dissertations

As the Internet continues to replace the brick-and-mortar store as the main place for purchasing goods, web-based companies are looking for ways to reduce the cost of delivering those goods. The use of Unmanned Aerial Vehicles, or UAVs, is one delivery method that is increasingly being used. These UAVs can be programmed with delivery routes and destinations and can complete the job while requiring limited intervention from human controllers. Sense and Avoidance (SAA) systems have recently been incorporated into these UAVs so that they can detect objects in their flight path, reroute the UAV accordingly and operate even more autonomously. …

Channel Fading Statistics For Real-Time Data Transmission In Emergency Call Systems And Unmanned Aerial Systems, Yunrui Li

Wayne State University Dissertations

The Third Generation Partnership Project (3GPP) selected an in-band modem to transmit emergency data over cellular voice channel for the European Union emergency call (eCall) system. However, the road test results presented by the Harmonized eCall European Pilot project showed that the success rate of data delivery was only 71%, indicating that there is significant potential to improve its performance.

In this dissertation, a testbed is designed for the eCall system that satisfies the 3GPP TS 26.267/268/269 standards. A method is proposed to measure the power of the received signal that passes through the in-band channel. Experiments are performed with …

Examining The Effectiveness Of Upward Bound On Postsecondary Success: A Phenomenological Study, Marilyn E. Ingram

Theses and Dissertations

As the achievement gap between African American and Latino students and their White counterparts continues to grow, lawmakers are searching for ways to decrease the disparity. As a result, college access programs that focus on improving basic skills and strengthening academic achievement have become essential to fostering student success. With Upward Bound being one of the longest running federally funded college access programs, its success and effectiveness have been the focus of several studies. Surprisingly, very little qualitative phenomenological research exists that is solely devoted to student perceptions. The purpose of this qualitative phenomenological study was to understand the impact …

The Role Of Dog Population Management In Rabies Elimination—A Review Of Current Approaches And Future Opportunities, Louise H. Taylor, Ryan M. Wallace, Deepashree Balaram, Joann M. Lindenmayer, Douglas C. Eckery, Beryl Mutonono-Watkiss, Ellie Parravani, Louis H. Nel

United States Department of Agriculture Wildlife Services: Staff Publications

Free-roaming dogs and rabies transmission are integrally linked across many low income countries, and large unmanaged dog populations can be daunting to rabies control program planners. Dog population management (DPM) is a multifaceted concept that aims to improve the health and well-being of free-roaming dogs, reduce problems they may cause, and may also aim to reduce dog population size. In theory, DPM can facilitate more effective rabies control. Community engagement focused on promoting responsible dog ownership and better veterinary care could improve the health of individual animals and dog vaccination coverage, thus reducing rabies transmission. Humane DPM tools, such as …

Persistent Spillback Of Bovine Tuberculosis From White-Tailed Deer To Cattle In Michigan, Usa: Status, Strategies, And Needs, Kurt C. Vercauteren, Michael J. Lavelle, Henry Campa Iii

United States Department of Agriculture Wildlife Services: Staff Publications

Free-ranging white-tailed deer (Odocoileus virginianus) are believed to be a self-sustaining reservoir for bovine tuberculosis (bTB) in northeastern Lower Michigan, USA. Although a comprehensive control program is in place and on-farm mitigation strategies to curtail bTB transmission between cattle and deer have been implemented for over a decade, cattle and deer continue to become infected with the disease. Thus, renewed motivation to eradicate bTB is needed if that is truly the goal. Recurrent detection of bTB in cattle in the region is of mounting concern for state and federal agricultural agencies, producers, and wildlife managers. Current on-farm mitigation …

Member-Level Redundancy Of Built-Up Steel Axially Loaded Members, Jason B. Lloyd, Francisco J. Bonachera Martín, Cem Korkmaz, Robert J. Connor Jan 2018

Member-Level Redundancy Of Built-Up Steel Axially Loaded Members, Jason B. Lloyd, Francisco J. Bonachera Martín, Cem Korkmaz, Robert J. Connor

S-BRITE Reports

Full-scale fracture tests were completed determining that mechanically-fastened steel built-up axially-loaded tension members are resistant to running fracture when a single component suddenly fractures. This characteristic of built-up member is referred to as Cross-Boundary Fracture Resistance (CBFR). A comprehensive finite element model-based parametric study was also performed investigating the post-fracture load redistribution behavior of multi-component built-up members. Simplified closed-form solutions were developed for engineering analysis of built-up members to evaluate for internal member redundancy and estimate safe inspection intervals that are based on the fatigue life of the member in the assumed faulted condition.
