ILSA Journal of International & Comparative Law

Saudi human rights lawyer and pro-democracy activist Waleed Abu Al-Khair was convicted for “inciting public opinion” and “harming the reputation of the King.” As a result, he is currently serving a fifteen-year prison sentence in the Kingdom of Saudi Arabia. This Article analyzes Abu Al-Khair’s criminal conviction under international law, with a focus on the universal standard for the protection of freedom of expression. Specifically, this article explores international law rules that call for narrow constructions of the offenses of “incitement” and “defamation” under domestic law when dealing with public figures and public affairs. Measuring The Impact Of Gun Violence On South Carolina Emergency Departments, Roxanne Renee Johnson Jan 2018

Measuring The Impact Of Gun Violence On South Carolina Emergency Departments, Roxanne Renee Johnson

MUSC Theses and Dissertations

Gun violence is a significant problem across the United States, and the economic impact of gun violence in South Carolina is not well understood. There has been a historical policy- driven trend to limit research on gun violence. Therefore, few empirical studies have been done to examine this problem. In order to determine the impact of gun violence on the healthcare utilization and cost resulting from gunshot wounds and injuries, ICD codes for state-level billing data were used to enable an estimation of county specific cost associated with gun violence. Federal laws exist on background check requirements although, state laws …

Repealing No-Fault Divorce Would Harm Survivors Of Domestic Violence In Texas, Judge Elmo B. Hunter Legal Center For Victims Of Crimes Against Women Jan 2018

Repealing No-Fault Divorce Would Harm Survivors Of Domestic Violence In Texas, Judge Elmo B. Hunter Legal Center For Victims Of Crimes Against Women

Hunter Center Publications

For the past two legislative sessions, the Texas Legislature has explored the repeal of no-fault divorce in the state. This paper explains why such action would be detrimental to the more than five million survivors of domestic violence in Texas. Briefly stated, requiring proof of fault in order to obtain a divorce imposes financial burdens that trap victims in abusive relationships and increases the risk of harm and lethality.

The economic impacts of repealing unilateral no-fault divorce will adversely affect not only victims of domestic violence but also the State of Texas itself. By its nature, fault-based divorce is significantly …

Differential Treatment Outcome Factors For Custodial And Noncustodial Mental Health Care Programs, Sheila Fay Waters Jan 2018

Differential Treatment Outcome Factors For Custodial And Noncustodial Mental Health Care Programs, Sheila Fay Waters

Walden Dissertations and Doctoral Studies

Researchers have suggested that jails and prisons in the United States are becoming the new mental health clinics, contributing to the phenomenon of mass incarceration and costing upwards of $15 billion per year in public revenue. The problem is no conclusive evidence exists that treatment in these custodial environments is more effective than that provided by noncustodial programs; especially for substance users. Additionally, the continuing incarceration of people with mental health problems by the hundreds of thousands poses a difficult ethical dilemma regarding why this population does not receive noncustodial or hospital treatment instead. The study addressed the research question …

Government And Nongovernmental Collaboration To Build Community Resiliency Against Terrorism In Oklahoma City, Kimberly K. Heltz Jan 2018

Government And Nongovernmental Collaboration To Build Community Resiliency Against Terrorism In Oklahoma City, Kimberly K. Heltz

Walden Dissertations and Doctoral Studies

The way communities build resiliency and prepare for acts of terrorism is ambiguous in the United States; best practices remain unclear. Due to mobility and advancements in communication technologies, individuals and organizations share information, incite anger, recruit, and act on ideological grievances with ease. Such grievances are bolstered by the political and social exclusion of disparate groups through poorly designed policies and ineffective government structures. Using a combination of social constructivism and systems thinking theories, this case study explored collaboration efforts between government agencies and nongovernment experts in Oklahoma City, OK, identifying best practices as a result of lessons learned …

Multiband Slot-Loaded Dipole Antenna For Wlan And Lte-A Applications, Samir Salem Al-Bawri, Mohd. Faizal Jamlos, Ping Jack Soh, Syed Alwee Aljunid Syed Junid, Mohd Aminudin Jamlos, Adam Narbudowicz

Articles

A multiband printed dipole antenna for wireless local area network (WLAN) and long-term evolution-advanced (LTEA) applications is investigated here. Its multiband characteristic is enabled by the Y-slot present in the upper arm of the dipole, while the antenna's dimensions are 0.08λo × 0.384λo at the lowest operating frequency. It features bandwidth of 14.6% centred at 2.4 GHz, and ∼30.5% centred at 5.5 GHz for WLAN operation. An additional bandwidth of 6.9% centred at 3.5 GHz supporting LTE-A applications is also featured. Besides being compact, the proposed antenna radiates omnidirectionally with a gain of up to 4.09 dBi. Simulations and measurements …

What The Police Don’T Know May Hurt Us: An Argument For Enhanced Legal Training Of Police Officers, Yuri R. Linetsky Jan 2018

What The Police Don’T Know May Hurt Us: An Argument For Enhanced Legal Training Of Police Officers, Yuri R. Linetsky

New Mexico Law Review

Using original empirical research, this Article identifies deficient legal training in police academies as a latent cause of improper arrests or detentions. This often results in unnecessary conflict between police officers and citizens, leading to endemic distrust of officers in the communities they serve. With enhanced legal training, police officers can avoid these negative interactions. Although police officers need not be lawyers, they must have more than a cursory understanding of the law. Their primary responsibility is to enforce state and local laws, which often requires officers to interpret statutory language in light of constitutional limitations. Current police academy curricula …

Resilient Response In An Age Of Change: Emergency Response Organizations’ Resilience In Times Of Disaster, Clara Decerbo Jan 2018

Resilient Response In An Age Of Change: Emergency Response Organizations’ Resilience In Times Of Disaster, Clara Decerbo

Open Access Dissertations

Impacts from major storms, floods, hurricanes, and heavy precipitation events disturb the lives of millions of people around the world every year, causing billions of dollars of damages and economic losses. As the number and destructiveness of natural disasters increase, the study of resilience offers possible solutions for minimizing loss of life and damage from disasters. Resiliency of communities and organizations in the face of global climate change is attracting increasing attention as a way to slow or reverse the increasing costliness and disruption of natural disasters. Despite the growing interest in resilience, no research focuses on the particular resilience …

An Evaluation Of Juvenile Lifers In Pennsylvania Pre And Post Act 33 Of 1995, Kieshia Martin Jan 2018

An Evaluation Of Juvenile Lifers In Pennsylvania Pre And Post Act 33 Of 1995, Kieshia Martin

Walden Dissertations and Doctoral Studies

Act 33 of 1995 is an amendment to Pennsylvania's Juvenile Act (2008). This amendment changed jurisdictional boundaries for juvenile offenders who committed violent crimes with weapons. As a result, youth who committed violent crimes with weapons were automatically transferred to the adult criminal justice system. Using punctuated equilibrium as the theoretical foundation, the purpose of this study was to determine if Act 33, as a punctuating event, resulted in an increase in the number of youth transferred to the adult criminal justice system and sentenced to life without the possibility of parole in an urban county in Pennsylvania. Secondary data …

When Death Becomes Murder: A Primer On Extrajudicial Killing, William J. Aceves Jan 2018

When Death Becomes Murder: A Primer On Extrajudicial Killing, William J. Aceves

Faculty Scholarship

International law prohibits the arbitrary deprivation of life, which includes extrajudicial killing. This norm is codified in every major human rights treaty and has attained jus cogens status as a non-derogable norm in international law. In the United States, the Torture Victim Protection Act ("TVPA") establishes civil liability for extrajudicial killing. As evidenced in the TVPA's text and legislative history, the definition of extrajudicial killing is based on international law. Despite the clear meaning of the TVPA's text and the clarity of international law, the TVPA's definition of extrajudicial killing is still contested in litigation, and some courts express uncertainty …

Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves Jan 2018

Interrogation Or Experimentation? Assessing Non-Consensual Human Experimentation During The War On Terror, William J. Aceves

Faculty Scholarship

The prohibition against non-consensual human experimentation has long been considered sacrosanct. It traces its legal roots to the Nuremberg trials although the ethical foundations dig much deeper. It prohibits all forms of medical and scientific experimentation on non-consenting individuals. The prohibition against non-consensual human experimentation is now well established in both national and international law.

Despite its status as a fundamental and non-derogable norm, the prohibition against non-consensual human experimentation was called into question during the War on Terror by the CIA's treatment of "high-value detainees." Seeking to acquire actionable intelligence, the CIA tested the "theory of learned helplessness" on …
