Workplace Privacy In The Age Of Social Media, Tess Traylor-Notaro

Global Business Law Review

This note addresses the lack of adequate protections in Ohio for social media privacy laws in the workplace and compares proposed legislation in Ohio to legislation that has passed in other states. It examines the provision of the SCA including the definition of "user" and whether social media sites fall under its umbrella. It also looks at the safeguards and limitations of the SCA and how it is used to protect a private employee’s social media account. It analyzes the state statutory laws in Arkansas, Illinois, and California passed specifically to prevent employers from requesting passwords to personal Internet accounts. …

Exploring Transit’S Contribution To Livability In Rural Communities: Case Studies Of The North Dakota Cities Of Valley City And Dickinson, Ranjit Godavarthy, Jeremy Mattson

Journal of Public Transportation

This paper investigates the nexus of transit and rural livability as demonstrated by case studies in the North Dakota communities of Valley City and Dickinson. While there are many factors that influence the livability of a rural community, transit is believed to be an important contributor. For each of the two North Dakota communities considered, public/resident surveys, local transit rider surveys, and stakeholder interviews were conducted to understand differing opinions on livability and how transit contributes to livability.

In both Valley City and Dickinson, surveys of residents showed that they believe affordable housing, low crime, quality healthcare, overall cost of …

The Politics Of Public Budgeting In Illinois, John Jackson, John Foster Jul 2018

The Politics Of Public Budgeting In Illinois, John Jackson, John Foster

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

This paper is about taxing, revenue and public budgeting in Illinois. The concept of public budgeting includes both the revenues raised by government and the ways in which those revenues are spent on the functions and programs sponsored by governments. This paper focuses especially on spending, that is on how and where revenue is distributed in the state in the form of public services and programs. It provides relevant data on the statewide distribution patterns and especially the question of whether those expenditures of the taxpayers’ money disproportionately benefit one region over the other. This question has provoked a long …

Evolution Of Community Policing In New York City, Kristine Lamburini

Honors College Theses

This study examines the various community policing initiatives, or lack of community policing initiatives, within the New York City Police Department (NYPD) from 1984 to present. Community policing is a policing model that is currently in the forefront of the criminal justice field due to strained relationships between many communities and the police. The community policing initiatives examined in this study are organized as follows: the Community Patrol Officer Program (C-POP) under Police Commissioner Ward (1984-1989); the Safe Streets, Safe City Program under Police Commissioner Brown (1989-1992), which established community policing as the dominant operational philosophy in the NYPD; Broken …

Righting A Wrong: Woodrow Wilson, Warren G. Harding, And The Espionage Act Prosecutions, David Forte Jul 2018

Righting A Wrong: Woodrow Wilson, Warren G. Harding, And The Espionage Act Prosecutions, David Forte

Law Faculty Articles and Essays

This is a story of excess and reparation. It is a chronicle of one President from the elite intellectual classes of the East, and another from a county seat in the heartland. Woodrow Wilson was the college president whose contribution to the art of government lay in the principle of expertise and efficiency. When he went to war, he turned the machinery of government into a comprehensive and highly effective instrument for victory. For Wilson, it followed that there could be little tolerance for those who impeded the success of American arms by their anti-war propaganda, draft resistance, or ideological …

The Mountain Of A Thousand Holes: Shipwreck Traditions And Treasure Hunting On Oregon's North Coast, Cameron La Follette, Dennis Griffin, Douglas Deur

Anthropology Faculty Publications and Presentations

“Euro-Americans in coastal communities conflated and amplified Native American oral traditions of shipwrecks in Tillamook County, increasingly focusing on buried treasure,” write authors Cameron La Follette, Dennis Griffin and Douglas Deur. In this article, the authors trace the Euro-American blending of Native oral tradition with romances and adventure tales that helped create the “legends contributing to Neahkahnie [Mountain]'s reputation as Oregon's treasure-seeking haven.” They also examine the history of treasure-seeking in the area and describe the escalating conflict between Oregon's treasure-hunting statute and cultural resources protection laws, which led finally to statutory repeal that ended all treasure-hunting on state lands. …

Immigration As Commerce: A New Look At The Federal Immigration Power And The Constitution, Jennifer Gordon Jul 2018

Immigration As Commerce: A New Look At The Federal Immigration Power And The Constitution, Jennifer Gordon

Indiana Law Journal

When the United States government sets immigration law and policy, how much attention must it pay to constitutional rights? This question has been much debated since President Donald Trump issued a series of immigration-related executive orders in his first week in office, including a bar on entry by citizens of a set of majority-Muslim countries, but it was controversial long before then. In important part, the answer depends on what the Constitution says about the scope and limits of the power of the federal government over immigration. Therein lies the tale. On this subject, the country’s founding documents say very …

Rural Futures Institute: Publications

Conclusion

The proportion of rural Nebraskans accessing the Internet using their cell phone has increased compared to two years ago. But, the proportion subscribing to high-speed Internet service at home remained stable during the past two years. Persons living in or near the smallest communities are less likely than persons living in or near larger communities to have high-speed Internet service at home.

Not many rural Nebraskans report significant limitations from their home Internet service on their ability to do most tasks. At least one in ten report being limited significantly or not being able to play real time video …

Emotional Judges And Unlucky Juveniles, Ozkan Eren, Naci Mocan Jul 2018

Emotional Judges And Unlucky Juveniles, Ozkan Eren, Naci Mocan

Faculty Publications

Employing the universe of juvenile court decisions in a US state between 1996 and 2012, we analyze the effects of emotional shocks associated with unexpected outcomes of football games played by a prominent college team in the state. We find that unexpected losses increase sentence lengths assigned by judges during the week following the game. Unexpected wins, or losses that were expected to be close contests ex ante have no impact. The effects of these emotional shocks are asymmetrically borne by black defendants. The impact of upset losses on sentence lengths is larger for defendants if their cases are handled …

Research and development into drone technology has exploded in the United States in the recent decades. From the operation of killer drones in the military to agricultural survey drones in farms, the proliferation of drone technology is well on its way to radically altering the American future. However, there remains numerous laws, policies, and regulations that place stifling restrictions on drone development and operations in America. Halfway across the world, China has also begun to experience the "drone revolution," but with its relatively laxer laws regarding both commercial and public drone operations and manufacturing, it seems poised to surpass the …

The Narrative And Rhetoric Of Student Debt, Jonathan D. Glater Jul 2018

The Narrative And Rhetoric Of Student Debt, Jonathan D. Glater

Utah Law Review

The swirl of concerns about and criticisms of the cost of higher education and the debt burdens taken on by students masks a deeper confusion over the goals student aid should pursue and over reforms to enable achievement of those goals. This Article explores how the rhetoric used in public discussion of college cost and student borrowing can get in the way of what would be a difficult but critically important debate over goals. Higher education is a personal, private “investment” that must be “worth it” to the student; student “aid,” flexible loan repayment plans, even debt forgiveness, all aim …

Federal Sentencing Guidelines, Thomas D. Church

Mercer Law Review

In 2017, the United States Court of Appeals for the Eleventh Circuit continued its efforts to untangle the complex web of laws known as the Federal Sentencing Guidelines. The year saw a number of precedential decisions interpreting its provisions, including those governing specific offenses such as drug trafficking and fraud, as well as those setting forth the proper methodology for establishing a defendant's criminal history.

This Survey identifies and summarizes the important holdings from these decisions. Section II begins with the decisions reviewing an application of the Guidelines provisions for specific offenses, and the different enhancements available for certain classes …
