Heart Rate Dynamics During And After Simulated Fire Ground Tasks: Effects Of Physical Fitness And Training, Anssi Ilmari Saari Jan 2019

Heart Rate Dynamics During And After Simulated Fire Ground Tasks: Effects Of Physical Fitness And Training, Anssi Ilmari Saari

Theses and Dissertations--Kinesiology and Health Promotion

Firefighting is a strenuous occupation that increases the risk of cardiovascular events. Greater levels of physical fitness and training improve firefighters’ occupational performance, but little is known whether they are related to lower physiological stress and recovery from fire ground tasks. Heart rate, heart rate recovery and heart rate variability have been used to evaluate physical stress in association with exercise and fire ground tasks. However, there is a paucity of research evaluating the effects of physical fitness and training on heart rate dynamics during a simulated fire ground test (SFGT). Therefore, the primary purposes of this study were to …

Congress And The Independence Of Federal Law Enforcement, Andrew Kent Jan 2019

Congress And The Independence Of Federal Law Enforcement, Andrew Kent

Faculty Scholarship

Not since the Nixon presidency has the issue of the professional neutrality and independence of federal law enforcement from White House interference or misuse been such a pressing issue. This Article describes the problem, details Congress’s important role in responding to it during the 1970s, and makes specific recommendations for Congress today. As important background, this Article recounts the abuses of the Hoover era at the Federal Bureau of Investigation (“FBI”), and the ways the Nixon White House sought to both impede and corrupt the Department of Justice (“DOJ”) and the FBI. It then describes what an engaged Congress looked …

Could The Benefits Of The Public Service Loan Forgiveness Program Be Retroactively Curtailed?, Gregory S. Crespi Jan 2019

Could The Benefits Of The Public Service Loan Forgiveness Program Be Retroactively Curtailed?, Gregory S. Crespi

Faculty Journal Articles and Book Chapters

There is a sharp tension between the expectations that hundreds of thousands to millions of persons have or will have regarding their right to have their federal student loan debts forgiven under the Public Service Loan Forgiveness (“PSLF”) program and the legitimate public concerns regarding the large costs and regressive incidence of the PSLF program’s benefits. In 2017, the Trump Administration proposed abolishing the PSLF program for future federal Direct Loans, but this proposal was not adopted. A similar proposal was made in 2019 as part of the Administration’s fiscal 2020 budget proposal, with little chance of adoption. But given …

African American Males' Perception Of The Prince Georges' County (Md) Police And Improving The Relationship, Katija J. Ra'oof

Walden Dissertations and Doctoral Studies

The shootings and killings across the country of unarmed African American males by police officers, has become a topic of discussion. Previous research indicates that African American males, in comparison to other groups, are more likely to have adverse encounters with law enforcement officials. The purpose of this phenomenological study was to explore the experiences and perceptions of African American males in Prince Georges' County regarding encounters with the Prince Georges' County Police Department and how the relationship can improve. Max Weber's social action theory was used to examine perception and purposive sampling aided in gathering this information from a …

A Quantitative Analysis Of Re-Offense Among Delinquent Foster Care Youth In Georgia, Brian Keith Jones

Walden Dissertations and Doctoral Studies

Nationwide more than 2 million youth are placed in custody annually, approximately 80,000 children return home, and more than 70% have a diagnosable mental disorder. The purpose of this quantitative study was to examine the outcomes of 311 youth released from secure residential facilities in Georgia between January 2012 thru May 2017. In the dataset, 136 youth returned to regular homes, 128 returned to group homes (GC), and 47 returned to traditional foster homes (TFC). The goal of the study was to examine the differences in probation outcomes based on the type of placement. For the purpose of the study, …

The Use Of Compassionate Release Policies For Elderly Offenders, Lindsey Martin Jan 2019

The Use Of Compassionate Release Policies For Elderly Offenders, Lindsey Martin

Walden Dissertations and Doctoral Studies

This research examined the use of compassionate release policy in response to the fastest-increasing segment of the prison population- elderly offenders. Though this policy is an approach to this problem, there was little available research regarding which correctional organizations in the United States adopt compassionate release and how it is used. The purpose of this nonexperimental comparative quantitative study was to examine the use of the policy in neighboring and distant state correctional systems relative to those organizations that used the policy more frequently to determine if the leader-laggard theory of policy diffusion was an effective policy-implementation framework. The research …

Marijuana Legalization And Traffic Fatalities Involving Cannabinoids, Mark Lewn Hake Jan 2019

Marijuana Legalization And Traffic Fatalities Involving Cannabinoids, Mark Lewn Hake

Walden Dissertations and Doctoral Studies

Washington State and Colorado were the first states to legalize recreational marijuana. According to the Washington Traffic Safety Commission, the number of drivers who tested positive for marijuana in traffic fatalities increased 48% from 2013 to 2014, and marijuana legalization may have influenced this increase. Since marijuana legalization is new to the United States, the effects of this change in policy are untested in the literature. The purpose of this quantitative study using a regression point displacement design was to examine the relationship between traffic fatalities involving cannabinoids in Washington State before and after marijuana legalization. Rational choice theory and …

Accomplished Education Leaders' Perspectives On Competition, Capacity, Trust, And Quality, Robert Lee Williams Jan 2019

Accomplished Education Leaders' Perspectives On Competition, Capacity, Trust, And Quality, Robert Lee Williams

Walden Dissertations and Doctoral Studies

From 2017 to 2019, the primary strategy to improve public schools in the U.S. was increasing competition through the expansion of charter schools and the promotion of vouchers to send public school students to private schools. The problem this presented was that key education leaders had not provided adequate input and feedback into this strategy. The purpose of this qualitative study was to gather the perspectives of accomplished education leaders on how Tiebout's theory of competition and the concept of the Ontario K-12 School Effectiveness Framework impacted quality, trust, and capacity. Data were collected using semistructured interviews with a purposeful …

Dna Integrity In Forensic Samples, Samantha L. Ramey Jan 2019

Dna Integrity In Forensic Samples, Samantha L. Ramey

Graduate Student Theses, Dissertations, & Professional Papers

When packaged genetic evidence samples are stored in close proximity, there is a higher chance for cross-contamination, which can lead to potential false results. The goal of this study was to test DNA storage methods and environments to determine the best way to avoid potential cross-contamination. Established protocols for storing different types of genetic evidence samples were evaluated: biological swabs and DNA cards. A known concentration of pig DNA was introduced to the evidence samples. Three different evidence drying times of the DNA-free swabs and cards were implemented before packaging: immediate packaging, an hour drying, and 24 hours drying. The …

Doctrinal Dynamism, Borrowing, And The Relationship Between Rules And Rights, Joseph Blocher, Luke Morgan Jan 2019

Doctrinal Dynamism, Borrowing, And The Relationship Between Rules And Rights, Joseph Blocher, Luke Morgan

Faculty Scholarship

The study of "Rights Dynamism," exemplified in Timothy Zick' s new book on the First Amendment's relationship with the rest of the Bill of Rights, can enrich our understanding of constitutional rights. It also opens a door to another potentially fruitful arena: what we call "Doctrinal Dynamism." Constitutional rights often interact and generate new meanings and applications by way of importing and exporting one another's doctrinal rules, even when the rights themselves do not intersect directly in the context of a single case. Focusing on these doctrinal exchanges can illuminate the strengths and weaknesses of various rules, the specific interests …

State Standing And Cooperative Federalism, Ernest A. Young Jan 2019

State Standing And Cooperative Federalism, Ernest A. Young

Faculty Scholarship

State lawsuits challenging federal policy generally encounter arguments that the states lack standing to sue, either under Article III’s “case or controversy” clause or under various prudential standing doctrines. These arguments have often taken novel forms—such as claims that states’ injuries are “self-inflicted” or offset by other benefits of federal policies—that have few precedents or analogs in the standing jurisprudence governing suits by private individuals. The United States has taken the position, in other words, that states should have special disabilities in filing lawsuits that would not apply to ordinary litigants. Likewise, prominent academics have argued that uniquely narrow standing …

Federal Criminal Risk Assessment, Brandon L. Garrett Jan 2019

Federal Criminal Risk Assessment, Brandon L. Garrett

Faculty Scholarship

Risk assessments are a common feature of federal decisionmaking, including across a range of administrative agencies. However, in federal criminal law, risk assessments have been only haltingly adopted. Decisions regarding bail, sentences, and prison programming have largely been made based on official discretion. Risk assessment instruments are currently used in federal courts pretrial and postconviction, and in federal prisons regarding security levels and reentry, with highly uneven results to date. The adoption of the First Step Act, which has the ambition to transform the federal prison system through the use of risk instruments, has the potential to introduce a more …

Wealth, Equal Protection, And Due Process, Brandon L. Garrett Jan 2019

Wealth, Equal Protection, And Due Process, Brandon L. Garrett

Faculty Scholarship

Increasingly, constitutional litigation challenging wealth inequality focuses on the intersection of the Equal Protection and Due Process Clauses. That intersection—between equality and due process—deserves far more careful exploration. What I call “equal process” claims arise from a line of Supreme Court and lower court cases in which wealth inequality is the central concern. For example, the Supreme Court in Bearden v. Georgia conducted analysis of a claim that criminal defendants were treated differently based on wealth in which due process and equal protection principles converged. That equal process connection is at the forefront of a wave of national litigation concerning …

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey Fagan Jan 2019

The End Of Intuition-Based High-Crime Areas, Ben Grunwald, Jeffrey Fagan

Faculty Scholarship

In 2000, the Supreme Court held in Illinois v. Wardlow that a suspect’s presence in a “high-crime area” is relevant in determining whether an officer has reasonable suspicion to conduct an investigative stop. Despite the importance of the decision, the Court provided no guidance about what that standard means, and over fifteen years later, we still have no idea how police officers understand and apply it in practice. This Article conducts the first empirical analysis of Wardlow by examining data on over two million investigative stops conducted by the New York Police Department from 2007 to 2012.

Our results suggest …

Animal Welfare Act: Enforcement, Delcianna Winders, Varu Chilakamarri Jan 2019

Animal Welfare Act: Enforcement, Delcianna Winders, Varu Chilakamarri

Animal Law Review

Delcianna Winders discusses the Animal Welfare Act and how the United States Department of Agriculture enforces it. She also provides a critique of the USDA’s enforcement of the AWA, with particular attention to its heavy reliance on warnings and discounted penalties, which in many cases fail to deter regulated entities from violating the AWA. Varu Chilakamarri discusses how animal welfare issues are incorporated into the work of the Department of Justice (DOJ). She provides an overview of the AWA, noting the specific sections that provide for federal court review. Chilakamarri also discusses some of the programmatic steps the DOJ has …

2018 Federal Legislative Review, Anna Fugate Jan 2019

2018 Federal Legislative Review, Anna Fugate

Animal Law Review

2018 was a slow year for federal animal law legislation. Congress only signed the Endangered Salmon Predation Prevention Act into law, and that law permits the killing of sea lions to protect endangered salmon and steelhead populations. While Congress considered other animal legislation, none of this proposed legislation made it out of Congressional Committees and Subcommittees.

Stress Preparedness For Law Enforcement Officers Via Academic Training, Matthew Ridgeway Burke Jan 2019

Stress Preparedness For Law Enforcement Officers Via Academic Training, Matthew Ridgeway Burke

Walden Dissertations and Doctoral Studies

Most law enforcement officers experience a traumatic event within the first 3 years of duty but may not receive proper mental health training in the police academy to prepare them for a career in law enforcement, and little is understood about police academy training regarding mental health. Using secondary traumatic stress (STS) as a conceptual framework, the purpose of this qualitative study was to understand the perspective of law officers on the usefulness of academy training to prevent or manage mental health issues that may arise from law enforcement duty. Data were collected from 35 law enforcement officers in a …

The Ferguson Effect On Police Officers' Culture And Perceptions In Local Police Departments, Rarkimm K. Fields Jan 2019

The Ferguson Effect On Police Officers' Culture And Perceptions In Local Police Departments, Rarkimm K. Fields

Walden Dissertations and Doctoral Studies

The Ferguson effect is a recent hypothesis that suggests police officers have been influenced by negative media coverage of police conduct. The problem this study addressed is how policing continues to deal with perception, civil liability, and accountability issues related to police misconduct when interacting with Latino and African-American communities. The research was conducted to examine influence the Ferguson effect may have had on the culture and perceptions of police officers in local police departments. With a phenomenological qualitative approach, the research data were collected from interviews with 7 police officers across 3 police departments. The theoretical background of Merton's …

The Impact Of Critical Incident Team Training On Arrest And Diversion Rates, Richard Wayne Foss Jan 2019

The Impact Of Critical Incident Team Training On Arrest And Diversion Rates, Richard Wayne Foss

Walden Dissertations and Doctoral Studies

The Critical Incident Team (CIT) training program equips police officers with knowledge regarding mental illness and practical skills for effectively interacting with a mentally ill suspect. In addition to improving officer and suspect safety by decreasing the number of violent encounters between police and the mentally ill, CIT goals include reducing the number of mentally ill individuals who are arrested and providing them with assistance through community resources. However, there is a lack of empirical research on whether CIT training decreases arrest rates and increases diversion rates for mentally ill subjects. The purpose of this quantitative study was to measure …

Police Officers' Perceptions Of Changes In Their Behavior While Being Video Recorded, Steven Patrick Ufford Jan 2019

Police Officers' Perceptions Of Changes In Their Behavior While Being Video Recorded, Steven Patrick Ufford

Walden Dissertations and Doctoral Studies

Body worn cameras (BWCs) are a newer piece of equipment that has been issued to police officers in efforts to increase transparency and improve relations with the community. Researchers who have just recently begun studying the effects of BWCs have observed changes in behavior of officers who wear the equipment. Some of these changes potentially have an adverse effect on citizens and the officers who wear BWCs. Lipsky's street-level bureaucracy theory was utilized to examine police officer use of discretion when conducting field activities while wearing BWCs. The research question pertained to police officers' perceptions regarding changes in behavior while …
