Legal education forms part of America’s Critical Infrastructure whose continuity is important to the economy, public safety, democracy, and the national security of the United States. To address the COVID-19 pandemic and prepare for future viral pandemics and safety risks, this article recommends law schools develop a safety culture to foster health, safety, robust educational dialogue, and equity. To guide safety-and-equity-centered decision-making and promote effective legal education during and following the COVID-19 pandemic, this article contends legal education must put health, safety, and equity first. Dissertations and Theses
Nonprofit and voluntary organizations are part of the political economy that add to the services of public and private sectors by addressing civic interests, participation in democracy and providing social programs that improve quality of life. This sector is mostly comprised of small organizations whose impact is more than their budget size. At the advent of this study, information existed about the needs and capacity challenges of Oregon nonprofits in general but lacked specifics on smaller organizations, especially differentiating the urban rural distinction. The aim of this research was to explore the financial and human resource capacity of small nonprofit …

Emergency Department Closures: The Critical Case Of Reduced Care Accesswithin Rural Populations, Erene Shin, Jasmine Jaing, Orlando Caballero, Lauren Fujii, Elli Cooney
Silicon Valley Sociological Review
In this paper, the researchers analyzed the effects of overcrowding and financial difficulties faced by rural emergency departments, which can lead to closures. To achieve this goal, we relied on a systematic analysis of the rural emergency department system, including the financial aspects, ethical considerations, and patient demographics. The researchers also utilized past evaluated interventions in order to determine methods of creating an efficient emergency department. We found that while there was an increase in emergency department patients, finances have not increased to accommodate overcrowding. This paper contributes to emergency department and rural health literature, as the researchers propose an …

Through this case study analysis, the racial, social and fiscal aspects of the culture of policing are investigated between the years 2016 & 2020. The research here presents data on disparities within policing found at the national and local levels. …
Traveling Tolerances: English-Speaking Protestants Abroad After The Restoration, Lisa Clark Diller
Traveling Tolerances: English-Speaking Protestants Abroad After The Restoration, Lisa Clark Diller
Achieve
The debate over whether to tolerate Roman Catholics in England, and what any such toleration should look like, was especially lively after the Interregnum. The Act of Toleration did not, of course, include Roman Catholics, though there was widespread de facto freedom of worship for them after 1688. The scholarship of this conversation about toleration and its context is primarily rooted in conversations about political theology, the development of liberalism, and state formation. This paper begins and investigation into the ways in which travel observations and cultural comparisons rooted in international tourism might have shaped the views of English men …

Mindful yoga instruction refers to the concentration on the present moment in time (Germer, 2004) and consisting of yoga poses that involve stretching in combination with the inhalation and exhalation of the breath (Field, 2011). The yoga instruction was given to participants for ten minutes a day, every day, for a four-week long duration. This intervention was given by the classroom teacher (researcher) and was conducted before participants’ whole-group math lesson. The data collected reflects the impact …

Contract As Emergency Law, Xuan-Thao Nguyen
Contract As Emergency Law, Xuan-Thao Nguyen
Washington International Law Journal
This Article offers a new perspective of contract law as emergency law. Doctrines of impossibility, supervening events, force majeure, and good faith performance are core principles resiliently allowing parties to address contract nonperformance under state of emergency crises. Comparatively, China prefers drastic measures to confront contract nonperformance problems by issuing Certificates of Force Majeure, permitting Chinese companies to escape contract liability and forfeiting the resiliency of contract law as emergency law. The Article argues that the pandemic reaffirms the role of contract law as emergency law and urges governments to solidify the freedom to contract.

ETSU News
JOHNSON CITY — The Geoinformatics and Disaster Science (GADS) Lab at East Tennessee State University has received national recognition from FEMA, being featured in the federal agency’s Mitigation Planning Success Stories series. Currently, the online storymap only includes 13 stories nationally.
“To be featured in FEMA's Mitigation Success Stories is a huge deal since they only do a handful of these per month for the entire country,” said Andrew Joyner, director of the ETSU GADS Lab. “It means that ETSU's comprehensive hazard mitigation plan, approved in 2019, was among the best and most innovative plans approved by FEMA over …
To “Defund” The Police, Jessica M. Eaglin
To “Defund” The Police, Jessica M. Eaglin
Articles by Maurer Faculty
Much public debate circles around grassroots activists’ demand to “defund the police,” raised in public consciousness in the summer of 2020. Yet confusion about the demand is pervasive. This Essay adopts a literal interpretation of “defund” to clarify and distinguish four alternative, substantive policy positions that legal reforms related to police funding can validate. It argues that the policy debates between these positions exist on top of the ideological critique launched by grassroots activists, who use the term “defund the police” as a discursive tactic to make visible deeper transformations in government practices that normalize the structural marginalization of black …

What The Great Recession Revealed About Taxation By Citation And What Can Be Done About It, Dick M. Carpenter Ii, Chelsea Lawson, Courtney Deuser
University of Michigan Journal of Law Reform
In recent years, the issue of “taxation by citation” has grown in national prominence. It is generally defined as municipal revenue generation through fines and fees that transcends a clear relationship to public health and safety and serves more as a revenue generating device. According to critics, taxation by citation creates conflicts of interest, violates the rights of those with low income, and distorts law enforcement priorities. Municipal leaders reject such criticisms by denying taxation by citation even exists. To date, research findings have been mixed on whether cities practice taxation by citation. This Article examines whether there is a …
Loneliness / Togetherness : Interiority And Connection Under Isolation, Huaqin Chen
Loneliness / Togetherness : Interiority And Connection Under Isolation, Huaqin Chen
Masters Theses
Inhabitants’ perceptions can be greatly impacted when they are in an enforced space, a state of incarceration. That sense of confinement can cause mental or physical health issues on account of the loneliness, lack of interaction or confusion of time and space. Living through enforcement and isolation deeply affect human cognition and behavior. We can also easily find precedents of living through enforcement in the plots of films. By studying narrative, this thesis reconstructs domestic space by investigating the changes in our daily life after our current pandemic. A spatial sequence is created according to the relationwship among time, space …
Los Zetas, Neoliberalism, And Popular Opposition: A Study In Linkages, Gina R. Lyle
Los Zetas, Neoliberalism, And Popular Opposition: A Study In Linkages, Gina R. Lyle
Master's Theses
Los Zetas are considered by security analysts to be a transformative force within transnational criminal organizations (TCO), exporting their unique model throughout Mexico. Los Zetas’ idiosyncratic interventions include their diversification of criminal operations, professionalization of TCO security, sophisticated use of media and technology, extreme forms of violent coercion, and decentralized command structure. This project aims to complicate the narrative that Los Zetas emerged because of top leaders’ sadistic tendencies or due to an inherently violent culture in Mexico by reframing the group’s evolution within historical processes. Moving beyond Los Zetas, this project examines how persons affected by Los Zetas’ indiscriminate …

Mental Health Outcomes Of Various Types Of Fear Among University Students Who Have An Undocumented Legal Status During The Donald Trump Presidency, Liliana Campos
Doctoral Dissertations
Having an undocumented legal status is a risk factor for mental health conditions such as depression and anxiety among university students. Much of the literature on the experiences of university students who hold an undocumented legal status has primarily focused on better understanding the educational, social, financial, and legal challenges among undergraduate students. The literature has addressed how some of these difficulties impact components of their social and mental health wellness. Yet, there is still a dearth of research focused on further understanding the experiences of students who hold an undocumented legal status from a psychological perspective, and specifically, with …

Research Collection School Of Computing and Information Systems
Law enforcement agencies in dense urban environments, faced with a wide range of incidents to handle and limited manpower, are turning to data-driven AI to inform their policing strategy. In this paper we present a patrol scheduling system called GRAND-VISION: Ground Response Allocation and Deployment - Visualization, Simulation, and Optimization. The system employs deep learning to generate incident sets that are used to train a patrol schedule that can accommodate varying manpower, break times, manual pre-allocations, and a variety of spatio-temporal demand features. The complexity of the scenario results in a system with real world applicability, which we demonstrate through …
'Who' Or 'What' Is The Rule Of Law?, Steven L. Winter
'Who' Or 'What' Is The Rule Of Law?, Steven L. Winter
Law Faculty Research Publications
The standard account of the relation between democracy and the rule of law focuses on law’s liberty-enhancing role in constraining official action. This is a faint echo of the complex, constitutive relation between the two. The Greeks used one word – isonomia – to describe both. If democracy is the system in which people have an equal say in determining the rules that govern social life, then the rule of law is simultaneously before, after, concurrent and synonymous with democracy: It contributes to the formation of citizens with the capacity for self-governance, serves as the instrument through which democratic decisions …
