Weighing Pain: How The Harm Of Immigration Detention Must Be Factored In Custody Decisions, Linus Chan Jun 2021

Weighing Pain: How The Harm Of Immigration Detention Must Be Factored In Custody Decisions, Linus Chan

William & Mary Journal of Race, Gender, and Social Justice

The United States is currently in the midst of a “third wave of potential pretrial detention reform.” And while certain reforms are gaining traction in an effort to reduce pretrial criminal detention, efforts to do the same for immigration detention have lagged. Reformers and abolitionists make the case that immigration detention needs to be either restricted or eliminated entirely. Nonetheless, the number of people held in detention for immigration purposes rises year after year. Not only do the numbers of people in immigration detention grow, but the systems in place have grown less concerned with the harsh consequences of detention …

Sober Second Thought? Korematsu Reconsidered, Mark R. Killenbeck Jun 2021

Sober Second Thought? Korematsu Reconsidered, Mark R. Killenbeck

Arkansas Law Review

How to best describe and treat Korematsu v. United States? A self-inflicted wound? It is certainly an exemplar of a case that in key respects tracks Justice Stephen Breyer’s caution about decisions that have “harm[ed] not just the Court, but the Nation.” Part of an “Anticanon,” resting on “little more than naked racism and associated hokum” and “embod[ying] a set of propositions that all legitimate constitutional decisions must be prepared to refute”? Perhaps. Or is it simply an opinion and result that “has long stood out as a stain that is almost universally recognized as a shameful mistake”?

Guns In The Sky: Nevada's Firearm Laws, 1 October, And Next Steps, Dylan Lawter, Anya Sanko

Nevada Law Journal Forum

With incidences of high-profile mass shootings as well as daily gun violence continuing to rise throughout the United States, Nevada residents cannot help but wonder what the state is doing to stop and to prevent future incidents. Nevada has historically had permissive gun laws, being part of the “Wild West,” but in modern days, particularly since the 1 October shooting, Nevada legislators have enacted more gun laws. Additionally, judges and justices in Nevada courts have had to interpret new and old gun laws in novel ways, due to living in the modern era where gun violence seems to be the …

Adaptive Network Slicing In Fog Ran For Iot With Heterogeneous Latency And Computing Requirements: A Deep Reinforcement Learning Approach, Almuthanna Nassar

USF Tampa Graduate Theses and Dissertations

In view of the recent advances in Internet of Things (IoT) devices and the emerging new breed of smart city applications and intelligent vehicular systems driven by artificial intelligence, fog radio access network (F-RAN) has been recently introduced for the next generation wireless communications. The capability of F-RAN has emerged to overcome the latency limitations of cloud-RAN (C-RAN) and assure the quality-of-service (QoS) requirements of the ultra-reliable-low-latency-communication (URLLC) for IoT applications. To this end, fog nodes (FNs) are equipped with computing, signal processing and storage capabilities to extend the inherent operations and services of the cloud to the edge. However, …

Chemical and Materials Engineering Faculty Publications

The outbreak of the COVID-19 pandemic, in 2020, has accelerated the need for personal protective equipment (PPE) masks as one of the methods to reduce and/or eliminate transmission of the coronavirus across communities. Despite the availability of different coronavirus vaccines, it is still recommended by the Center of Disease Control and Prevention (CDC), World Health Organization (WHO), and local authorities to apply public safety measures including maintaining social distancing and wearing face masks. This includes individuals who have been fully vaccinated. Remarkable increase in scientific studies, along with manufacturing-related research and development investigations, have been performed in an attempt to …

Flying Free: A Research Overview Of Deep Learning In Drone Navigation Autonomy, Thomas Lee, Susan Mckeever, Jane Courtney

Articles

With the rise of Deep Learning approaches in computer vision applications, significant strides have been made towards vehicular autonomy. Research activity in autonomous drone navigation has increased rapidly in the past five years, and drones are moving fast towards the ultimate goal of near-complete autonomy. However, while much work in the area focuses on specific tasks in drone navigation, the contribution to the overall goal of autonomy is often not assessed, and a comprehensive overview is needed. In this work, a taxonomy of drone navigation autonomy is established by mapping the definitions of vehicular autonomy levels, as defined by the …

Tracking The Tracing: A Global Investigation Of Privacy Issues In The Age Of Covid-19, Jessie Miller Jun 2021

Tracking The Tracing: A Global Investigation Of Privacy Issues In The Age Of Covid-19, Jessie Miller

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

As the COVID-19 pandemic tore through the globe, policymakers grappled with two key questions. First, to what extent could new tools to collect and analyze data on a massive scale help limit the virus’s spread and, second, how would the collection of that data impact the privacy rights of individuals? This paper examines both questions and reveals how nation-specific traditions, values, and leaders shaped the delicate balance between the right to privacy and the protection of the population from COVID-19. An exploration of the surveillance techniques developed in response to the SARS and HIV pandemics reveals the growing consensus around …

A Balancing Act: Public Health, Covid-19, And The Economic Due Process “Right To Work”, Jennifer L. Piatt Jun 2021

A Balancing Act: Public Health, Covid-19, And The Economic Due Process “Right To Work”, Jennifer L. Piatt

Nebraska Law Bulletin (Selected Issues)

During the infamous Lochner era (1897–1937), courts invalidated hundreds of regulatory measures on economic liberty grounds, doing untold damage to public health. Two vehicles have recently emerged by which the Supreme Court could re-enter this long-dead line of “economic due process” jurisprudence: first, via challenges to particularly burdensome professional licensing requirements; and second, via challenges to business closure orders resulting from the COVID-19 pandemic. This article concludes that the Supreme Court’s re‑entry into the “right to work” conversation, albeit unlikely, could help prevent certain unduly burdensome licensing requirements from surviving simply on protectionist grounds. Nonetheless, to protect the public’s health, …

Corporate Sociopolitical Activism And Nonprofit Identity Orientation On An Individual's Likelihood To Support, Tara Duenas

University Honors Theses

The purpose of this study aims to identify whether corporate sociopolitical activism (CSA) as a marketing strategy impacts individual stakeholders and their likelihood to support (time, money, or for-profit partnership) a nonprofit who may have different identity orientations (collectivistic or relational). The two nonprofits that inspired this study are Portland State University (PSU) and SNACK BLOC. Both organizations vary greatly in size and have implemented CSA in response to police abolition within the past year and currently receive public funding. There are various organizational differences between these nonprofits but there has been a suggested link in research that an organization’s …

Petitions From The Grave: Why Federal Executions Are A Violation Of The Suspension Clause, Taran Wessells Jun 2021

Petitions From The Grave: Why Federal Executions Are A Violation Of The Suspension Clause, Taran Wessells

William & Mary Bill of Rights Journal

This Note will address the intersection of wrongful convictions, the federal death penalty, and habeas corpus to conclude that the federal death penalty is an unconstitutional violation of the Suspension Clause of the United States Constitution. Part I of this Note will establish that Congress may not suspend the writ of habeas corpus outside of wartime. Then, Part II will show that wrongfully convicted prisoners therefore have a constitutional right to a habeas petition if they discover new, exonerating evidence. Part III will argue that because executed prisoners cannot file a habeas petition for release, executing wrongfully convicted prisoners is …
