Metanarratives Of Traffic Policing, Jordan Blair Woods
Metanarratives Of Traffic Policing, Jordan Blair Woods
Connecticut Law Review
This Essay, written for the Commentary Issue on police and prison abolition, draws on principles of postmodern feminist and queer theory to evaluate the dominance of a police-reliant, “one-size-fits-all” model of traffic enforcement in the United States. Traffic stops are currently the most common interaction between police and civilians in the United States and are a persistent source of racial and economic injustice. This Essay theorizes the dominance of a police-reliant, one-size-fits-all model of traffic enforcement in terms of metanarratives of public order and public safety. As discussed, these metanarratives shape the structure of police agencies, the nature of the …

A Decarceral Cadence: Neurologic Music Therapy As An Abolitionist Project, Mallori D. Thompson, Richard A. Kirby
Connecticut Law Review
Because police and prison abolition must be approached while simultaneously improving quality of life, and thus reducing harm, abolitionist discourse should include health policies that regard the (de)regulation, use, and culture of addictive substances. This Essay calls for research into neurologic music therapy as a response to addiction, improving quality of life and paving the way for police and prison abolition.

Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield
Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield
Connecticut Law Review
This Essay presents the concept of “existential crime.” It argues that our notion of crime has conflated acts that challenge the racial premise on which a state is founded with acts that breach what Karim Murji (2009) calls “norms of propriety.”1 It argues that the conflation of these different types of social acts into our conceptualization of crime is a problem because this unnecessary and deliberate synthesis (1) privileges Western liberal philosophies that presume justice for everyone is achievable in states that were originally built on criteria for racial inclusion/exclusion, e.g., racial domination of one group over others; and (2) …

Improving Overweight And Over-Dimensional Logistics And Truck Routing, Jerry Kissick, Jerry Pigman, Jennifer Walton
Improving Overweight And Over-Dimensional Logistics And Truck Routing, Jerry Kissick, Jerry Pigman, Jennifer Walton
Kentucky Transportation Center Research Report
In 2012, the Kentucky Transportation Cabinet’s (KYTC) Division of Motor Carriers (DMC) issued 98,196 overweight or over-dimensional (OW/OD) permits. To determine whether a route can accommodate an OW/OD vehicle, analysts must have current and accurate data on construction schedules, road conditions, and detour routes, among other factors. This study documents processes used by DMC for permitting and routing OW/OD vehicles. It includes detailed flowcharts that capture each aspect analysts follow during the decision-making process. As part of this project, state transportation agency representatives from states bordering Kentucky (Illinois, Indiana, Ohio, West Virginia, Virginia, Tennessee, and Missouri) were interviewed to identify …

Voices From A Prison Pandemic: Lives Lost From Covid-19 At Lakeland Correctional, Kimberly Thomas
Voices From A Prison Pandemic: Lives Lost From Covid-19 At Lakeland Correctional, Kimberly Thomas
Articles
Coronavirus tore through jails and prisons like wildfire. In some states, more than half of the people incarcerated there tested positive for COVID-19; nearly 400,000 people in prison across the United States have tested positive. For people in prison, COVID-19 brought the loss of close friends, solitary confinement, loss of connection with family and programming, lack of information, and fear of contracting the virus. It has also reminded those who are incarcerated of the one-dimensional way in which people in prison are perceived. As stated by one collaborator, Cory Souders, "[s]o many men and women who come to prison are …

R. C. Bissonnette And The (Un)Constitutionality Of Consecutive Periods Of Parole Ineligibility For A Life Sentence: Why The Qcca Got It Right And Why Section 745.51 Should Never Be Re-Written, Adelina Iftene
Articles, Book Chapters, & Popular Press
This article reviews the constitutional arguments upheld by the QCCA in Bissonnette and weighs them against the challenges that trial judges have encountered in applying s. 745.51 since 2012. By drawing on a qualitative review of cases in which s. 745.51 has been applied, as well as Charter principles, sentencing case law, and international practices, this article posits that the QCCA was correct in its approach to s. 745.51, both in finding it unconstitutional and in finding that the provision should not be read down to render it constitutional. This article advances the central argument that, in the context of …

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett
Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett
Cardozo Law Review
Prosecutorial discretion in immigration enforcement stands at a crossroads. It was the centerpiece of Obama’s immigration policy after efforts to pass comprehensive immigration reform failed. Under the Trump administration, it was declared all but dead, replaced by an ethos of maximum enforcement. Biden has promised a return to the status quo ante, but the record of using prosecutorial discretion to accomplish humanitarian goals in immigration enforcement under Obama was, at best, mixed. Moreover, it is unclear whether Biden can depend on the availability of programs such as Deferred Action for Childhood Arrivals (DACA), Obama’s signature prosecutorial discretion program. Although the …
Rethinking Immigration Enforcement, Peter L. Markowitz
Rethinking Immigration Enforcement, Peter L. Markowitz
Articles
As the nation turns the page away from the dark chapter of President Trump's relentless assault on immigrants, it is time to take stock of the nation's unprecedented immigration enforcement regime. During its relatively short existence, the Immigration and Customs Enforcement agency (ICE) has deported more than twice as many people as were deported in the entire previous history of the United States. The human and fiscal costs of ICE's mass deportation agenda are astronomical, and there is almost universal agreement across the political spectrum that the United States' immigration enforcement apparatus is badly broken. That, however, is where the …

Use Of Public Benefits Over The First Year Of Pandemic: Exploring Access, Delays And Outcomes, Sam Bufe, Stephen Roll, Katie Kristensen, Dan Zhao, Mathieu Despard, Michal Grinstein-Weiss
Social Policy Institute Research
In response to the economic crisis caused by the COVID-19 pandemic, the U.S. federal government enacted initiatives designed to help households weather the pandemic’s effects. These initiatives included expansions of existing programs, such as unemployment insurance, as well as new programs like the economic impact payments. In this brief, we investigate the extent to which households relied on an array of public benefit programs over the course of the pandemic, how they used their economic impact payments, and the extent to which the unemployment insurance expansion was effective in insulating recipients from hardship during the pandemic.
We find that, in …

Sexual Assault Enablers, Institutional Complicity, And The Crime Of Omission, Amos N. Guiora
Utah Law Faculty Scholarship
Sex abuse, particularly of children, is a crime which any rational person would wish to prevent. However, when an individual’s loyalties and responsibilities to an institution put them at odds with preventing sex abuse, it is far too often the institution which takes precedence. This is the grim phenomenon of institutional complicity. It is a plague which, sadly, permeates institutions of all types, be it a school, hospital, sports team, church, military, or government agency. It also permeates countries as a global issue.
I have interviewed dozens of survivors who suffered under an abuser who was protected by an institution. …
Scrutiny-Determination Avoidance In First Amendment Cases: Laudable Minimalism Or Condemnable Evasion?, Clay Calvert
Scrutiny-Determination Avoidance In First Amendment Cases: Laudable Minimalism Or Condemnable Evasion?, Clay Calvert
Nevada Law Journal
This Article examines the United States Supreme Court’s practice in First Amendment cases of not resolving the precise level of scrutiny that applies to measure a statute’s validity. Rather than opting for one of two tiers of scrutiny— one more rigorous than the other—the Court sometimes dodges the issue. It does this by concluding that a statute would not pass muster under the more lenient standard, thereby rendering it unnecessary to decide which test was, in fact, more appropriate. The Court thus adopts an “assuming-without-deciding” logic in such cases, simply supposing the lesser standard applies without definitively holding as much. …

A Two-Step Polynomial And Nonlinear Growth Approach For Modeling Covid-19 Cases In Mexico, Rafael Perez Abreu C., Samantha Estrada, Hector De-La-Torre-Gutierrez
Psychology Faculty Publications and Presentations
Since December 2019, the novel coronavirus (SARS-CoV-2) and its associated illness COVID-19 have rapidly spread worldwide. The Mexican government has implemented public safety measures to minimize the spread of the virus. In this paper, we used statistical models in two stages to estimate the total number of coronavirus (COVID-19) cases per day at the state and national levels in Mexico. In this paper, we propose two types of models. First, a polynomial model of the growth for the first part of the outbreak until the inflection point of the pandemic curve and then a second nonlinear growth model used to …
