On August 13, 2020, Portland State University President Stephen Percy announced two key changes in the University’s approach to campus public safety: first, Campus Public Safety officers would begin to patrol the campus without firearms and, second, a new Reimagine Campus Safety Committee (RCSC) would convene during the 2020-21 academic year to make a comprehensive set of recommendations for additional changes to the University’s approach to campus safety, security, welcoming, and belonging. In that announcement, President Percy introduced a four-person Steering Committee for the RCSC (Jose Coll, dean of the School of Social Work; Vicki Reitenauer, faculty member in Women, …

A Field Study On Lidar Sensor For Unmanned Ground Vehicle Navigation Application In Precision Agriculture, Breeya Pederson
Agribusiness and Biosystems Engineering
LiDAR sensor’s mapping and detection abilities make these sensors an important tool for research on navigation and object detection for robots and vehicles. This study used a ground robot and LiDAR sensor to collect navigational data sets from North Dakota State University Research Extension Center agricultural test plots in Carrington, ND. Three different height and angle combinations were used to study the factors that could potentially affect object detection. Three trials were run for each sensor placement and recorded the distance the laser pulse traveled and the intensity of the laser. The analysis results showed that the data did not …
Can Brazilian Jiu Jitsu Be A Viable Treatment Option For Law Enforcement Officers With Ptsd?, Megan Rinderer
Can Brazilian Jiu Jitsu Be A Viable Treatment Option For Law Enforcement Officers With Ptsd?, Megan Rinderer
Graduate School of Professional Psychology: Doctoral Papers and Masters Projects
Law enforcement officers (LEO) are more likely to experience symptoms of PTSD when compared to the general population yet are less likely to seek mental health treatment (Jetelina et al., 2020). Given that LEO face unique occupational stressors and repeated exposure to traumatic events, treatment for PTSD among law enforcement populations poses unique challenges for clinicians. The combination of these variables precludes officers from seeking and receiving mental health services. Research regarding the efficacy of Brazilian Jiu Jitsu (BJJ) as a psychotherapeutic intervention is limited. To date, no studies have examined the use of BJJ to mitigate symptoms of PTSD …
Punitive Surveillance, Kate Weisburd
Punitive Surveillance, Kate Weisburd

Budget constraints, bipartisan desire to address mass incarceration, and the COVID-19 crisis in prisons have triggered state and federal officials to seek alternatives to incarceration. As a result, invasive electronic surveillance—such as GPS-equipped ankle monitors, smartphone tracking, and suspicionless searches of electronic devices—is often touted as a humane substitute for incarceration. This type of monitoring, which I term “punitive surveillance,” allows government officials, law enforcement, and for-profit companies to track, record, search, and analyze the location, biometric data, and other meta-data of thousands of people on probation and parole. With virtually no legal oversight or restraint, punitive surveillance deprives people …
The Immigrant Struggle For Effective Counsel: An Empirical Assessment, Jayanth K. Krishnan
The Immigrant Struggle For Effective Counsel: An Empirical Assessment, Jayanth K. Krishnan

Recently, in Department of Homeland Security v. Thuraissigiam, the Supreme Court upheld 8 U.S.C. § 1252(e)(2), a statutory provision placing restrictions on certain noncitizens from seeking habeas review in the federal judiciary. The Court focused on the Constitution’s Suspension Clause, but it also discussed the Due Process Clause, declaring that there was no violation there either.
One question which flows from this decision is whether the federal courts will soon be precluded from hearing other types of claims brought by noncitizens. Consider ineffective assistance of counsel petitions, which in the immigration law context are rooted in the Due Process Clause. …

New Originalism: Arizona's Founding Progressives On Extreme Punishment, John Mills, Aliya Sternstein
Faculty Scholarship
Originalism, together with textualism, has been of growing interest to legal scholars and jurists alike. Discerning and putting forth the views of “the founders” has become part and parcel of effective advocacy, particularly regarding constitutional questions. Arizona is no exception, with its courts explicitly giving originalism primacy over all other interpretive doctrines for discerning the meaning of an ambiguous provision of its Constitution.
Yet, the Arizona state courts have not engaged with the views of the state’s founders on key issues concerning the purposes of punishment, as demonstrated by the founders’ words and deeds. Arizona was founded in 1912 as …

The New Normal: Regulatory Dysfunction As Policymaking, Ming Hsu Chen, Daimeon Shanks
The New Normal: Regulatory Dysfunction As Policymaking, Ming Hsu Chen, Daimeon Shanks
Faculty Scholarship
Scholars often presume that administrative dysfunction is a deviation from the norm of regularity in administrative law. This presumption is reinforced by courts who defer to agencies on the basis of a legal fiction of idealized regularity. In reality, irregularities are common in policymaking and they make agencies vulnerable to dysfunction. Irregularities are not bugs, but features of the administrative state. Sometimes, a national emergency makes political influence unavoidable and urges departures from usual regulatory processes. At other times, however, the framing of a problem as a national emergency is a pretextual justification to pursue a pre- determined political goal …
Colorblind Nationalism And The Limits Of Liberalism, Ming Hsu Chen
Colorblind Nationalism And The Limits Of Liberalism, Ming Hsu Chen

Policymakers and lawyers posit formal citizenship as the key to inclusion. Rather than presume that formal citizenship will necessarily promote equality, this Article examines the relationship between citizenship, racial equality, and nationalism. It asks: What role does formal citizenship play in excluding noncitizens and Asian, Latinx, and Muslim citizens racialized as foreigners? What effects does it have on the meaning of being American as a non-White citizen? The Article argues that commitments to colorblind equality and democratic self-governance of the nation stand in contradiction to aspirations to protect all persons within the nation. Consequently, individual rights designed to remedy racial …

Every state has a set of transparency statutes that bind state and local governments. In theory, these statutes apply with equal force to every agency. Yet, in practice, law enforcement agencies enjoy a wide variety of unique secrecy protections denied to other government entities. Legislators write police-specific exemptions into public records laws. Judges develop procedural approaches that they apply exclusively to police and prosecutorial records. Police departments claim special secrecy protections from the bottom up. This Article maps the legal infrastructure of police-records secrecy. It draws upon the text of the public records statutes in all fifty states, along with …

Few contest the importance of a robust transparency regime in a democratic system of government. In the United States, the “crown jewel” of this regime is the Freedom of Information Act (FOIA). Yet despite widespread agreement about the importance of transparency in government, few are satisfied with FOIA. Since its enactment, the statute has engendered criticism from transparency advocates and critics alike for insufficiently serving the needs of both the public and the government. Legal scholars have widely documented these flaws in the federal public records law. In contrast, scholars have paid comparatively little attention to transparency laws at the …

Assessing The Potential And Pathways For Renewable Energy Transformations In Orleans, California, Malcolm Prescott Moncheur De Rieudotte
Cal Poly Humboldt theses and projects
In what is now known as the state of California in the United States, the Karuk Tribe is interested in deploying a renewable-powered microgrid in the rural community of Orleans to improve electricity system reliability and resilience to address a wide range of challenges, including extreme events such as wildfires. This study assesses the potential of local distributed renewable energy and battery storage to meet Orleans' energy needs today and in the increasingly electrified future using an energy model. It also identifies existing cultural and social priorities for energy technology along with structural barriers to renewable energy adoption and the …

American Surrogacy: Babies For Sale?, Madison Edwards
American Surrogacy: Babies For Sale?, Madison Edwards
Honors Projects
More surrogacy contracts are fulfilled in the United States than in any other country (Bromfield, 2016, p. 193). In 2014, there were approximately 2,000 surrogacy arrangements in the U.S., yet the market is totally unregulated (Shellnutt and Grizzle, 2018, p. 31). Given that 1 in 6 American couples face infertility, there will continue to be a demand for alternative and assisted reproductive options (Shellnutt and Grizzle, 2018, p. 34). This paper seeks to explore several areas of surrogacy, including contract enforcement, potential problems parties in surrogacy agreements face, current legislation, the role of religion in surrogacy, and specific case studies. …

Legal Introspection Towards The Development Of Right To Privacy As Fundamental Right In India, Payal Thaorey
Legal Introspection Towards The Development Of Right To Privacy As Fundamental Right In India, Payal Thaorey
Indonesia Law Review
Privacy of the individual is an essential aspect of dignity. The ability of the individual to protect a zone of privacy enables the realization of the full value of life and liberty. Liberty has a broader meaning of which privacy is a subset. All liberties may not be exercised in privacy. Yet others can be fulfilled only within a private space. Privacy enables the individual to retain the autonomy of the body and mind. The autonomy of the individual is the ability to make decisions on vital matters of concern to life. The journey of right to privacy has been …

Police Officer Political Identity And Their Opinions Of Public Protests, Lois V. Woods, Kimberly K. Blackmon
Journal of Criminal Justice and Law
Purpose: Controversy surrounding the BLM movement and the insurrection at the US Capitol on January 6, 2021, has been felt even within the ranks of policing. Participation of police officers in the Capitol riot seemed to be at odds with the duty and responsibility of those officers who sustained serious injuries that day. Method: Using data collected from active law enforcement officers, the current study examines how political identity may play a role in a police officer’s perceptions of law enforcement engagement in political protests. Results: The only significant difference found was police refraining from engaging in or participating with …

The Effect Of Corporate Social Responsibility On Brand Awareness: Evidence From The Insurance Sector In Zimbabwe, Kudzaishe Charlotte Gaura, Wilbert Manyanga, Lovemore Chikazhe
Journal of Marketing and Consumer Behaviour in Emerging Markets
The aim of this study was to establish the eff ect of corporate social responsibility (donations, sponsorship and community involvement) on brand awareness within the insurance sector in Zimbabwe. Data was gathered from 350 insurance customers using a structured questionnaire with Likert-type questions. The fi ndings show that corporate social responsibility positively infl uences brand awareness. The study contributes to studies that proved a signifi cant relationship between corporate social responsibility and brand awareness in sectors other than the insurance sector. Thus, insurance fi rms are advised to seriously plough back proceeds to their communities

This research report presents the findings from the implementation assessment of the NYC Mayor's Action Plan for Neighborhood Safety (MAP). Researchers from the John Jay College of Criminal Justice relied on an assortment of evaluation data to identify outcome differences between MAP communities and the matched set of comparison communities. Using administrative and survey data, researchers tested relationships between the various efforts of MAP and key outcomes expected to result from those efforts. Information obtained through interviews and observations provided context to understand the evolution and implementation of MAP. The investigation provided policymakers with important information about the possible effectiveness …

Peer Effects And Recidivism: The Role Of Race And Age, Kegon Teng Kok Tan, Mariyana Zapryanova
Economics: Faculty Publications
Recidivism rates are a growing concern due to the high cost of imprisonment and the high rate of ex-prisoners returning back to prison. One policy-relevant and potentially important determinant of recidivism is the composition of peer inmates. In this paper, we study the role of peer effects within a correctional facility using data on almost 80,000 individuals serving time in Georgia. We exploit randomness in peer-composition over time within prisons to identify effects of peers on recidivism rates. We find no evidence of peer effects for property or drug-related crimes in the general prison population. However, we find strong peer …

Think Nationally, Act Locally: Cities And The Struggle For Social Justice, Harold Mcdougall
Think Nationally, Act Locally: Cities And The Struggle For Social Justice, Harold Mcdougall
San Diego Law Review
Liberals and progressives typically look to the national government to make policy aimed at achieving social justice. Historically, that is not without reason. As Professor Kathleen Morris of Golden Gate University School of Law put it in a recent email exchange, "social elites reached for the federal level in large part because the states and localities proved themselves to be genuinely terrifying to marginalized folks between 1860 and 1980.”
Few things remain constant in the struggle for social justice, however. The liberal and progressive national focus backfired as conservative and right-wing forces built power in state legislatures, enabling them to …

Policy And Polity: Space, Boundaries, And Governance In Early Modern London, 1580-1640, Michael Britton
Dissertations - ALL
The kingdom's principal city for law, governance, trade, and consumption, early modern London experienced a period of rapid growth and sprawl from the mid-sixteenth century. This nurtured more dense and frequent mobility and produced a dynamic, kinetic city. For civic authorities, however, boundaries took on greater urgence. Drawing on theories and principles of border studies, this dissertation treats the city's boundaries as processes forged and transformed by engagement, by the interplay between popular activity, political programs, and perceptions of space and authority. Policy and Polity, Space, Boundaries, and Governance in Early Modern London, 1580-1640 examines bordering at London Bridge, the …

Police Use Of Social Media Technologies, Akpomudiare Darlynton Adegor
Theses and Dissertations
This study used a qualitative research design to analyze how the Little Rock Police Department (LRPD) utilizes social media technologies to promote its community policing philosophy. I conducted a content analysis on 586 tweets by LRPD and 992 public responses posted between May 2020 and May 2021. From my analysis, I found that LRPD social media platforms support both community policing and problem-solving. LRPD uses social media for interactions, connections, and partnerships with community members. The second notable finding was that the public is responsive and receptive to LRPD’s use of social media to connect with them. However, LRPD’s level …
Commodifying Marginalization, Abbye Atkinson
Commodifying Marginalization, Abbye Atkinson

Pillars of U.S. social provision, public pension funds rely significantly on private investment to meet their chronically underfunded promises to America’s workers. Dependent on investment returns, pension funds are increasingly investing in marginalized debt, namely the array of high-interest-rate, subprime, risky debt—including small-dollar installment loans and other forms of subprime debt—that tends to concentrate in and among historically marginalized communities, often to catastrophic effect. Marginalized debt is a valuable investment because its characteristically high interest rates and myriad fees engender higher returns. In turn, higher returns ostensibly mean greater retirement security for ordinary workers who are themselves economically vulnerable in …
