The Failures Of Good Moral Character Determinations For Naturalization, Zachary New

This Article examines the effects of the good-moral-character requirement in naturalization proceedings. Specifically, it looks to such character requirements as a method by which a citizen polity screens out undesirable noncitizens from those who are deserving of inclusion in the "in"g roup of citizenship. The Article discusses historical methods of good-moral-character adjudication, and especially how such methods carried an undercurrent of forgiveness and redemption-an undercurrent lacking in the current method of statutory bars to showings of good moral character. By looking at specific examples of statutory bars to showings of good moral character, this Article argues that the overinclusive nature …

In 2019, the Governor of California vowed to fundamentally transform the state’s youth justice system. The legislature endorsed this commitment by enacting SB 823, which began a phased closure of state-run youth prisons in 2021. California is not the first state—nor will it be the last—to close facilities in light of decreased youth crime and greater awareness of the harms associated with incarceration. Although a welcomed development, the closure of youth prisons should not be viewed as the culmination of reform; rather, it is only the beginning. To achieve far more impactful change, state and local jurisdictions must confront the …

Over the years, innovations such as community-oriented policing, problem-oriented policing, and crime analysis have helped police agencies control, reduce, and prevent crime and disorder, and improve police and community relations. However, research shows that some officers are resistant to using these innovations in practice. Few studies have examined the causal mechanisms behind innovation resistance. This doctoral dissertation details a study that utilized a mixed method approach to partially test a framework that encompassed two theories to explain officer resistance to innovation: The Model of Consumer Resistance to Innovation from the consumer psychology and marketing fields (Ram & Sheth, 1989), and …

Fentanyl is an opioid that is about 100 times more potent than morphine, and its analogs are just as potent, and some like carfentanil are even more so potent. In recent years, fentanyl and its analogs have been responsible for over 50% of overdose-related deaths. In response, the DEA has placed all fentanyl analogs as Schedule I compounds because of their non-medicinal use and high potential for abuse and physical dependence. However, fentanyl analogs have high structural and mass spectral similarities due to the extremely conservative nature of the core fentanyl structure, which makes the differentiation and identification of fentanyl …

IoT (Internet of Things) devices have become increasingly popular in recent years while WiFi continues to serve as primary network provider indoors. With the advancements in technology, the networks of IoT devices continue to weave closely with indoor WiFi network deployments. Both kinds of these networks primarily operate in 2.4 GHz ISM Band (though latest WiFi standards can operate in 5 GHz and 60 GHz bands, too). With the multitude of tiny IoT sensors being deployed indoors alongside operational WiFi networks, severe interference scenarios cannot be ruled out. The growing academic literature around freedom of thought, conscience, and religion has stretched the topic to many arenas and offered a detailed analysis of its relevance to numerous related concerns. It has, rightly, gone beyond a theoretical consideration as an individual right to also examining it within the community and society at large. This Article, however, assesses whether we need to return to ensuring that freedom of thought, conscience, and religion rest on a sufficiently close nexus with the conviction of particular claimant(s), and why this matters.

This article examines the political reasons for the expansion of alternatives to detention (ATD) for immigrants under President Joe Biden’s administration. Enrollment in ATDs has doubled since the beginning of Biden’s presidency in January 2021, a stark growth after over ⅔ of voters polled by the ACLU said they would support the elimination of private immigrant detention centers. To understand the growth of ATD, I analyze the bipartisan expansion of immigrant detention and militarization of the U.S. Mexico border, discussing the Democratic Party’s history of criminalizing immigrants and bolstering surveillance in service of racist notions of “national security.” I then …

In the 21st century, cyber-based attackers such as advance persistent threats are leveraging bots in the form of botnets to conduct a plethora of cyber-attacks. While there are several social engineering techniques used to get targets to unknowingly download these bots, it is the command-and-control techniques advance persistent threats use to control their bots that is of critical interest to the author. In this research paper, the author aims to develop a command-and-control microservice application programming interface infrastructure to facilitate botnet command-and-control attack simulations. The proliferation of “smart technologies” has created significant opportunities to leverage data to improve everyday life across sectors. In cities around the world, local governments and private enterprises, often partnering together, have launched projects that integrate smart technologies with Internet of Things (“IoT”) capabilities into public spaces in order to promote efficiency, safety, mobility, and innovation. Pretrial detention has become normative in contemporary criminal justice, rather than the exception to a rule of release for individuals not convicted of any crime. Even the opportunity for release with a bond amount often eludes the many individuals who are unable to afford, to pay. Defendants detained, pending trial suffer numerous negative consequences to their own legal cases, such as being more likely to feel pressured to plead guilty and to receive a prison sentence. The high numbers of those detained appear to disproportionately impact minorities and. have contributed to mass incarceration. As a. result, of these issues, the …

Environmental justice screening and mapping tools visually depict the distribution of environmental justice burden across a geographic area. How that burden is measured varies according to location—different communities face different challenges, and a mapping tool that represents the landscape of environmental justice in one community may not adequately capture the distribution of EJ burden in another area. Who decides what “burden” means for each community? In this study of environmental justice in New Haven, CT, I argue that it is residents and local community leaders whose perspectives are most critical to how environmental justice is defined. Abolishing The Evidence-Based Paradigm, Erin Collins

The belief that policies and procedures should be data-driven and “evidence-based” has become criminal law’s leading paradigm for reform. This evidence-based paradigm, which promotes quantitative data collection and empirical analysis to shape and assess reforms, has been widely embraced for its potential to cure the emotional and political pathologies that led to mass incarceration. It has influenced reforms across the criminal procedure spectrum, from predictive policing through actuarial sentencing. The paradigm’s appeal is clear: it promises an objective approach that lets data – not politics – lead the way and purports to have no agenda beyond identifying effective, efficient reforms. …

This qualitative study was conducted to investigate the impact COVID-19 had on teachers’ instructional practices, technology preparedness, and social and emotional well-being. The results of this study can be used to inform school leaders, administrators, and teachers about methods to support teachers who teach during a worldwide crisis. The study was conducted utilizing a survey instrument and interviews. The survey and interviews indicated that COVID-19 affected teachers who taught virtually during the COVID-19 pandemic. The survey and interview participants identified supports that teachers needed to have in order to successfully teach virtually during a pandemic, such as technology, professional development …

This article considers the extensive repressive measures enacted around the world during and in the wake of the First World War. While repressive developments in the World War I and post-war periods have previously been examined in different national contexts, little scholarship has adopted a more global lens.
