Understanding The Relationship Between Black Chicago Youth And Chicago Drill Music Culture, Dan'iel Tamirra Kendricks Apr 2022

Understanding The Relationship Between Black Chicago Youth And Chicago Drill Music Culture, Dan'iel Tamirra Kendricks

Dissertations

Chicago is most noted as a beautiful, Midwestern city, set to the backdrop of Lake Michigan, with skyscrapers and the bustling energy of the downtown Magnificent Mile. The “Tale of Two Cities,” Chicago is a city full of hope, opportunity, and potential for some, but a city plagued with poverty, violence, disinvestment, and hopelessness for others. There has been a significant increase in the awareness of the violence happening across Chicago. The emergence of social media has provided a direct and unfiltered view of the reality of violence the city has faced on an ongoing basis. Crimes such as shootings, …

Prosecutorial Nonenforcement And Residual Criminalization, Justin Murray Apr 2022

Prosecutorial Nonenforcement And Residual Criminalization, Justin Murray

Articles & Chapters

In recent years a small but influential group of locally elected prosecutors committed to criminal justice reform have openly refused to enforce various criminal laws—laws prohibiting marijuana possession, sentence enhancements, laws authorizing the death penalty, and much more—because they see those laws as unjust and incompatible with core reform objectives. Condemned by many on the political right for allegedly usurping the legislature’s lawmaking role and praised by many on the left for bypassing dysfunctional state legislatures in favor of local solutions, these prosecutorial nonenforcement policies are commonly said to have the same effect as nullifying, or even repealing, the laws …

Second Amendment Realism, Michael R. Ulrich Apr 2022

Second Amendment Realism, Michael R. Ulrich

Cardozo Law Review

In District of Columbia v. Heller, the Supreme Court declared a constitutionally protected individual right to keep and bear arms. Subsequently, the scope of the right has been hotly debated, resulting in circuit splits and lingering questions about what, exactly, the right entails. Despite these splits, the Court has denied certiorari to the myriad gun cases to land on its doorstep. But the balance of the Court has shifted and, so too, has its willingness to hear these cases. Among the most pressing questions in Second Amendment jurisprudence is the constitutionality of public carry restrictions. With the Court set …

A Transcendental Phenomenological Study Of Mental Health Symptoms And Awareness In The College Student Population, Stephanie Ann (Hare) Wallace Apr 2022

A Transcendental Phenomenological Study Of Mental Health Symptoms And Awareness In The College Student Population, Stephanie Ann (Hare) Wallace

Doctoral Dissertations and Projects

The purpose of this transcendental phenomenological study was to understand mental health concerns and the services provided within the college population located at an on-ground campus in the United States. The theories guiding this study were Schlossberg’s transition theory and self-efficacy theory, which play a major role in understanding the concerns and heightened symptoms students faced when transitioning into the college setting. The transcendental phenomenological study focused on gathering data from sophomore students enrolled at Rose College who have recently faced the transition from high school or undergraduate settings. The setting took place virtually due to restrictions and limitations of …

Strategies To Improve Communication In Healthcare: An Integrative Review, Tracy Lynn Macdonald

Doctoral Dissertations and Projects

The purpose of this integrative review is to research, analyze, critique, and synthesize current literature to determine current practice of communication within healthcare. Communication errors continue to have a negative impact on patient outcomes, so this literature review will consider current strategies to improve communication, and thus improve patient outcomes. Several themes were identified as strategies to improve communication. Although there is abundant research on the topic of communication in healthcare, there is still a need for further adoption and implementation of various communication strategies, as well as a need for further evaluation to determine if these strategies do improve …

The Pandemic's Impact On The Efficacy Of Chaplaincy At The Baldwin State Prison, John Gomez Apr 2022

The Pandemic's Impact On The Efficacy Of Chaplaincy At The Baldwin State Prison, John Gomez

Doctoral Dissertations and Projects

Chaplains usually provide pastoral care for inmates, staff members, and counseling for offenders and offenders’ families. Because of the pandemic, they have not provided adequate pastoral care and counseling in their respective facilities. The restrictions imposed by the pandemic have negatively impacted the chaplain’s ability to adequately provide pastoral care and counseling in most federal and state correctional institutions. The Department of Georgia Correctional facilities, particularly at the Baldwin State prison, has also experienced this decrease in pastoral care and counseling due to the pandemic. In the Georgia Department of Corrections, all visitations, including lawyers and clergy, have been suspended …

The Significance Of Trauma In The Relationship Between Co-Occurring Disorders And Recidivism Among Participants Of A Community Mental Health's Jail Diversion Program, Emily A. Schott Apr 2022

The Significance Of Trauma In The Relationship Between Co-Occurring Disorders And Recidivism Among Participants Of A Community Mental Health's Jail Diversion Program, Emily A. Schott

Doctoral Dissertations and Projects

Abstract Individuals with a psychiatric diagnosis have higher levels of criminal justice involvement compared to the general population. Multiple programs have been developed through grant monies utilizing various models to allow these individuals to be linked to mental health services in the community for the treatment of symptoms which may contribute to recidivism. These programs are designed to provide an encounter with mental health professionals who collaborate with law enforcement and other agencies to intercept these individuals at various points of justice involvement and possibly prevent further entanglements with the legal system. This study explores how trauma may impact justice …

Inside The Black Box Of Prosecutor Discretion, Shima Baradaran Baughman, Megan S. Wright, Christopher T. Robertson

Faculty Scholarship

In their charging and bargaining decisions, prosecutors have unparalleled and nearly-unchecked discretion that leads to incarceration or freedom for millions of Americans each year. More than courts, legislators, or any other justice system player, in the aggregate prosecutors’ choices are the key drivers of outcomes, whether the rates of mass incarceration or the degree of racial disparities in justice. To date, there is precious little empirical research on how prosecutors exercise their breathtaking discretion. We do not know whether they consistently charge like cases alike or whether crime is in the eye of the beholder. We do not know what …

The Firearm Preemption Phenomenon, Rachel Simon Apr 2022

The Firearm Preemption Phenomenon, Rachel Simon

Cardozo Law Review

Forty-five states have adopted express preemption statutes curtailing or entirely prohibiting local gun regulation, and several jurisdictions now threaten localities with penalties for violating such restrictions. These measures have been remarkably effective in reducing the breadth and variety of gun laws nationwide, but their consequences have only just begun to attract attention. Public debates over guns tend to center on the Second Amendment while overlooking state-level obstacles to local lawmaking, and the scholarship on state-local preemption lacks an analysis devoted exclusively to the gun-policy space.

To fill these gaps, this Article provides a comprehensive account of the firearm preemption phenomenon. …

Publications and Research

Most New York City neighborhoods did not experience high rates of shootings in recent years, but others clearly did. Comparing crime rates across these relatively small geographic areas is important for officials considering where to invest in resources that support public safety and community wellbeing.

The Contemporary American Juvenile Justice System: Revisiting Parens Patriae, Katarzyna Celinska, Amina Cheboubi Apr 2022

The Contemporary American Juvenile Justice System: Revisiting Parens Patriae, Katarzyna Celinska, Amina Cheboubi

Publications and Research

The American juvenile justice system has undergone significant transformations since its inception in the late 19th century. In this paper, the authors seek to analyze the historical context of and subsequent reforms to the juvenile system and process in order to determine whether they remain true to their origins of the legal doctrine of parens patriae. Specifically, the authors contrast rehabilitative notions of parens patriae with the “tough on crime” perspective that developed in the 1990s in response to rising crime rates. This debate is illustrated by landmark Supreme Court cases, waivers to the adult system, increases in the use …

Pandemic Responses: What They Reveal About Crisis Management, Decision-Making, And Shared Governance, Daniel J. Julius Mar 2022

Pandemic Responses: What They Reveal About Crisis Management, Decision-Making, And Shared Governance, Daniel J. Julius

Journal of Collective Bargaining in the Academy

Colleges and universities have, by and large, responded well, one might say, very effectively as organizations, to the pandemic. This observation may come as a surprise because some would vehemently disagree. Surprising also because in many academic environments, decision-making around managing crises, let alone implementation of solutions, is slow, politicized, and often driven by personal or constituent agendas. Responding to internal or external challenges, implementing strategic plans or effectuating decisions proactively, particularly at the system or institutional level, is difficult. I believe this less than sanguine view is commonly held, and research on decision making in academic organizations over the …

Exploring The Relationship Between Student Expected Engagement And Referrals To The Behavioral Intervention Team, Makenzie R. Schiemann Mar 2022

Exploring The Relationship Between Student Expected Engagement And Referrals To The Behavioral Intervention Team, Makenzie R. Schiemann

USF Tampa Graduate Theses and Dissertations

Higher education administrators are tasked with supporting and retaining students with increasing needs. These needs often include emotional and mental health issues but can worsen to include suicidality and violence toward others. Traditional campus approaches for supporting students and intervening for violence, such as counseling and campus safety, have been reactionary rather than proactive. Behavioral Intervention Teams (BITs) have emerged as a mechanism for heading off violence before it occurs while also supporting students who may never engage in violence but need support. These teams were born out of the concept that violence is preventable and have grown into a …

Optimized Emergency Call Handling In Nr-5g Only Mode Without Emergency Call Support, Mahesh Telang Mar 2022

Optimized Emergency Call Handling In Nr-5g Only Mode Without Emergency Call Support, Mahesh Telang

Defensive Publications Series

To enhance reliability for emergency calls, some networks, such as New Radio 5G Communication (NR5G) networks, provide multiple ways to originate emergency calls, and in particular provide an emergency call fallback (ES-FB) service. However, under some user equipment (UE) configurations and conditions, the ES-FB service is not available, potentially delaying the emergency call. When the UE is in a configuration or condition where ES-FB is potentially available, the UE searches for a network cell that supports emergency service over the IP Multimedia Subsystem (“IMS”), thereby enhancing the speed and reliability of emergency calls.

A Comparative Examination Of Disaster Organizations In The Philippines, South Korea, And The United States, Junmo Kim, Seung-Bum Yang, Ador R. Torneo Mar 2022

A Comparative Examination Of Disaster Organizations In The Philippines, South Korea, And The United States, Junmo Kim, Seung-Bum Yang, Ador R. Torneo

Asia-Pacific Social Science Review

The Philippines is highly vulnerable to weather-related and other natural disasters given its location in the Pacific Ring of Fire. Its disaster organization, the National Disaster Risk Reduction and Management Council or NDRRMC, however, has limited capacity, as demonstrated in its handling of natural disasters in the last 20 years. In this paper, we adopt a comparative approach and compare the NDRRMC with the U.S. Federal Emergency Management Agency (FEMA) and South Korea’s Disaster and Safety Management (DSM) in terms of mandate, organizational structure, resources, and technical capacity to identify possible areas requiring reform. We observe that the NDRRMC’s working …

History Repeating Itself: The Resurgence Of The Taliban And The Abandonment Of Afghan Women, Hannah Bogaert Mar 2022

History Repeating Itself: The Resurgence Of The Taliban And The Abandonment Of Afghan Women, Hannah Bogaert

Immigration and Human Rights Law Review

For two decades the United States and its allies fought against the Taliban in Afghanistan. After the U.S. withdrawal from Afghanistan in late 2021, the Taliban has once again claimed the power of the country. The Taliban has already begun to implement restrictions that deny Afghan women their human rights. This article will outline the Taliban’s disregard for the International Bill of Human Rights, analyzing the Taliban’s observance of human rights before the U.S. invasion in 2001, post- U.S. withdrawal expressions by the Taliban in 2021, and post-U.S. withdrawal actions in 2021. Finally, this article will analyze different actions available …
