Criminal Court System Failures During Covid-19: An Empirical Study, Cynthia Alkon Aug 2022

Criminal Court System Failures During Covid-19: An Empirical Study, Cynthia Alkon

Faculty Scholarship

How did the criminal legal system respond to the early months of pandemic in 2020? This article reports the results of a unique national survey of judges, defense lawyers, and prosecutors that gives a snapshot of how the criminal legal system responded to the COVID-19 in the first five chaotic months. Criminal courts in the United States rely on in-person proceedings and formal and informal in-person communications to manage caseloads. The survey results detail, in ways not previously fully understood, how crucial these in-person communications are and how ill-prepared the criminal courts and legal professionals were to deal with the …

School Resource Officers' Reports Of Training And Perceptions Of High School Students With Disabilities, Kandace T. Jones Aug 2022

School Resource Officers' Reports Of Training And Perceptions Of High School Students With Disabilities, Kandace T. Jones

All Graduate Theses and Dissertations, Spring 1920 to Summer 2023

The purpose of this explanatory sequential, mixed methods research study was to identify the perceptions of school resource officers (SROs) regarding high school students with disabilities and their preparedness to work with this population, as a result of their SRO training. This study involved a national quantitative survey of SROs working in public high schools, followed by one-on-one interviews from the same sample to allow for a deeper analysis of the survey results and develop a theory on how training impacts SRO preparedness and their perceptions of high school students with disabilities. The resulting theory ascertained that the presence of …

Othering In Immigration Laws, Andrea Wright, Quenten Jackson, Cesar Raymundo Jul 2022

Othering In Immigration Laws, Andrea Wright, Quenten Jackson, Cesar Raymundo

Immigration Scholarship: History, Trends and Development in Global Immigration

The ethical wrongs in immigration laws severely impact what it means to be an immigrant American citizen. The Hispanic and Latino groups experience “citizenship” in the United States in a way that portrays them as uneducated and poor criminals, and this paper seeks to understand the reasoning behind this unfair reputation. In order to answer questions of ethics and law, this paper begins with studying the root of othering, regarding immigration in the United States. This research paper investigates the evolution of race-based exclusion laws in immigration and focuses on the relationship between these exclusion laws and race hierarchy in …

A More Grown-Up Response To Ordinary Adolescent Behaviors: Repealing Pins Laws To Protect And Empower D.C. Youth, Mae C. Quinn, Tierra Copeland, Tatyana Hopkins, Mary Brody

University of the District of Columbia Law Review

In February 2020, the District of Columbia (“District” or “D.C.”) Juvenile Justice Advisory Group (“JJAG”), issued an important report calling for decriminalization of “status offenses.” Status offenses are alleged youthful wrongdoings that are prosecuted in the District as “Persons in Need of Supervision” cases.1 This Position Paper provides additional support for JJAG’s recommendations. It offers guidance and suggestions to help the District successfully transition away from PINS prosecutions—while also ensuring community youth feel safe, supported, and empowered in their own lives as they transition to adulthood. The D.C. Metropolitan Police Department has historically been the enforcement arm to address youth …

Neutralizing The Tentacles Of Organized Crime. Assessment Of An Anti-Crime Measure In Fighting Mafia Violence, Anna Laura Baraldi, Erasmo Papagni, Marco Stimolo Jul 2022

Neutralizing The Tentacles Of Organized Crime. Assessment Of An Anti-Crime Measure In Fighting Mafia Violence, Anna Laura Baraldi, Erasmo Papagni, Marco Stimolo

Fondazione Eni Enrico Mattei Working Papers

Organized crime reinforces its corrupting influence on politics through violent intimidation. Anti-crime measures that increase the cost of corruption but not of the exercise of violence might accordingly lead mafia-style organizations to retaliate by resorting to violence in lieu of bribery. On the other hand, anti-corruption measures might also induce criminal clans to go inactive, owing to the higher “entry barriers” to the “business” of influencing politics, which would reduce violence. To determine which of these possible effects is prevalent, we undertake an empirical assessment of the impact of city council dissolution for mafia influence as prescribed by Decree Law …

Sexing The Stage: Designing Sets For Queer Plays, Elliot Cetinski Jul 2022

Sexing The Stage: Designing Sets For Queer Plays, Elliot Cetinski

Theater Summer Fellows

How can we design queer plays in a way that acknowledges challenging content and celebrates queer theater history? How does a set designer use the research on a play’s challenging content and its historical relevance to influence the design and aid in telling the story? What are the tools and processes indispensable to a scenic designer’s creative process? Answers to all of these questions are the goal of my project, where I am exploring the queer plays of 1920s’ playwright Mae West and designing the set for her play The Pleasure Man through a modern queer lens. As a queer …

The Dangerous "Wasn't Super Consensual" Sexual Culture Of Santa Clara University, Molly Flood Jul 2022

The Dangerous "Wasn't Super Consensual" Sexual Culture Of Santa Clara University, Molly Flood

Silicon Valley Sociological Review

The rise in cases of sexual assaults occurring on Santa Clara University’s campus begs the question of why and how the sexual culture on campus allows these traumatic situations to occur and prompts the consideration of how best to support the survivor and uphold justice. Previous research has explored the saturation of sexual assaults on college campuses and revealed a lack of understanding of what constitutes consent and college environments being prone to such crimes. In an effort to center survivors' needs, I utilized personal stories from the Instagram account @metoo.scu to gather information on the assaults and personal sentiments …
