Nevada Supreme Court Summaries
A defendant is constitutionally entitled to a prompt hearing after being taken into custody from pretrial release, and at that hearing, the State bears the burden of demonstrating probable cause. A violation of a condition of a pretrial release may lead to statutory sanctions, and the court does not recognize a distinction between so-called “technical” and “substantive” violations. NRS 178.4851 and Valdez-Jimenez require the district court to make findings of fact on the record that each condition of pretrial release is the least restrictive means of ensuring public safety and the defendant’s return to court.

Count On Me?: Explore The Effect Of Covid-19 City Out-Migration On The 2020 Census: A Case Study On New York City, Clara Fong
Undergraduate Research (Journal)
The United States’ decennial census is the gold standard for enumerating the country’s population. Its data are used by private developers as well as federal and state governments to efficiently allocate federal resources, determine Congressional representation, and provide access to public safety and emergency preparedness (Why We Conduct the Decennial Census). Historically, the census has seen the lowest response rates from low-income populations, communities of color, foreign-born populations, and children (O’hare, 2019). However, early reports on the 2020 Census uncovered that in major metropolitan cities, notably in New York City, these may not be the only undercounted groups. Historically high-income, …
High Time For Change: The Legalization Of Marijuana And Its Impact On Warrantless Roadside Motor Vehicle Searches, Molly E. O'Connell
High Time For Change: The Legalization Of Marijuana And Its Impact On Warrantless Roadside Motor Vehicle Searches, Molly E. O'Connell
Washington and Lee Law Review Online
The proliferation of marijuana legalization has changed the relationship between driving and marijuana use. While impaired driving remains illegal, marijuana use that does not result in impairment is not a bar to operating a motor vehicle. Scientists have yet to find a reliable way for law enforcement officers to make this distinction. In the marijuana impairment context, there is not a scientifically proven equivalent to the Blood Alcohol Content standard nor are there reliable roadside assessments. This scientific and technological void has problematic consequences for marijuana users that get behind the wheel and find themselves suspected of impaired driving. Without …

Difference In Preparedness: Do School Staff Feel Prepared For An Active Shooter Or Attack?, Susanne R. Gaal, Matthew B. Fuller, Stacie Szaal, Katherine Linn, Cherokee Ford
School Leadership Review
The 2020 Texas Educators’ Needs Assessment Regarding School Safety and Victims Services included responses from educators across the state of Texas regarding school safety. This needs assessment generated data that provided researchers with the unique opportunity to analyze the school safety issues in Texas (Fuller et al, 2020). The purpose of the study was to evaluate Texas K-12 educators responses to their school’s preparedness for an active attack or shooter using data from that needs assessment. To build a strong analysis, the results were separated into three categories: educator role; Texas school regions; and urbanicity. Pearson chi square statistical analysis …

A Multi-Site Study Of Firearms Displays By Police At Use Of Force Incidents, Timothy Cubitt, Justin Nix
A Multi-Site Study Of Firearms Displays By Police At Use Of Force Incidents, Timothy Cubitt, Justin Nix
Criminology and Criminal Justice Faculty Publications
The power to use force is a defining characteristic of policing, one that is accompanied by a responsibility to exercise these powers in the circumstances deemed necessary. This study analyzes data from four policing agencies to predict the likelihood of an officer drawing and pointing their firearm at a use of force incident. Findings suggest that situational factors were important in influencing whether an officer may draw and point their firearm. However, a priming effect, in which officers were more likely to draw their firearms when dispatched to an incident, may also be present. The rate that officers drew and …

A Commercial Law Of Privacy And Security For The Internet Of Things By Stacy-Ann Elvy, Melissa Indome
A Commercial Law Of Privacy And Security For The Internet Of Things By Stacy-Ann Elvy, Melissa Indome
Osgoode Hall Law Journal
FROM SMART CARS TO SMART REFRIGERATORS, the internet of things (IoT) has revolutionized various facets of our lives. These novel developments galvanized what scholars now deem to be the Fourth Industrial Revolution. This new era is characterized by technology-driven innovation that marries aspects of the physical, digital, and biological domains, going so far as to defy preconceived notions of human capabilities and behaviour. The societal proclivity towards digitization and automated processes has spurred the proliferation of companies entering the technology arena. Corporations are leveraging emerging technologies to cater to consumers’ idiosyncratic needs more effectively. Central to this objective is the …
Animal Rights Activism And The Constitution: Are Ag-Gag Laws Justifiable Limits?, Jodi Lazare
Animal Rights Activism And The Constitution: Are Ag-Gag Laws Justifiable Limits?, Jodi Lazare
Osgoode Hall Law Journal
It is a troubling time to be an animal rights activist in Canada. Recently, Alberta adopted legislation to create harsh penalties for trespassing onto private property, for obtaining permission to enter private property based on false pretences, and for interfering with vehicles on public highways. These laws relate to agricultural lands, to private property generally, and, where roads are concerned, to public property. Ontario has adopted similar legislation aimed specifically at agricultural property. The legislation in both provinces purports to protect the security of farmers, their families, and rural property owners generally, as well as the safety of the food …

Final Report - Simulation Training To Work With Bridge Inspection Robots, Sushil J. Louis
Project WD-3
This project aims to investigate and develop a software system that helps bridge inspectors work together with semiautonomous and autonomous robots that efficiently and effectively inspect truss bridges more thoroughly in less time. Our first project WD-2 effort developed a simulation training system for bridge inspection, enabling a heterogeneous group of simulated robots to accelerate comprehensive bridge inspections. This new project WD-3 will investigate and develop techniques to 1) map the simulated world to the real world, 2) connect simulated robots with real robots being developed in other INSPIRE projects, and 3) investigate and develop algorithms, protocols, and autonomy for …

Media Influence Through What Is Reported And How It Is Reported, Tammy Parker Johnston, Veronika Humphries
Southern University College of Business E-Journal
Living in the digital age certainly has its advantages but presents challenges to the basic principles of integrity, honesty, and truthfulness. Media bias can be detected by reviewing the list of trending and widely discussed topics shared by media outlets. The news presented can often be identified as leaning towards one of the three political spectrums: right-wing, left-wing, or center. The infiltration of political bias within the media influences public opinion.

Staying Out Of Trouble? Effect Of High School Career Counseling On Crime, Stephen Barnes, Louis-Philippe Beland, Swarup Joshi, Barton Willage
Economics Faculty Works
Human capital-based models of crime imply that increasing educational attainment will decrease crime. A growing body of empirical work has supported this hypothesis, however the evidence is still limited. We investigate if a high school career coaching program, Career Compass of Louisiana, decreases youth crime during and after high school. Career Compass provides students counseling services regarding college admissions, financial aid, and career exploration. We use student-level administrative education and crime convictions data and a difference-in-differences empirical strategy to test for an education-crime relationship among high school seniors. While existing research shows the Career Compass program increases post-secondary enrollment, we …
