State Constitutional Rights And Democratic Proportionality, Jessica Bulman-Pozen, Miriam Seifter
State Constitutional Rights And Democratic Proportionality, Jessica Bulman-Pozen, Miriam Seifter
Faculty Scholarship
State constitutional law is in the spotlight. As federal courts retrench on abortion, democracy, and more, state constitutions are defining rights across the nation. Despite intermittent calls for greater attention to state constitutional theory, neither scholars nor courts have provided a comprehensive account of state constitutional rights or a coherent framework for their adjudication. Instead, many state courts import federal interpretive practices that bear little relationship to state constitutions or institutions.
This Article seeks to begin a new conversation about state constitutional adjudication. It first shows how in myriad defining ways state constitutions differ from the U.S. Constitution: They protect …

Estimation Of Idle Time Using Machine Learning Models For Vehicle-To-Grid (V2g) Integration And Services, Prashanth Rajagopalan
Theses and Dissertations
As the Electric Vehicles (EVs) market continues to expand, ensuring the access to charging stations remains a significant concern. This work focuses on addressing multiple challenges related to EV charging behavior and Vehicle-to-Grid (V2G) services. Firstly, it focuses on accurate minute-ahead (20 minute \& 30 minute intervals) load forecasts for an EV charging station by using four years of historical data, from 2018-2021. This data is recorded from a university campus garage charging station. Machine Learning (ML) models such as Seasonal Auto-Regressive Integrated Moving Average (SARIMA), Random Forest (RF), and Neural Networks (NN) are employed for load forecasts in terms …
Performance Analysis Of Data-Driven Algorithms In Detecting Intrusions On Smart Grid, Tala Talaei Khoei
Performance Analysis Of Data-Driven Algorithms In Detecting Intrusions On Smart Grid, Tala Talaei Khoei
Theses and Dissertations
The traditional power grid is no longer a practical solution for power delivery due to several shortcomings, including chronic blackouts, energy storage issues, high cost of assets, and high carbon emissions. Therefore, there is a serious need for better, cheaper, and cleaner power grid technology that addresses the limitations of traditional power grids. A smart grid is a holistic solution to these issues that consists of a variety of operations and energy measures. This technology can deliver energy to end-users through a two-way flow of communication. It is expected to generate reliable, efficient, and clean power by integrating multiple technologies. …

Strengthening Urban Resilience: Understanding The Interdependencies Of Outer Space And Strategic Planning For Sustainable Smart Environments, Ulpia-Elena Botezatu, Olga Bucovetchi, Adrian V. Gheorghe, Radu D. Stanciu
Engineering Management & Systems Engineering Faculty Publications
The conventional approach to urban planning has predominantly focused on horizontal dimensions, disregarding the potential risks originating from outer space. This paper aims to initiate a discourse on the vertical dimension of cities, which is influenced by outer space, as an essential element of strategic urban planning. Through an examination of a highly disruptive incident in outer space involving a collision between the Iridium 33 and Cosmos 2251 satellites, this article elucidates the intricate interdependencies between urban areas and outer space infrastructure and services. Leveraging the principles of critical infrastructure protection, which bridge the urban and outer space domains, and …

Public Attitudes Towards Non-Criminal Preventive Detention As A Function Of The Covid-19 Pandemic, Matt Zaitchik, Kyle Gamache, Judith Platania
Arts & Sciences Faculty Publications
Non-criminal preventive detention is justified by both the state’s parens patriae and police power roles. Individuals with mental illness and individuals with a highly communicable, potentially lethal disease can be involuntarily detained. Modern applications of quarantine have led to higher court decisions that address the balance between liberty and public health and safety. The inherent tensions that underlie quarantine law – individual liberty versus public safety – are apparent in our contemporary, COVID-19 America. Consequently, much of the current discussion appears to have political overtones. In order to empirically address this issue, in the current study we examine attitudes towards …

A Literature Analysis Of Microgrid Optimization Studies, Izzy Medeiros
A Literature Analysis Of Microgrid Optimization Studies, Izzy Medeiros
Honors Theses and Capstones
Senior civil engineering student, Izzy Medeiros, is presenting her honors thesis in the form of a literature analysis. Her research involved investigating existing microgrid studies and where there are current gaps in the knowledge. About 40 publications written within the last 20 years were analyzed for their research goals, optimization objectives, and microgrid design, pointing to where this research is currently lacking. Most real studies were conducted in Asia, as Southeast Asia has island communities that need the reliability of a renewable microgrid during extreme weather events. Photovoltaic panels in combination with wind turbines comprise the most common configuration of …
Carceral Deference: Courts And Their Pro-Prison Propensities, Danielle C. Jefferis
Carceral Deference: Courts And Their Pro-Prison Propensities, Danielle C. Jefferis
Fordham Law Review
Judicial deference to nonjudicial state actors, as a general matter, is ubiquitous, both in the law and as a topic of legal scholarship. But “carceral deference”—judicial deference to prison officials on issues concerning the legality of prison conditions—has received far less attention in legal literature, and the focus has been almost entirely on its jurisprudential legitimacy. This Article contextualizes carceral deference historically, politically, and culturally, and it thus adds a piece that has been missing from the literature. Drawing on primary and secondary historical sources and anchoring the analysis in Bourdieu’s field theory, this Article is an important step to …
The Need For Curtains Of The Soul: Privacy Versus Transparency In The Instrumented World Of Algorithmic Artificial Intelligence, Michael Martin Losavio
The Need For Curtains Of The Soul: Privacy Versus Transparency In The Instrumented World Of Algorithmic Artificial Intelligence, Michael Martin Losavio
FIU Law Review
We approach a privacy singularity in pervasive data collection and inference that may reveal all about our lives. While privacy might not yet be dead, we struggle to maintain its shield for personal autonomy. Part of this contemporary challenge comes from the massive data sets generated every day everywhere. And then the powerful analytics that reveal all. This is further challenged by efforts at data transparency that may reveal too much of one’s life. Preservation of privacy, if we deem it important enough to preserve, must have a robust set of technical and legislative implementations on collection, storage, transmission and …

Unmasking The Power Dynamic Between Local School Boards And The State Executive Branch: Implications For Future Local School Safety Protocols, Karla Michelle Cejas
Unmasking The Power Dynamic Between Local School Boards And The State Executive Branch: Implications For Future Local School Safety Protocols, Karla Michelle Cejas
FIU Law Review
The COVID-19 pandemic has brought attention to the government’s power in controlling the operation of public schools. The legal and political differences among local school boards and the State’s COVID policies are exemplified in media headline battles pertaining to school reopening and the Governor’s so called “anti-mask mandate.” The State capitalized on its emergency powers at the expense of providing local school boards with the autonomy to enact district-wide protective measures. Local school boards have faced several challenges in arguing against State Emergency Orders including a difficulty with proving state compulsion to comply with its directives, overly broad statutory language …
Age Is Not Just A Number: Problems With Florida’S Statutory Minimum Age For Juvenile Delinquency And Why It Must Be Increased, Natalie Brooks
Age Is Not Just A Number: Problems With Florida’S Statutory Minimum Age For Juvenile Delinquency And Why It Must Be Increased, Natalie Brooks
FIU Law Review
Under a Florida law enacted in 2021, any child over the age of six years old can be arrested and subjected to juvenile delinquency proceedings. Florida, as well as the United States in general, is an outlier when it comes to statutory minimum ages for juvenile delinquency. The most common and recommended minimum age internationally is fourteen years old, and many studies show that arresting, charging, and adjudicating children below the age of fourteen is counterproductive, as it leads to increased recidivism, potentially violates due process, and leaves lasting negative effects on children. This comment will discuss juvenile delinquency in …
Model Legal Processes For Court Ordered Mental Health Treatment - A Modern Approach, Brian D. Shannon
Model Legal Processes For Court Ordered Mental Health Treatment - A Modern Approach, Brian D. Shannon
FIU Law Review
The United States Conference of Chief Justices and Conference of State Court Administrators established the National Judicial Task Force to Examine State Courts’ Response to Mental Illness in 2019. As part of its overall efforts, the National Judicial Task Force then partnered with the Equitas Project of Mental Health Colorado to appoint a select workgroup to develop model statutory language for court-ordered mental health treatment, emergency psychiatric intervention, medication over objection, and criminal matters involving persons with mental illness. This Model Legal Processes Workgroup included judges, psychiatrists, medical school professors, law professors, and others whose goal was to draft model …
Toward Modernization: Using Strategic Development To Address Deficits In The Juvenile Justice System, David A. Mcleod, Emily A. Roberts
Toward Modernization: Using Strategic Development To Address Deficits In The Juvenile Justice System, David A. Mcleod, Emily A. Roberts
National Youth Advocacy & Resilience Journal
The Juvenile Justice System was established on the premise of rehabilitative action for behaviors that have led youth to the criminal justice system. However, the system has increasingly moved away from this original concept toward a punitive model. The authors present how this movement resulted in the devolution of human rights for the youth involved, a decrease in public safety, and a radical departure from fiscal responsibility related to the theoretical origins of rehabilitation. Studies on topics ranging from costs of correctional centers to trauma experienced by youth in these systems, along with many others, are compared to identify specific …

Deploying The Wto Agreement On Government Procurement (Gpa) To Enhance Sustainability And Accelerate Climate Change Mitigation, Robert D. Anderson, Antonella Salgueiro, Steven L. Schooner, Marc Steiner
GW Law Faculty Publications & Other Works
Mitigating climate change and promoting sustainability are defining challenges of our time. Public procurement has a vital role to play in responding to the current crises. This article makes the case that the World Trade Organization’s (WTO) Agreement on Government Procurement (GPA), and specifically the Work Programme on Sustainable Procurement that has been initiated pursuant to the Agreement, can serve as important instruments to promote sustainable approaches to public procurement internationally, consistent with the goals of climate change mitigation.
The Work Programme, which was established at the time of the GPA’s modernization in 2012 and on which important work has …
Promoting Female Sporting Opportunities Without Title Ix: The Spanish Experience, Stephen Ross, Maria Josefa Garcia Cirac
Promoting Female Sporting Opportunities Without Title Ix: The Spanish Experience, Stephen Ross, Maria Josefa Garcia Cirac
Faculty Scholarship
This article compares the American approach to improving sporting opportunities for females – Title IX – with approaches taken by Spain. Because of the singular American dedication to elite interscholastic and intercollegiate sports, Title IX’s requirement of equal treatment requires that elite female athletes have equivalent opportunities to elite male athletes. The Spanish approach looks instead on the social benefits of athletics participation for boys, men, girls, and women.
Police Secrecy Exceptionalism, Christina Koningisor
Police Secrecy Exceptionalism, Christina Koningisor
Utah Law Faculty Scholarship
Every state has a set of transparency statutes that bind state and local governments. In theory, these statutes apply with equal force to every agency. Yet, in practice, law enforcement agencies enjoy a wide variety of unique secrecy protections denied to other government entities. Legislators write police-specific exemptions into public records laws. Judges develop procedural approaches that they apply exclusively to police and prosecutorial records. Police departments claim special secrecy protections from the bottom up.
This Article maps the legal infrastructure of police-records secrecy. It draws upon the text of the public records statutes in all fifty states, along with …

Abstract Due to irregularities and shortages in electricity generation and distribution, 95% of Cameroon’s population suffers from debilitating effects on national economic security, public health, education, safety, and quality of life. Cameroon needs a sustainable, efficient, and innovative electricity source and policy system. Failure to meet this demand forestalls the much-needed socio-economic and political development of the country. The purpose of the present study was to explore inadequacies of the current hydroelectric supply system in Cameroon, putting into perspective factors that impeded the development of a sustainable electricity supply system, strategies to alleviate these impediments, and the most cost-effective framework …

Examining The U.S. Disaster Management Program: A Case Study Of The U.S. Virgin Islands Hurricanes Irma And Maria Evacuation, Victoria F. Vachon
Walden Dissertations and Doctoral Studies
AbstractWhether from natural or human causes, every global community is at risk for overwhelming, destabilizing incidents. Hurricanes Irma and Maria devastated the U.S. Virgin Islands in late August and early September 2017, necessitating the urgent evacuation of hemodialysis patients over 1000 miles to the U.S. mainland. Because the damage and response to the U.S. territory were unprecedented, the public health implications of the government’s strategies on the evacuated population subset were unexplored. However, available information suggested that some evacuees sustained avoidable harm while in the protracted care and custody of the government. This qualitative case study, conceptually framed by Bronfenbrenner’s …
Relationship Between Perceived Language Proficiency And Economic Life Satisfaction For Migrants, John Ndunduma
Relationship Between Perceived Language Proficiency And Economic Life Satisfaction For Migrants, John Ndunduma
Walden Dissertations and Doctoral Studies
The United States needs migrant workers to fill the labor market gap because baby boomers are retiring from the US workforce in large numbers beginning in 2020. Approximately 2.1 million migrants came from Africa to fill the U.S. labor shortage. Many of these African migrants faced challenges with English language proficiency. There are benefits to the United States involved with increasing the economic wellbeing of migrants, such as reducing remigration, increasing the high-skilled labor force, and increasing cultural diversity. This study used Maslow’s motivational theory to test significant relationships between perceptions of English language proficiency (PELP) and economic life satisfaction …

Technological And Pedagogical Challenges For Teachers During Covid-19, Suzanne Reaid
Walden Dissertations and Doctoral Studies
AbstractImplementation of a national contingency plan to mitigate the effects of a natural disaster or major health crisis for schools in the United States has been a focus of scholars since the polio epidemic in 1916. While examining the impact of the COVID-19 pandemic on education in the United States, researchers demonstrated that online remote instruction was adopted as a temporary answer to school closures, yet teachers were not prepared for this type of teaching. Researchers had yet to identify the technological and pedagogical challenges for teachers who taught remotely during the crises with little distance education experience. The purpose …
The Perceived Impact Of Childbirth Related Ptsd And Maternal Bonding, Sheila Baez
The Perceived Impact Of Childbirth Related Ptsd And Maternal Bonding, Sheila Baez
Walden Dissertations and Doctoral Studies
AbstractChildbirth has been increasingly viewed as a potentially traumatic event and process impacting both mother and infant. Previous research on childbirth has concentrated on the development of postpartum depression and its impact; research on posttraumatic stress disorder (PTSD) after childbirth has been limited. However, the results of this research study suggested that the development of childbirth-related PTSD may be a far more common phenomenon than previously suggested. Bowlby’s attachment theory and Ainsworth’s further development and expansion of the theory served as a framework which investigated the experiences of 10 biological females, aged 21 and over previously diagnosed with PTSD after …
Workplace Bullying On Human Resources Management Performance In Correctional Facilities, Oliver Onyeka Ehiahuruike
Workplace Bullying On Human Resources Management Performance In Correctional Facilities, Oliver Onyeka Ehiahuruike
Walden Dissertations and Doctoral Studies
AbstractWorkplace bullying, as part of a hostile work environment, impacts human resources management (HRM) work outcome metrics, employees' attitudes toward their job, organization, and behavioral intentions that collectively affect organizational goals. Addressed in this study are the problems of workplace bullying of corrections employees, which negatively affect HRM outcome measures of turnover intention, organizational commitment, and employee job satisfaction. The purpose of this quantitative correlational research study was to determine the relationship between workplace bullying and turnover intention, organizational commitment, and job satisfaction among corrections employees in Texas. Homans's social exchange and Bourdieu's social capital theories were used in this …
The Experiences Of Successful Formerly Incarcerated African American Males, Bernice Gordon-Young
The Experiences Of Successful Formerly Incarcerated African American Males, Bernice Gordon-Young
Walden Dissertations and Doctoral Studies
African American men are incarcerated at alarming rates and often recidivate at high rates within 3 years. Researchers have demonstrated that recidivism rates last through years 4 and beyond. There is limited qualitative data to provide strategies from formerly incarcerated African American males who have been successful at not recidivating for 10 or more years after their release. The purpose of this Afrocentric-hermeneutic phenomenological study was to bridge the gap in the literature and explore the lived experiences of African American males who were formerly incarcerated and have positively changed their lives to avoid further criminality. A purposeful and snowball …
Sex Offenders’ Risk Assessment Process And Effects On Jurisdiction Transitioning, Lonnie Keith Grabowska
Sex Offenders’ Risk Assessment Process And Effects On Jurisdiction Transitioning, Lonnie Keith Grabowska
Walden Dissertations and Doctoral Studies
AbstractThe Adam Walsh Act created sex offender notification and registration requirements to encourage state compliance toward federal guidelines and assigned threat levels to registered sex offenders using mandated assessment processes. Researchers have pointed out that the transition by states using tiered assessment processes to the federally mandated guidelines has led to operational changes to state registration procedures. The purpose of this quantitative study was to understand the effects and impacts on jurisdictions transitioning the designation of registered sex offenders’ threat assessment levels from a formal risk-based assessment process to the mandated Sex Offender Registration and Notification Act conviction-based assessment tool …

Walden Dissertations and Doctoral Studies
AbstractPsychoactive substance (PAS) abuse is a major public health problem leading to increased morbidity and mortality. In Nigeria, the incidence rate of PAS abuse has remained high, particularly in the youth population. The purpose of this study was to examine the influence of social factors and school enrollment status on PAS abuse in youth in Southeast Nigeria. The social ecological model and the theory of reasoned action were the theoretical frameworks used for this study; they were selected due to their focus on multiple levels of factors that influence behavior. A quantitative cross-sectional study design approach was used to determine …
