Squatters Squabbles: The Use Of Mediation To Provide Beneficial Solutions To Adverse Possession Claims In New Jersey, Bayla Zohn Jan 2024

Squatters Squabbles: The Use Of Mediation To Provide Beneficial Solutions To Adverse Possession Claims In New Jersey, Bayla Zohn

Cardozo Journal of Conflict Resolution

In our society, law is a complex and ever-evolving field, constantly adapting to fit our needs. Yet, there are certain legal matters we would expect to have clear and obvious resolutions. Property ownership should be simple and unambiguous, governed by "established legal rules and precepts." Examine a deed, survey the stated legal owner of the tract of land, and your answer should be uncomplicated. Yet, there are a multitude of complex laws that allow individuals to obtain legal ownership of land in a seemingly illicit fashion.

The New American Conspiracism: The Conspiracy Mentality And The Consequences For American Democracy, Jennifer M. Seech Seramur

Wayne State University Dissertations

This research is at the forefront of a developing field of inquiry into the psychological impacts of an American media environment plagued with mis- and disinformation. Many have suggested that we have entered a "post-truth" era and this phenomenon will have disastrous consequences for the stability of American democracy. However, few have empirically tested these notions. This research seeks to fill part of this gap in knowledge by analyzing a survey with over 8,000 participants to bring empirical evidence to bear on these assertions. Through an assessment of the effects of a conspiracy mentality (or one’s proclivity to endorse and …

Abstract

VIRTUAL SUPERVISION VERSE FACE-TO-FACE SUPERVISION AND HOW IT IMPACTS SELF-EFFICACY FOR COUNSELORS-IN-TRAINING

by

LINDA YATOOMA

May 2024

Advisor: Dr. Anita Welch

Major: Counselor Education

Degree: Doctor of Philosophy

The study focuses mainly on counselors-in-training self-efficacy and the impact of clinical supervision. The sample size of 227 counselors-in-training all received some type of clinical supervision. The deliverance of clinical supervision did not have any significance between them. Therefore, virtual clinical supervision is just as effective as face-to-face clinical supervision. Also, the counselors-in-training who were in internship class had a much higher level of self-efficacy than the counselors-in-training in the technique …

Literature Unbound: Black Carceral Consciousness From 1965 – 1975, Allan L. Ford Jan 2024

Literature Unbound: Black Carceral Consciousness From 1965 – 1975, Allan L. Ford

Wayne State University Dissertations

Genre has the capacity to help readers my closely understand certain writings; however, strict reliance on genre alone can cloud or betray the author's intentions. This is especially true when the author is imprisoned. From autobiographic writings by Huey Newton and Rubin Carter, to the collected letters and essays of Angela Davis, George Jackson, and Eldridge Cleaver, to certain works of poetry by Ericka Huggins and Etheridge Knight, a certain expression of humanity is alive in their words. I use a method of analysis for these works called Black carceral consciousness to perform close readings of these works in an …

Autonomous Robot For Indoor Enhanced Living (Ariel), Prabhjot Kaur Jan 2024

Autonomous Robot For Indoor Enhanced Living (Ariel), Prabhjot Kaur

Wayne State University Dissertations

The global population is aging rapidly, with the total percentage of older adults (65 years and older) projected to increase from 10\% of the total population in 2022 to 16\% by 2050, according to the World Population Prospectus 2022 issued by the United Nations. For certain parts of the world such as Europe and North America, this translates to 1 in every 4 persons is projected to be 65 years or older by 2060. This trend raises concerns about providing quality long-term care for the older population. Moreover, according to the 2021 survey by the American Association of Retired Persons …

Examining The Impact Of Yoga And Mindfulness On Perceived Caregiver Stress And Burden, Michelle Renaud Jan 2024

Examining The Impact Of Yoga And Mindfulness On Perceived Caregiver Stress And Burden, Michelle Renaud

Wayne State University Dissertations

PURPOSE: In the United States, there are approximately 34 million informal caregivers; defined as individuals who provide unpaid help to older adults (Lavela & Ather, 2010). Among this population, there is a growing health concern focusing on the potential physical and psychological risks linked to caregiving. Therefore, the purpose of this study was to investigate how a yoga and mindfulness intervention may influence changes in caregivers’ perceptions of stress and burden as well as their resting heart rate (HR) and blood pressure (BP). METHODS: Eight caregivers participated in an eight-week yoga and mindfulness intervention, with 60- minute sessions featuring gentle …

Inflation Expectations And Political Polarization: Evidence From The Cooperative Election Study, Ethan Struby, Christina Farhart Jan 2024

Inflation Expectations And Political Polarization: Evidence From The Cooperative Election Study, Ethan Struby, Christina Farhart

Department of Economics Working Paper Series

Using a unique, nationally representative survey from the 2022 midterm elections, we investigate the partisan divide in beliefs about inflation and monetary policy. We find that party identity is predictive of inflation forecasts even after conditioning on beliefs about both past inflation and the Federal Reserve’s long-run inflation target. Partisan forecast differences are driven by respondents who express low generalized trust in others and have a high degree of political knowledge; high-trust and low- knowledge partisans make similar forecasts all else equal. This finding is consistent with the literature in political psychology that examines the endorsement of conspiracy theories and …

A Different Approach To Agency Theory And Implications For Esg, Jonathan Bonham, Amoray Riggs-Cragun Jan 2024

A Different Approach To Agency Theory And Implications For Esg, Jonathan Bonham, Amoray Riggs-Cragun

Seattle University Law Review

In conventional agency theory, the agent is modeled as exerting unobservable “effort” that influences the distribution over outcomes the principal cares about. Recent papers instead allow the agent to choose the entire distribution, an assumption that better describes the extensive and flexible control that CEOs have over firm outcomes. Under this assumption, the optimal contract rewards the agent directly for outcomes the principal cares about, rather than for what those outcomes reveal about the agent’s effort. This article briefly summarizes this new agency model and discusses its implications for contracting on ESG activities.

Overseeing The Administrative State, Jill E. Fisch Jan 2024

Overseeing The Administrative State, Jill E. Fisch

Seattle University Law Review

In a series of recent cases, the Supreme Court has reduced the regulatory power of the Administrative State. Pending cases offer vehicles for the Court to go still further. Although the Court’s skepticism of administrative agencies may be rooted in Constitutional principles or political expediency, this Article explores another possible explanation—a shift in the nature of agencies and their regulatory role. As Pritchard and Thompson detail in their important book, A History of Securities Law in the Supreme Court, the Supreme Court was initially skeptical of agency power, jeopardizing Franklin Delano Roosevelt (FDR)’s ambitious New Deal plan. The Court’s acceptance …

The Sec, The Supreme Court, And The Administrative State, Paul G. Mahoney Jan 2024

The Sec, The Supreme Court, And The Administrative State, Paul G. Mahoney

Seattle University Law Review

Pritchard and Thompson have given those of us who study the SEC and the securities laws much food for thought. Their methodological focus is on the internal dynamics of the Court’s deliberations, on which they have done detailed and valuable work. The Court did not, however, operate in a vacuum. Intellectual trends in economics and law over the past century can also help us understand the SEC’s fortunes in the federal courts and make predictions about its future.

A Hard Pill To Swallow: The Abysmal Mental Health Standards Of Detained Immigrant Children In The United States, Rama Bankesly Jan 2024

A Hard Pill To Swallow: The Abysmal Mental Health Standards Of Detained Immigrant Children In The United States, Rama Bankesly

Seattle University Law Review

After setting foot into the U.S., unaccompanied children must learn to navigate academic and legal systems while receiving little support and carrying the heavy burden of effects of trauma on their mental health. They need access to mental health care from qualified professionals, but as this Comment will explain, they systematically fail to receive care, as can be seen in cases like Doe v. Shenandoah Valley Juv. Ctr. Comm’n. In Shenandoah, an unaccompanied child arrived in the U.S. and was placed in a facility that failed to provide remotely adequate mental health care and in fact was subjected …

An Online Module To Promote Self-Care And Resiliency In Nursing Students, Karen Higgins, Janice Hawkins, Beth Tremblay, Lynn Wiles

Ellmer School of Nursing Faculty Publications

Because the demands of nursing education can impact the physical and mental health of nursing students, the American Association of Colleges of Nursing’s revised Essentials require inclusion of self-care and resilience education in nursing curricula. This article describes the development, implementation, and evaluation of a self-care module in a new online undergraduate course. Using the REST mnemonic (relationships, exercise, soul, and transformative thinking), students developed personalized self-care plans for the semester. End-of-course evaluations revealed an increase in self-care activities. The most used activities were exercise, humor, intentional rest, and healthy eating.

Envisioning Munster Technological University As A Trauma-Sensitive University, Marie Singleton Jan 2024

Envisioning Munster Technological University As A Trauma-Sensitive University, Marie Singleton

Theses

Trauma-informed care works on the assumption that individuals utilizing relevant services have experienced trauma (Palmer, 2020). The trauma-informed approach focuses on providing empathy and compassion to create healing relationships and ensure accessibility for all service users. This approach is aimed at understanding, identifying, and addressing trauma in organisations by making changes to practices, policies, and procedures (Champine et al., 2022). Substance Abuse and Mental Health Services Administration (SAMHSA) (2014:10) states that ‘trauma results from an event, serie s of events, or set of circumstances that is experienced by an individual as physically or emotionally harmful or threatening and that has …

What Are Munster Technological University Students’ Experiences Of Menstruation And Reusable Period Products?, Kate Dolan Crowley

Theses

This study examines the attitudes of students in Munster Technological University (MTU) towards menstruation and period products. It is estimated that in Ireland, between 53,000 and 85,000 Irish menstruators may be at risk of period poverty (Government of Ireland, 2021). There is also evidence to suggest that some students have experienced period poverty (Ministry of Education, 2023; Brinkley and Niebuhr, 2022; Munro et. al., 2021). Period poverty has an impact on the physical, mental, and social well-being of menstruators, ultimately affecting their quality of life.

A mixed-method study was undertaken, consisting of questionnaires (n=319) and one-toone semi-structured interviews (n=10) to …

Reducing 30-Day Hospital Readmission In The Older Homebound Population: Using An Interprofessional Communication Protocol Within A Multidisciplinary Hospital At Home Program, Pamela Ann Alvey Jan 2024

Reducing 30-Day Hospital Readmission In The Older Homebound Population: Using An Interprofessional Communication Protocol Within A Multidisciplinary Hospital At Home Program, Pamela Ann Alvey

Yale School of Nursing Digital Theses

Home-bound patients aged 65 and older are at the highest risk for avoidable 30-day hospital readmission: a factor contributing to rising healthcare costs and comprising over 30% of Medicare’s spending. The Hospital Readmission Reduction Program (HRRP) deemed that one in five patients that were discharged from the hospital were readmitted within 30 days, resulting in an annual waste of $17 billion. The increase in homebound older patients, coupled with ongoing avoidable 30-day readmissions, resulting in poorer quality of life, makes this a critical issue for the U.S. healthcare system. A key gap identified in the prevalence of avoidable 30-day readmissions …

The Power Of The Story, Rogelio Paquini Jan 2024

The Power Of The Story, Rogelio Paquini

Journal of Adventist Youth and Young Adult Ministries

When most people ignore the story of Scripture, there needs to be a different approach to reach them for Jesus regarding knowledge of the biblical narrative. The evangelistic system to reach this generation needs to change. The Next BIG Thing in youth ministry is returning to the power of storytelling. To reach this generation it is imperative to practice storytelling, especially the story of the Bible. Our identity as Seventh-day Adventists depends on the strength of our story in connection with prophetic and historical narratives. We get to tell a story of hope, not of disappointment; a story of cooperation …

Attention-Language Interface In Multilingual Assessment Instrument For Narratives (Main), Irina A. Sekerina, Olga Parshina, Vladislava Staroverova, Natalia Gagarina

Publications and Research

The current study employed the Multilingual Assessment Instrument for Narratives (MAIN) to test comprehension of narrative macrostructure in Russian in a visual world eye-tracking paradigm. The four MAIN visual narratives are structurally similar and question referents’ goals and internal states (IS). Previous research revealed that children’s MAIN comprehension differed among the four narratives in German, Swedish, Russian, and Turkish, but it is not clear why. We tested whether the difference in comprehension was (a) present, (b) caused by complicated inferences in understanding IS compared with goals, and (c) ameliorated by orienting visual attention to the referents whose IS was critical …

Enhancing The Perception Of Public Urban Spaces Via Place-Making: Martyrs' Square And Selected Locations In El-Gaish Street Case Study, Vert Kamal Ramzy, Nanees Abdel Hamid Mohamed Ali Elsayyad, Lamis Saad El-Din El-Gizawi Jan 2024

Enhancing The Perception Of Public Urban Spaces Via Place-Making: Martyrs' Square And Selected Locations In El-Gaish Street Case Study, Vert Kamal Ramzy, Nanees Abdel Hamid Mohamed Ali Elsayyad, Lamis Saad El-Din El-Gizawi

Mansoura Engineering Journal

Trust be told that urban spaces have generated a lot of controversy in recent years. The major issues that I will address in this paper are transformations in the urban environment affected by different appearances due to economic and social changes that shape their meaning through human interactions for creating a social life. With the emergence of modern architecture and planning patterns, urban spaces have become the focus of researchers for study and analysis to determine the best destination.

This paper aims to present place-making as an approach to strengthening the perception of public urban spaces and, consequently, its impact …

Protection Of Cultural Property In Armed Conflict And Military Necessity, Fausto Pocar Jan 2024

Protection Of Cultural Property In Armed Conflict And Military Necessity, Fausto Pocar

Intercultural Human Rights Law Review

The protection of cultural property in armed conflict has been a matter for special consideration by customary and conventional international humanitarian law since its first expressions. The Hague Conventions of 1899 and 1907 already enunciated a principle of protection in this matter, as shown in particular by the Regulations concerning the laws and customs of war on land annexed to the fourth convention, which provided that in sieges and bombardments all necessary steps must be taken to spare, as far as possible, buildings dedicated to religion, art, science, or charitable purposes, historic monuments, hospitals, and places where the sick and …

Sialylation As A Mechanism For Preferential Ligand Binding In Cfs1r, Eric J. Beaulaurier Jan 2024

Sialylation As A Mechanism For Preferential Ligand Binding In Cfs1r, Eric J. Beaulaurier

EWU Masters Thesis Collection

Macrophages are immune cells that help provide the first line of defense against a wide range of internal and external insults and create the bridge between innate and adaptive immune responses. When macrophage homeostasis is disrupted, disease states occur. Associated disease states include rheumatoid arthritis, Alzheimer’s disease, and multiple sclerosis. The survival and proliferation of macrophages is largely controlled by signaling through colony stimulating factor 1 receptor (CSF1R). Notably, this receptor can be activated by two non-homologous ligands, colony stimulating factor 1 (CSF1) and interleukin- 34 (IL-34). These two ligands are differentially required for macrophage homeostasis across body systems and …

Addressing Psychosocial Factors In Upper Extremity Injuries To Improve Outcomes And Quality Of Life, Jace Allard Jan 2024

Addressing Psychosocial Factors In Upper Extremity Injuries To Improve Outcomes And Quality Of Life, Jace Allard

Occupational Therapy Capstones

Purpose: Following upper extremity injuries, negative psychosocial factors such as anxiety, stress, post-traumatic stress disorder, and depression are found to be prevalent (Hardison et al., 2021; Maddison et al., 2023). Negative psychosocial symptoms such as these can negatively affect recovery outcomes and quality of life for individuals (Kinsley et al., 2020; Sposato et al., 2018). Typical treatment received in hand therapy for individuals with upper extremity injuries consists primarily of physical remediation through a biomedical frame of reference and less on addressing psychosocial factors (Chown et al., 2018; Kurrus et al., 2022; Robinson et al., 2016). Certified hand therapists report …

Transitional Support Programming For First-Year Occupational Therapy Graduate Students, Samantha Proctor

Occupational Therapy Capstones

Title: Transitional Support Programming for First-Year Occupational Therapy Graduate Students

Background: The focus of the project represents the Scholarship of Application, which is the translation of existing research into practice. A student’s transition from undergraduate to graduate-level programs can be challenging due to the increased academic rigor inherent to graduate programs. This can lead to an imbalance in students' lives and an increase in stress, anxiety, and burnout. As the overall well-being of students decreases, the likelihood of students experiencing academic hardships increases. Students need diverse academic and professional skills to navigate graduate school successfully; however, many students lack those …

Clearing Ethnic Minority Roadblocks To Entry Into The Field Of Dietetics: A Mixed Analysis, Lisa C. Best Jan 2024

Clearing Ethnic Minority Roadblocks To Entry Into The Field Of Dietetics: A Mixed Analysis, Lisa C. Best

UNF Graduate Theses and Dissertations

Background - Dietitians are represented by fewer than 3% African Americans and 6% Hispanics compared with population demographics of 13% and 19% respectively. Despite 50 years of research on pipeline education, mentorship programs, cultural competency, and funding opportunities, minority participation in dietetics remains disproportionately low. At a time of increasing health care disparity, it is more important than ever to recruit and retain minorities in dietetics to optimally serve an ever increasingly diverse population.

Methods - 18 Historically Black Colleges and 26 high Hispanic census schools nationwide were contacted by email and follow-up phone call to explore and address ethnic …
