A Progressive Response: Judicial Delegation Of Authority To Federal Probation Officers, Jacy Owens Sep 2025

A Progressive Response: Judicial Delegation Of Authority To Federal Probation Officers, Jacy Owens

Florida Law Review

Federal probation officers supervise millions of offenders who must each comply with a multitude of probation conditions. These officers need enough flexibility to deal with the evolving needs of each offender, without having to clog the court system with repeated requests for modifications. Yet federal courts differ in the amount of discretionary authority they grant to federal probation officers. In fact, some courts find a violation of the judiciary's Article III sentencing power when a court grants any discretionary authority to a probation officer. This Note argues, however, that federal courts can delegate a large degree of discretionary authority to …

Expert Paternalism, Jeremy A. Blumenthal Sep 2025

Expert Paternalism, Jeremy A. Blumenthal

Florida Law Review

Scholars and policymakers from multiple disciplines have long debated whether and when paternalistic intervention might be appropriate to guide ordinary decisionmakers choices and behaviors. Recently, the use of empirical data has begun to inform this debate. Some such research has demonstrated that individuals' susceptibility to cognitive and emotional biases leads to nonoptimal decisions in a variety of areas, including health, finance, and safety, among others. This has led some scholars to suggest a role for third-party intervention to help protect citizens from their own biased decisionmaking.

Critics of this approach suggest that such intervention prevents individuals from learning from their …

Safeguarding The Safeguards: The Aca Litigation And The Extension Of Indirect Protection To Nonfundamental Liberties, Abigail R. Moncrieff Sep 2025

Safeguarding The Safeguards: The Aca Litigation And The Extension Of Indirect Protection To Nonfundamental Liberties, Abigail R. Moncrieff

Florida Law Review

As the lawsuits challenging the Patient Protection and Affordable Care Act (ACA) have evolved, one feature of the litigation has proven especially rankling to the legal academy: the courts' incorporation of substantive libertarian concerns into their structural federalism analyses. The breadth and depth of scholarly criticism is surprising, especially given that judges frequently choose indirect methods, including the structural and process-based methods at issue in the ACA litigation, for protecting substantive constitutional values. Indeed, indirect protection of constitutional liberties is a well-known and well-theorized strategy, which one scholar recently termed "semisubstantive review" and another theorized as "judicial manipulation of legislative …

Heroism Science

This article presents the development and implementation of the Heroic Imagination Project (HIP) in Portugal, tracing its evolution from inception to expansion across educational and community contexts. In 2018, the authors attended the Hero Round Table in San Francisco, receiving training from Zimbardo on the bystander effect and strategies to counteract it. Recognizing the absence of HIP curricula for younger audiences and the importance of fostering prosocial behavior early, the team created tailored programs: HIP Kids for children and HIP Teens for adolescents. Since 2018, these programs have been implemented in schools and social centers, reaching approximately 1,200 participants. Developed …

Leveraging Ai To Democratize The Hidden Curriculum In Medical Education: An Implementation Framework, James Keith Martin Ii, Mercedes Byrd Sep 2025

Leveraging Ai To Democratize The Hidden Curriculum In Medical Education: An Implementation Framework, James Keith Martin Ii, Mercedes Byrd

Libraries Scholarship

The “hidden curriculum” in medical education—comprising unwritten rules, values, and expectations—significantly impacts student success, yet remains inaccessible to students from underrepresented backgrounds. This paper presents a theoretical framework and practical implementation strategy for using artificial intelligence (AI) to democratize access to this hidden curriculum. We analyze how cognitive load theory and the Fast/Slow Thinking paradigm explain inequities in professional integration, then propose a comprehensive implementation approach to guide equitable AI integration. This model demonstrates how AI tools, when thoughtfully implemented, can reduce cognitive burdens on disadvantaged students, accelerate professional acculturation, and contribute to building an inclusive medical workforce.

Assertions Of Monastic Identity And Power In The Cloister And Nave Of St. Gall, John D. Treat Sep 2025

Assertions Of Monastic Identity And Power In The Cloister And Nave Of St. Gall, John D. Treat

The Ozark Historical Review

The Carolingian monastery lived in an unresolved tension between the purity of separation from the world and the benefits to be gained from secular engagement. To confront this dilemma, the parts of the monastery received new layers of symbolic meaning, opening some spaces to lay penetration while shielding others more securely. Here I will examine the monastic cloister and the nave of the abbey church as instances of these two tendencies.

“It’S Like Mental Marginalization”: Stories Of Four Music Students At A Hispanic Serving Institution., Sarah Minette Sep 2025

“It’S Like Mental Marginalization”: Stories Of Four Music Students At A Hispanic Serving Institution., Sarah Minette

Visions of Research in Music Education

Researchers have explored the ways in which P-12 teachers and students negotiate Latino/a/x/e cultural and musical identities in the classrooms (Abril, 2009; Lechuga & Schmidt, 2018; Palkki, 2015). While some have connected culturally responsive teaching to the needs of the growing number of Latino/a/x and Hispanic students in P-12 settings (Abril & Kelly-McHale, 2015), currently, no studies within music education address the experiences of music students at Hispanic Serving Institutions (HSIs), as well as the music making practices, curriculum, and faculty experiences at HSI. This case study examined how a music department at an HSI served the needs of its …

Music Making To Transgress: A Phenomenology Of Transgressive American Music Educators, Anders P. Lewis Sep 2025

Music Making To Transgress: A Phenomenology Of Transgressive American Music Educators, Anders P. Lewis

Visions of Research in Music Education

This phenomenological case study examined four self-described transgressive music teachers in the United States. Transgressive teachers may be described as those who challenge oppressive structures, both in educational settings and in the broader social context, to support marginalized students. Findings suggest that teacher identity creation and analytic frameworks of oppressive structures shape the elements of their transgressive pedagogies. These findings also suggest varied paths of becoming for transgressive teachers. The researcher concludes with suggestions for further research and implications for current teachers.

Autonomous Instrumental Music Learning On An Online Platform: How Is Study Motivation Related To Engagement And Study Outcomes?, Kai Tuuri, Jukka Vahlo, Oskari Koskela

Visions of Research in Music Education

Musical instruments have been recognized as attractive targets of volitionally developed long-term engagement. However, in music education research, the significance of autonomy in fostering learning motivation has mainly been perceived through the prism of student-teacher interaction. Addressing this gap, this study shifts the focus towards an autonomous learner perspective embracing the learner’s volitional approach and interest in engaging with musical instrument learning. Through an analysis of a survey sample (N=215) involving participants’ experiences with an online music learning platform, the study explores participants’ study motives and their association with study engagement, alongside the subsequent learning and wellbeing outcomes. An exploratory …

Conducting Inclusion: A Udl-Inspired Approach To Choral Education, Maria Varvarigou Sep 2025

Conducting Inclusion: A Udl-Inspired Approach To Choral Education, Maria Varvarigou

Visions of Research in Music Education

In this paper I explore the possibilities of a Universal Design for Learning (UDL)-inspired curriculum developed over four years of teaching a module on choral conducting education in three formats: online, as blended, and in-person. The learners were primary school generalist student-teachers. They had diverse backgrounds, experiences, and levels of confidence in choral singing and conducting. Examining UDL through the theoretical lens of inclusive pedagogy offered a theoretical foundation to discuss my approach to creating inclusive choral conducting environments that promote learning and participation. At the same time, implementing inclusive pedagogy through UDL brought to the surface institutional challenges and …
