Continued Conflation Confusion In Louisiana Negligence Cases: Duty And Breach, Thomas C. Galligan Jr.
Continued Conflation Confusion In Louisiana Negligence Cases: Duty And Breach, Thomas C. Galligan Jr.
Journal Articles
Negligence has five elements: duty, breach, cause-in-fact, scope of risk, and damages. Logic dictates that courts, lawyers, scholars, and law students should keep them separate. But they consistently fail to do so. Courts continue to conflate or collapse elements; they combine duty and scope of risk and they combine duty and breach. In combining duty and breach courts purport to determine duty based on the facts of the particular case but, in fact, they are really deciding a question of breach-whether the defendant exercised the care of a reasonable person under the circumstances. In conflating duty and breach courts are …

Porous polymer microspheres are employed in biotherapeutics, tissue engineering, and regenerative medicine. Porosity dictates cargo carriage and release that are aligned with the polymer physicochemical properties. These include material tuning, biodegradation, and cargo encapsulation. How uniformity of pore size affects therapeutic delivery remains an area of active investigation. Herein, we characterize six branched aliphatic hydrocarbon-based porogen(s) produced to create pores in single and multilayered microspheres. The porogens are composed of biocompatible polycaprolactone, poly(lactic-co-glycolic acid), and polylactic acid polymers within porous multilayered microspheres. These serve as controlled effective drug and vaccine delivery platforms.

The synergistic effect between metal ions and increasing the surface area leads to the fabrication of supercapacitor materials with high capacities. It is predicted that transition metal selenide compounds will be ideal electrode materials for supercapacitors. However, the defects of poor conductivity and volume expansion of the compounds are fundamental problems that must be solved. In this work, we successfully synthesized the cobalt–nickel selenide nitrogen-doped carbon (H-CoNiSe2/NC) hollow polyhedral composite structure using ZIF-67 as a precursor. The CoSe2 and NiSe2 nanoparticles embedded in the NC polyhedral framework offer a wealth of active sites for the whole …

Telehealth services can address many barriers to traditional office-based mental health services. Few studies have assessed youth and caregiver perceptions of and satisfaction with trauma-focused interventions delivered via telemental health. The current study presents data collected using the Telehealth Satisfaction Questionnaire (TSQ), which was developed to measure child and caregiver satisfaction with services, comfort with the telehealth equipment, and barriers to traditional office-based services. Thirteen clinicians delivered home- and school-based Trauma-Focused Cognitive Behavioral Therapy (TF-CBT) via videoconferencing on tablets and computers to 60 child patients (71.7% Latinx, 18.3% Black, and 10.0% non-Hispanic White). Patients and caregivers completed the TSQ at …

Nitrous oxide, also known as “laughing gas,” is a naturally occurring gas that is colorless, odorless, nonflammable, and nontoxic. It has been used as an inhalant anesthetic in the medical field for more than 150 years for dental and surgical procedures. Due to its wide availability and ability to cause euphoria, its recreational use is on the rise. We present a case of subacute combined degeneration (SCD) due to nitrous oxide-induced vitamin B12 deficiency. The patient presented with bilateral lower extremity paresthesia, weakness, and ataxic gait. The patient was found to have vitamin B12 deficiency. An MRI of the cervical …
Mitigating Catastrophe Risk For Landowners, Stewart E. Sterk
Mitigating Catastrophe Risk For Landowners, Stewart E. Sterk
Articles
Local, national, and global catastrophes entail significant risk for landowners. The government-sponsored National Flood Insurance Program illustrates how subsidizing insurance against catastrophe risk can result in overinvestment in risk-prone properties. Government intervention, however, has largely been a response to the historical failure of the private insurance industry to provide adequate protection against correlated risks, a failure with the potential to generate underinvestment in land and devastate existing owners.
When data is available about the incidence and severity of potential disasters, improvements in technology have made it more feasible for insurers to calibrate premiums and discounts with greater accuracy, and sophisticated …
Colorblind Nationalism And The Limits Of Citizenship, Ming Hsu Chen
Colorblind Nationalism And The Limits Of Citizenship, Ming Hsu Chen
Cardozo Law Review
Policymakers and lawyers posit formal citizenship as the key to inclusion. Rather than presume that formal citizenship will necessarily promote equality, this Article examines the relationship between citizenship, racial equality, and nationalism. It asks: What role does formal citizenship play in excluding noncitizens and Asian, Latinx, and Muslim citizens racialized as foreigners? What effects does it have on the meaning of being American as a non-White citizen? The Article argues that commitments to colorblind equality and democratic self-governance of the nation stand in contradiction to aspirations to protect all persons within the nation. Consequently, individual rights designed to remedy racial …

Lgbtq-Parent Families: Diversity, Intersectionality, And Social Context, Abbie E. Goldberg
Psychology
Lesbian, gay, bisexual, queer, and trans (LGBTQ) parents become parents in a variety of ways, including via reproductive technologies, through foster care and adoption, and in the context of different-gender relationships. This review addresses research developments over the past 5–6 years, revealing that LGBTQ people continue to face barriers in becoming parents, especially those who are trans, of color, and have limited financial means. Bisexual and trans parents are increasingly centered in research, and have unique experiences of parenthood related to navigating (in)visibility and stigma in various contexts. Recent work has documented the impacts of sociopolitical events (e.g., COVID-19, the …

Efficient Approach For Solving (2+1) D- Differential Equations, Luma N. M. Tawfiq, Noor A. Hussein
Baghdad Science Journal
In this article, a new efficient approach is presented to solve a type of partial differential equations, such (2+1)-dimensional differential equations non-linear, and nonhomogeneous. The procedure of the new approach is suggested to solve important types of differential equations and get accurate analytic solutions i.e., exact solutions. The effectiveness of the suggested approach based on its properties compared with other approaches has been used to solve this type of differential equations such as the Adomain decomposition method, homotopy perturbation method, homotopy analysis method, and variation iteration method. The advantage of the present method has been illustrated by some examples.
