The Use And Abuse Of Tradition: A Comment On Degirolami’S Traditionalism Rising, Andrew Koppelman
The Use And Abuse Of Tradition: A Comment On Degirolami’S Traditionalism Rising, Andrew Koppelman
The Journal of Contemporary Legal Issues
Marc DeGirolami’s essay, Traditionalism Rising, argues that the Supreme Court is now deploying what he calls “traditionalist methodology” to decide cases, and that when it cites tradition it is following a “larger, longstanding interpretive method.”
The paper is a valuable contribution that documents an important trend. The Court is in fact invoking tradition with remarkable frequency. But it is a mistake to call what the Court is doing a single “methodology.” Tradition is relevant in different ways in different contexts. It is confusing to conflate them.

Deontology In Graphs: An Elucidation, Alec Walen
The Journal of Contemporary Legal Issues
Representing conceptual relationships in graphic form can be clarifying. The exercise can make the graph composer and the graph reader ask questions they otherwise might not have asked. Of course, graphs also require the composer to make choices: what do you put in, what do you merely approximate, what do you try to make precise, what might look more precise than you mean to be? These choices need to be explained and defended to make the graphs meaningful representational tools. But if explained and defended, graphs can provide a distinctively helpful tool, especially to those like moral philosophers who tend …
The Acquisition Of Twitter: The Legal Interplay Between Elon Musk, Shareholders, Employees, And The Government, Florence Shu-Blankson
The Acquisition Of Twitter: The Legal Interplay Between Elon Musk, Shareholders, Employees, And The Government, Florence Shu-Blankson
University of Miami Business Law Review
This article examines the acquisition process of Twitter by Elon Musk. It will analyze the legal validity of Musk’s initial claims for rescinding his offer, as well as Twitter’s defense arguments. It will consider questions such as: Did Twitter cause a material adverse effect to its operations that would be a basis for Musk to avoid the deal? Did Musk run afoul of any regulatory requirements under the Securities and Exchange Commission (SEC) and Federal Trade Commission (FTC) regulations? What impact did the ultimate sale of Twitter have on other stakeholders, such as corporate executives and non-executives, shareholders, employees. The …
Virtual Stardom: The Case For Protecting The Intellectual Property Rights Of Digital Celebrities As Software, Alexander Plansky
Virtual Stardom: The Case For Protecting The Intellectual Property Rights Of Digital Celebrities As Software, Alexander Plansky
University of Miami Business Law Review
For the past several decades, technology has allowed us to create digital human beings that both resemble actual celebrities (living or deceased) or entirely virtual personalities from scratch. In the near future, this technology is expected to become even more advanced and widespread to the point where there may be entirely virtual celebrities who are just as popular as their flesh-and-blood counterparts—if not more so. This raises intellectual property questions of how these near-future digital actors and musicians should be classified, and who will receive the proceeds from their performances and appearances. Since, in the near-term, these entities will probably …

The Social Clerisy: Conservative Political Philosophy As A Philosophy Of Pluralism And The Social Group, Luke C. Sheahan
The Social Clerisy: Conservative Political Philosophy As A Philosophy Of Pluralism And The Social Group, Luke C. Sheahan
The Journal of Contemporary Legal Issues
Conservative political philosophers should be counted among, as Nisbet writes, “those thinkers who have resisted the appeal of the One, the unitary and monistic, and have found not merely reality but freedom and justice and equity to lie in plurality.” They should take as their starting point Nisbet’s tradition of the plural community. Given our place in history, following the increasing alienation and decline of social groups chronicled by Putnam and others, conservatives should feel free to pillage the ideas of pluralist thinkers outside the conservative tradition. Nisbet admits repeatedly throughout the decades of his long career that there seems …
Discord In Concordance Cosmology And Anomalously Massive Early Galaxies, Stacy S. Mcgaugh
Discord In Concordance Cosmology And Anomalously Massive Early Galaxies, Stacy S. Mcgaugh
Faculty Scholarship
Cosmological parameters are constrained by a wide variety of observations. We examine the concordance diagram for modern measurements of the Hubble constant, the shape parameter from the large-scale structure, the cluster baryon fraction, and the age of the universe, all from non-CMB data. There is good agreement for (Formula presented.) and (Formula presented.). This concordance value is indistinguishable from the WMAP3 cosmology but is not consistent with that of Planck: there is a tension in (Formula presented.) as well as (Formula presented.). These tensions have emerged as progressively higher multipoles have been incorporated into CMB fits. This temporal evolution is …

“So, Do Not Fear”: Religion And The Prevalence, Persistence, And Severity Of Anxiety Disorders Among Black Americans, Ann W. Nguyen, Nichole Cobb, Kedong Ding
Faculty Scholarship
Background: There is a dearth of scholarship that explicates the effects of religious participation on anxiety disorders among Black Americans. A better understanding of the links between religious participation, a coping resource, and anxiety disorders among Black Americans remains essential, given Black Americans are less likely than their white counterparts to seek professional treatment for mental health problems, leading to greater unmet mental health needs. The aim of this study was to investigate whether religious participation is associated with the prevalence, persistence, and severity of anxiety disorders among Black adults. Methods: We used a national sample of Black adults (N …

There are more than 5000 confirmed and validated planets beyond the solar system to date, more than half of which were discovered by NASA’s Kepler mission. The catalog of Kepler’s exoplanet candidates has only been extensively analyzed under the assumption of white noise (i.i.d. Gaussian), which breaks down on timescales longer than a day due to correlated noise (point-to-point correlation) from stellar variability and instrumental effects. Statistical validation of candidate transit events becomes increasingly difficult when they are contaminated by this form of correlated noise, especially in the low-signal-to-noise (S/N) regimes occupied by Earth-Sun and Venus-Sun analogs. To diagnose small …

A Quintic B-Spline Technique For A System Of Lane-Emden Equations Arising In Theoretical Physical Applications, Osama Ala’Yed, Ahmad Qazza, Rania Saadeh, Osama Alkhazaleh
College of Humanities and Sciences Faculty Papers
In the present study, we introduce a collocation approach utilizing quintic B-spline functions as bases for solving systems of Lane Emden equations which have various applications in theoretical physics and astrophysics. The method derives a solution for the provided system by converting it into a set of algebraic equations with unknown coefficients, which can be easily solved to determine these coefficients. Examining the convergence theory of the proposed method reveals that it yields a fourth-order convergent approximation. It is confirmed that the outcomes are consistent with the theoretical investigation. Tables and graphs illustrate the proficiency and consistency of the proposed …

But for the Internet, many of our interactions with others would be impossible. From socializing to shopping, and, increasingly, working and attending class, the Internet greatly facilitates the ease of our daily lives. However, we frequently neglect to consider that our conduits to the Internet have the potential to lead to harm and injury. When the Internet was in its infancy, and primarily was a repository of information, Congress recognized the threat of continual lawsuits against online entities stemming from the content created by their users. The Communications Decency Act of 1996 arose to mitigate the seemingly Herculean task for …
A Bloodless, Crownless, Hydroponic Conservatism: America In The 21st Century, Rachel Lu
A Bloodless, Crownless, Hydroponic Conservatism: America In The 21st Century, Rachel Lu
The Journal of Contemporary Legal Issues
Defining conservatism feels audacious. The mere attempt seems to place us in company with Lincoln, Kirk, Buckley, Hayek, Oakeshott, Scruton, Reagan and Thatcher, and many more illustrious personalities. One can hardly aspire to offer the definitive take; at best, we might hope to draw meaningful connections between a long-running conversation about conservatism, and the cultural or political struggles of our own time. That less-ambitious goal may still be very worthwhile, however. There is a reason why conservatives love to debate conservatism. It helps us to identify worthwhile goals, and remind ourselves why they matter. Looking at the political right today, …

Human immunodeficiency virus (HIV) testing during pregnancy is crucial for the prevention of mother-to-child transmission of HIV, through aiding prompt treatment, care, and support. However, few studies have explored HIV testing among pregnant women in Rwanda. This study, therefore, aimed to determine the prevalence and associated factors of HIV testing among pregnant women in Rwanda. We used secondary data from the 2020 Rwanda Demographic and Health Survey (RDHS), comprising 870 pregnant women. Multistage stratified sampling was used by the RDHS team to select participants. We conducted bivariable and multivariable logistic regression to explore factors associated with HIV testing using SPSS …

Implantation Of A Capsular Tension Ring During Cataract Surgery Attenuates Predicted Remodeling Of The Post-Surgical Lens Capsule Along The Visual Axis, Kurt A. Ameku, Caleb C. Berggren, Ryan M. Pedrigi
Department of Mechanical and Materials Engineering: Faculty Publications
Introduction: Cataract surgery permanently alters the mechanical environment of the lens capsule by placing a hole in the anterior portion and implanting an intraocular lens (IOL) that has a very different geometry from the native lens. We hypothesized that implant configuration and mechanical interactions with the post-surgical lens capsule play a key role in determining long-term fibrotic remodeling.
Methods: We developed the first finite element-growth and remodeling (FE-G&R) model of the post-surgical lens capsule to evaluate how implantation of an IOL with and without a capsular tension ring (CTR) impacted evolving lens capsule mechanics and associated fibrosis over …
Beyond Standard Model: Structure Factors Of Models Of Different Quarks And Neutrinos As Spinning Structures Made Of Basic Fractional Charges +- E/3, Polievkt Perov
College of Arts & Sciences Faculty Works
We consider a possible line of “elementary” particles as composite spinning structures made of just two basic elementary particles of charges + e/3 and -e/3. In considered structures, up to 3 basic charges can be on the axis of rotation and other charges can be in a revolving motion about the axis. In addition to the simplest structures of quarks, an electron and a neutral particle containing mostly one or no charges on the axis of rotation, suggested initially in [4], we analyze possible spatial structures of spinning composite particles having 2 or 3 charges on the axis of rotation. …
Synthesis And Characterization Of Bio Based Amphiphilic Molecules, Vandana Singh
Synthesis And Characterization Of Bio Based Amphiphilic Molecules, Vandana Singh
Theses and Dissertations
Among various molecular self-assemblies, low molecular weight gelators (LMWGs), that can form gels in organic solvents/water/oils, have gained much research attention due to their huge potential applications. Generally, gels are soft nanomaterials formed by the self-assembly of amphiphilic molecules into a three-dimensional fibrous network entrapping the solvent.
As these gels are formed by self-assembly via non-covalent interactions they are reversible and differ from macromolecular gels. To synthesize LMWGs, biomolecules such as fats, oils, fatty acids, lignocelluloses, sugars, amino acids, and peptides are commonly used as their inherent property favors self-assembly. In the current scenario, interest in synthesizing bio-based gelators has …

We Experimentally Realize the Peregrine Soliton in a Highly Particle-Imbalanced Two-Component Repulsive Bose-Einstein Condensate in the Immiscible Regime. The Effective Focusing Dynamics and Resulting Modulational Instability of the Minority Component Provide the Opportunity to Dynamically Create a Peregrine Soliton with the Aid of an Attractive Potential Well That Seeds the Initial Dynamics. The Peregrine Soliton Formation Is Highly Reproducible, And Our Experiments Allow Us to Separately Monitor the Minority and Majority Components, And to Compare with the Single Component Dynamics in the Absence or Presence of the Well with Varying Depths. We Showcase the Centrality of Each of the Ingredients …

Marine Science
Arctic marine ecosystems are becoming more boreal due to climate change. Predictions of ecosystem change focus mainly on Arctic inflow or interior shelves, with few comprehensive studies on Arctic outflow regions. During September–October 2017, soft-bottom communities were sampled and benthic ecosystem processes were quantified at 12 stations on the Northeast Greenland shelf (outflow shelf) and compared to the last regional ecosystem study, conducted in 1992 and 1993. The benthic habitat was characterized in terms of sediment granulometry, pigment concentrations, and porewater chemistry (dissolved inorganic carbon, nutrients). Total abundance and biomass of macrobenthos and meiobenthos, bacterial abundance, porewater dissolved inorganic carbon …

Program completion is a translation from the language of logic programs into the language of first-order theories. Its original definition has been extended to programs that include integer arithmetic, accept input, and distinguish between output predicates and auxiliary predicates. For tight programs, that generalization of completion is known to match the stable model semantics, which is the basis of answer set programming. We show that the tightness condition in this theorem can be replaced by a less restrictive “local tightness” requirement. From this fact we conclude that the proof assistant ANTHEM-P2P can be used to verify equivalence between locally tight …

In a non-payment proceeding, the court ruled that the landlord's offer of a renewal lease during a holdover proceeding did not create a new tenancy but settled pending litigation. The court distinguished relevant laws and held that the landlord was obligated to offer a renewal lease, and by offering it during litigation, did not voluntarily create a new tenancy. Respondent's argument that a new tenancy was created was denied.

Sodium- (Na+) and potassium- (K+) ion batteries are cost-effective alternatives to lithium- ion (Li+) batteries due to the abundant sodium and potassium resources. Solid polymer electrolytes (SPEs) are essential for safer and more efficient Na+ and K+ batteries because they often exhibit low ionic conductivity at room temperature. While zwitterionic (ZW) materials enhance Li+ battery conductivity, their potential for Na+ and K+ transport in batteries remains unexplored. In this study, we investigated the effect of three ZW molecules (ChoPO4, i.e., 2-methacryloyloxyethyl phosphoryl- choline, ImSO3, i.e., sulfobetaine ethylimidazole, and ImCO2, i.e., carboxybetaine ethylimidazole) on the dissociation of Na+ and K+ coordination …
