Musical Chairs: Vertical Antitrust Should Prevail Over Congressional Payola Prohibitions To Protect Musicians, Maria Stevenson Jan 2025

Musical Chairs: Vertical Antitrust Should Prevail Over Congressional Payola Prohibitions To Protect Musicians, Maria Stevenson

The University of Chicago Business Law Review

The music industry is highly concentrated at multiple stages along the production chain between the Big Three music group conglomerates (Universal, Sony, and Warner) and the three largest streaming services (Spotify, Apple, and YouTube). The Big Three and the streaming services have extensive vertical arrangements, from the Big Three having ownership stakes in the largest streaming services to their contracts for the streaming services’ algorithms to prioritize Big Three artists. This resembles historical radio era payola arrangements. This double layer of market concentration and the arrangements between music production and distribution primarily harm musicians, who lack the bargaining power to …

Market Signals And Price Setting: Unveiling Barometric Price Leader In The Hotel Sector, Sung W. Lee, Donna Quadri-Felitti, Ami Sharma, Seoki Lee

Journal of Hospitality Financial Management

This paper introduces the concept of barometric price leadership to the hotel sector, where a leading hotel sets prices that reflect demand and supply trends, guiding other hotels in the market to set their prices. While the significance of competitor-based pricing has been rec- ognized, the strategic influence of such price leaders on rivals' pricing has not been thor- oughly examined. This conceptual study delves into the existing literature to discuss the underpinnings and implications of such leadership, illustrating how prices portray vital mar- ket information. The study argues for the recognition and strategic importance of barometric price leaders in …

No More, No Less: A Constitutional Challenge To North Carolina's Noneconomic Damages Cap In Medical Malpractice Litigation, Pierce A. Shipway Jan 2025

No More, No Less: A Constitutional Challenge To North Carolina's Noneconomic Damages Cap In Medical Malpractice Litigation, Pierce A. Shipway

Campbell Law Review

In 2011, the North Carolina General Assembly passed General Statute section 90-21.19, statutorily limiting the amount of noneconomic damages medical malpractice plaintiffs can receive, regardless of the jury’s determination. At the time, critics of the law cited constitutional issues with the statute, but now the North Carolina Court of Appeals has finally answered the question: Does the cap violate our sacred and inviolable right to a trial by jury? Although the North Carolina Court of Appeals says no, this Comment argues yes—by inserting itself into the jury box, the General Assembly unduly and unconstitutionally infringes on the ancient mode of …

The Youth Music Institute At The University Of Wisconsin, Summer 1969, Phillip Hash

Faculty Publications - Music

The purpose of this historical study was to examine the planning, implementation, participants, and activities associated with the Youth Music Institute (YMI) held at the University of Wisconsin from July 7 to August 1, 1969. Organizers hoped this event would bridge the communication gap between society, educational institutions, and youth through a collaborative learning environment involving students, music educators, guidance counselors, and professional recording artists. Participants used the term “youth music” to encompass multiple genres that captured the interest of young people, including various forms of rock, blues, soul, country western, jazz, and ethnic styles. The program consisted of lectures …

“…They’Re Still Blaming It On The Person Being Lazy”: Stigma In The Lives Of Precariously Housed And Unhoused People, Brenna Jones, Brian Pitman Jan 2025

“…They’Re Still Blaming It On The Person Being Lazy”: Stigma In The Lives Of Precariously Housed And Unhoused People, Brenna Jones, Brian Pitman

Graduate Research - Criminal Justice Sciences

Housing is increasingly a market exploited by corporations and what Samuel Stein calls the Real Estate State. Consequently, the state continues to target those impacted by these policy choices with removal and further stigmatization to clear the way for profit-making, which is tied to the housing market. The process of removal is accomplished through various forms of stigmatization and dehumanization, first at the public and institutional level. These stigmas then trickle down to intra-community and self-stigmatization. In all, these stigmas serve to justify and maintain the evolving status quo of homelessness and precarious housing, deflecting the blame of this “crisis” …

Detection Of Hybrid Optical Anapoles In Dielectric Microspheres, Uttam Manna, Iker Gómez-Viloria, Robert Sevik, Isaac Tribaldo, Mahua Biswas, Gabriel Molina-Terriza, Jorge Olmos-Trigo

Faculty publications – Physics

Nonradiating optical anapoles are special configurations of charge-current distributions that do not radiate. It was theoretically predicted that, for microspheres, electric and magnetic dipolar coefficients can simultaneously vanish by engineering the incident light, leading to the excitation of nonradiating hybrid optical anapoles. In this work, the experimental detection of hybrid optical anapoles in dielectric microspheres (TiO2) is reported using dual detection optical spectroscopy, developed to enable sequential measurement of forward and backward scattering under tightly-focused Gaussian beam (TFGB) illumination. The results show that the excitation of TiO2 microspheres (diameter, d ≈1 µm) under TFGB illumination leads to …

Examining Equifinality And Multifinality Using Outcome-Partitioned Person-Centered Analyses: A Proof-Of-Concept With Youth Developmental Assets And Health, Luke Russell, Todd M. Jensen, Jonathon J. Beckmeyer, Chang Su-Russell Jan 2025

Examining Equifinality And Multifinality Using Outcome-Partitioned Person-Centered Analyses: A Proof-Of-Concept With Youth Developmental Assets And Health, Luke Russell, Todd M. Jensen, Jonathon J. Beckmeyer, Chang Su-Russell

Faculty Publications - Family and Consumer Sciences

Early general systems theorists proposed a key difference between living systems and physical systems is the widespread presence of equifinality and multifinality among living organisms. That is, in living systems, there are often variable pathways to the same outcomes (equifinality), or the same starting conditions can lead to disparate outcomes (multifinality). Family scientists, however, frequently use methods (adapted from the physical sciences) that fail to reflect these characteristics within their statistical models. In this paper, we propose and provide a preliminary proof-of-concept of how an outcome-partitioned set of person-centered analyses might be used to develop alternative models that more comprehensively …

Gay Rodeos, Western Wear, And Unresolved Tensions In 21st-Century North America Cowboy Culture And Esthetics, Kelly L. Reddy-Best, Malena Silva Jan 2025

Gay Rodeos, Western Wear, And Unresolved Tensions In 21st-Century North America Cowboy Culture And Esthetics, Kelly L. Reddy-Best, Malena Silva

Faculty Publications - Family and Consumer Sciences

In the 1970s, activists founded the International Gay Rodeo Association in the North American Midwest, disrupting traditional heteronormative and hypermasculine norms within cowboy culture. In this research, we critically analyze the intersections of cowboy manifestations and twenty-first century LGBTQ+ communities in North American queer cowboy portrayals via the gay rodeo. Specifically, we examine how the gay rodeo creates space for LGBTQ+ style, fashion, and dress embodiments in relation to the longstanding, heteronormative Wild West hero of the late 1800s. We analyzed two types of primary sources: the 2014 film Queens & Cowboys: A Straight Year on the Gay Rodeo and …

Carceral Consequences And Perverse Perks: Care And The Disciplinary Alternative School, Kaitlyn J. Selman Jan 2025

Carceral Consequences And Perverse Perks: Care And The Disciplinary Alternative School, Kaitlyn J. Selman

Faculty Publications - Criminal Justice Sciences

Drawing on in-depth interviews with current and former students, parents, teachers, and staff members connected with three alternative schools in one Kentucky, USA school district, this work contributes to the theorization of carceral care. Instead of reducing the alternative school, its processes, and its functions down into a dichotomized question of good or bad, productive or violent, we come to see the dialectical nature of carcerality and the logics of care. Specifically, the negative consequences that students are subjected to are justified and internalized by the (perverse) benefits of attendance, thus dissipating from the realm of critique. As such, I …

The Effect Of Length Of Nursing Shift On The Development Of Medical Errors, Andrew J. Hom Jan 2025

The Effect Of Length Of Nursing Shift On The Development Of Medical Errors, Andrew J. Hom

Nursing | Senior Theses

The relationship between extended nurse work hours and increased clinical errors is a growing concern in nursing and healthcare systems. This issue has only grown more pronounced since the pandemic, which exacerbated staffing shortages and placed unprecedented demands on the nursing workforce. Longer shifts often lead to fatigue, impaired decision-making, and decreased cognitive performance, creating challenges for both nurses and patients. To better frame the analysis, this thesis relied on The Swiss Cheese Model to better conceptualize risk management. This thesis examined the correlation between consecutive hours worked and the frequency of errors made by nurses while also exploring the …

Atypical Presentation Of Cd4+ Small/Medium T-Cell Lymphoproliferative Disorder, Rafael Do Valle, Reem Ayoub, Marshall Hall, Henry Lim, Christian Scheufele, Garrett Furth, Michael Carletti, Stepehen E. Weis

North Texas Research Forum 2025

Introduction: Primary cutaneous CD4+ small/medium T-cell lymphoproliferative disorder (PCSM-LPD) is a rare cutaneous disorder that until 2016, was classified as a primary cutaneous lymphoma. PCSM-LPD histopathologically consists of a localized proliferation of small to medium-sized T lymphocytes. Clinically there is minimal to no systemic involvement. It typically presents as an asymptomatic, solitary red-purple nodule, papule, or plaque on the face. PCSM-LPD has an indolent course and an excellent prognosis. It is important to recognize PCSM-LPD as a distinct entity from primary cutaneous lymphoma to avoid treatments with side effects. Case Presentation: A 68-year-old female with a history of insulin-dependent type …

North Texas Research Forum 2025

Background Patients rely on durable medical equipment (DME) to maintain their independence, however supplying and ordering DME for patients is challenging due to lack of a clear workflow, inadequate documentation, and differing coverage criteria, which has led to delays in patients receiving their DME. Current criteria to order DME include the following items: equipment description, quantity, length of need (estimate), diagnosis, recent height and weight, name, date of birth, home address, insurance company and member ID. The objective of this quality improvement project is to provide a clear and concise template for providers to use in ordering DME. Methods The …

Objective: This case report highlights the diagnostic challenges of non-traumatic myositis ossificans (MO), a rare benign heterotopic ossifying lesion, and emphasizes its potential to mimic malignancy. Case Presentation: An 18-year-old female with no trauma history presented with a one-month history of progressive right calf pain, ankle weakness (4/5 strength), and difficulty ambulating. Initial ultrasound suggested a hematoma, but the persistence of symptoms prompted advanced imaging. CTA revealed arterial extravasation, while MRI identified a heterogeneously enhancing soleus muscle mass, raising suspicion for sarcoma. Core biopsy demonstrated focal bone formation, mitotically active stroma, and a "zone phenomenon" (central cellularity with peripheral osteoid …

Granulomatosis with polyangiitis (GPA) is characterized by vasculitis of small and medium sized blood vessels and granulomatous lesions of the upper respiratory tract. A rare condition associated with GPA, subglottic stenosis, presents in about 20% of cases on inpatient GPA. Symptoms such as stridor, hoarseness, dyspnea and dysphagia are hall marks of subglottic stenosis. Here we present the case of a male patient with life threatening subglottic stenosis that required tracheostomy.

North Texas Research Forum 2025

Background: Residency is defined by constant change. The expectations, specialty, preceptor teaching styles and varied knowledge sets needed for each rotation differ greatly. As a result, residents are forced to adapt their learning styles quickly, to ensure they optimize the small amount of time allotted to them. Multiple studies have shown the high levels of stress, depression, anxiety and impostor syndrome that run rampant throughout medical learners, residents included. Our residency program has recently started a new obstetrics rotation with many requirements still unknown. This study evaluates the efficacy of the update to the “The Intern Survival Handbook” in mitigating …
