Religious freedom has re-emerged as a controversial issue in the courts, in the Church, and in the public square in the United States. This essay examines the groundbreaking contribution that John Courtney Murray, SJ made to bring about a paradigm shift in Roman Catholic teaching on religious freedom. This shift can be traced to the Church’s transitioning from the view that “error has no rights” to only people—not ideas—have rights. In his classic essays in We Hold These Truths, John Courtney Murray developed an understanding of “the American proposition” that integrated a theological account of human good with the search for public consensus in a constitutional democracy. While this understanding of the relationship between religious freedom and political life was incorporated into Catholic social teaching at the Second Vatican Council, subsequent developments in both political theory and theology call Murray’s understanding of public discourse into question. Religious freedom is too important a right to be politicized. Religions have an important role to play in the public sphere and are an indispensable voice in ethical conflicts of different kinds. Therefore, religions are necessarily political. But this does not mean that they should follow a political theology which claims that only those laws are valid that concord with the natural and, ultimately, divine law. I analyze the theological context of the religious freedom debate in the twentieth century, adding a theological-ethical analysis to the legal interpretations. The contemporary context presents countless ideologies and conflicting views about what femininity is and what it is not. In particular, the modern pursuit of equality and autonomy has resulted in the perception of motherhood as inconvenient in some quarters or, worse yet, inconsequential. The thesis of the unity of the virtues—one must possess all of the virtues to possess even one of them—was upheld in different forms by Plato, Aristotle, Augustine, and Aquinas. However, contemporary moralists almost universally decry this thesis as distorting the nature of virtue as it is materialized in the lives and actions of ordinary people. The widely publicized British case of Charlie Gard became an international cause célèbre when the treating physicians petitioned the British courts to prevent the parents from taking their dying child to America where a physician held out promise of an unproven experimental therapy. The case became more sensationalized when the press reported that Pope Francis had intervened in the case against the position of the Vatican’s Academy for Life on the appropriate response to a patient with a lethal genetic disorder for which there was no known treatment. It seems likely that change in Islam will be affected both by outside and internal sources, as was the case for the Catholic Church and its journey to Dignitatis Humanae. However, one thing the Catholic experience suggests is that meaningful and profound change does not simply come from outside pressures; it comes from authentic and sincere evaluation and interpretation by insiders of a religious tradition of that tradition itself. I argue that the Christian Neo-conservatives (like many before them, including the Medieval crusaders) read the bible mythologically, and thus uproot the the bible from its traditional moral, theological, historical, and grammatical anchors in service to a specific eschatological vision. This shift is rhetorical in nature in that those receiving the biblical text now are not the same as those who originally received it, nor are they the same as the scholars, theologians, and historians who have been careful to read the text with integrity. The call for Justice and Mercy in the teachings of Pope Francis raises critical questions across theological and secular contexts. In the light of the Pontiff’s call for a Jubilee year of Mercy, in Evangelii Gaudium, and references in his teachings to these themes, I intend to investigate the theological meaning of Justice and Mercy and to reconcile these with what Pope Francis means. Then proffer as a concrete example, discordancy in Africa as an opportunity for a doctrinal and magisterial definition on the use of condoms as prophylactics to show a Church that acts mercifully and does justice.

The present study analyzes the socio-historical context and setting narrated in the canonical episode of Paul’s arrest and his treatment in Jerusalem according to the narrative of Acts 21:27-40a and 22:23-29. The pericopes become the fundamental platform through which it is possible to present both a hermeneutical and theological interpretation of the liabilities and ultimate consequences of racial profiling, especially when it is exercised by the civil authorities, an institutionalized power, or a general culture. The ethical debate about guns in America pivots around the themes of harmful consequences and individual liberty. Gun control advocates argue for greater legal control of guns on the grounds that such a policy would save lives. They envision a society ruled by an enlightened policy that seeks to minimize harm and maximize benefit for all. On the other hand, proponents of gun control shift the focus in the debate from consequences to individual liberty, which they elevate to a position of overriding value.
