A Due Measure Of Fear In Criminal Judgment, Benjamin L. Berger

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

What ethos is appropriate to the modern act of criminal judgment? in the long history of the criminal trial, passing judgment on the accused was, for the adjudicator, a fearful act filled with the ologically inspired anxiety. This paper argues that, despite the contemporary attenuation of this specific form of anxiety, criminal judgment ought still to be infused with a due sense of the perils associated with passing legal and moral judgment upon another. There is a strange disconnect between the formal understanding of the separation of religion from government in the United States and the almost ubiquitous use of religious language in political discourse, not to mention the web of complicated religious motivations that sit on or just below the surface of policy debates. For those who understand that God's littlest children have the same right to life that all God's children have, the day on which the United States Supreme Court decided Roe v. Wade was a day that echoed the grief and frustration that, more than a century earlier, accompanied the decision in Dred Scott v. Sandford. And the day on which the United States Supreme Court decides to overturn Roe v. Wade and all the other pro-abortion decisions will be a day of heart-felt thanksgiving. How can it be that respected Catholic legal scholars can reach seemingly opposite conclusions about “Law and Economics?” Stephen Bainbridge has argued that both the descriptive and normative aspects of the Law and Economics movement are consistent with and even demanded by the Catholic understanding of the nature of the human person in a fallen world and our historical experience with totalitarian regimes. This article suggests that church-linked universities and colleges can and should show that there is an alternative to the expediency and pseudo-utilitarian thinking which currently dominates higher education. Such institutions can and should serve as beacons of a virtuous approach to education which can show others a more positive way forward. Theology and ethics”both disciplines mutually informing the other”hold the key to fostering and promoting a true culture of ministry both in the day-to-day existence of universities and colleges and in nurturing young minds to take that culture of ministry out into the wider community.
