Our symposium conveners have focused us on “the relationship between liberalism and Christianity and their influence on American constitutionalism.” My objective is to complicate the relationship and reorient the influence. The focus of my inquiry is the liberty of conscience and its implications for the relationship between church and state. By approaching these issues through the lens of political theology (as distinct from either political or constitutional theory), hope to show that some of the most significant embodiments of conscience in the American colonies can neither be squared with an individualistic liberalism (as some on the left are prone to …

Over the past 45 years, there has been a dramatic decrease in the number of religious and priests working in Catholic schools in the United States. Currently, 96% of all elementary and secondary faculties are comprised of lay men and women (McDonald, 2010). This same phenomenon can be found in Marianist-sponsored secondary schools in the United States. Prior to accepting a leadership position in a high school, Marianist brothers and priests were formed in a comprehensive theological and spiritual framework which incorporated the study of scripture, Church history, magisterial documents, liturgical prayer, moral theology, and other spiritual practices. Surely there is enough kindling lying about in the Bible and in subsequent moral theology to fire up love for neighbors and compassion for countless “friends” in foreign parts--and in crisis. And, surely, the momentum of love’s labor for the just redistribution of resources, fueled by activists’ appeals for solidarity, should be sustained by stressing that we are creatures made for affection, not for aggression. Yet experience, plus the history of the Christian traditions, taught Reinhold Niebuhr, who memorably reminded Christian realists, how often love was “defeated,” how a “strategy of brotherhood . . . degenerates from mutuality to a …

The First Amendment's Religion Clauses: "Freedom Of Conscience" Versus Institutional Accommodation, Michael J. White

The phrase "freedom of conscience" is, of course, not to be found in the United States Constitution: the First Amendment says only that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof." However, it seems probable that one, then-contemporary Protestant conception of freedom of conscience was presupposed in these two clauses. Evidence for this conjecture can be found not only in the debate and proposals concerning the Bill of Rights of the United States Constitution but also in the frequently more expansive language of early state constitutions.

Kings And Tyrants: Leonardo Bruni's Translation Of Xenophon's "Hiero", Brian Maxson

Leonardo Bruni published one of his most widely copied translations, Xenophon's pro-monarchical Hiero, shortly before he penned his more famous original works, his Dialogues and Panegyric to the City of Florence. Scholars have traditionally focused on the political ideas present in these original treatises; yet, despite the centrality of political ideas to the Hiero, its temporal proximity to these works, and its enormous popularity (the work exists in 200 fifteenth-century manuscripts), scholars have neglected to offer a full assessment of Bruni's translation in the context of these works. Those who ignore Luther’s critical agility in moral reasoning based on natural law in favor of a reactionary turn to a regime of biblical law create “misery and tribulation,” as Luther lamented, and seriously enfeeble the Christian faith for life today. Christians rightly use their God-given powers of reason to work out affairs in the present order.

In an effort to assess the latest thinking in the Roman Catholic Church on economic matters, this communications note briefly highlights the recent publication of a new encyclical by Pope Benedict XVI, Caritas in Veritate (Charity in Truth). Core ethical values, consistent with previous examples of Catholic Social Teaching (CST), are retained. However, some important nuances are added to previous treatments and certain points of emphasis are shifted to account for recent global developments. Key areas that relate to abiding marketing issues are spelled out and some brief commentary on matters of importance to macromarketing is offered.

Although J.R.R. Tolkien’s reputation in recent years has benefited immensely from Peter Jackson’s film productions of The Lord of the Rings, C.S. Lewis still far outreaches him in terms of public awareness and popularity, specifically within the Christian world. Most are surprised to learn that Tolkien played a major role in Lewis’ conversion, rather than vice versa, and that their famous friendship did not continue indefinitely, but began to fade with the publication of Lewis’ The Chronicles of Narnia. In Planned Parenthood of Southeastern Pennsylvania v. Casey,' the Supreme Court replaced the trimester framework, first articulated nineteen years earlier in Roe v. Wade,2 with a new test for determining the constitutionality of abortion regulations-the "undue burden standard."3 The Court's 2007 decision in Gonzales v. Carhart 4 was its most recent occasion to use the undue burden standard, as the Court was called upon to ascertain the constitutionality of the Partial-Birth Abortion Ban Act, a federal statute proscribing certain methods of performing second- and third-trimester abortions.5 A majority of the Court held that the regulation was constitutionally permissible, finding that …

Despite a long-standing historical debate in Catholicism about whether second grade is an age-appropriate time to receive the Sacrament of Reconciliation, there has been a virtual absence of Catholic children's own voices and perspectives about this sacrament and its spiritual and moral effects. Joining a growing number of religious scholars who stress the need to engage in child-centered research, I conducted a qualitative study interviewing Catholic second graders about the Sacrament of Reconciliation. The purpose of this article is to analyze their drawings of this religious ritual. According to many psychologists and art therapists, children can best capture how they …

The development of the commitment of All Hallows College to poverty reduction is recounted. From its founding in 1842, All Hallows was focused on training seminarians for ministry in impoverished areas worldwide. Faced with a decline in candidates for the priesthood, it began offering lay ministry training in the early 1980s, with a special emphasis on the home mission in Ireland. It became renowned for its pastoral ministry education. The college instituted a justice/service element in all its courses and has created a postgraduate program in Social Justice and Public Policy The genesis of the latter, its requirements, and goals …

The Problem Of Catholic School Teachers Deferring To The Home On Controversial Religious Issues, Graham P. Mcdonough

This paper observes that an ironic tension occurs in the discussion of controversial issues in some Catholic schools. One technique that teachers use in response to student disagreement with the official Church view on a controversial issue like contraception, homosexuality, or female ordination is to present Church teaching but then suggest that students follow up at home with their parents for further information. While this technique is promising to some degree, it sits uneasily against the remarks that some Catholic education commentators make regarding deficiencies in the home regarding student formation and socialization in the faith.
