The Law Of Information States: Evidence From China And The United States, Bridget Fahey, Yuping Lin, Taisu Zhang Jan 2024

The Law Of Information States: Evidence From China And The United States, Bridget Fahey, Yuping Lin, Taisu Zhang

Public Law and Legal Theory Working Papers

Government could not function—legally, administratively, or politically—without producing information about the population, the economy, crime, elections, public health, and more. This Article theorizes the informational incentives of political and administrative officials and the legal interventions that can control them. It then uses case studies in the United States and China to illustrate those informational dynamics in practice. Our account reveals a novel form of information regulation: government structure and, in particular, the vertical division of informational powers between levels of government, or “informational federalism.” We describe the use of informational federalism and its distinctive functions as part of the portfolio …

How Much Does U.S. Fiscal System Redistribute?, Thomas Coleman, David A. Weisbach Jan 2024

How Much Does U.S. Fiscal System Redistribute?, Thomas Coleman, David A. Weisbach

Public Law and Legal Theory Working Papers

There is a widespread view that the tax and transfer system has become less progressive and less redistributive. To assess this view, we compare data from three studies: Con- gressional Budget Office (2024), Piketty, Saez, Zucman (2018), and Auten and Splinter (2024). Although they use different definitions of income, units, and taxes and transfers, all three show that the tax and transfer system has become more redistributive, not less. We also review all studies of the issue since 2012, which confirms these findings. In short, there is robust evidence across definitions and methodologies, that the tax system has become more …

The Additionality Double Standard, James Salzman Jan 2024

The Additionality Double Standard, James Salzman

Public Law and Legal Theory Working Papers

Carbon offsets are widely criticized for lacking additionality. The public debate, how- ever, has failed to recognize that the problem of additionality goes far beyond offsets. It arises any time the government subsidizes an activity. Programs with longer histories than offsets and far more money at stake offer valuable lessons for managing lack of additionality in offsets. The article sets out the current efforts to prove offset additionality, explains why major government programs present comparable additionality challenges, and show why other programs’ problems of additionality are perceived as significantly different than those for offsets. We examine the toolkit used to …

Admissions Essays After Sffa, Sonja B. Starr

Public Law and Legal Theory Working Papers

The Supreme Court concluded its 2023 decision barring affirmative action in university admissions with a qualification: although they may not give weight to “race qua race,” universities may consider individual applicants’ discussion of race-related life experience that bears on their strengths and potential. This “essay carveout” provides a potential path forward for universities (and other entities to which the affirmative-action ban may eventually apply). But the Court also warned against using it to enact “indirect” affirmative action, and legal advocates of colorblindness stand poised to challenge any use of essays that appears to stray over this line. So where is …

Unwritten Administrative Law And The Regulatory Last Mile, Anthony B. Derron Jan 2024

Unwritten Administrative Law And The Regulatory Last Mile, Anthony B. Derron

Public Law and Legal Theory Working Papers

Programs like the Clean Water Act, Clean Air Act, and Resource Conservation and Recovery Act are ostensibly federal. But once they change hands from national to subnational, they’re implemented through state statutes and regulations, not direct enforcement of the United States Code. As a result, state, not federal, administrative law governs in many bread-and-butter situations. Through a comprehensive fifty- state survey, I find that this body of law is largely unwritten.

Yet cooperative federalism relies on the capacity of state institutions to function. And equally critical is the existence of law that shepherds a program from congressional subcommittee to the …

The Geopolitics Of Digital Regulation, Aziz Z. Huq Jan 2024

The Geopolitics Of Digital Regulation, Aziz Z. Huq

Public Law and Legal Theory Working Papers

Contemporary regulation of digital technologies by nation-states unfolds under a darkening shadow of geopolitical competition. The United States government operates simultaneously in a domestic political environment dominated by oligopolistic firms competing to expand, and in an international political environment wherein it competes with other sovereign nations by cultivating and deploying digital technological capacities for geostrategic ends. Thanks to the ensuing cross-cutting pressures, national and supranational regulation can take on surprisingly reticulated, even baroque or perverse, forms.

Three recent monographs offer illuminating and complementary maps of these geopolitical conflicts and the national responses to digital technologies upon which they rest. One …

Cash Substitution And Deferred Consumption As Data Breach Harms, Lisa Yao Liu, Lior Strahilevitz Jan 2024

Cash Substitution And Deferred Consumption As Data Breach Harms, Lisa Yao Liu, Lior Strahilevitz

Public Law and Legal Theory Working Papers

Federal courts have long been divided over whether consumers whose data are breached suffer an “injury in fact” that gives them standing to sue under Article III of the United States Constitution. Judicial opinions find no constitutional standing in a narrow majority of such cases, and plaintiffs are likely to lose absent causal links to subsequent identity theft or the disclosure of embarrassing information. Consumers whose data are breached thus are left without a federal remedy, and firms’ incentives to invest in data security are diminished. Our paper identifies a novel injury that results from data breaches. Upon learning about …

Global Communities: The Potential Of Street Art And The Public Space, Elena Picech Jan 2024

Global Communities: The Potential Of Street Art And The Public Space, Elena Picech

The Coastal Review

This paper highlights the significance of physical proximity and the potentiality of socio-spatial situations as tools to enrich study abroad programs. Particular attention is given to street art and the public space. While, studying on-site can be somewhat uncomfortable, it can potentially prompt unique reflections, enhance student’s learning and encourage introspection. Being on-site provides the opportunity to come into contact and to connect with the physical objects and their environment. It enables a multisensory and immersive embodied experience. Leveraging art for communicative educational activities can facilitate a participatory experience, promote critical thinking and enhance cultural understanding.

Tbp1: An Essential Regulator Of Transcription In Toxoplasma Gondii, Robert Kelly Jan 2024

Tbp1: An Essential Regulator Of Transcription In Toxoplasma Gondii, Robert Kelly

Master's Theses and Capstones

Transcription is well-conserved across eukaryotes, lending itself to countless studies in model organisms. Still, some early-diverging eukaryotes, such as Apicomplexans, continue to deviate from canonical gene expression. One such Apicomplexan is the single-celled parasite, Toxoplasma gondii. Toxoplasma maintains many elements of conventional eukaryotic transcription but demonstrates a relatively short 8-hour replication time. This suggests that transcription is tightly regulated in these parasites, consistent with their ability to differentiate between life stages per the demand of the host environment. Transcription initiation has, however, remained elusive in Toxoplasma. The formation of a preinitiation complex (PIC) has not been characterized as the parasites …

Role Of Edaravone Nanosuspension In Preterm Labor And Birth Outcomes, Sruthi Sarvepalli Jan 2024

Role Of Edaravone Nanosuspension In Preterm Labor And Birth Outcomes, Sruthi Sarvepalli

Theses and Dissertations

Annually, preterm birth (PTB) affects fifteen million infants, posing a significant risk of infant mortality and lifelong disability. Among various triggers, it is well-established that infection-associated oxidative stress and inflammation can induce preterm labor. There is no FDA approved medication for the prevention of PTB except tocolytics which provide marginal benefit at a later stage. Scarcity of therapeutic intervention and unmet medical need propelled us in investigating a novel drug molecule. Our current research is focused on investigating the potential of Edaravone (EDA), an FDA-approved antioxidant and anti-inflammatory medication, in delaying preterm labor and improving neonatal outcomes. Our goal is …

Therapeutic Intervention Of Neuroinflammation In Alzheimer Disease By Inhibition Of Classical Complement Pathway Using Anti-C1r Loaded Exosomes, Terjahna Richards Jan 2024

Therapeutic Intervention Of Neuroinflammation In Alzheimer Disease By Inhibition Of Classical Complement Pathway Using Anti-C1r Loaded Exosomes, Terjahna Richards

Theses and Dissertations

Alzheimer’s disease (AD) is a neurodegenerative disease associated with memory decline and cognitive impairment. It is a growing global health and socioeconomic concern, affecting more than 50 million people worldwide. Current therapeutics focus solely on symptomatic management instead of preventative or curative strategies. This is mainly a result of the complexity of the pathophysiological mechanism and the poor understanding of the disease progression. Recently, studies have focused on bridging knowledge gaps giving rise to substantial evidence on the vital role of neuroinflammation in the progression of AD. Neuroinflammation has been shown to be a precursor to apparent amyloid plaque accumulation …

Hjp 272, An Endothelin Receptor Antagonist, And Its Role In Cancer Cell Migration And Invasion, Nabeela Fatima Baig Jan 2024

Hjp 272, An Endothelin Receptor Antagonist, And Its Role In Cancer Cell Migration And Invasion, Nabeela Fatima Baig

Theses and Dissertations

Endothelins are a family of versatile peptides composed of 21 amino acids with three isoforms: ET-1, ET-2, and ET-3. As the most abundant of the three isoforms, ET-1 is involved in various biological processes, such as regulation of vascular tone, humoral homeostasis, and neural crest development. However, focus is now being directed towards investigating the functions of the Endothelin axis in the progression of different tumor types including ovarian, prostate, breast, lungs etc. HJP 272 is a novel ETAR antagonist and while our group has previously researched its effects on lung inflammation and preterm birth, this study marks the first …

Chemical Investigation Of Membrane Vesicles Isolated From Pseudoalteromonas Rubra, Margaret Hill Jan 2024

Chemical Investigation Of Membrane Vesicles Isolated From Pseudoalteromonas Rubra, Margaret Hill

Open Access Master's Theses

The microbial communities of crustose coralline algae (CCA), a known substrate for coral recruitment, produce bioactive compounds that aid in the physiological processes of larval settlement and metamorphosis. One example is the proposed larval morphogen cycloprodigiosin which is produced by CCA-associated Pseudoalteromonas rubra strains. However, the lipophilicity of this compound limits its water solubility and raises questions regarding its delivery in the marine environment. In this study, we hypothesized that hydrophobic chemical signals are packaged within bacterial membrane vesicles (MVs). A combined genomic and metabolomic approach was used to investigate specialized metabolites produced by CCA-associated P. rubra strains KB1 and …

Latinx Respects: Using Theatre To Prevent Dating Violence, Heidi Adams Rueda, Patricia Newman, Kathleen Mcgee Jan 2024

Latinx Respects: Using Theatre To Prevent Dating Violence, Heidi Adams Rueda, Patricia Newman, Kathleen Mcgee

Social Work Faculty Publications

Teen dating violence is a serious health issue facing youth in the United States. A nationally representative survey found that 8.0% percent of youth who had dated within the past year had been physically hurt on purpose by a dating partner and another 6.9% had experienced sexual violence (Kann et al., 2018). Latinx females experience physical and sexual violence at higher rates compared to national averages (i.e., 9.2% and 11.1%, respectively; Kann et al., 2018). Further, nearly 30% of romantically involved youth have been victims of digital dating abuse within the past year (Hinduja & Patchin, 2021).

Contexts Contributing To Burnout And Potential Coping Strategies To Support Work-Life Balance And Health Management Among Occupational Therapy Practitioners, Nora Duren, Kearyn Nelsen, Jada Welke

Critically Appraised Topics

The focus of this critically appraised topic paper is the aspects of burnout that occupational therapy (OT) practitioners face in a professional capacity, as well as environmental and personal contexts (AOTA, 2020) that have been shown to reduce the intensity of burnout within the profession. According to the American Occupational Therapy Association (AOTA), context can be described as the “broad context that encompasses environment and personal factors” (p. 36). “Environmental factors are aspects of the physical, social, and attitudinal surroundings in which people live and conduct their lives” (AOTA, 2020, p. 36). Additionally, the AOTA defines personal factors as the …

The Role Of Occupational Therapists Working With Adults With Substance Use Disorder In Rural Areas, Kyra M. Jessen, Jackie M. Middendorf Jan 2024

The Role Of Occupational Therapists Working With Adults With Substance Use Disorder In Rural Areas, Kyra M. Jessen, Jackie M. Middendorf

Critically Appraised Topics

This critically appraised topic paper focused on the availability of occupation-based interventions for adults (18 years and older) faced with substance use disorders in rural areas. The main factors to consider in this scenario were the population of rural areas, substance use services in rural areas, and the role of occupational therapy. The U.S. Census Bureau did not directly define rural but instead considered rural to be any area that is not urban, while urban areas were considered to have more than 50,000 people and urban clusters were stated to have between 2,500 and 50,000 people (U.S. Department of Agriculture, …

The Connecticut Municipal Real Property Tax: A Closer Look At The Historic And Evolving Landscape, Dan M. Smolnik Jan 2024

The Connecticut Municipal Real Property Tax: A Closer Look At The Historic And Evolving Landscape, Dan M. Smolnik

Western New England Law Review

Connecticut’s tax on real property has been adopted by the continuum of time as necessary to the public fisc. In 1639, Connecticut adopted the Fundamental Orders, a document that arose from the agreement among the towns of Hartford, Wethersfield, and Windsor and bore more than a passing resemblance to seventeenth century charters of trading companies. What set the Orders apart was that they served to organize a body politic and, hence, became the first democratic written constitution in history. The chain of events set in motion in seventeenth century Connecticut yielded the new nation’s Articles of Confederation, and, as centralized …

A Proposed Technique Using Machine Learning For The Prediction Of Diabetes Disease Through A Mobile App, M. Samir Abou El-Seoud Jan 2024

A Proposed Technique Using Machine Learning For The Prediction Of Diabetes Disease Through A Mobile App, M. Samir Abou El-Seoud

Computer Science

With the increasing prevalence of diabetes in Saudi Arabia, there is a critical need for early detection and prediction of the disease to prevent long-term health complications. This study addresses this need by using machine learning (ML) techniques applied to the Pima Indians dataset and private diabetes datasets through the implementation of a computerized system for predicting diabetes. In contrast to prior research, this study employs a semi-supervised model combined with strong gradient boosting, effectively predicting diabetes-related features of the dataset. Additionally, researchers employ the SMOTE technique to deal with the problem of imbalanced classes. Ten ML classification techniques, including …

Social Acceptance, Well-Being, And The Desire To Start A Family Of Lgbtq+ People In Thailand, Wirunphat Manitsorasak Jan 2024

Social Acceptance, Well-Being, And The Desire To Start A Family Of Lgbtq+ People In Thailand, Wirunphat Manitsorasak

Chulalongkorn University Theses and Dissertations (Chula ETD)

Despite Thailand’s image as a “living paradise” for LGBTQ+ individuals, empirical research on social acceptance and family formation remains limited. Public discourse has questioned whether the growing visibility of LGBTQ+ populations may contribute to the national fertility decline. Given this context, this study focuses on LGBTQ+ individuals and explores three dimensions: (1) societal tolerance toward LGBTIQAN+ individuals and sexual diversity, (2) public attitudes toward LGBTIQAN+ parenting, and (3) the well-being and family formation intentions of LGBTQ+ individuals. Employing a quantitative approach, the study draws on two data sources: (1) secondary data from three waves of the World Values Survey (2007, …
