Fingerprints And Fragments: Reflections On The Challenges And Contributions Of Socio-Legal History, Elizabeth Lhost
Fingerprints And Fragments: Reflections On The Challenges And Contributions Of Socio-Legal History, Elizabeth Lhost
Socio-Legal Review
To narrate law’s past, legal history depends on archives. Yet law’s archive, developed to serve law, necessarily dictates history’s terms. Critical legal history challenges this relationship. Inspired by trends in subaltern and postcolonial studies, critical legal historians push back against the dominance of doctrine. They bring the complexities of context and the vagaries of society, economy, and politics to bear on law’s story, framing law as part of, not separate from, history. To do this, critical legal historians challenge law’s archive. They interrogate what is said and what remains unsaid in the written record. They articulate the role that bureaucracy …
Socio-Legal Enquiry On A Global Scale: Legal Intermediation, The Geography Of Extraction, And The (Re)Negotiation Of Africa’S Relationship With The World Economy, Sara Dezalay
Socio-Legal Review
This paper asks: what does socio-legal enquiry tell us about one of the most pressing problems of our time— climate change? Can (and should) socio-legal enquiry provide a meaningful critique of the so-called green transition? Law’s ubiquity in the ongoing phase of capitalism—from the predominance of private contracts in the regulation of relations between states and transnational corporations to the formidable growth of transnational dispute settlement mechanisms since the turn of the 1990s raises a challenge for socio-legal enquiry. Where do we put the cursor of law’s empowering potential as opposed to its enabling role in reproducing patterns of inequality …

A Case Study Of The Influence Of The Teacher Librarian On Middle And High School Student Book Selection, Hilary Peyton, Lindsay Salinas, Josie Smock, Meg Tisinger
Graduate Research Papers
This study examines the influence of the teacher librarian on middle and high school student book selection through library programming that includes teacher librarian book promotion strategies, specifically book talks, book displays, and genrefication in a school library. This qualitative case study of 60 Iowa middle and high school students aims to answer two questions: 1) What strategies do middle and high school students use for selecting books for pleasure reading? 2) How do teacher librarian book promotion strategies influence student selection of books for pleasure reading? Using participant surveys and interviews the study revealed 3 major themes: 1) Most …

A Case Study Of The Impact Of Lateral Reading Instruction On Students’ Evaluation Of Digital Information, Devon Allbee, Jenny Marburger, Tiffany Ostrowski
Graduate Research Papers
This qualitative study reports the impact of lateral reading instruction on students’ abilities to evaluate sources. This study consisted of students in three different Language Arts classrooms. There were 22 ninth-grade students in Classroom 1, 27 seventh-grade in Classroom 2, and 33 tenth-grade students in Classroom 3. Students participated in a series of lessons involving instruction, modeling, and practice of lateral reading. After each of these lessons, student data was collected using pre-, mid-, and post-assessments. Researchers used a rubric (see Appendix D) to score students’ lateral reading moves during a pre- mid- and post-assessment. A score of 0 meant …

The inevitable leakage of privacy as a result of unrestrained disclosure of personal information has motivated extensive research on robust privacy-preserving mechanisms. However, existing research is mostly limited to solving the problem in a static setting with disregard for the privacy leakage over time. Unfortunately, this treatment of privacy is insufficient in practical settings where users continuously disclose their personal information over time resulting in an accumulated leakage of the users' sensitive information. In this paper, we consider privacy leakage over a finite time horizon and investigate optimal strategies to maximize the utility of the disclosed data while limiting the …

Software-Defined Networking (SDN) offers a centralized network management approach that can effectively address the complex and varied traffic demands characteristic of Industrial Internet of Things (IIoT) environments by decoupling the control plane from the data plane. The centralized control architecture of SDN necessitates the performance optimization of controllers to manage diverse traffic efficiently within IIoT applications. This paper explores the criteria for selecting controllers in SDN-enabled IIoT (SD-IIoT) environments, utilizing the Less Complex Analytic Network Process (LC-ANP) to establish their prioritization. A ranking system for SD-IIoT controllers is formulated using LC-ANP, and experimental validation of this method underscores its effectiveness …

A Machine Learning-Based Wrapper Method For Feature Selection, Damodar Patel, Amit Saxena, John Wang
Department of Information Management and Business Analytics Faculty Scholarship and Creative Works
This paper presents a two-stage feature selection scheme using machine learning techniques. In the first stage a wrapper method is adopted to select various combinations of subsets of features from the original dataset. The performance of the model is evaluated by three classifiers: K-Nearest Neighbor (KNN), Support Vector Machines (SVM), and Random Forest (RF). In the second and final stage, a sequential backward feature selection Method is applied. The proposed method is demonstrated on eighteen datasets and the average classification accuracy of eighteen datasets achieved is 89.81%, 87.55%, and 89.82% using the KNN, SVM, and RF classifiers, respectively with a …

The United States federal debt has witnessed a significant surge over recent decades. This study delves into inquiries regarding the persistent patterns in federal debt, key factors driving this alarming trend, and the optimal timing for implementing corrective measures to mitigate its speeding flight. Utilizing modern machine learning techniques, notably Random Forest (RF) and Support Vector Regression (SVR), alongside conventional statistical forecasting techniques, the research aims to predict future trends. It emphasizes the critical role of business analytic thinking in deciphering fiscal system-based complexities. To address the mounting challenges, these research findings underscore the urgent necessity for efficacious policies to …
Politicizing Antisemitism Amidst Today's Educational Culture Wars, Lili Levi
Politicizing Antisemitism Amidst Today's Educational Culture Wars, Lili Levi
Articles
The traditional narrative of American Jewry emphasizes American exceptionalism with respect to antisemitism. But there have been clear signs of a resurgence of public antisemitism in the United States even before the massive rise in antisemitic expression and incidents associated with the Israel-Hamas war of fall 2023.
One of the notable aspects of the rise and normalization of antisemitic expression is the deployment of antisemitism as a political tool. For example, in addition to Democrats and Republicans accusing each other of complicity in antisemitism, both federal policy since the Trump era and state anti-antisemitism legislation have targeted campus antisemitism in …

Rivers Of Language Across Oceans: Review Essay Of River In An Ocean: Essays On Translation, Edited By Nuzhat Abbas, Luise Von Flotow
Journal of Feminist Scholarship
This article presents an academic review of the collection of articles “on translation” and entitled river in an ocean. It engages with the foreword by Françoise Vergès and the introduction by editor Nuzhat Abbas, which set the tone of ‘decolonial feminism’ that permeates the essays. The reviews of the eleven essays—by women from southeast Asia, Africa, Palestine and Saudi Arabia—come from the perspective of feminist translation studies but pay careful attention to their very specific concerns around exile and life in diaspora.
Overcoming The Pragmatic Approach Of The United Nations Guiding Principles On Business And Human Rights In Relation To The Fossil Fuel Industry, Barnali Choudhury
Overcoming The Pragmatic Approach Of The United Nations Guiding Principles On Business And Human Rights In Relation To The Fossil Fuel Industry, Barnali Choudhury
Articles & Book Chapters
Business has been good for Big Oil. Last year, the five largest Western oil companies raked in over USD$200 billion in profits. Last year, the global carbon emissions from the fossil fuel industry also peaked. Companies produced over 36 billion tons of carbon dioxide emissions during the year and global warming hit a new sustained high. Increasing temperatures also caused socio-economic impacts such as deaths, displacement of people, loss of employment and adverse impacts on food security.
While numerous studies have drawn links between the corporate activities of the fossil fuel industry and the devastating environmental and human rights impacts …
Beauvoir, “French” Feminisms, And “Translation Work:” A Roundtable Conversation, Sandrine Sanos, Judith G. Coffin
Beauvoir, “French” Feminisms, And “Translation Work:” A Roundtable Conversation, Sandrine Sanos, Judith G. Coffin
Journal of Feminist Scholarship
This conversation featuring four scholars—Sandrine Sanos, Judith G. Coffin, Lorraine Delavaud, Marine Vaslin—took place on zoom on December 1, 2023. It was organized, transcribed, and edited by Sandrine Sanos who also wrote the introduction to contextualize the conversation. The roundtable reflects on the making of the translation of Judith Coffin’s book on Beauvoir; and how it became a collective object, and the challenges and productive limitations that it involved, showing how such a project helped forge and relied upon transnational, transdisciplinary, and transgenerational feminist solidarities. The ways Beauvoir became a transatlantic object sheds light on the ways that the book …
Environmental Law For A Just Transition, Dayna Nadine Scott
Environmental Law For A Just Transition, Dayna Nadine Scott
Articles & Book Chapters
The environmental justice movement, which turns our attention to fairness in the distribution of environmental benefits and burdens and in the processes, biases and
structures that determine those distributions, is challenging the foundations of environmental law.
• ‘Extractivism’ – a mode of accumulation that necessitates both a high pace and a large scale of taking of natural resources such as fossil fuels – is deeply embedded in environmental law, producing uneven costs/benefits and intense, concentrated impacts on people and ecosystems. Even as we move towards a greener economy, environmental laws and regulations governing such areas as facility siting, pollution permitting, …

We Shall Overcome: The Evolution Of Quotas In The Land Of The Free And The Home Of Samba, Stella Emery Santana
Seattle University Law Review
When were voices given to the voiceless? When will education be permitted to all? When will we need to protest no more? It’s the twenty-first century, and the fight for equity in higher education remains a challenge to peoples all over the world. While students in the United States must deal with the increase in loans, in Brazil, only around 20% of youth between the ages of twenty-five and thirty-four have a higher education degree.
The primary objective of this Article is to conduct an in-depth comparative analysis of the development, implementation, and legal adjudication of educational quota systems within …
Shifting Shapes: Transnational Tactics Of The Authoritarian Right In Brazil And Russia, Erin Katherine Krafft, Caroline De Souza
Shifting Shapes: Transnational Tactics Of The Authoritarian Right In Brazil And Russia, Erin Katherine Krafft, Caroline De Souza
Journal of Feminist Scholarship
Global right-wing anti-gender movements have developed a transnational pattern in their uses of language as a means of subjugation and of control, and this article examines manifestations of this pattern in two specific states: Brazil and Russia. By exploring the anti-gender languaging, rhetoric, and legislation advanced by Jair Bolsonaro (President of Brazil 2019–2022) and Vladimir Putin (President of Russia 2000–2008 and 2012 to the present) and their supporters, we find that, in both contexts, anti-gender campaigns are reactions to and also drivers for increasingly dramatic political and social conflicts, and in each case, anti-gender ideologies are embedded in larger right-wing …

Older Women Workers, The Pandemic, Employment Discrimination And Lifetime Disadvantage, Susan Bisom-Rapp
Faculty Scholarship
As a group, older women workers were among those most severely impacted by the COVID-19 crisis. Drawing from both intersectionality and cumulative disadvantage theory, the Model of Lifetime Disadvantage created by Bisom-Rapp and Sargeant helps frame the position of these workers in the labor market prior to and during the pandemic. The model also explains why and how disjointed, incremental legal interventions are unable to meet the challenge of gendered ageism, which surged during the crisis. Disasters produce impacts unevenly on individuals and communities. Older women are a diverse group, whose social position is mediated by race, ethnicity, sexual orientation …
Community Organizing For Democratic Renewal: The Significance Of Jacques Maritain’S Support For Saul Alinsky And His Methods, Brian Stiltner
Community Organizing For Democratic Renewal: The Significance Of Jacques Maritain’S Support For Saul Alinsky And His Methods, Brian Stiltner
Philosophy, Theology and Religious Studies Faculty Publications
Jacques Maritain’s ideas about democratic renewal remain as important and inspirational as ever. A less well-known element of Maritain’s political thinking is his support for grassroots community organizing. This support, peppered throughout his writings, comes into stark relief when examining his longtime friendship and correspondence with Saul Alinsky, the dean of community organizing in the US. This article argues, first, that we must understand Maritain and Alinsky’s friendship to properly appreciate the legacy of Maritain’s political thought and, second, that understanding the complementarity of their approaches allows us to see that together these two friends present a powerful strategy for …

The Role Of Caregiver Anxiety, Sleep, Distress, And Emotion Socialization Behaviors On Child Behaviors, Amanda Hicks
The Role Of Caregiver Anxiety, Sleep, Distress, And Emotion Socialization Behaviors On Child Behaviors, Amanda Hicks
Master's Theses and Doctoral Dissertations
In early childhood, caregivers are the primary agents of emotion socialization, helping their child identify, label, and healthily express their emotions. How a caregiver aids in emotion development and understanding has important implications for their child’s behavior regulation. Distressed caregivers may have difficulty helping their child cope with negative emotions leading to an increased likelihood of problem behaviors over time. While some literature has highlighted an association between caregiver anxiety and child behavior problems, little is known about the mechanisms by which anxiety negatively impacts child behaviors. Caregiver risk factors such as poor sleep, distress related to their child’s negative …
“We Gon’ Be Alright”: How Resiliency & Africultural Coping Behaviors Factor Into African American College Students’ Intentions To Seek Mental Health Services, Taylor Garland
Master's Theses and Doctoral Dissertations
Background: African Americans, apprehension toward utilizing mental health services (MHS) has a long history in the United States. The low rates of utilizing MHS can result in detrimental health consequences, both mental and physical, despite there being a developing literature base on how evidence-based treatments are effective in therapy with African Americans.
Objective: There is expansive literature on several factors (e.g., stigma, cultural mistrust) that contribute to African Americans’ hesitancy concerning seeking MHS. The current study aimed to add to this literature base. Specifically, this study sought to acknowledge both African American college students’ choices to use alternative coping strategies …

Trigger Events And Leadership: Crucible Moments In Leadership, Timothy M. Authier
Master's Theses and Doctoral Dissertations
Being and becoming an educational leader is a process that engages multiple levels of challenge, training, processing, and understanding. The many demands placed on school administrators create many challenges and put a great deal of adversity in the pathway of administrators. The training process involving graduate degrees in educational leadership attempts to support aspiring principals and district leaders by applying technical skills and practices. However, the challenges and adversity that arise in education consistently cause other factors, of which administrators may have some awareness but need more official training and teaching on navigating. Thus, topics frequently discussed, such as emotional …

Determining Why Before How: Crafting Mission, Vision, And Values Statements To Facilitate Undergraduate Music Theory Curriculum Reimagining, Paula Maust, Vid Smooke
Journal of Music Theory Pedagogy
The Department of Music Theory at the Peabody Conservatory of the Johns Hopkins University recently joined many other institutions across North America in reimagining our undergraduate curriculum. Following practices more commonly found in the nonprofit sector, we began this undertaking by crafting mission, vision, and values statements. These newly articulated ideals for our department then served as a polestar, effectively guiding the rest of the curriculum review and revision. The process we effected created an environment that facilitated creative thinking while simultaneously engendering clear consensus among our colleagues.
In this paper, we—as co-chairs of the committee charged with reviewing the …

“Duet Me”: Music Theory Pedagogy In The Age Of Social Media, Alyssa Barna
Journal of Music Theory Pedagogy
In this article, I outline a possible use of social media platforms in the music theory and ear-training classroom using a model assignment on (but not exclusive to) TikTok. I show how students can work collaboratively and musically in a platform they may use in everyday life to promote collaboration and engagement with musics and people outside the walls of the university. From this study, I extrapolate themes that illustrate both the benefits and pitfalls of social media use (pedagogically and otherwise). The first section situates social media platforms among the variety of technologies used in theory classrooms in the …

Engaging Aural Skills Students With Model-Eliciting Activities, Aaron Galliher
Journal of Music Theory Pedagogy
This mixed-methods study explores how using Model-Eliciting Activities (MEAs) in an aural skills classroom can promote student motivation and engagement. MEAs require students to create models to solve progressively complex problems. As students develop and refine their models, they engage in a testing and iteration process that prioritizes learning over final outcomes, which fosters student empowerment. The specific MEA implemented was focused on music transcription skills and used the MUSIC Inventory of Motivation survey to assess student motivation and engagement, complemented by follow-up interviews that explain the results of the survey. Many students scored high on this survey and expressed …
The Phenomenology Of Success: Women Who Made It To The C-Suite Despite Barriers, Bettye H. Smith
The Phenomenology Of Success: Women Who Made It To The C-Suite Despite Barriers, Bettye H. Smith
Dissertations
Multiple researchers have explored avenues to achieve gender diversity in leadership, primarily by studying the barriers to success for aspiring women leaders. Despite barriers, a small group of women have risen to the top positions of US corporations, demonstrating that there is a path to success and highlighting an opportunity to address leadership diversity differently. Whereas most research on gender diversity in leadership focuses on the barriers women encounter, this qualitative phenomenological study focused on how women can succeed. By leveraging Bronfenbrenner’s ecological systems theory to explore systems that enabled a phenomenal group of women to advance to the C-suite, …
