Graduate Thesis and Dissertation 2023-2024

This study investigates the extent to which the Florida B.E.S.T (Benchmark for Excellent Student Thinking) English Language Arts (ELA) standards demand that students participate in dialogic interactions within the 10th grade ELA classroom. Dialogic demands, characterized by active discourse and collaborative sense-making, are the opportunities students interact with one another or with a text. The dialogic elements of classroom pedagogy are an increasingly recognized critical component of effective literacy instruction in contrast with the monologic classroom where teachers are the primary source of information. A Critical Discourse Analysis through the lens of Fairclough is used as this research aims to …

Journal of Urban Culture Research

The reformulation of Wayang performances into Wayang Climen has provided a fresh avenue for urban audiences to access tradition-based entertainment, which plays a crucial role in the transmission of cultural knowledge and values. After limited performance opportunities due to COVID-19 restrictions, puppeteers are now vying to put on elaborate performances. However, such performances are often expensive, space-intensive, and lengthy, making them inaccessible for urban communities with restricted resources. This study explores how puppeteers have reimagined performances by streamlining their duration, reducing venue requirements, and narrowing thematic focus to retain the essence of traditional Wayang while making it accessible to urban …

Who Is "Women's Health" For? Lgbtq+ Inclusion In Sexual And Reproductive Health Care, Evan Thomas England Jan 2024

Who Is "Women's Health" For? Lgbtq+ Inclusion In Sexual And Reproductive Health Care, Evan Thomas England

Doctoral Dissertations

Throughout modern Western history, access to fully affirming and supportive sexual and reproductive health care (SRH) has been denied to most women and sexual and gender minorities. Also, as demonstrated by the ubiquity of the term “women’s health,” SRH often reflects a cisgender heterosexual (cishet) women-centered approach, alienating transgender, non-binary, gender nonconforming, and sexual minority individuals who are not cishet women but are in equal need of the same life-saving screenings, treatments, and counseling services. Due to the operationalization and reproduction of gendered ideologies and unequal social hierarchies within SRH, inadequate access to quality sexual health education for youth, and …

Pristine Or Perilous? Evaluating The Risks Of Cyanotoxin Production, Exposure, And Accumulation In Gye Lakes, Katherine Low Jan 2024

Pristine Or Perilous? Evaluating The Risks Of Cyanotoxin Production, Exposure, And Accumulation In Gye Lakes, Katherine Low

Doctoral Dissertations

Toxins produced by cyanobacteria (hereafter, cyanotoxins) are among the most lethal known biotoxins. Cyanotoxin exposure is assumed to occur mainly through direct contact with surface-bloom-forming cyanobacteria that are most commonly observed in warm, nutrient-rich lakes. However, recent observations of cyanotoxin accumulation in the Greater Yellowstone Ecosystem (GYE), an area where cyanobacteria blooms are rarely observed, have raised concerns over wildlife health in this highly protected region. In response, we sampled twelve clear-water lakes in the GYE to identify potential sources of cyanotoxins (particularly the neurotoxin beta-methylamino-L-alanine, BMAA), exposure routes, and health risks.Despite nutrient limitations and cool water temperatures, the sampled …

What If Criminal Lawmaking Becomes Trustworthy?, Zachary S. Price Jan 2024

What If Criminal Lawmaking Becomes Trustworthy?, Zachary S. Price

Journal of Criminal Law and Criminology

One common theoretical perspective posits that courts should assume a counter-majoritarian role in criminal law because the political process systematically disfavors the interests of criminal suspects and defendants. Recent shifts in the politics of crime complicate this perspective’ s assumptions, raising the paradoxical possibility that welcome improvements in the politics of crime will weaken the theoretical case for counter- majoritarian judicial decisions. This Article tentatively considers whether, if at all, courts’ interpretive approach should change in response to any continuing moderation of historic “tough on crime” politics. It suggests that while arguments for narrow construction of criminal statutes will remain …

Rethinking The Balance Of Interests In Non-Exculpatory Defenses, Paul H. Robinson, Jeffrey Seaman, Muhammad Sarahne Jan 2024

Rethinking The Balance Of Interests In Non-Exculpatory Defenses, Paul H. Robinson, Jeffrey Seaman, Muhammad Sarahne

Journal of Criminal Law and Criminology

Most criminal law defenses serve the criminal law’s goal of shielding blameless defendants from liability. Justification defenses, such as self- defense and law enforcement authority, exculpate on the ground that the defendant’s conduct, on balance, does not violate a societal norm. Excuse defenses, such as insanity and duress, exculpate on the ground that, while the defendant may well have violated a societal norm, it was done blamelessly. That is, it is the excusing conditions, not the defendant, that is to blame. In contrast, a third group of general defenses, which have been called “non-exculpatory defenses,” bar liability in instances where …

Past, Prologue, And Constitutional Limits On Criminal Penalties, Maria Hawilo, Laura Nirider Jan 2024

Past, Prologue, And Constitutional Limits On Criminal Penalties, Maria Hawilo, Laura Nirider

Journal of Criminal Law and Criminology

Most criminal prosecutions occur at a level that is both neglected by many legal scholars and central to the lives of most people entangled in the criminal legal system: the level of the state. State v. Citizen prosecutions, which encompass most crimes ranging from robbery to homicide, are governed both by the federal constitution and by the constitution of the prosecuting state.

This is no less true for sentences than for prosecutions. When it comes to sentences, state courts are bound by the Eighth Amendment to the United States Constitution, which famously proclaims that no American shall be subjected to …

"The Clearest Proof": Constitutional Concerns Surrounding The Illinois Sexually Violent Persons Commitment Act, Ethan Solomon Jan 2024

"The Clearest Proof": Constitutional Concerns Surrounding The Illinois Sexually Violent Persons Commitment Act, Ethan Solomon

Journal of Criminal Law and Criminology

The Illinois General Assembly enacted the Sexually Violent Persons Commitment Act (SVPCA) in 1998, allowing the State to petition for the indefinite detention of those who have committed sexually violent crimes if those individuals have mental illnesses that predispose them to commit further crimes in the future. Although the United States Supreme Court has upheld similar state statutes as constitutional in the past, the SVPCA does not comport with the Court’s basic requirements for such statutes because it is functionally punitive and implicates traditional goals of punishment. Moreover, § 40(b)(5) of the SVPCA, which pertains to conditional release, violates two …

A New Theory Of Gun Control: A Federal Regulatory Blueprint To Hold America's Firearms Industry Accountable For Mass Shootings, Carl Stier Jan 2024

A New Theory Of Gun Control: A Federal Regulatory Blueprint To Hold America's Firearms Industry Accountable For Mass Shootings, Carl Stier

Journal of Criminal Law and Criminology

In 2005, President George W. Bush signed the Protection of Lawful Commerce in Arms Act (PLCAA) into law, granting the firearms industry near-perfect legal immunity. PLCAA shifted the risk of firearm production, distribution, marketing, and injuries to the public. Two decades ago, mass shootings were anomalies. Today, they are alarmingly common. From 2021 to 2023, the United States averaged 663 yearly mass shootings, and from 2004 to 2022, active shooter events spiked 1,150%. The larger gun violence epidemic now costs taxpayers over $550 billion annually, forcing Congress to seek solutions with increasing desperation. However, new state laws and lawsuits targeting …

Rubbing Salt Into The Wound: Environmental Injustices In Prisons And The Difficulties Of Obtaining Relief, Savannah Markel Jan 2024

Rubbing Salt Into The Wound: Environmental Injustices In Prisons And The Difficulties Of Obtaining Relief, Savannah Markel

Journal of Criminal Law and Criminology

American prisons are often built near or on environmentally hazardous lands. Not only do prison locations affect prisoners’ health and well-being, but deteriorating confinement conditions exacerbate such safety and wellness risks. In seeking justice for these environmental violations, prison litigants often choose to raise claims under the Eighth Amendment’s Cruel and Unusual Punishment Clause. However, the Clause requires litigants to meet an extremely high—indeed, near-impossible—bar to succeed on their claims. Environmental justice advocates have proposed an alternative remedy which calls on the Environmental Protection Agency (EPA) to regulate environmental injustices in prisons. This Comment analyzes the difficulties of raising an …

County Prosecution And State Preemption: The Confusing Politics Of Criminal Legal Reform And Backlash, John Pfaff Jan 2024

County Prosecution And State Preemption: The Confusing Politics Of Criminal Legal Reform And Backlash, John Pfaff

Journal of Criminal Law and Criminology

Urban reform prosecutors, who are generally elected at the county level, find themselves in a tricky political spot. On the one hand. most urban counties are in many ways “too big” for reformers: they include large numbers of suburban voters who generally dislike reform, in no small part because they are relatively unaffected by the decisions prosecutors make. On the other hand, these counties are also often “too small”: they lack the political power to resist efforts by conservative state legislatures and governors to rein in, if not outright remove, reformers. This Article examines both vulnerabilities. It first maps out …

Community Health Workers To Strengthen Hiv Care Continuum And Prep Delivery In The Us/Hics: A Scoping Review, Vanessa Abigail Nunez Jan 2024

Community Health Workers To Strengthen Hiv Care Continuum And Prep Delivery In The Us/Hics: A Scoping Review, Vanessa Abigail Nunez

Public Health Theses

Introduction: With the ongoing global HIV/AIDS burden, community-based service delivery models are increasingly recognized, with community health workers (CHWs) at the forefront. In high-income countries (HICs) like the United States, CHWs have long served marginalized communities, gaining recent legislative attention. Despite this, there's still a need for comprehensive evidence on CHW integration in healthcare delivery.

Methodology: We conducted a scoping review to gather available evidence on community health workers (CHWs) and their impact on HIV outcomes in HICs, and to identify evidence gaps in the use of community-based HIV/PrEP services in HICs. Using the American Public Health Association’s definition of …

Association Of Immune Checkpoint Inhibitor Approval On Suicide Rates Among Patients With Cancer: A Pre-Post Analysis With Seer, Rachel Wang

Public Health Theses

Objective: Patients with cancer are at elevated suicide risks compared to the general population, and patients diagnosed with advanced cancers have higher suicide risks compared to those diagnosed with early-staged cancers. Immune Checkpoint Inhibitors (ICIs) were initially approved to treat metastatic melanoma, non-small cell lung cancer (NSCLC), and renal cell carcinoma (RCC), and an unpublished study observed a decreased suicide risk in patients with these cancers at all stages. This study evaluates suicide risks in patients with breast, colorectal, liver, pancreatic, and prostate cancer, of which ICIs have limited effects on, to assess if the lower suicide rates observed previously …
