Much of our federal administrative law relies upon supposedly mandatory procedures that agencies often ignore. So, can the administrative state achieve legitimacy if it is bound by laws that it rarely, if ever, complies with? New data shows that agencies simply ignore administrative procedures without recourse because compliance ultimately depends on who holds power in the administrative state––not congressionally delegated rules or procedures imposed by the President. The American juvenile court system does not recognize a right to a jury trial. It should. The juvenile court system was born out of the Progressive Era, a period of social and political change in the U.S. Its creators envisioned a system that cared for children and considered which individual treatment would suit each child in the system. However, the actual history of the juvenile court did not follow this idealistic vision. The rapid development of sophisticated artificial intelligence (“AI”) tools in healthcare presents new possibilities for improving medical treatment and general health. Currently, such AI tools can perform a wide range of health-related tasks, from specialized autonomous systems that diagnose diabetic retinopathy to general-use generative models like ChatGPT that answer users’ health-related questions. Non-profit hospitals have long been required to provide certain benefits to the community in which they reside in order to maintain tax-exempt status. The nature of these community benefits has evolved since the mid-twentieth century, but “charity care”—free or discounted care for patients who are unable to pay for it—is the quintessential hospital community benefit. Although the Patient Protection and Affordable Care Act of 2010 (ACA) extended eligibility for subsidized health coverage to many more people living in the United States, some noncitizens—including those without a valid immigration status—were excluded. Recently, several states and cities have enacted equal pay laws in a push for pay transparency in job postings to inform and help reduce wage gaps. Some of these laws also require a description of the employee benefits that the company offers. However, none of these laws require a detailed description of said benefits, even though employee benefits on average make up 24% of an employee’s compensation.

The United States has delegated the responsibility of keeping the lights on to a self-regulatory organization called the North American Electric Reliability Corporation (NERC). Although NERC is a crucial example of industry-led governance—and regulates in an area that is central to our economy and basic human survival—this unusual institution has received scant attention from policymakers and scholars. Such attention is overdue. To decarbonize its economy, the United States must enter a new “electric era,” transitioning many sectors to run on electricity while also transforming the electricity system itself to run largely on clean but intermittent renewable resources. Prosecutors face criticism for prosecuting too many minority members and too few police. Recently, some reformers have won prosecutorial elections by pledging to change these priorities. Yet scholars have identified two impediments to police prosecutions. First, county prosecutors often answer to suburban voters indifferent to the excesses of city police. Second, prosecutors depend on those police to investigate their cases and to endorse them as effective. This Article argues that the influence of residents and police on prosecutorial decisions depends on the political geography of a prosecutor’s office. Sacred Victims: Fifty Years Of Data On Victim Race And Sex As Predictors Of Execution, Scott Phillips, Justin F. Marceau, Sam Kamin, Nicole King

Journal of Criminal Law and Criminology

In this essay, we update and expand David Baldus’s famous study of Georgia homicides in the 1970s to uncover the impact of the race and sex of homicide victims on whether a defendant was sentenced to death and ultimately executed. We show that the odds of a death sentence were sixteen times greater if the victim was a White woman than if the victim was a Black man, even when other factors that might explain the disparity were taken into account. Furthermore, we identified a clear hierarchy among victims with regard to whether a death sentence was ultimately carried out. …

Urban trees contribute to decarbonisation. However, the removal of trees may release the stored carbon within them. In Hong Kong, Acacia confusa and Leucaena leucocephala are being removed, but with unknown carbon impacts. This industry-academia-government collaborative research aimed to: (1) report the amount of carbon stored inside A. confusa and L. leucocephala harvested from slopes; (2) estimate the carbon storage of a tree using dendrometric measurements; and (3) explain the variation in carbon content percentage of urban trees with respect to tree species, part of the tree, and position within the part. 10 A. confusa and 10 L. leucocephala were …

This dissertation investigated the impact of Historically Black Colleges and Universities (HBCUs) teacher preparation programs on at-risk adolescents, focusing on preventing their entry into the school-to-prison pipeline (STPP). The study explored graduate perceptions of the strategies and practices these programs teach to prepare educators for addressing the needs of at-risk students. The research highlights the historical context of the STPP, emphasizing the systemic inequalities and discriminatory practices that perpetuate it. Radiolysis is a complex phenomenon in which molecules subjected to ionizing radiation form new chemical species. Electron-beam irradiation has proven to be a versatile approach for significantly altering materials’ properties and forms the basis for electron-beam lithography using both organic and inorganic resists. Electron-beam exposure is normally carried out under high vacuum conditions to reduce contamination and allow for unhindered interaction between the electrons and the resist material. To prevent conflicting state-law interests and federal copyright interests in a single claim, Congress enacted Section 301 of the Copyright Act of 1976—providing a two-prong test to determine when a state-law claim is preempted by federal copyright law. Though Section 301 appears to be a clear and simple test, it has proven to be anything but. Between 1986 and 2023, six of the thirteen circuit courts decided whether state-law right of publicity claims are preempted by federal copyright law using the Section 301 two-prong test, but each court’s analysis was vastly different from the other. This study evaluated the refinement of sorghum, corn, and cowpea grains using the processing steps and equipment originally designed for wheat milling that consists of a conventional gradual reduction system. The need to mill these grains resulted from a desire to produce alternative ingredients for developing new fortified blended extruded foods used for food aid programming. Milling of white sorghum grain resulted in a crude protein content of 7.4% (wb) for both whole and coarse-milled flour. The crude protein content in whole fine-milled sorghum was 6.8% (wb), which was significantly lower than that of whole coarse flour at 9.3% (wb). …

Cannabidiol (CBD) is a crystalline compound extracted from a high-CBD variety of the Cannabis sativa plant. It has various pharmacological effects, including antipsychotic, anti-inflammatory, anti-seizure, and anxiolytic properties. However, developing CBD formulations presents several challenges due to its high lipophilicity (log P of 6.3), poor water solubility (0.1 μg/mL), and significant first-pass metabolism, which results in low oral bioavailability, estimated at just 6%. Furthermore, research has demonstrated that CBD is susceptible to degradation from exposure to light, temperature, and oxidation during formulation. Currently, Epidiolex is the only commercially available preparation containing CBD that has been approved by the US-FDA for …
