The Rise Of Counter-Terrorism And The Demise Of Human Rights, Fionnuala Ní Aoláin Jan 2024

The Rise Of Counter-Terrorism And The Demise Of Human Rights, Fionnuala Ní Aoláin

Emory International Law Review

This lecture addressed the consolidation and expansion of counter-terrorism norms and institutions since 9/11. The rise of counterterrorism has enabled the consolidation of autocracy, sustained democratic backsliding and undermined the capacity of civil society to function across the globe. The impact on human rights has been extensive and highly detrimental to the most vulnerable individuals and groups across the world. Drawing on my work as United Nations Special Rapporteur on Counter-Terrorism and Human Rights since my 2017 appointment, the lecture shows the hard choices that must be made nationally and globally to reverse these trends.

Therapeutic Plasma Exchange Is Feasible And Tolerable In Severely Injured Patients With Trauma-Induced Coagulopathy, Sarah A. Moore, Marian A. Rollins-Raval, Jennifer M. Gillette, Joseph E. Kiss, Darrell J. Triulzi, Mark H. Yazer, Jasmeet S. Paul, Christine M. Leeper, Matthew D. Neal, Jay S. Raval

Pathology Research and Scholarship

OBJECTIVES: Trauma-induced coagulopathy (TIC) occurs in a subset of severely injured trauma patients. Despite having achieved surgical hemostasis, these individuals can have persistent bleeding, clotting, or both in conjunction with deranged coagulation parameters and typically require transfusion support with plasma, platelets, and/or cryoprecipitate. Due to the multifactorial nature of TIC, targeted interventions usually do not have significant clinical benefits. Therapeutic plasma exchange (TPE) is a non-specific modality of removing and replacing a patient's plasma in a euvolemic manner that can temporarily normalize coagulation parameters and remove deleterious substances, and may be beneficial in such patients with TIC.

METHODS: In a …

You Are What You Eat: Social Media's Influence On Health And Beauty Practices For Young Latinx Women, Anaís Martínez Castañeda Jan 2024

You Are What You Eat: Social Media's Influence On Health And Beauty Practices For Young Latinx Women, Anaís Martínez Castañeda

Scripps Senior Theses

This thesis delves into the experiences of young Latinx women, exploring how they internalize societal messages propagated through social media that equate whiteness with wellness and beauty standards. Conversations with young LatinX women reveal that performances of whiteness intertwine with dietary practices and notions of thinness, influencing their perceptions and behaviors. This internalization leads to harmful tendencies of body surveillance and diet restriction in an attempt to conform to dominant social media norms. Furthermore, this messaging can result in the rejection of ethnic foods and adversely impact their overall well-being. However, amidst these challenges, participants reevaluated their internalized beliefs and …

Synthesis, Characterization, And Performance Assessment Of Reusable And Biodegradable Antimicrobial Polymeric Membranes For Aerosolized Pathogen Inactivation And Filtration, Ebuka Ogbuoji Jan 2024

Synthesis, Characterization, And Performance Assessment Of Reusable And Biodegradable Antimicrobial Polymeric Membranes For Aerosolized Pathogen Inactivation And Filtration, Ebuka Ogbuoji

Theses and Dissertations--Chemical and Materials Engineering

Air filtration technology has proven effective in purifying air by trapping particulates which can cause adverse health effects. High Efficiency Particulate Air (HEPA) filters, capable of capturing over 99.99% of PM0.3, are recommended for critical applications. However, conventional non-woven HEPA filters rely on electrostatic interactions to trap smaller particles, which can deplete over time or after cleaning, reducing filtration efficiency and posing health risks. Additionally, these filters contribute to plastic waste.

This dissertation investigated the feasibility of using flat sheet polymeric membranes fabricated via nonsolvent-induced phase separation (NIPS) as reusable and biodegradable alternatives to commercially available non-biodegradable air …

Fda Modernization Act 2.0: The Beginning Of The End For Animal Testing In Drug Development, Julia Williams Jan 2024

Fda Modernization Act 2.0: The Beginning Of The End For Animal Testing In Drug Development, Julia Williams

Animal Law Review

Historical drug testing protocols utilized animal testing to determine whether drugs were safe and effective for use in humans. However, recognizing that testing drugs on other species is potentially dangerous for humans, troubled by failures, unnecessarily expensive, and time consuming, the FDA Modernization Act 2.0, passed in December 2022, removed animal testing as a requirement for new drug applications. While this was an important step forward, a notable failure of that Act is that it did not go far enough to end animal testing. Accordingly, this Article proposes an FDA Modernization Act 3.0.

The FDA Modernization Act 3.0 would ensure …

De-Myth-Ifying Laboratory Animal Law: The Truth Behind Four Commonly Misunderstood Facts In Laboratory Animal Welfare Law, Rebecca Critser Jan 2024

De-Myth-Ifying Laboratory Animal Law: The Truth Behind Four Commonly Misunderstood Facts In Laboratory Animal Welfare Law, Rebecca Critser

Animal Law Review

The subspeciality of laboratory animal law presents unique difficulties because it requires familiarity with two highly specialized fields: law and science. Consequently, it is not surprising that some aspects of laboratory animal law have been misunderstood. This Article highlights four such misunderstandings surrounding laboratory animal law and provides an explanation of the truth behind each myth. The myths discussed include: (1) the AWA is the only federal law applicable to laboratory animals; (2) states are preempted from regulating the laboratory animal space; (3) birds, rats, and mice are not covered under federal law; and (4) the 3Rs are explicitly required …

Pinky Swear? We'll Be Together Forever: Queering Girlhood, Sophie Kim Jan 2024

Pinky Swear? We'll Be Together Forever: Queering Girlhood, Sophie Kim

Scripps Senior Theses

Throughout popular culture, friendships between girls are often portrayed as emotionally intimate partnerships. The fact that these relationships are rarely questioned about the possibility for attraction, while encounters between boys and girls often are, demonstrates the hegemony of the heteropatriarchal social order. The prevalence of passionate, partnership-like friendships among girls within mainstream society will be analyzed through a queer lens, positing that common conceptions of girlhood are inherently queer regardless of the presence of attraction. By conducting open-ended, semi-structured interviews, this qualitative research study aims to ask: how do young adults interpret their experiences with closeness in relationships with other …

Conspiracy Theory Ideation In The Hypermodern Era: Epistemologies Of Conspiracy Communities On Reddit, Rachel L. Anderson Jan 2024

Conspiracy Theory Ideation In The Hypermodern Era: Epistemologies Of Conspiracy Communities On Reddit, Rachel L. Anderson

Scripps Senior Theses

Underpinning injurious right-wing political coalitions, anti-vaccination campaigns, out-group derogation, and, in drastic circumstances, instances of genocide, conspiracy theory informs myriad anthropogenic movements that jeopardize pillars of democracy and scientific reasoning. Yet, the label of “conspiracy theorist” is also manipulated and weaponized as a mechanism of social control. The epithet of conspiracy theorist may systematically deflect “questions or concerns about power, corruption, and motive” thus “demobilizing certain voices and issues in public discourse” (Husting and Orr 2007:127). The construction of conspiracy theorists as primitive champions of paranoid fantasy thus symbolically silences socially anomalous or embargoed discourse. Using a content analysis of …

Decoding Job Market Trends: Chatgpt’S Influence On Soft And Hard Skill Demands, Larkin Barnard-Bahn Jan 2024

Decoding Job Market Trends: Chatgpt’S Influence On Soft And Hard Skill Demands, Larkin Barnard-Bahn

Scripps Senior Theses

As the abilities of Artificial Intelligence (AI) grow, automation anxiety (the fear of being replaced by technology) has plagued the workforce—especially after the launch of the advanced Generative AI tool ChatGPT. To avoid structural unemployment, workers may need to invest in developing skills not easily replaced by AI. Some scholars argue that AI is less able to replicate soft skills than hard skills, but the literature lacks studies that indicate a causal effect across industries and occupations. This paper investigates how the public release of ChatGPT has influenced the demand for soft skills relative to hard skills in the U.S. …

Political Neutrality In The Rules Of International Sports Federations: Compatible With Fundamental Freedoms?, Ilias Bantekas Jan 2024

Political Neutrality In The Rules Of International Sports Federations: Compatible With Fundamental Freedoms?, Ilias Bantekas

Fordham Intellectual Property, Media and Entertainment Law Journal

International sports federations celebrate and impose strict political neutrality in their institutional rules. Such neutrality is inconsistent with the individual rights of athletes to freedom of expression and peaceful assembly. The contractual basis of such restriction is irrelevant because fundamental rights are constitutionally entrenched and cannot be limited by contract or law, save for if the expression incites to violence, hatred, discrimination or is otherwise inconsistent with criminal law. There is no empirical evidence suggesting that restricting the political expression of influential athletes leads to generalized political or other violence. Instead, it is clear that international sports federations, and particularly …

Is Garcetti Too Cool For School?: Why Garcetti V. Ceballos Should Not Apply To School Teachers, Jordan Zaia Jan 2024

Is Garcetti Too Cool For School?: Why Garcetti V. Ceballos Should Not Apply To School Teachers, Jordan Zaia

Fordham Intellectual Property, Media and Entertainment Law Journal

The First Amendment is implicated by students and teachers every day in public schools. For years, courts followed the test established in Pickering v. Board of Education to analyze free speech claims for public school teachers. However, teachers’ protections were changed in 2006 when the U.S. Supreme Court decided Garcetti v. Ceballos. Since then, the circuits have inconsistently applied this test in cases relating to education. With the circuit split and high-profile cases rising in the federal circuits, the Supreme Court may have an opportunity to resolve the issue.

This Note advocates for the Supreme Court to rule that Garcetti …

Cross-Border Data Regulatory Frameworks: Opportunities, Challenges, And A Future- Forward Agenda, Andrew D. Mitchell, Neha Mishra Jan 2024

Cross-Border Data Regulatory Frameworks: Opportunities, Challenges, And A Future- Forward Agenda, Andrew D. Mitchell, Neha Mishra

Fordham Intellectual Property, Media and Entertainment Law Journal

This Article evaluates the existing regulatory framework for cross-border data flows across Bahrain, Djibouti, Jordan, Kuwait, Morocco, Nigeria, Oman, Pakistan, Rwanda, and Saudi Arabia. A common factor among these countries is that they are members of the Digital Cooperation Organization (“DCO”). It considers how these countries have devised laws, regulations, and policies on cross-border data flows to enable digital trade, and how these instruments promote the growth of a robust digital economy, both domestically and internationally. The Article then offers policy recommendations for DCO members to consider in developing relevant laws and regulations on data flows.

These …

Anti-Drag Laws And Free Speech: The First Amendment Case For Protecting Drag, Dr. Joel Timmer Jan 2024

Anti-Drag Laws And Free Speech: The First Amendment Case For Protecting Drag, Dr. Joel Timmer

Fordham Intellectual Property, Media and Entertainment Law Journal

In 2023, there were six federal court cases involving anti-drag laws or government denials of permission to hold drag shows on public property. All but one of these cases concluded that drag shows constituted expressive conduct protected by the First Amendment. Four of the cases involved challenges to recently enacted anti-drag laws, and in each of those cases, the courts found the laws to violate the First Amendment on multiple grounds, including not being narrowly tailored to achieve their purpose, as well as being vague and overbroad. However, one court, ruling on a denial of permission to …

Minecraft As A Teaching Tool: Online Experiential Learning For The Law School Classroom, Maria Jose Schmidt-Kessen, Stina Teilmann-Lock, Florence Villesèche, Andrea Wallace Jan 2024

Minecraft As A Teaching Tool: Online Experiential Learning For The Law School Classroom, Maria Jose Schmidt-Kessen, Stina Teilmann-Lock, Florence Villesèche, Andrea Wallace

Fordham Intellectual Property, Media and Entertainment Law Journal

The Article explores the potential use of Minecraft for experiential learning in higher education. In theory and in practice, intellectual property (IP) questions increasingly arise around if or how digital art can be owned, shared, and reused, as well as how digital realities interact with the various legal regimes. In its sandbox environment, Minecraft allows players to explore these questions through collective co-creation and creative decision-making pertaining to the subsequent re-use of their digital creations. Players become better equipped to reflect on the process of copying, creating, and exploiting their digital creations using the legal tools offered by IP law, …

Exploring Sigmoidal Bounded Confidence Models With Mean Field Methods, Tian Dong Jan 2024

Exploring Sigmoidal Bounded Confidence Models With Mean Field Methods, Tian Dong

HMC Senior Theses

Mathematicians use models of opinion dynamics to describe how opinions in a group of people change over time, which can yield insight into mechanisms behind phenomena like polarization and consensus. In these models, mathematicians represent the community as a graph, where nodes represent agents and edges represent possible interactions. Opinion updates are modeled with a system of differential equations (ODEs). Our work focuses on the sigmoidal bounded confidence model (SBCM), where agents update their opinion toward a weighted average of their neighbors' opinions by weighting similar opinions more heavily. Using tools developed in physics (mean-field theory), we derive a continuity …

On The Legality Of Defrauding The Public, Wes Henricksen Jan 2024

On The Legality Of Defrauding The Public, Wes Henricksen

Marquette Law Review

Speech used to intentionally mislead others to gain a tangible benefit while causing harm to the one deceived or to others is generally labeled “fraud.” This term is used in both legal and nonlegal contexts. Where speech used to defraud satisfies the elements of a tort or a crime, it becomes “actionable fraud.” Categories of actionable fraud include common law deceit, securities fraud, and wire fraud. But taken together, these laws address harmful dishonesty in an inconsistent manner. While they broadly prohibit deceiving individual victims, they often allow deceiving the public at large. As a result, it is often lawful …

Resourcing Your Community: Building A Connection Through Overlooked Histories, Estella Inda Jan 2024

Resourcing Your Community: Building A Connection Through Overlooked Histories, Estella Inda

Humboldt Journal of Social Relations

Community-based research is a valuable tool used to address inequities in Dr. Martin Luther King, Jr. Library’s local history archives. By collaborating with the community to establish permanent collections dedicated to those overlooked narratives, the library realized its community members were an untapped resource who were enthusiastic to fill informational gaps and appreciated the opportunity to preserve information for future generations. By acknowledging the historical significance of their previously undocumented experiences, equity was added into Dr. Martin Luther King Jr. Library’s archival collections and, in turn, helped the community see value in a relationship with the library. Simple neighborhood discussions …

Recourse For Defects And Deception: A Multifactor Duty Test For Online Platforms, Edward J. Janger, Aaron D. Twerski

Marquette Law Review

Amazon is the world’s largest platform for consumer retail sales. It plays a crucial role in matching buyers and sellers and consummating their transactions. It has, for the most part, escaped tort liability for harm caused by defective products sold by third-party vendors on its website. The majority of cases have held Amazon immune from suit because Amazon did not take title to the goods. It was not formally a seller despite the fact that it controls every aspect of the sale from receiving the order, (often) warehousing and shipping the goods, and collecting payment. This formal approach creates a …

Benefits Transparency, Samantha J. Prince Jan 2024

Benefits Transparency, Samantha J. Prince

Marquette Law Review

Recently, several states and cities have enacted equal pay laws in a push for pay transparency in job postings to inform and help reduce wage gaps. Some of these laws also require a description of the employee benefits that the company offers. However, none of these laws require a detailed description of said benefits, even though employee benefits on average make up 24% of an employee’s compensation.

Businesses can choose how much to disclose with respect to their benefits and they may even engage in what this author calls “benefits washing”—a practice where companies provide vague or misleading information about …

A Fourth Amendment Of People And Places: Three Foundational Claims About Geofencing, Jordan Wallace-Wolf Jan 2024

A Fourth Amendment Of People And Places: Three Foundational Claims About Geofencing, Jordan Wallace-Wolf

Marquette Law Review

In Carpenter v. United States, the Supreme Court held that sufficiently lengthy surveillance of a person’s location was a search that presumptively required a warrant. This holding, the Court wrote, was an application of Katz v. United States’s battle cry that the Fourth Amendment “protects people, not places.”

Unfortunately, that battle cry is increasingly part of the problem. It was suited to Carpenter because it concerned the surveillance of Timothy Carpenter’s movement over 127 days. But police are increasingly supplementing long-term tracking of particular suspects with comparatively short-term tracking of whoever happens to occupy a particular swath of space during …
