Tech Platforms And The Common Law Of Carriers, Ganesh Sitaraman, Morgan Ricks Jan 2024

Tech Platforms And The Common Law Of Carriers, Ganesh Sitaraman, Morgan Ricks

Duke Law Journal

Ever since Justice Clarence Thomas observed in a concurrence that tech platforms like Twitter were analogous to common carriers, there has been increasing interest in the possibility of regulating them under common carrier principles. Most of the conversation has centered on potential legislation, not on applying the common law’s common carrier obligations to big tech. Indeed, when Ohio sued Google under the common law’s common carrier principles, commentators called the lawsuit “bizarre.”

In this Article, we argue that far from being “bizarre,” tech platforms are and should be subject to liability at common law for violating the duties of common …

"Children Are Different" And Their Lawyers Should Be Too, Samuel K. Lawrence Jan 2024

"Children Are Different" And Their Lawyers Should Be Too, Samuel K. Lawrence

Duke Law Journal

Nearly sixty years ago, In re Gault guaranteed children in juvenile court the right to counsel. However, Gault fell short. While recognizing children’s distinct vulnerability, the Court created a right for children that is weaker than that of adults and failed to recognize how youth in fact require a more expansive right to counsel. Grounded in the stories of court-involved youth who received deficient representation, this Note illustrates the devastating consequences of Gault’s limitations. It argues that the differences between children and adults that compelled the Court to adopt additional protections for children in sentencing also justify an expanded …

International Competition In The High North: Kingston Conference On International Security 2022

Books, Monographs & Collaborative Studies

The 16th annual Kingston Consortium on International Security conference, “International Competition in the High North,” took place on October 11–13, 2022, in Kingston, Ontario, Canada. The conference examined the Arctic region in the context of ongoing climate change and against the backdrop of war in Ukraine. Over the past several years, the United States has acknowledged the growing importance of the Arctic as a strategic region, and the Department of Defense and each of the US military services have published Arctic policies or strategies. In addition, the Department of Defense has created a new regional study center, the Ted Stevens …

To Touch Time: U.S. Black Feminist Modernist Sculpture In The 1970s And 1980s, Sarah Louise Cowan Jan 2024

To Touch Time: U.S. Black Feminist Modernist Sculpture In The 1970s And 1980s, Sarah Louise Cowan

Art and Art History Faculty Publications

Modernist propositions long have been understood as atemporal—somehow outside of time—or insistently hailing the future. This temporal framework suppresses the contributions of those excluded from modernist canons, particularly Black women. In this article, visual and material analysis of sculptural works produced in the 1970s and 1980s by U.S. Black women artists Beverly Buchanan, Senga Nengudi, and Betye Saar reveal how Black feminists have engaged with modernist protocols in order to redress cultural erasures of Black women. These practices exemplify Black feminist modernisms, or creative practices that unsettle the racist and sexist logics of dominant cultural institutions. Each of these artists …

Characterizing Biogenic Mnox Produced By Pseudomonas Putida Mnb1 And Its Catalytic Activity Towards Water Oxidation, Elisa Morales, Lauren N. Formankski, Sarah E. Shaner, Kari Stone Jan 2024

Characterizing Biogenic Mnox Produced By Pseudomonas Putida Mnb1 And Its Catalytic Activity Towards Water Oxidation, Elisa Morales, Lauren N. Formankski, Sarah E. Shaner, Kari Stone

Chemistry Department Faculty Articles

Mn-oxidizing microorganisms oxidize environmental Mn(II), producing Mn(IV) oxides. Pseudomonas putida MnB1 is a widely studied organism for the oxidation of manganese(II) to manganese( IV) by a multi-copper oxidase. The biogenic manganese oxides (BMOs) produced by MnB1 and similar organisms have unique properties compared to non-biological manganese oxides. Along with an amorphous, poorly crystalline structure, previous studies have indicated that BMOs have high surface areas and high reactivities. It is also known that abiotic Mn oxides promote oxidation of organics and have been studied for their water oxidation catalytic function. MnB1 was grown and maintained and subsequently transferred to culturing media …

Construct Validation Of A Learning Resources Rubric [Lrr]: A Modified Delphi Study, Lei Wang Jan 2024

Construct Validation Of A Learning Resources Rubric [Lrr]: A Modified Delphi Study, Lei Wang

Dissertations - ALL

Abstract Central to the landscape of education is the understanding that instruction is fundamentally purposeful, aiming to facilitate effective learning. Grounded in this premise, instructional design emerges as a complex and multifaceted profession. In the digital era, Instructional Designers (IDs) harness technological advancements to shape robust learning resources. However, with a burgeoning array of resources, each varying in efficacy, arises the pressing need for designs firmly anchored in evidence-based learning principles. The challenges encountered by IDs, especially in crafting resources that accentuate deeper learning, cannot be overlooked. Existing rubrics, while extensive, often fall short in addressing the nuances imperative for …

The Process Becomes Part Of You: A Methodology For Analyzing Institutional Mediation And Programmatic Possibilities In Community Writing, Chad Seader Jan 2024

The Process Becomes Part Of You: A Methodology For Analyzing Institutional Mediation And Programmatic Possibilities In Community Writing, Chad Seader

Dissertations - ALL

To guide antiracist curriculum reform in higher education and better support college writers from racially marginalized and traditionally underserved backgrounds, this dissertation emerged from a five-year ethnographic study of a slam and spoken-word poetry program housed in a DEI office at a large research university. Merging feminist ethnographic methods and sociolinguistic scalar theory, this study develops a methodology for analyzing how institutional influence affects how people engage with writing programs in curricular, co-curricular, and community contexts alike—even in spaces outside of formal institutional structures. The study finds that student writers use slam and spoken-word poetry to bridge the embodied knowledge …

Multi-Functional Phenolic Acid-Based Shape Memory Polymer Foams As Hemostatic Agents, Changling Du Jan 2024

Multi-Functional Phenolic Acid-Based Shape Memory Polymer Foams As Hemostatic Agents, Changling Du

Dissertations - ALL

Severe trauma causes 5 million deaths annually worldwide, 30-40% of which are due to uncontrolled bleeding. Of these, 39% of trauma wounds develop polymicrobial infections, and even if the patient can be treated in the hospital, the patient is at significant risk of contracting drug-resistant bacteria. Therefore, we developed dual incorporated phenolic acid (DPA)-based shape memory polymer (SMP) foam as a hemostatic agent. In emergencies, this DPA-based SMP foam can be injected into the deep wound to rapidly stop bleeding and disinfect the wound to prevent hemorrhage and wound infection. Additionally, when the patient is exposed in the hospital, this …

Containment: Logistics, Environmental Conflict, And The Legal Geography Of Inland Ports, Jared Charles Whear Jan 2024

Containment: Logistics, Environmental Conflict, And The Legal Geography Of Inland Ports, Jared Charles Whear

Dissertations - ALL

In 2020, as the COVID-19 pandemic disrupted the supply chain, people worldwide received a crash course in the importance of logistics when corporations like Amazon became a lifeline for many. Before this increased public attention, however, scholars in geography had shown logistics to be a highly political yet indispensable process in the operation of global capitalism. Much of this scholarship underscores how the logistics industry frequently operates at the expense of marginalized people, workers, and the environment. In this dissertation, I expand on this work by adding a legal geography and political ecology analysis—a legal political ecology approach—to examine the …
