Reading Between The Treaties: Why The Supreme Court Must Honor The Indian Canons Of Construction, Amelia R. Wimmer

This Note critically examines the Indian canons of construction as interpretive tools employed by the United States Supreme Court in cases involving treaties and statutes with Tribal Nations. Ultimately tracing their origins to Worcester v. Georgia, this Note explores how the Indian canons were designed to protect tribal sovereignty, ensure the liberal construction of ambiguous provisions in favor of tribes, and prevent the abrogation of tribal land and rights. Shifts in interpretive philosophy and the rise of textualism have led to a checkered application of the Indian canons across courts. However, a continued application of the Indian canons is necessary …

Special Domestic Violence Criminal Jurisdiction (SDVCJ), enacted through the Violence Against Women Act, was designed to address jurisdictional gaps that long allowed non-Indian perpetrators of domestic violence in Indian Country to evade accountability. Yet despite restoring Tribal authority, SDVCJ remains significantly under-implemented. This Note argues that this failure is not merely a policy shortcoming, but a legal one. Congress restored Tribal criminal jurisdiction while conditioning its exercise on federal funding, coordination, and institutional support. Federal agencies, however, have failed to provide the consistent infrastructure necessary for SDVCJ to function in practice. These failures breach the federal trust responsibility, which imposes …

Multilingual assessment is an area of growing relevance and importance in the field of speech language pathology. The purpose of this study was to evaluate the current assessment practices among school-based SLPs in relation to their language background status (e.g. monolingual, bilingual, multilingual) and their perceptions on issues related to multilingualism. A survey instrument was created, which asked SLPs to respond to questions on various topics, including demographics, caseload information, assessment practices, statements on multilingual perceptions, and clinical scenarios. NBA games generate a lot of data, thanks to tracking technologies like SportVU and Second Spectrum. This thesis will used this data to help understand player performance, team strategies, and game outcomes. We use advanced statistics and machine learning techniques to analyze player performance, like how efficiently they shoot (eFG%), their overall impact on the game (PER), and how much of the team's offense they use (USG%). Thirty-one U.S. states and the District of Columbia currently authorize pharmacists to prescribe hormonal contraception. Expansion of pharmacist scope of practice into areas such as contraceptive prescribing represents an extension beyond traditional baseline licensure authority. As a result, jurisdictions frequently require additional training to address competency, patient safety, and liability considerations. Because regulation of pharmacy practice occurs at the state level, training requirements vary across jurisdictions. State boards of pharmacy websites and publicly available regulatory materials were reviewed to identify training requirements for pharmacists authorized to prescribe hormonal contraception. Federal criminal forfeiture is a powerful tool meeting at the nexus of criminal law and property law. Courts justify its use based on its English common law history. After seizing and selling assets, the federal government doles out payments from its Assets Forfeiture Fund to cooperating law enforcement agencies through equitable sharing agreements that bind recipients to use funds for law enforcement purposes. Tribal Nations have compelling legal and policy arguments for their entitlement to greater access to and discretion over forfeiture funds obtained through seizures in Indian country. BACKGROUND: Age-related changes in exercise performance during adolescence are complex because of progressive physical and functional changes, in which multiple factors are involved.
METHODS: Peak and submaximal cardiopulmonary exercise testing (CPET) parameters were studied in healthy children and adolescents.
RESULTS: TTotal 303 subjects were divided into six groups by ages and sex: ≤11 years old (yo) (28/22 for males/females), 12–15 yo (61/98), and ≥16 yo (52/42). Rest and peak heart rate (HR) were comparable in all groups. Absolute peak values of oxygen consumption (˙ VO2), work rate (WR), and oxygen pulse (OP) were higher in older age groups in both …

There is a dearth of information on the physical aspects of the Double Empathy Problem which is the bidirectional challenge of shared empathy and understanding between autistic and neurotypical individuals. Storytelling has been shown as means to facilitate empathy between storytellers and listeners in both neurotypical and autistic populations through behavioral research. Functional near-infrared spectroscopy (fNIRS) is a neuroimaging technique used to evaluate the hemodynamic response in the cortex and can be used to compare hemodynamic responses across multiple individuals (i.e., hyperscanning). This study examines elderly consumers’ perceptions of the design of AI insurance chatbot services in a phygital context. Drawing on the extended reality technology (ERT) framework and the stimulus–organism–response (SOR) model, it explores the cognitive–affective dynamics shaping chatbot adoption in a sensitive service setting. Data were collected from 396 elderly consumers of major insurance companies in Malaysia and analysed using structural equation modelling to assess mediating and moderating effects. Findings show that perceived trust critically mediates the relationship between cognitive factors and chatbot adoption. Technology anxiety and perceived complexity strongly moderate the trust–usage relationship, confirming a triadic interaction. The study …

Young people are increasingly forming and expressing civic identities in digital spaces. Yet, digital media literacy interventions have had limited success translating these competencies into sociopolitical action and, in some cases, may even constrain youth online civic engagement. This sequential mixed-methods study examines factors shaping youth online critical action using panel survey data (n = 704), followed by qualitative re-analysis of interviews (n = 23) with youth aged 15–24 to further unpack patterns identified in the survey findings. The impact of online social influence on social learning, health behaviour and population health is a new, rapidly developing area of study. Previous research focused specifically on digital influencers suggests they may be able to affect group-level diffusion of health-protective behaviours such that they modify epidemic outcomes. However, formal models have yet to test the intuitive hypothesis that the effect of digital influencers is sufficient to generate tangible real-world effects on epidemics. Aversive conditioning theories of restrictive eating disorders propose that gastrointestinal (GI) visceral sensitivity (i.e., hypervigilant monitoring and worry about GI sensations) is implicated in the maintenance of restrictive eating disorders (i.e., anorexia nervosa [AN], atypical anorexia nervosa [AAN], and avoidant/restrictive food intake disorder [ARFID]). Specifically, a negative reinforcement process is posited in which disordered eating behaviors (e.g., restriction, purging) help to mitigate or avoid GI-related distress, and are thereby reinforced. The process of building “civil peace” is a dynamic process that aims at creating appropriate conditions of peace when conflicting forces, groups, and polices diverge. This concept is relative because it contains components that balance the internal and external environment, where peace-building is not undertaken in a historical or cultural vacuum, but rather works to develop comprehensive civic and national values: “The movement from the present toward the desired future is not a straight line, but rather a set of dynamic initiatives” (Lederach, 10). This article describes a criminal justice senior-level undergraduate course, CRIJ 4350: Peace, Nonviolence, & Justice, at a Hispanic-serving institution known as the University of Texas Rio Grande Valley, in the U.S.-Mexico borderlands. The course centers five key frameworks: critical pedagogy, intersectionality, decolonial theory, restorative and transformative justice, and trauma-informed care, as this course departs from carceral models of justice education. There are an increasing number of students with Autism, ADHD, and other neurodiversities attending institutions of higher education. Unfortunately, most higher education faculty do not receive formal training or support around the skills, knowledge, and pedagogy needed to effectively design and implement instruction that removes barriers to accessing the post-secondary curriculum. This was the case for the first author, a content expert with a Ph.D. in Digital Media. Problem: Physical therapy (PT) outcome disparities exist among racial and ethnic minority groups in the United States. Implicit racial and ethnic biases (IREBs) may contribute to these inequities. Understanding IREBs within PT practice is crucial for addressing disparities and helping physical therapists comply with the American Physical Therapy Association Code of Ethics Principles. Purpose: This study examines the role of IREBs in PT by exploring physical therapists' awareness of them and their potential influence on PT practice. Methods: A virtual explanatory sequential mixed-methods design was employed, integrating quantitative surveys and qualitative interviews. One of the most difficult and complex symptoms in children with autism spectrum disorder (ASD) and comorbid attention deficit hyperactivity disorder (ADHD) is hyperactivity. This has a substantial negative impact on daily functioning, learning, and responsiveness to therapy interventions, as well as on intervention programs that aim to manage behavior in schools and clinical settings, thereby restricting children's engagement in these programs as management behaviors become more emphasized.
